The City Commission of the City of Clearwater met in Special Session Thursday,
November 30th, 1049 at 7:30 P. M. with the followinr, members present:

The Mayor called the meeting to order and stated that the pllrpose of the meet-
ing was to receive the Auditors Report for the fiscnl year ending June 30, 1949,
Consideration of an application for a license, without fee, for the Veterans of
}i'oreign Wars to sponsor a Carnival in the C1 ty limi ta, and to conduct a Public
Hearing on the proposed amendment to the Zoning Law.

The City Clerk reported that the Audit Report b~. H. :M. Turnburke, C. P. A.~
for the riscal year end lng Jlme 30th had been delivered to his office and copies
forwarded to each of the Conmissioners. Commissioner Drew moved that the report
be accepted. The motlon was seconded by Comrliss:t,oner Brown and carried.
Mr. E. J. Hunter appeared before the Commission in behalf of the Veterans of
Foreign Wars' request that the Cowaission waive the license fees for a Carnival
Sponsored by that organization. He stated that the carnival was already on
location and that both the V. F. W. and the Carnival Company would suffer con-
siderable loss if the permit should not be granted. A petition signed by 32
persons residing near the location of the carnival~ expressing disapproval and
demanding that the permit be refused, was read by the Clerk. l-1r. D. P. Iden and
George Reynolds were present at the meeting and expressed their disapproval.
Af'ter some discussion" the Mayor polled the other members of the COTi1r.1ission and
each COMmiSSioner, when questioned, stated that he was opposed to waiving the
License Fees..
At the City Attorney's su~gestion, it was agreed that the items to be con-
sidered f'or a change in zoning regulations would be taken up in the same order aa
advertised.
Mr. Ralph Richards, representing the Horner Realty COI:1pany, asked that Mr. Homer's
property~ East of Edgewater Drive, not be zoned as R-l. Mr. Lewis Homer stated that
he had purchased the property with the intention of building apartments, that for
Buch use the property was worth approximately $26,OOU.OO, whereas if he had to
parcel it into lots it would not bring over $16,,000.00.
Itemlll.The Edgewater Drive Association had requested that all land lying along both
sides of Edgewater Drive extending from the rear property line o~ all lots facing
South on Sunset Point Road North to the Dunedin line and East to the Atlantic Coast
Line Railroad be changed from B-2. zoning to R-1. Co:rnl11issioner Brown moved that
Item 1 (the foregoing) be ref'erred to the Zon~ng Board for their study and a
written recommendation by December 7th. The motion was seconded by Commissioner
Casler and carried unanimously.
IteD1#2. The proposal to rezone thos& certain lots on South Fort Harrison Ave., now
zoned for business so that the lots could be used only for doctors" dentists or
other professional offices, was referred to the Zoning Board for study and a
recommendation to be made by December 7th, on a motion made by CO~llissioner Drew,
which was seconded by Cornr,lissi oner Brown and ca rried unanlT:1ously.

Sarah McJ.iullen Sub, from R-2 to ItBusiness" Zoning be placed in the Ordinance for the
referendum. The motion was seconded by Commissioner Drew and carried.

Item #6, Propos&l to delete rrom Zoning law, regulations for signs in order that
this subject may be covered by a separate Ordinance. Conuaisaioner Casler moved
that Item #5 be put on referendum to be effective March 1st. fj,'he motion was
seconded by Commissioner Drew and carried unanimoualy.
Commissioner Drew moved that item #6, prohibiting the parking of trailers,
except within Trailer Parka, be deferred to the next IJeeting, ];ecember 9th. The
motion was seconded by Con~is8ioner Casler and carried.

Item #9. The C~ty Attorney reported that checking had disclosed that lot 12,
Block 3,. Knollv-IOod Heplat was now zoned for uBusinessu on Zoning maps but restricted
against "Business" through deeded restrictions. COIl1I!1issioner 8~wlI moved that item
/fd not be considered. The motion was seconded by Comnissioner.iJl'8w and carried.
Item #10. Proposa~ to rezone property on both sides of Gulf-to-Bay Blvd., from
Duncan Avenue to Belcher Road, for ~urpose of extending business zone approximately
300 Feet from Gulf-to-Bay Blvd. The Clerk read a Resolution addressed to the
Conmisaion by the Crest Lake Association opposing any change in Zoning regulations
on the South side of Gulf-to-Bay Blvd. adjacent to Duncan Avenue.
Mrs. J. D. Williams, 525 Phoenix Ave. stated that the home owners in Suburb
Beautiful were unalterably opposed to any increase in property zoned as "business"
1n Suburb Beautiful. Messrs. George W. Smith and H. H. Baskin, representing
Mr. Horace Roberts, requested that Mr. Roberts' property l~novm a s Tract uA n, Replat
of Block Dp Suburb Beautiful~ be zoned for business for a deptll of 300 feet.
Mr. H. M. Blanton~ representing Paul Chipello, requested that the East 5 Acres of
the NEt of the NW~ or SEt of Section 14, Township 29 S, Range 15 E, be zoned for
"Business" to a depth of 300 Feet. Commissioner Casler moved that the changes on
the ~orth side of Gulf-to-Bay Blvd. East of Duncan Avenue. recomnended by the
Zoning Board~ be placed on the ballot for the referendum. Conmissioner Brown
seconded the motion and it carried unanimously.
Commissioner Casler moved that Tract A, Replat of' Block D, Suburb Beautiful
and the East 5 Acres of N.E.t of N.w.i of s.E.i of Section 14, Township 29 5, Range
15 E. be zoned for "Business' for a depth of 300 feet and the remainder of the
properties on the South side of the Boulevard East to Belcher Road be zoned accord-
ing to the Zoning Board's recommendations. Commissioner Kennedy seconded the
motion and it carried unanimously.
The City Manager reco~ended the installation of 127 feet of li inch ~as main
on Walnut Street at an estimated cost or $80.00. On a Diotion by Commissioner Casler,
seconded by Commissioner Drew and unanimously carried, the City Manager's
recommendation was approved.
There being no further business to come before the Board, the meeting was
adjourned.

At the regular monthly meeting of the Crest Lake Association which was held
Tuesday evening, Novelnber 15, 1949, the f'ollowing resolution 'VIas passed unanimously
by the 185 members present:
RESOLVED that the membership of the Crest Lake
Association go on record as being strongly opposed
to any change in the present zoning regulations of
the area--the south side or G~lf-to-Bay Bouleval~
adjacent to Duncan Avenue. Homes were built in this
section recently and also many years ago, and if this
area were rezoned for business purposes, it would be
to the detriment of the property owners.

We, the undersigned, express herewith our disapproval of the City of Clear-
water granting a permit to the V. F. W. oarnival to set up facilities and run
on the John Sadlon property, located on the west side of South Fort Harrison
at the city l~lt8, as we do not feel that this location is the proper place
for a oarnl val.
We have no ill-feeling toward the V. F. Vi., and are strongly in accord
with their purpose and sponsorship of. the carnival. We a~e not prejudioed
to the oarnival itself; but we feel that it's operationet this location is
definitely detrimental to the good of property owners snd travelling public
in this area, sa well sa the patrons and personnel of the oarnival.
We demand that this permit shall not be granted, In due consideration o~
the clear facts, namelYI
1. That during the delay 1n granting pe~it. the large trucks and trailers
which have been parlced on both side of Fort Harrison since early
Sunday, have proven a traffio hazard.
2. That there 1s no parking space for the patrons of the carnival.
3. That there is no sidewalk on Fort Harrison at this location for
carnival patrons to use.
4. That there are no street lights on Fort Harrison at this 10cat10n,
making it hazardous after dark for both drivers and pedestrians.

We have no i1l-feeling toward the V, F. W., an,d are st�ongly in �ccord
�with their gurpose and sponsorship of the carnival. We are not prejudiced
to the carnival itself; but we feel that itts operation a� this location is
de�initely detximen�al to tha good af propertg ownars and travelling puUlic
' in this arear as well as the patxons and personnel of the carnival.
We demand that this permit shall not be granted, in dtte consideration of
the clear facts, namelq:
1. That during the delay in granting Permit, the large trucks and trailers
which have been parked on bot� side af' Fort Harrisan sinae early
SundayD heve proven a traffic hazard,
2. That there is no parking space for the patrons of the carnival.
3. Thet there is no sidewalk on Fort Har�ison at this locr�tion for
carnival patrons to us�.
4. That there are no strest lignts on Fort FIarrison ai: this l.ocation,
making it hazardous aftex dark for bath drivers and pedestrians,
as a large majority of the carnival business is dona aiter dark.
