Ben~tt - City Manager George MoClamma Chief ot Police Ben Krent~an City Attorney The meeting baving been called to order the minutes ot the regular meeting of June 6th and the adjourned meeting of June 13th were read and approved subject to the following correction: The item referring to the resolution by the Clear- water Federation ot Civic Clubs requesting the elimination of parking on west side or Myrtle Ave. to read "on west side ot Myrtle Ave. between Turner and Jeffords sts." The Clerk read a letter from W. W. Blackburn. owner of the building on Cleveland st. now occupied by the Smith Hardware Store, oalling attention to the flood condi- tion in this area. after every rain, and requesting that the Commission have a storm sewer installed to correct the oondition. This was item #7 on the agenda and was dis cussed la ter. A letter from the Clear~ater Federation of Civic Clubs, addressed to the C1ear- ~ater Board of Realtors, submits a resolution endorsing the elimination of real estate "for rent" and "for sale" signs and urges the enforcement of Sec. XII. Sub- section (3) of Ordinance No. 455, The zoning Ordinance. A letter fram the Clear- water Federation of Civic Clubs, addressed to the City Commission endor~es using and applying the utility tax refund toward the construotion of a municipal pier or toward a s~~ing pool for colored people. Commissioner Brown moved that the letter relative to elimination of real estute signs and also the letter pertaining to tbe utility tax refund be turned over to the proper committees. The motion ~as se- conded by Commissioner Drew and carried. w. W. Blackburn appeared before the Commission in support of his written re- quest that a storm se~er be installed to correct the flood condition at Smith Hard- ware building. He stated the t the oondit.ion complained of has been caused by the development of that area having raised the ground level around this location. Mr. Ernest Green was present and stated that a recently laid gas line and a broken drainage pipe was responsible for the same sort of condition at his property on Prospect and Park: sts. City Manager Bennett said that the proposed sewer would cost approximatAy $18,000.00. Mr. Blackburn was asked if he had any plan for fi- nancing the project to 8uggest, as the City was not in a position to advance the necessary funds. Commissioner Brown moved that the City Manager & the Mayor be ap- pointed as a Committee to confer with interest property owners and work out a plan tor financing the requested improvement. Commissioner Casler secomed )dr. Brown's moti on and it carried unanimously. The Clerk read a letter from Billy Hargraves, President of Clearwater High School Student Body, relative to the proposed Youth Center. Mr. Blackburn, a member of the Recreation Committee stated that the Committee has a comprehensive,program and he believed the Student Body had been misinformed. On a moti'on by Commissioner Drew. seconded by Commissioner Casler and unanimously carried the City Clerk was instructed to acknowedge receipt of the letter with thanks and inform the Stud~nt Body that the City .bas as comprehensive a program a8 can be accomplished at this time am that the Student Body will be consulted at sum t:lJne as any increase in tbe program is considered. Mr. Blackburn said he would be glad to discuss the Com- mittees program with the students. The Mayors Committee on refunding the 5~ utility tax had no plan to present at this meeting, but reported th.at a meeting was to be held at the Cafe~eria at noon, Thursday. June 23rd to formulate a plan. commissioner Dre\\ reported too t the Committee appointed to check into Mr. John s. Gross~ charges of unfairness against the ~lumbers ~aminlng Board had met with the Examining Board, examined the examination ~pers made out by Mr. Gross and had ooncluded toot the exan.lination had been fair and impartial and recommeni ed that tJB action of the Examining Board be sustained. On a motion by Mr. Drew, seconded by ~. Casler. and unan~ously oarried, the report of the Committee was accepted. In connection with the method at handling fees collected by the Plumbers EXamining Board. the Committee reoommended that all tees collected by the Board be turned into the City Treasury and that the city be billed by the Board for the expense incurred in conducting examinations. Commissioner Drew moved that the Commission ad,opt the metb.od of handl ing funds as recommended in the Committees report. The motion was second ed by commiss! oner Brow n and carried unanimous ly. Commissio~er Kennedy moved that Geo. 1.. Brown. Mr. Gross' attorney be advised by the City Manager that the Com- mission has met and sustained the action of the Examining Board. On a motion by Commissioner Kennedy, seoonded by Commissioner Drew and unanimously carried, the request of the Clearwater Art Museum tor a new lease on a part of the Chamber of Comnerce building, was referred to the City Manager for investigation and report. " " A letter trom Attorney Ralph Richards requests on behalf of Mr. Johns, lessee ot the Clearwater Bay Club a contribution of $300.00 towards a new roof for the building leased to Mr. Johns by the City. On a motion by Mr. Drew, seconded by Mr. Kennedy and carried, the request was denied. Voting "aye" Mayor-Commissioner sargeant and Commissioners Brown, Drew ani Kennedy. Mr. Casler did not vote. City Attorney Krentzman presented an Ordimnce levy ing a license tax on the sale of to baceo produ cta. Commissioner Drew moved the. t the Ordinance be passed on tbe first reading. City Manager Bennett reported tnat it would cost the City approximately $200.00 to repair the driveway known as spring Court and about $20.00 a year tor maintenance. Mr. Bennett said he could not recommend the aoceptanoe of a 13 ft street. On 8 motion by Commissioner Drew, seconded by Commissioner Casler and unanimously oarried the matter was deferred to a meeting Monday, June 27th and the city Clerk was instructed to write Mr. A. N. Smith inviting him to be 'present at that time. On a motion by Oommissioner Casler, seconded by Commissioner Brown and unanLnously carried, the budget of the Chanber 01' Commerce and of the Junior Chamber o~ Co~roe was increased by $1000.00 eaoh. On a motion by Commissioner Drew, seconded by Com- missioner Casler and oarried, Mayor Sargeant was designated as the City's re~eBentative at meetings of the Chamber 01' Commerce Advertising Committee. CommissIoner Casler moved that the Resolution adopting the Budget for fiscal year 1949-1950 be approved for a public hearing ob Monday, June 27th at 7:30 P.M. and the City Clerk to advertise the pUblic hearing. The amount of money required to make the proper drain- age, I understand is between $12,000 and $15,000. I realize that this cannot be charged to any immediate operating fund. Being interested in how the city was going to spent its money I read it.. Under the heading ot Recreation you nave quite a variety of things, all seemingl,y good in appearance except tor the f1rst, marked $20,900 for salaries, etc~ Now city recreation is of great interest to the youth ot our city, probably of more interest than any other city enterpris e. There has been talk cir oulated thro ugh. the sohool by eith er a troublemaker or a oontientous citizen tba t the spending ct'the money appropriated under salaries eto. which is left after salaries are paid, which would be a great deal if Eddie Moore, Miss Prosser, Mr. AIle n am a head swimming instruotor tor the summer are the only ones paid from this fund, is decided upon in a closed session of the recreation oommittee.. This along ~ith the seeming lack of interest trom the oity com.mis sion in doing anything in the way of a youth center has caused several kid's blood to boil. If I temember correctly, wnen Mr. Lee of the Optimist's Club brought the youth center project before the oommission, they promised to consider it in this year's budget. Was that a promise or just a means of'. getting rid of Mr. Lee? We tbe stud en ts of C.B.S. are very much interested in starting a year-round youth program and will be glad to do anything we can to help make it a reality. If it's student opinion you want, ~t let us know--we'+l get it for you. I hope you will take tbese tew words into consider~tion and help us get this matter settled. Last year the Ci'ty leased a b\1i~ Ing now known as the Clearwster Bay Club to my client Paul Johns for a ]eriod of rive years at a monthly rental of $300.00. The lease requires Mr. Johns not only to pay $300.00 per montn rent, but also to pay all taxes on the property, keep it insured against tire, and pay tor all repairs. Wben Mr. Johns leased this property from the Ci~y, he did not make as full an investigation as he should have r..~gardin8 the condi tion of tb e bu iIding, part ioularly the root. Shortly atter be signed the lease and went into possession. he l' ou.nd that the root leaked. Tbe condi ~lon of tbe roof has becane steadily ~orse, until now it is going to be absolutely necessary ~o have some majox repairs made to th e roof. I have had the building inspe cted by Tack and Warren, and have a wrl tten report t rom tbem in wilich they say they "ill charge $478.00 to plaoe the roof in such a condition tI1at the1 can guarantee it 'Watertight for a period ot four years. I am writing to request tba~ the Oity share t~is ex~ense with Mr. Johns in some proportion to be agreed upon. In making this request, I fully realize that the lease requires, Mr. Johns to .make all repairs, and that he should have investigated 'the oon- dition o~ the roof before he signed the lease. Bllt I am sure the City wants to be fair abou~ the matter, and in view of the fact that Mr. Johns is ~ing mucb more rental than the building ever brougbt betor e and bas improved it by the expenditure ot JlBny thousands ot dollars on repairs and improvements, I believe the Oity may teel justified in helping him out with the rooting expense.
