Commissioner Drew moved that the receipt of the Resolution be acknow- ledged and ..tl1e Association in:formed that their cooperation will be welcomed. The motion~ seconded by Oommissioner Casler. and carr~ed unanfmously. The Octll'littee, investigating the mattero.f'.lacceptlng and improving Spring Oourt, had no report a t this time. ..." The Clerk read a letter addressed to the Commission by Mr. R. O. Downie. who reports that Mr. F. "L. Skinner had agreed to donate a lot on Clearwater street between Cherokee and Cypress Ave. to the Clearwater Beach Community Church, and requests that the Commission cooperate with Mr. Skinner in having the property replatted. Mr. Downie also suggested that the City donate lots opposite the Ohurch property to the Church. Mr. Downie was present and was assured that the City would cooperate with Mr. Skinner in securing a re-plat of the property, and was intorI;ted that the property which the City had been requested to donate was involved in a long term lesse; but the City Attorney and the Engineer would investigate the possibility of securing parkinr, privileges on the property for the Church. , ' , .. I I 1 I Chief Peter Treola, of the Fire Department, submitted a ~p setting forth the proposed Fire limits for Zones land 2, which was expla~ned by Willi~ Lee, Engineer and o. lIe Anderson, Building Inspector. City A. ttorney Krentzman sub- . mitted Ordinance 577 which would establish Fire Zones 1 and 2~ which Ordinance contained an Amendment to ~le Southern Standard Building Code which would pro- hibit the establishment of Dry Cleaning Plants ~n both Zones 1 and 2. After some discussion, Commissioner Drew moved that Section 4,be deleted from the Or- dinance as read and the Ordinance be adopted as amended. The motion was seconded by Commissioner Casler and carried. Voting "Aye" Mayor-Commissioner Sargeant end Oommissioners Brown, Casler, Drew and Kennedy_ Voting "Nott none. Commissioner Casler moved that Ordinance 571 be passed on the second reading by title only_ The motion was seconded by Commissioner Drew and carried. Voting "Aye" Mayor- Oommissioner Sargeant and Commissioners Brown. Casler, Drew and Kennedy. ,Voting "No" none. Commissioner Casler moved that Ordinance #571 be passed on the third reading. Commissioner Drew seconded the motion and it carried. Mayor-Oommissioner Sargeant and Commissioners Brown, Casler, Drew and Eennedy voted "Aye". Voting "No ft none. \ . , I City, Attorney Krentzman reported that the proposed plat of "Robersons Sub- division' had been checked by the Engineering Department, and t"ound to comply with City requirements as to streets and boundaries. Acting City Manager Middle- ton recommended that the plat be approved. Commissioner Kennedy moved that the City Managers reoommendation be approved and the plat accepted. The motion was seconded by Commissioner Brown and carried unan~ously. PaUl Kane of the Employment Oommittee submitted a manual on the Classifi- cation of Employees for the consideration of the Commission. On a mot~on by Oommissioner Kennedy, seconded by Commissioner Brown, end unanimously carried; that action on the Manual be deferred and the City Clerk be instructed to nave not less than ten copies of the Manual prepared tor members of the Commission and the Employees Committee to study. Mr. B. R. Erir,gs appeared before the Commission to request that some action be taken to correct the flood cmndition ~n front of his building on South Garden Avenue after each rain; stating that he had measured 19 inches of water in the street during a recent rain storm. Paul Y~ne, of Public Service Department. re- ported that he had checked the adjacent storm sewers and he be11eved the condi- tion would be remedied by the replacement of 100 ft. of damaged stor.m sewer. A work order for this work, at an estimated cost of' $444.S0,"was submitted. On a motion by Commissioner Brown, seconded by Oomm1BBione~ Drew and unanimously Car- ried; the work order was approved. The City 01erk reported that delinquent taxes t"or ~937 and prior years a. mounted to 030,542.92, and delinquent Improvement Liens t"or 1937 and prior years amounted to $98,540.07 exclusive ot City owned property; the last item including liens in the amount ot $11,925.45 against property ow.nod b~ the County School Board. Koenig, requasted that the Commission grant per.mission to ereot ~ sign advertising the KOen1g Hotel 8 feet back from the Curb line on the street right of way, with the reservation of the City's right to have the sign removed on 7 days not1ce. Comm1ssioner Casler moved that the City Manager, Mayor S&rgeant and Commissioner Drew be appointed on a Committee to work out the matter. Tho mot10n was seoonded by Oommissioner Brown and carried. Commiss1oner Drew voted "Non. Aot1ng C1ty Manager M1ddleton recommended the expenditure of $2200.00 for 8urfacing 635 ftc of Palm Bluff St. East ot Greenwood Ave. stqting that $1964.71 from last years budget credited to this account had not been used. On a motion by Commissioner Drew, seconded by Commissioner Brown and urantmously oarr1ed; the work order tor this project was approved. City Attorney Krentzman presented a Resolution which would amend the Res- 01ut10n passed by the Commiss1on on June 27, so as to permit funds fr~m the 6% utility tax refUnd to be used for construct10n; as well as for the purchase of land for a sW1nnning pool for negroes. Commiss10ner Drew moved that the Reso- lution be passed as read. The motion was seconded by Commissioner Casler and carried by the unanimous vote of the Conmdss10n. Mr. Ralph Richards delivered to the Commission a deed from the Board of Pub11c Instruction to a five acre tract South of Stevenson Creek and East of the Disposal F1ant, and called attention to the fact that the land oonveyed was to be used exclusively for the benefit of negroes; and part1cularly, tor the purpose of providing negroes with an Athletio Field, amusement park, re- creation area, or similar faci11ties. 0n a motion by Commissioner Drew, sec- onded by Commissioner Casler and carr1ed, ~e deed was accepted. :<;,:". .',',:" '-',',,',,'.~, (/ ;.'". ., ". .1 .' Gross had requested that he be given another examination by the Plumbers Examining Board. Mr. Sargeant stated that it was the recommendation of the Examining Board, that there ahould be a lapse of at least six months after an applicant had fiiled in an examination before a re-examination is given. The matter of Mr. Gross' request was tabled, by consent. The City Manager presented a resolution which would require three property owners to clean their lots of grass, weeds and underbrush. On a motion by Com- m1ssioner Brown, seconded by Commissioner Casler and unanimously carried the resolution was adopted. Mr. Ralph Richards, represent1ng Lee H. Reid owner of Lot 30, Bluff View, requested that a 15 ft. setback be per.mitted on Jeffords St. 1nstead of 20 ft. , as provided for in the Zon1ng Ordinance. lire Richards was informed that 1t 'Would be necessary to hold a public hearing on such a requ6st, which would have to be advertised. Ordinance #576 was re-passed on the fourth reading in the same ror.m as passed on June 27 and July 5th. Commissioners Brown, Casler, Drew and Kennedy voted "Aye-. Voting "No" none. Commissioner Drew reported that he had discussed the matter of giving tire protection to areas outside the City with County Commissioner John Chesnut, who l1ad inqu1red as to the type of charges to be made for such protection. Mr. Drew suggested that valuations used by the County, both inside and outside the City. be used as a basis with a poos1ble charge of 2 mills on the properties arfected. Mayor Sargeant suggested that a letter be written to the Governor, request1ng the lifting of rent contr01s in Clearwater. By consent, action was deferred until the City Attorney can render a legal 'opinion. The matter to be placed on the agenda tor the next regular meeting of the Comm1ssion. The CommIttee on the Public Comfort Station was not prepared to make a re- port at this time. 'l'he matter of a nuisance caused by a Junk Yard on S. Ft. Harrison was dis- cussed.
