the regular meeting of December 8, 1948 were read and approved after the following
corrections were made:
1. It was moved by Commissioner Drew, seoonded by (;omllissioner Sergeant B nd
unanimously carried that the recommendation ot: the Zoning Board 00, al.low a seven f"oot
set-baok in the zoning hardship case of G. ~. SnYi.ler pertaining to Lot 10, Block 26~
Mandalay, be approved and the Oity Attorney be instructed to advertise a public
hearing.
2. That the proposed change in name of Druid Road be worded so as to show that
part of Druid Rood west of Ft. Harris;Jn hvenue as West Druid !toad, and that part East
of l!'t. Harrison ,i1,vel1ue as Ea st Druid Road.

Commission to protest the proposed ohange in the name or ~ark Avenue to North
Washington Avenue. ~~. Clyde Marlow requested the classification of the name of
Minnesota Drive, Elnd was informed that the legul name or the street was Minnesota
Drive.

known as Palmer street, be ofricially designated as Cross Street.
It was moved by Oommissioner Crane, seconded by Oommissioner Kennedy and
'unanimously carried that the Resolution to cbange street names as recommended by the
Committee on street names, be a~proved.
It was moved by Commissioner Crane, seconded by Oommissioner Dre~ and unanimously
oarried that the applioation of Mrs. Ferguson for a license to operate a second hand
store on South Ft. Harrison Avenue, be approved.
The application of D. J. Bowman of Dunedin, ~or a license to operate 8 taxi,
was referred to the License Committee.

The Deed to the property purchased by the County School Board was presented to
the School BOard, Bnd a cbeck In the arro unt of ~15,875 was accepted by the Commission.
The offer of $7500.00 for Blks 29,Jai, 32 in Magnolia .Park: Subdivision made by
Mr. Paul Randolpb, was rend. On the motion of COIIlIllissioner Drew and seoonded by
Commissioner Crane, the Commission ordered that the property be adve~tised and so1d
at publio auction at a buse price of $7500.00. The motion~8s QDanimously carried.
The City Clerk+~ybmitted a report on the instruotion of E1ection Ofrioials, and
a certificate that/vo~ing machines had been properly prepared f"or the ele cti on,
Deoember 21, 1948. It was moved by Commissioner Crane, seconded by Oommissioner Dre~
and ~nanimously carried that the report be accepted and made a part of the minutes.
The request of the heirs of George H. Smoyer far a quit-01sim deed rrom the Oity
for the North 10 feet or lot 6, Block 3, Earll and Tates SUbdivision, was by unanDmous
consent referred to a Committee composed or Comnissioners Kennedy, Crane and Sargeant
far their investigation and report.
The report of the Pinellas Oounty Service Orrioer was presented to the Commission
and ordered entered into the minutes as a matter of reoord.

It was moved by Cwmmissianer Crane, seoonded by Oommissioner Kennedy and
unanimously oarried that the Lions Olub oonstruotion permit be extended for a period
of th irty days.
The keys of the voting machines to be used in the election of Deoember 21, 1948
were presented to the Oity Oommission by the Oity Olerk.
The City Oommission now aoted as Trustees for the Pension Fund. It was moved
by Commissioner Crane~ seoonded by oommissioner Drew and unanimously oarriea that the
recommendation of the Pension Board that Mrs. Lee MoMullen be gr8nted a pension of
$58.53 monthly until she remarries or until the youngest ohi~d reaohes the age ot
sixteen years, be approved subject to the examination of the Oity Attorney.

notified that due to tne passing or Lee MOMullen, Superintendent of the Publio
Service Department, his widow, Mrs. Nan McMullen is eligible to reoeive a pension

~~. McMullen's length of service with the Oity of Olearwater was 10 years,
three months and 29 days. His average salary for the last three years was $283.29
per month; two per cent or this rigure equals $5.6658, ~ultiplied by number ot
years worked equals ~58.53 per month, 1~. McMullen's retirement pay. As Mrs.
MoMullen has two children under the age of sixteen (16) years; David H. McMullen,
born November 11, 1946, and George E. McMullen, born February 2, 1944, she will
reoeive the tull amount or said pension until she remarries or until the youngest
child has reached the age of sixteen years.

We represent the heirs of George R. Smoyer, owners of Lots 5
and 6 of Earll and Tate's SUbdivision, Clearw8ter, upon which is situated the
premises known as the Legal BUilding. On JW1e 28, 1912 J. R. Jeffords and wife
and G. R. Smoyer and \\life, then owners of 1he property, oonveyed the north. ten
teet ot said lots to the Town of Clearwater, which instrument of oonveyanoe was
recorded 1n ~u1t Olaim Deed Record 2, page 129, Pinellas 'County reoords. The
deed oontained the follo~ing s~tement:
"Be it provided thot the said town of Clear-
water shall be the legal and eq uiteble 'owner
of tue above described property, as long as
said land shall be used for the purpose of iii
publio alley, and men said land is no longer
used for the purpose of a public alley, 1 t shall
revert back ~o tba owner of the property from
whioh it was taken."
The north t en feet of all of the lots f'rom Osoeol& .Avenue through
Lot 5 \YaB deve~oped and used as an alley, but the north ten feet of Lot 6 has never
been used as an alley since the date of the deed a bove mentioned. This statement
has been verified by the unanimous concurrence of a number of longtime residents of
the city.
The aotual course of the alley has been to the north from the
east end of Lot 5 to Laura street.
It 1s the contention of the present owners of Lots 5 and 6 that,
since the north ten feet of Lot 6 \Vas never used as an alley, no title thereto was
ever vested in the To~ of Clearwater, and even if it was vested with title, it was
immed1a tely re1inquished by virtUB of the :raillU'e to use the property for the
purpose or a public ul~ey.
,
The present o~ners of this property are desirous of clearing :this
cloud from the title to their property, and, in order to avoid the necessity of
bringing a court aotion to quiet ,the title to the property, request is hereby ~de
that the Oity of Olearwater quit-claim its interest, i1' any, to the north ten feet
of Lot 6 as above described.
This letter is submitted in triplicate, with acoompanying sketches
to illustrate the matter in question.

Drive.
Commissioner vrew recamnended that the sh�rt street in the Carlouel section,uae�

The Deetl to the property purchased by the Cou�ty School Board was presented to
the School Bosrcl, and a check in the amo unt oP �TS,$75 tvas accepted by the Commission.
The of�er o� �7500.00 for Blks 2y,�, 32 in 1ldagnolia Yark Subdivisi�n made by
Mr. Paul Randclph, was read. On the motion of Commissioner Drew and seconded by
Commissioner Crane, the Commission �rdered that the property be advertised snd sold
at p ublic euction at a base price of �7500.00. The motion was unanimousl;� carrie:�.
The City Clerk���}bmitted a rep ort on the instruction oP Election Officials, and
a certificate that/�ro iing machines had been properly prPpared for the election,

The raquest of the heirs of George K. smoyer i'ar a quit-claim deed from the Gity

.^,onsent reYerred to a Committee composed of Commissioners Kennedy, Crane and Sargeant

of 6 inch water main with a fire hydrant, at the Northarly end of the beaah at an

unanimously carried that the Lions Club construction permit be extend'ed for a period
o� thirty days.
