Mayor Seavy at this time announced the appointment of N. C. Wells
to the Chamber of Commerce Little Pass Committee.
.CIty Attorney Smith now read a resolution concerninp the nulf Oil
Corporation and the City of Clearwater and speclrically affectIn~ the East
Fifteen Feet of Lot 3 of Edward Mill's Subdivision. It was moved by Mr.
Smith, seconded by Mr. Crane and carried that the resolution be adopted. City
Attorney Smith explaIned that in return for the adoption of this resolution by
the City the nulf Oil Corporation was prepa~ed to turn over to the City a

We, the undersi~ned residents and property owners in the ~dpewater Drive section
north of stevenson Creelr, wish to rerl~ter our protest a~ain8t rezonln~ o~ Lote 2,
3,4, and 5, north of Sunget Point Hoad, Block A, Sunset Point Subdivision, as
recorded in Plat Book 4, Pa~e 56.

This sectIon has been operatlnr as an R-2 ~one Rince the zonin~ ordinance was
first adopted on Apr'll 14, 1932, and dllI,inr- all that time, thore has never been any
need for a chanre In classification.
The only non-con1'orminr" \l3€ in this section is the .'Jepvice station located on
Lot 4, and, alt.hourh it does not confo!'ITl to the zmnl7 requirements, It was in
operation at the time the ordinance W~3 ado~ted; conse~lently, it was permittod to
continue 1n operation, and 1s still operatin~ at the present time. There is, there-
fore, no need to chan~e the clBnsiflcation on lot 4.
A permit has been is~ued, and work is undel' way, for' the construction of a
duplex apartment on Lot 5, which is permissible under the present zonin~ restrictions,
so we see no reason for rezonin~ Lot 5.
The claim i9 made that Lots 2 and 3 are not suitable for residential purposes,
and that the y cannot be sold unles s they are re zoned for bu~ine S!'l. If that Wel'e
true, it would be true not because of location, but I'uther because of' the unsirrhtly
build!n,.. that is now on Lot 3, and, for 1~he same reason, it would not be suitable
for busines:-: purposes. However, despite the condition of the buildin~, it has been
rented continuously as a residence, due prIncIpally to the housinp' shortao:e.
Furthermore, less than two weeks a~o, Lot 3 was sold at a ~ubstantial price, and
it seems that this in itself rerutes the statement that Lots 2 and 3 are not
marketable unless reclassified 13.9 busines8 lots.
Additional business would add to the conp'estion and already hazardous traff'ic
condition, which has been roecorrnized cy the City Traffic Com.mission, with warninl7.
notice posted on the stevenson Creek Prid~e, and an overhead si~nal established.
Under the present zonin~ ordinance, there is no diff'erentiotion between types
of business, and a chanre to businel3s ~t8tU~ would include any and all businesses,
other than manufacturinr', many of wLich would be most undesirable, and damarinp:
. to the character of thiR communit.y.

Due to its undesir3blillty as a business location, the type of business that
would be attracted would be undesirable, and not an asset to the community.
Any chan~e made'now would establish a bRd preceoent, not only ror this areaf
but for other sections of' r;learwater, Rlsa.

This particular sectien has a considerable amount of vacant property, and
any chan~e in 7.onin~ would impair the development of this section as a strictly
residential community.

We feel that there should be no chun~e in the zoninr ordinance unless it
would be to the benefit of the entire area, and that a chan~e made separately to
satisfy profit motives would be an injustice to the remainder of the property
owners and residents of this community.
The Edfl'ewater Dpive Association was f01'med by resIdents of this area to improve,
deve lop and beau ti fy thi s secti on of Clearwa ter, "ClearwD. ter' s Pron t Door", and to
work ror the beautification of Edrewater Drive, so that it will be a continuation
of the beautiful thorou~hrare that Dunedin has eRtablished on its portion of
Edpewater Drive.
The. si rners of thi s petition are pl'opel"ty owners who have already built
residences, or are plannin"" to do so when buildin~ restrictions are lifted, and
have purchased or retained their properties with the assurance that they would be
protected by the existin~ zonin~ ordinance.
Any. chan~e of the exiRtin~ zonin~ ordinance would be most unfair to those
who have invested in this area.
Approximately 52 per~ons have ~i~ned the above.

to property owners in this area, who have purchased land and built houses thereon,
and who relied upon the provisions of the present zonin'" ordinance to protect
them from the encroachment of business establishments in any part of the Sunset
Point Su bdi vi:ion. It is r-ener911y recor"nized tha t the a r0a bounded bySunset
Point Dr>ive on the south~ F;drrewater Drive on the 'Nest, Dourr1as Avenue on the
east~ and Union street on the north, is ~ne of the finest sections of this city.
While more or less dormant for many years, there has been considerable bui1din~
of ~ome very attractive homes in thLs section durin'" the past two years, and
numerous others ape either in course of construction, or planned. 'Nhatever
interests are seekinr thIs modification of the zonin~ ordinance have no re~ard
for the people who have contrib1.)teu to the upbui1dinr" of this section. It Is
now ror the City Admlnistr~tion boldly- to stand behind us property owners
who have relied upon the pl'otection of the zonlnl'" lRw.
In most of the cities that have a real zonlnr- ordinance there are
provi s1 ons requi rinr- th e approve 1. of a spec i fi ad percenta (Te of property
ownership~ abu:t;tlnp', adjacent to, or within a certain area adjacent to the
proposed modification. If your Commission were to canvass this particular
area you would find that every home owner, with one or two exceptions, is
opposed tp this proposed rezonin~.
A~ T am leBvin~ eB~ly tomorrow mornin'" for an extended vacation, I
"lhall not be Rble to attend the hearin~ on the 19th. I find that a rlunber of
residents of this locality who are vitally interested in this matter are at
present absent. It seems to me that, as a matter of fairness, this hearin~
should be postponed to a later date, to I"'ive such persons an opportunity to
pre sent their views. After all, why th1 s Cl'rea t rw~h?
I own 160 feet frontarre on Sunset Point Drive; have just conpleted
a splendid house on the east 80 feet, and have in contemplation the building
of a second house on the west 80 feet, but certainly will not proceed with that
operation if the area is to be rezoned to permtt hot-do~ stands, shoe-shlne~parlors,
dry-cleanin~ establishments, and other similar kinds of business, occupyinr \~at
are rene ral1y called "tax payer" buildlnl~ s. And that Is exactly wha t rezoninr;!
will lead to.

The City Commission ahall have author'ity to establish
reasonable standards for, and shall have r-eneral control over the type
of, examinations to be ~iven all applicants.
(c) In the event applicunt passes said examination
satisfactorily, the Board shall Issue to him a Certificate entltlinp him
to the issuance of' a license in the na1'!1E' des1."11ated on his application,
upon payment of the required OccutJ8.tional License Ilax.
(d) Any applicant failln~ to pass the examination
satisractorily, may be re-examined wit~out additional examination fee,
wi thin one year.
(e) All licenses issued under the provisions of thIs
Ordinance shall expire on the 30th day of September each year. Any
licensee may renew his license certificate within t'hirty (30) days from
its expiration without re-examination and shall secure his current
occupstional license by payinrr the prescribed tax.
(f) Licenses may be transferred, subject to the examination
provisions set out above, when there is a bonafide sale and transfer of the
property used and employed in the business as stock in trade, provided
such transfer shall be made within ten (10) days after said sale takes place.
(~) Any chan~e of name under which a license has been
issued shall be approved by the Board.of Examiners.
(h) A copy of any license certificate lost, destroyed or
mutilated shall be issued by the Board.
(i) The filin~ of a petition in voluntary bankruptcy by any
Contractor holdinV' a license under this Ordinance, shall automatically serve
to revoke his license, pendinr action by the Board as provided under Section 8
below.

We, the undexait�ned residen�s ar�.d property owners in the �d�evrater Drive section
north of Stevenson Creek, wish to recrister our proteat a�ainst rezonin� 08 Lots 2,
3, 4, and 5, north of Sunset Point Rpacl, 131ock A, Sunset Foint Subdivision, as
recorded in Flat Book 4, Ya�e 56.
This section has been operatin� as an R-2 'Lone since the zonina ordinance was
first adppted on April 14, 1932, and durint� all �hat time, there has never been any
need far a chanp�e in classification.
The nnly non-con£ormin� use in this section zs the service station located on
Lot 4, and , al�hourrh it c�oes noi; conPorrri to the zcr�n�r requirements, it was in
operation at tlae time the ordinance tiv�a adopte�l; consequently, it was permitted to
continue in operati�n, and is s�Gi11 operat;inR at the present time. There is, �here-
fore, no need to chan�*e the classification on �,ot 4.
A pe�mit has been issued, and Nrork is urider way, ior the cnnstruction of a
d.uplex apartment on Lo� 5, which is permissible under the present zoninn restrictions,.
so v�e see mo xeason for z•eZoning Lot 5.
The claim is made that Lots 2.and 3 are not suitable for residential purposes,
and �hat they cannot be sold u.nless they are rezoned for business. If that were
true, it ��ould be true �1ot because oi loca�Gion, but rather because o£ the unsiahtly
buildinr* th at is now on Lot 3, and, for the same reason, it would not be suit�ble
for business purposes, However, despite the condition of the buildin�, it has been
rented continuously as a rEsidence, due prineipally to the housin� shorta�e.
Furthermore, less than two weeks a*�o, Loi 3 was sold at a substantial, price, and
it seems that this in itself refutes the statement that Lots 2 and 3 are not
marketablE unless reclassif�ed as business lots.
Additional business would add to the cont�estion and already hazardous traffic
condition, wY?ich has been recot�nized by the City Traffic Commission, vrith warnin�
notice posted on the Stevenson Creek Bridre, and an overhead si�^nal estGblishe�i.
"Under the presEnt zonin� ord�nance, there is no di£ferentiation bet�xeen types
of business, and a chan�e to business status would include any and all businesses,
o�her than manufacturir��, many of which would be most nndesirable, and dama�inp
to the charac�er of this com_munity.
Uue to its undesirablility as 2 business location, the type af business Lhat
would Ue attracted �vould be undesirable, and not an asset fio the community.

The Ed�ewater Drive Association was formed bp residents of this area to improve9
deuelop and beautify �his section of Clearwater, "Glearwater�s Front Door", and to
work for the beautification of �'drewater Drive, so that it w�Il be a continuation
of'the beautiful thorour*hfa�e thaG Dunedin has established on its portion of
Ed�ewater Drive.
The si�ners o#' this petition are proper�y oraners who have already built
residences, or are plannin� to do so when buildin�^ iestrictions are liited, and
have purchased or retained their properties tivith the assurance that they would be
protected by the existin� zonin�^ ordinance.

of a putalic hearin�*, sched�xled for Aua�ist 19th, on a proposal to rezone, for
business purposes, Lots numbered 2, ��, 4, and 5, SLtnset Point Subdivision.
I desire to rerister a most emphatic protest ap�ainst such rezor_ir_�*,
as I believe it would be a serious set back to the further .development of this
splendid rEsidential secLion of Clearv�a�erz also it would be manifestly unfair
to proper-�y o�vners in this area, who hava purchased land and built houses thereon,
anrl v�ho rAlied upon the provisions of the present zonin�' ordinance to protect
them from the encroachment of business establishments in any �art of' the Sunaet
Point 5ubdivi son. It is �*enerally recorni�ed that the area bounded bySunset
Point Drive or the south, Edt�awater Drive on the ,'Je�t, Doue�las Avenue on the
eas�, and �nion Street on the north, is one of the finest sections of this ci�y.
"�Plhile r�ore or less dormant for many pears, there has been considerable buildina;
r.f some very attractive homes in t,his ssction durina the past two years, and
r.tunerous athers are either in course of constr•uction, br planned. Whateve-r

Tn most o� the cities that have a real zonin�- ordinance thera are

ownership, abuttinF, adjacent to, or within a aertain area adjacent to the
proposed modi£ication. If your �ommission were ta canvass this particular
area you would iind that everf home oc�ner, �r.�ith one or two exceptions, is
opposed to this proposed rezonin�. -

submit satisfactory evidence thereof. In the event that the Eoard shall
fiz�d that the applicant is unable to submit satisfactory evidence of his
�eneral qualiiications and references as aforesai� the applicant sh�ll be
so advised in �nmitin� and he shall have the ri�ht to ap�eal from the action
of the Board as grovided in Section 11.
The City Commission ahall have authority to establish
i=easonable st�ndards for, and shall have �eneral cor.trol over tYa type
of, examir�ations to be �iven all applicants.
(c) Tn the event applic2nt passes said ehar,iination
satisfactorily, the Board sha11 issue to him a Certif:ica�Ee Entitlinc him
to the issuance of a license in the name des��nated on his application;
upon pagment of the required Ocetzpational License jax.
(d) Any applicant failin� to pass the exAmination
satisfactorily, ma� be re-examined without additi�nal exanination fee,
within one year. ,
(e) A1? licenses issued undEr the provisions of this
Ordinanoe shall expire on trhe 3�th day of September each year. Any
licensoe may renew his license certificate �vithin t�irty (30) days irom
its expiration without re-examination and shall secu�e his current
occupational license by pay3na the �?rescribed tax.
(f) Licenses may be transferred, subject to the examination
provisions set ouL above, when there is a bonafide sale and tr�jnsfer of the
property used and employed in the bu�inass as stock in trade, provided
such transfer shall be made within ten (10) days after said s21e takes place.
(P`) Any chan�e of name under rl�hich a licei�se has been
issued shall be approved by the Board.oi Examiners.
(h) A cop�T of any liconse certificate 1ost, destroyed or
mutilated shall be issued b,y �he I3oard.
(i) The filin� of a petition in volantar� bani�ruptcy by any
Contrac�or holdin:r a license under this Ordinance, shall autamatically serve

Commission.
The Buildin.r, PlumbinF� or El�ctrical Inspectors of the City
of Clearwater, the Arehitect or �Qineer responsible t'or the plans under �vhich
the Contractor is workin^, or any nerson directl3* interested, reay prefer
chare�es ap�ainst any licensee under this Ordinance, char�in�* any of above
acts or omissions. Such char�es shall be in �✓nitin�*, stivorn to by complainant
and submitted to the Board. The Board shall then, not later than thirty (30)
dsy� after the fiTin� oi said char�*es, investi�ate the char�*es and make
finds and recommendations thereon. � copy of the charres, to�ether witH
notice of the time and place o�' he4rir.�*, shall be'` le�ally served on the
accused at least five (5) days before Lre date fiYed for the lae�rin�. At
the hearinfi, the accused shall have the rir�ht to appear pereonally and by

City Clerk to suspend or revoke the license or take such other action-as
may be determined. The Citg �ommission shall also act on any recommendations
for reinstatement or re-isauance o£ licenses as recommended b,y i;he Board.
