The meeting being called to order, the minutes ot the regular meeting of
Ootober 11th were approved subject to ~e folloWing correotion: Paragraph 7 show-
ing a motion made and seoonded by Commissioner Brown be correoted to show that motion
was made by Commissioner Brown and seconded by Commissioner Ca8~er.
The City Manager submitted the request of W. E. Crown that Lot 1, Block 52 and
Lot 6, Block 7, Mandalay, be changed from Rl to R2 Zoning, together with the Zoning
Board's recommendation that Mr. Grown's request be granted prov~ded there were no
objections. The Clerk read a letter from Ralph W. Carson objeoting to the proposed
change on behalf of the Clearwater Beach Association, also telegrams from Commander
Fletcher W. Brown, George W. Rogers and G. C. Adkins, propert7 owners in the area
which would be affected~ protesting the proposed change. Thirty six persons in the
audience, by a standing vote, signified their opposition to the granting ~f Mr. Crown's
request. Mr. George S. Studwell, 1.'1. B. Thayer, Charles P. Day, George <.B~rgiiiiijpand
others gave their reasons for objecting to any change in Zoning in ~is are6.~
Attorney A. T. Cooper spoke in behalf of 1.1r. Crown. Commissioner Drew moved that
the Commission deny the petition or Mr. Crown for rezoning, due to objection raised~
follOWing the Zoning Board's recommendation. The motion was seconded by Commissioner
Brown and carried unanimously.

The Clerk read a lette~ L~om Attorney George W. Smith petitioning the Commission
to zone Lot 5 less the East 236 Feet, Block A, John R. Davey Subd1vision belonging
to A. D. Hartsell as business property instead of R2, as it is now zoned. Mr. Smith
and Mr. H. 11. Baskin were present and pointed out that Mr. Hartsell's property
adjoined City Properties which are being used for business purposes. Commissioner
Brown moved that the ususl procedure in hardship csses be rollowed and a public hearing
advertised. The motion was seoonded by Commissioner Casler and carried unanimously.
The Clerk read a letter from Attorney George W. Smith, requesting that Mr. Horace
Roberts be granted a per.mit to install 8 Trailer Park on his property at the inter-
section of Duncan Avenue and Gulf to Bay Boulevard using the area 132.5 feet deep now
zoned for business purposes. the property being described as Trsct A, Rep1at of
Block D, Suburb Beautifu1. In another letter Mr. Smith requested that the Commission
oonsider increaSing the depth of the property zoned ror business to the full depth ot
Tract A. Mr. M. B. Thayer on behalf of Mrs. Anna Mueller, who owns property 1n the
immediate vicinity, objected to any increase in the area zoned for business or any
extension of business zone further than the present depth of 132.5 feet. By
unanimous consent the matter was deterred ror further consideration at the next
meeting of the Commission.
~e Clerk read a letter fro~Mr. Thomas Hamilton, Attorney tor the Atlantio
Coast Line Railroad, setting :forth the railroad company's objections to opening a
crossing over the company's tracks at Pierce Street. Commdssioner Drew moved that
receipt of the letter be aoknowledged, the letter be filed for future reference and
counsel for the railroad notified when the matter of a Pierce Street crossing comes
up in the future. The motion was seconded by Commissioner Brown and carried.
Commissioner Casler did not vote.
The City Manager submitted a tabulation of bids for furnishing a blanket
dishonesty bond on City employees. the low bid being $619.40 submitted by the Accident
& Casualty Insuranoe Company through the Cloninger Insurance Agency. On a motion
by Commissioner Drew, seconded by Commissioner Casler and carried, the low bid was
acoepted.
It was moved by Commissioner Drew. seconded by Commissioner Casler and
unantmously carried, that the request of Alec Byschinsky for a license to sell
beer and wine at 607 Palm Bluff Street be denied.
City Attorney Krentzman reported on his attendance at the hearing ot the
Peninsular Telephone Company's appl~cat1on for an increase in rates before the
State Railroad and Utilit1es Commission in Tampa, and expressed his appreciation or
the assistance given by the City Manager. Mr. Krentzman submitted Q bill of $300.00
fnr extra services rendered in the telephone company hearing. o.n a motion by
Commissioner Casler, seconded by Conmissioner Brown and unanimously carried, the
pa,ment of $300.00 to Mr. KrentZInan for extra services was approved~

Mr. Casler moved that the Mayor and the City Attorney attend the meet1ng or
the Florida League of Municipalities at Fort Myers November 27th to 29th, and tne
Mayor authorized to vote for the City. The motion was seconded by Oommissioner
Brown and carried.
Commissioner Brown moved that Ordinanoe #582 be passed on the seoond reading.
Commissioner Drew seconded the motion and it carried. Commissioners Sargeant,
Brown, Casler and Drew voted "Aye". Vot 1ng '''no'' none.

The City Manager reported that 52,100 cubio yards ot sand had been stock piled
on the beach at Everinghamts Pav1lion at a cost of $20,630.00. Cormissioner Drew
moved that the expenditure of $20,630.00 for stook piling be approved. The motion
was seconded by Commissioner Casler and carried unanimously. The City Manager
reported that 18,548 oubic yards of sand had been stock piled at the second rill
at the City Park at a cost of $5,564.40. On a motion by Commissioner Drew,
seconded by Commissioner Brown and carried, the expend1ture was approved.
The Clerk read a letter addressed to Mayor Sargeant by Dixie Mason proposing
to install Ch~istn~a Chimes in the business district for the holiday season at a
oost ot $250.00. On a motion by Commissioner Brown, seconded by Commissioner Drew
and carried, the matter was referred to the City Manager for investigation.
On a motion by Commissioner Brown, seoonded by Commissioner Drew and carried,
the report of the County Service Of~ioer ror the month of Ootober was accepted.
A petition submitted by business firms located in the block requested that the
City install 12 Minute parking meters on Garden Avenue between Cleveland and Park
Streets. The petition boro the signatures of owners or managers of twenty three rirms.
On a motion by Commissioner Brown, seconded by Oommissioner Casler and unani~ously
carried, the ~tter was referred to the City Manager and the Ohler of Police for
investigation and report.
Commissioner Brown moved that purohase of twelve l2-Minute parking meters at a
cost of $642.00 for installation on Garden Avenue between Cleveland and Hendrix Streets
be authorized. The motion was seoonded by Commissioner Drew and carried unanimously.
A petition bearing signatures of ten persons and addressed to Mayor Sargeant
requested that the City take steps to have vacant lots in the 1300 and 1400 blocks
on Rogers Street cleaned up on account of the presence of the large number of snakes
infesting this area. By consent the matter was to be referred to the City Manager
and the snake catcher contacted.

members be approved but that the terms be staggered. The motion was seconded by
Commissioner Drew and carried unanimously.
The Mayor recommended the appointment of. Reade Tilley and Newton Barlow to the
Civil Servioe Board for 3 year terms. On a motion by Commissioner Brown, seoonded
by Commissioner Casler and unanimously carried, the appointments were approved.
The City Manager submitted a list of bids reoeived for labor and equipment for
laying the 12 inch water main on South Greenwood Avenue. On a motion by Comm1ssioner
Drew, seconded by Connnissioner Brown and unanimously carried, the low bid of" 04..964.00
submitted by Marianni-O'Brien of St. Petersburg, ~~orida was acoepted.
The C1ty Manager reported that M. R. Boyce Company had submitted a bid of
$1,771.00 for labor and equipment for replacing the 8" steel welded pipe under the
channel at the East Causeway drawbridge. No other firms had submitted a b1d.
Commissioner Drew moved that the Boyce Company bid be accepted. Commissioner Casler
seconded the motion and it carried unanimously.
The City Manager recommended the installation of 275 feet of 6" water main on
Bay Esplanade at an estimated cost of $700.00,

260 teet of 1" gas main on Harbor Drive at an estimated cost of $125.00.
On a motion by Commissioner Brown, seconded by Commissioner Drew and carried, the'
extensions were approved.
The proposed 240 feet of li" gas main extension on Walnut Street was not approved
as it wos for space heating only, but was deferred until suoh time as the app~1cant
purchased a store or other gas appliance.

the City Zoning Ordinance to operate a trailer par'k on the North 300 feet of Tract "A",
Block "D~, Suburb Beautiful, aCCOrding to Replat of said Block "nil, which application
was approved by the Zoning Board upon condition that I re-locate certain shower and
~oilet faoilities away from the Duncan Avenue side of the property.
:I now understand that under the Zoning Ordinance, I am restrioted at this loca:tion
~o using only an araa running 132.5 feet south of Gulf-to-Bay Boulevard for trailer
park purposes~ as the remainder of my property 1s zoned as an B-2 Multiple Dwelling
District.
1 am therefore reapplying for such speoial permit for the permitted depth of 132.5 ~eet
south of Gulf-to-Bay and according to the attached plan. I have received the approval
ot the Sta te and County on my 8 pplica tion and he ve found no opposition from any other
property owner in the vicinity. I propose to put in a park which will be attractive to
the public and constitute an asset to the City. It is my hope that when such is possible,
I may extend the park south for an additional area but in the meantime I am sure I can
operate satisfactorily on the 132.5 feet zoned for business.

I am writing in connection w~th your recent applicat10n for approval of plans for a
trailer park to be located for a distance o~ 300 teet South of Gulr-to-Bay Boulevard and
170 feet East of Duncan Avenue.
This area is located within Tract "Aw ot a He-plat of Block D. Suburb Beautiful.
Tract "A" is zoned by the City as R-2 (DlUltiple dwelling district) except for 132.5 fef;lt
South of Gulf-to-Bay Boulevard. Under Ord1na nee #455. the zoning ordinance of the City,
automobile trailer parks can be located only in nB" Business District and there only when
special permit has been secured trom the City Cocmisslon following a recommendation by
the zon1ng board. Th1s is covered in Section VI (9) of the Act.
It follows that your application cannot be granted by the City unless you w1sh to
limit it to an area not exceeding 132.5 feet South of Gulf-to-Bay Baulevard.
As you know, I was 1nstructed by the Con~ission to advertise this matter for a
public hearing at the next Commission meeting ~f investigation indicated that the request
conformed to the zoning act. .
Under the circumstanceB~ I will not advertise the matter and will aweit a reply from

This property is almost completely surrounded by City owned property devoted to
Park purposes, including 1n addition other business uses such as an eating place
operated by the Shuffleboa~ Club and a Radio Station~in the Municipal Auditorium.
The property to the Southeast of this Lot is now designated for business use, and
that which lies directly across Pierce Street to the South of it is now unimproved.
It is apparent that, with ~e increased activities being conducted on the City's
property, captioned lands have been rendered almost Wholly unsuitable for residential
use because of the incidental bright lights, noise and general use by the public of all
ages. It is believed that such change would be oompletely harmonious with the purposee
of the zoning ordinance, that no one could could be adversely affected by such change and
that contrary-wise, no one would be benefitted by continuing the present use. It 1s also
believed that had the makers of the original Zoning Map contemplated the development
which has occurred in the various park activities and businesses, they would not have
originally designated this property otherwise than as a business zone and that to make

Pinellas County, Florida,
which said property is now designated on the Zoning Map of the City of Clearwater for
Ilultlple Dwelling R-2 use. The property to the east, southeast and north is all zonedl
for public use, which as a matter of fact includes various businesses, such ae restaurant
business operated by the Shuffleboard Club and a radio station in the Municipal Auditor-
ium. Mr. Hartsell's property is bounded on the West by tho Bay and across Pieroe Street
on the South is unimproved.
As is apparent, there is an unnecessary hardship resulting from prohibiting
Mr. Hartsell from using his property tor businese purposes, which is contrary to the
purpose and intent of the Zoning Regulations of the City and does not affect any other
property owner, nor the public in general, adversely. Neither is there any benefit to
oontinuing the restriction of this property to its present designation of R.a.
You are therefore respectfully petitioned to grant a variance from the strict
letter of the provisions of the Zoning Ordinance which variance will be in harmony with
the general purpose and intent of the Zoning Ordinance, so that substantial justice may
be done, by authorizing the use of above described property for business purposes, its
use for residential purposes being permanently impaired because of the operation of the
various park aotivities immediately adjacent to it.

I am this morni~g in receipt of a letter from the lega1 department of the A. C. L.
Ra1lroad. enclo2ing a letter from Mr. L. S. Jeffords, Vice President ot the A.e.L., con-
taining the information that both the Coast Line and Seaboard have informally advised
the authorities of tho City of Clear~ater of their opposition to opening of any additional
rail level crossings at this t me.
The letter further says:
"That there are paved streets for the outlet of traff'io at
Cleve1and, Park~ Franklin. Court, Chesnut, Turner, P1ne Street
and Druid Road, that eight out of nine streets were open across the
Coast Line in this territory; that 1f' Pierce Street were opened up,
all it would do 1s to dump trafr1c into Myrtle Ave. which is a
deed end street on both the North and South. There a,re no places
of business between the A. C. L. and S. A. L. tracks on Pierce
street and there 1s no valid reason or dire necessity for opening
Pierce Street."
"It would itnpose added restrictions and burden of operations to
the ra ilroad. "
The letter states that in 1922 the Coast Line very- generously conveyed title to
a 100' right of way at Court street, and that the~ have cooperated with the City or
Clearwater in every wa~ that was possible for the up-building and bette~ent ot Clearwater.
I am ~urther instruoted to advise the City authorities that, after careful
consideration, the A. C. L. Railroad cannot agree to the opening of Pierce Street across
their property at this ttme.

snakes invading garages and houses.

reverted to wilderness. It is our understanding thero is an o~inance requiring. owners
to keep these 10ts cleared.

talked with the neighbors and are agreed this situation must be cleared up. There are

At a meeting of the Clearwater Beaeh Association held on October 11th, it ~s
reported to the members that several property owners intended to seek en R-a elassi-
fication for certain areas north and south or the cld Mandalay Hotel ruins in order
to erect multiple dwellings. ~his would involve an exception to ~e present R-l
classification for the whole area north of Acacia Street on Clearwater Beach except
for Blook 81 on Which is now located on the old ~Qndalay Hote~ ruins.

permanent residents have built in this- area on the strength ot it being a single-'
famI1~ dwelling classification (~-1). Such an exoeption would be an open wedge to'
applications trom others who wish to oommercialize their property with multiple
dwellings.
After a general discussion, the writer was direoted to address this letter to

the auihoritiea of the City oP Clearwater of their opposition to opening ef at�y additional
rail level crossings At this t ime.
The Zetter further says:
��That there are paved streets for the outlet of traffic at
Cleveland, Park, Franklin, Courtr Chesnut, Turner, Pine Street
and Dru3d Road, thst eight out of nine streets were open across the
Coast Line in this territorg; that if Pierce Street were opened up,
sll it would do is to dump traffic into Ivtyrtle Avem whioh is a
dead end street on both the North �and Southm There are no places
of business between the A. C. I,. and S, A. L. tracks on �ierco
Street and thore is no vs13d reason or dira necessity for opening
