CITY COMMISSION MEETING
November 4, 1946
The Oi ty Commission met in regular session the everrl.np. or
November 4, 1946 in the City Hall at 1:30 P.M. with the ro~10wing members'
present: Mayor Geo. R. Seavy, T. A. Johnson, J. R. Cra~e, Jesse G. Smith,
w. C. Wells; Absent - none.
The meetinr.- was called to order by Mayor Seavy and the minutes
of the previous meetin~ were read and app~oved.
The Board-had berore it a letter sirned by C1i:ff'ozod A. McKaY'
of Pulley and McKay, asking for a lease on the south wing of the c~ty
Audito~um. Alonp, with the ~ffe~was tendered a cheok ro~ $150.00 in pay-
ment of the first three month's rent. It was moved by Mr. Crane, seconded
by Mr. JOhnson, and car~ied that the lease be drawn with a proviso in the
lease that the leased premises could only be used for radio purposes.
A letter was ~ead from Mrs. J. Earle Davidson protesting the ~iring
of engines and the blowin@ of train whistles within the City Limits. MaY'or
Seavy volunteered to check into the matter and see ir somethinp. could be done
about the blowing of whistles.
It was moved by Mr. Smith, seconded b~ Mr. Crane and carried that
Lee MoMullen'be granted permission to locate a trailer park adjaoent to
2601 Gulf to Bay Blvd. Mr. MeMullenvs letter is set out below.
In response to a question ~rom Mr. Johnson, Mayor Seavy exp~ained
that since about seven years alO when he first became a member of the Cit~
Commission it has been the practioe or the Police Departmen~toarrest Bolita
pedlers, allow bond to be given whioh was later estreated. Further, that
the bonds at :first were set at $25.00 but have been increased fran time to
time until about a year ar,o when they were set at $100.00. That the money
from the estreated bonds had as a matter of course come into the City's
.treasury. Mayor Seavy stated that according to the best information he could I
rind, Bolita throwin~ was not takin~ place within the City Limits of Olearwater~
*with fu11'knowledge' and'oonseri~ or the City Commission
It was moved by Mr. Johnson, seoond~d by Mr. Crane and carried that
this COmmi,ssion definitely and unequivocably disavow, disclaim, wnd disown
any arrangement,. agreement or understatldin~ made by any prev~ous connnission
or any officer, .past or present, of the City or Clearwater, which in any way
attempted to control the enforcement of any law against gambling in any for.m
in the City, and suggested that the City Manager instruct the Chief ot Police
to vigorously enforce all of the laws of the city of Clearwater, fairly,
~mpartially, and without f'ear or favor.
City Attorney Geor~e Smith at the instance of Mayor Seavy explained
in somewhat deta~l the Vance Barden lease, covering property at the northeast
intersection of Causeway Boulevard and Mandalay Blvd. The lease showed a
right of renewal for a five year period in June 1946.
A Letter was read fram ~~. F. L. Hendrix, City Manager, tendering
his resignation on the basis 01' his failure to maintain more strict control
over the Police Department and asking that the Commission accept his resignation
on that ground a~one. At this t~e each commissioner expressed himself as
having no suspicion whatever conce~inp the dishonesty or Mr. Hendrix: Mr.
Johnson added that he did think Mr. Hendrix had been lax in the discharge
of his duties. It was moved by Mr. Crane, seconded by Mr. Johnson and
unanimously carried that the resienation of Mr. Hendrix accord1np.; to the
~enor' of' his letter be accepted.
It was moved by Mr. Johnson, seconded by Mr. Cr~e and carried
that Mr. C. Fred Taylor be appointed c~ty Mana(!er for the purpose or signirg
checks and other 1egal papers.
The Co1lllI11ssion unanimously agreed to meet the next day at ~2 :00 .
noon in an 01'fic1al meet!ng't0'make a'~&mpo~~y'appointment o:f a City Manager./
Eac~ commissioner waived a serving o:f Special Notice at this meeting. This'
waiver was on the motion or Mr. Wells, seconded by Mr. Crane. The motion
was carried unanimously .
There being no further business to come before the Board~ the meeting
was adjourned.

For some time. trains, go~ng. throuph the residential seotions
of the city have been~ tired and their whistles are blown much louder and
more frequently. Due to the firinr, of these trains each home is being
literally ooated with more soot than fonnerly.
I'have been a home owner and resident here for several years
and have always been under the, impres~ion that firing trains within the
oi ty lim! ts was not permi:tted by oi ty ordinance.

Gentlemen:-
As you know, a recent investigation of the Police Department
resulted in the dismdssa1 o~ the'Chie~ of Police and two other officers on
the ~unds of improper conduot. Under the Charter, it was my duty as City
Manager to maintain strict supervision of the P01ice Department as we11 as
all other departments of the City. While it is true that the misconduct charged
against these police officers took place at times when I could not well have
lmown about them, still it was no doubt my duty to know what went on in the
Police Department at al.l 'elmes. I have never attempted to avoid any o:f the
responsibilities of my office, and I am ~lling to accept :full responsibility
in this case. I there~ore f'eel that my rai1ure to maintain more strict contr01
over the Police Department and all of its o~ficers has impaired my ef'fectiveness
as City Manager and indicates that my resignation should be submitted.
There have been some newspaper articles imp1y1Il8 that there
was some laxness on my part or some irregularities in the City Hall in conneot1on
with bolita proseoutions. These charges are absolutely untrue~ I believe yoa
gentlemen lmow me well enough and have sufficient confidence in me to mow that
I would never pe:Mn1t any such irregularities, either in my department or in
any other department of' the City. It there is the slightest doubt in your minds
on this pOint, then I would like to retain my position as City Manager until a
full investigation can be made that will remove any such doubt. And if such
an investigation is desired, then I pledge you my rull cooperation.
Thus I am submitting my resignation ...o.D the sole basis of' my
failure to maintain more striot control o~ the Po1ioe Department, and ir my
resignation is aocepted I request that it be aocepted on that basis alone.
