THIS AGREEMENT, Made and entered into this 28th day of February 1946, by
and between the ATLANTIC COAST LINh RA1LROAD COM~ANY, a corporation created and
organized under and by virtue of the laws or the State or Virginia hereinafter for
convenience styled the Railroad Company, the rirst party, and the CITY OF' CLEAR-
WATER, a municipal corpora~ion under the laws of the State of Florida, the second
pa rty :
WITNESSETH, The t the Railroad CODlpany I for and in considera tion of' the
sun of One Dojlar to it 1n hand paid by the second party, the receIpt whereof is
hereby acknowledged, and the perfonnance of the covenants hereinaf'ter contained
on the part of the second party, does hereby give and grant unto the second party
the right and privilege to lay and maintain, for the purpose of' a gas nmin, a line
of' 3-inch wrought iron pipe across the right of' way and underneath the main track
of' the Railroad Company at Clearwater, Florida, at a point 2952 feet southwardly,
measured along the center line of the Hailroad Company's main track~ from mile
post 136 (from Sanford); said line or pipe to extend across said right of way at
right angles with said center line; said line of pipe to be entirely underground
and as shown in red on the blue print hereto attached and made a part hereof; said
right o~way being 30 feet wide on each side of said center line.
And the second party hereby convenants and agrees with the Railroad
Company in consideration thereof, as follows:
(1) That the second party shall lay and maintain said pipe in a manner
satisfactory to the Engineer Llaintenance of Way of the Railroad Company and so as
not to interfere with pipe or other structures now in place; and in the event
that the said pipe shall become in need of' repairs, the second party shall repair
same upon notice given by the said Engineer, and upon the failure of the second
party to make such repairs, the Railroad Company may make all necessary repairs, but
at the cost of the second party; which said cost the second party hereby agrees and
promises to pay on demand.
(2) That the second party shall assume entire responsibility for all
damages caused in any manner by the said pipe to the property or employees of' the
RailDoad Company or to any other person or property; and that the second party
shall protect and save harmless the Railroad Company from any and all damages and
losses caused in any manner from the said pipe, howsoever resulting.
(3) That the second party will at any tille, upon thirty days' written
notice given by the Railroad Company, change and alter the location of said pipe
to confor.m to any changes or improvements that may made by the Railroad Company
in its tracks or roadway at said location.
It is expressly understood and agreed that no assessment shall be made
against the Railroad Company to cover the cost (or any part thereof) of construc-
tion and/or maintenance of said pipe, including material, labor and any other
item of expense incident thereto.
(4) That the second party will pay to the Railroad Company, on bills
rendered by the Railroad Company, the full amount of all cost and expense which
may be incurred by the Railroad Com~ny in protecting its.track or tracks by
driving piling or by other means while said pipe is being placed therunder.
(5) That the p~rtion of said line of pipe which passes underneath
said track and roadbed thereof shall be encased by and &t the expense of' the
second party in cast'iron or concrete pipe or larger diameter, properly vented
at each end and placed at a minimum depth of 48 inches below the base or rail of'
said track or not less than l~ inches below the bottom of the Railroad Company's
roadway ditches--~hichever depth is the lower.
.It is understood and agreed thAt this contract sr~11 not be binding un-
til it ~s been ratified by proper ordinance or resolution of the City Commissioners
of the second party, a copy of which resolution or ordinance is attached hereto and
made part of this agreement,

A G R E E MEN T
TH1S AGREEMENT is entered into this 19th day of March, A.D. 1946, by and
between the Cl ty of Clea I'wa ter, Florida, hereina fter referred to as the Ci ty, and
theCleveland Baseball Company, hereinafter referred to as the Company, as follows:
1.
The Company agrees that the Cleveland American League Baseball Club will
do its spring training for 1946 in the City of Clearwater, and to play its home spring
eXhibition games in said City.

The City agrees to provide the Company with free use of the baseball park
located in said city, andplayers' dressing rooms, to have the playing field in proper
condition. The City shall make some minor repairs and improvements that have here-
tofore been requested by the Company, particularly to raise the height of the right
field fence, to repair the wire screening over the grandstand in back of the batter's
box, and to provide a suitable batting cage.

Company.
All gate receipts taken in during the training season shall go to the

It is understood that the Company has arranged to have its players stay
at the Fort Harrison Hotel in Clearwat er durinr; the training season. In addition
to the sleeping rooms to be occupied by the players a d officials, it is under-
stood that the Company will requir'e three extra rooms-one to be used as an office
for the ~anager, one to be used as an orfice for the secretary, and one to be used
by the trainer in administering treatments to players. All sleeping rooms are
to be paid ror by the Company, but the City guarantees that the three extra rooms
above mentjoned shall be furnished bo the Company at a rate not exceeding $3.00
per day for each room. Any charges made by the hotel for said three rooms in
excess of ~3.00 per day per room shall be taken care or by the City.

The ~~ty'agrees to keep the grandstand and bleachers in proper state of
repair. and the Company shall not be held responsible ror any accidents that may
occur or injuries that may be received on account of the City's negligence in
failing, to keep the grandstand and bleachers in a safe and pro~r condition for
use by spectators.
6.
It ia understood that if the training facilities of the City proves sat-
isfactory to the Company, an additional agreement sha~l be entered into at the
close of the 1946 spring training season extending this agreement to cover follow-
ing training saason or seasons.

The City Commtssion met in regular session the evening of MEll'ch 18, 7:30P.M. with
ell present with. the exoeption ot: Herbert Grice.

The meeting was oolled to order by Me:.yor Seevy end the minutes of the previous'
meeting were reed end apprJvad.
The President and Vice President of the Cleal~ater Shuffleboard Olub were
present and urged the club's need of substantial contributions from the oity to take
oare of their needs of'fast groVling m.:mbership. The Commission informed Mr. Jarvis, the
president, that every effort would be made to assist the Shuffleboard Club in so fer as
city's budget would permit. This request will be gone into thorouP,,111y before th e
approval of next year's bJ.dget. Faots and figures ooncerning operation, membership,
receipts and disbursements are set out below:
The City Commisolon informed Mrs. Cleiland Williman anj Mr. O. L. Jaymes who
anDeared on beh~lf of Civio Art Center that the question of whether or not the Civio Art
center building oould be placed in the waterfront perk or Crest Lake park~ould nElve to
wait until a m~ster pIon of these parks could be completed. It was expected thElt the
p5rk arohi tect would be in Clearwater wi thin the next few weeks and start work on this
project.
Two bids were before the o.Jurt cone er ning the resurfacing of Myrtle hven ue from
,; Court Street to Turner Street. Both of these bids being for mixin~-in place Jobs, with

Inas'much as work that is to be done on curbing and .man-holes, City ~~nager Henarix
was requested to fUrther investigate these bids to the end that a final figure might be

It wes moved by Mr. Smith and seconded by W~. Wells and cElrried that an agreement
with the Oleveland Baseball Company "be approved. This agreement is set out below:
Upon reoommendation by ~lr. Hendri x, it was moved by Mr. Wells and seconded by
Mr. Johnson and oar'ried that the request to discount taxes on property in Section 16-29-16
bordering Tampa Bay and immediately north of Gulf-to-Bay Boulevard, be refused.
It Vias moved by Mr. Johnson and seconded by Mr. Smith and carried that the resignation
of Paul F. Randolph, Alfred P. Marshall, N. W. Hopkins, Frank Tack and Jessie P. Mo Olung
as members of the Zoning board be acc epted. Resignation set out below.
Oommunication from Ci ty .Planning Boar1 was read concerning further triEll of parallel
parking. This question was passed over until next meeting of board. hI so the Planning
Board recommended the repair of Seminole Street dock end the construction of North end
South Wing on the west end of the dock. The Oommission asked Mr. Hendrix to investigate
the condition of the dook end the possibilities of putting it into oondition for use as a
fiShing pier.

Before the Board wes 8 petition expressing an approval of angle parking. The
signatures 'Were as Merchants end Business men and numbered about 70. This petition is
set out below.
It was moved by Mr. Smith and seconded by 1tr. Wells and carried that an agreement
with i\.tlantic Coast Line Railway Co. concerning a gas mEain on V!yatt street be approved.
This agreement is set out below.
It was moved by Mr. Smith, seconded by Mr. Johnson and carried that Gerard Kooy
and Herman Watts, doing business as CleBrwater Bar and Grille be issued a liquor
occupational lioense. The written applioation is set out below.
.at the suggestion of Mr. Johnson, the ,Cor::miss ion requested that the Oity Attorney
be drawn an ameadment for traffic ordinance #404. This amendment to designate the Greenwood
Avenue as a through street Lakeview .hvenUe as B stop street at the intersection of these
two thoroughfares.
Motion made by Mr. Smith was seconded by Mr. Wells and ~arried that a resolution
concerning special election to be held on April 9th be approved. Resolution set out

Commissioner Smith reported thbt the negroes are very anxious to secure help from
the City for fence around recreation grounds just north of Prospeot Avenue. Mr. Smith
said it was reported to him that 8 wire fence would cost about $3,000.00. Mr. Hendrix
was asked by Commission to investigate cost of putting this cyolone fence around the
ball park similar to the one now us ed at Green Field.
Mr. Richards and Mr. Swift were asked to investigate and see if any Errangements
should be made to lessen the hazerd caused by riding of motor bikes by under age ohildren.
There being no further business to come before the Board, the meeting was adjourned.

not to intsrfere with pipe or other structures now in place; and in the event
that the said pipe shall became in need'of repairs, the second party sha 11 repair
sane upon notice given by the said Engineer, and upon the fa'ilure oY the second
party to make such repairs, the Railroad Conpany znaq make all necessary repairs, but
at the cost of the second party; which said cost the second partg hereby agrees and
promises to pay on demand.
�2i �'hat the second party sha11 assume entire responsYbility for all
damages ca.ised in any manner by the said pipe to the groperty or emploqees of the
Rai l�noad Gon;psng or to any other person �r property; and that the second party
shall pr,otect and save harmless the Pailroad Company from any and al1 uamages and
losses caused in any manner from the said pipe, howsoever resulting.
(3) That the second party w�li at any tine, upon thirty da�s� written
notice given-by the Railroad Company, change and alter the location of said pipe
to conform to anp changas or improvements that may made by the Railroad C�mpang
in its tracks or roadway at said location. -
It is expressly understood ann agreed Lhat no assessment shall be made
against the Railroad Company to cover the cost (or any part thereof) of construc�
tion and/or maintenanco of said pipe, inclv.ding material, labor and any other
item of expense incident thereto.
(4) That the second party will pay to the Railroad Company, on bills
rendered by the Railroad Company, the full amount of all cost and expense which
may be incurred by the Railroad Comg�ny in proteating`its�track or tracks by
drivir�g piZing or by other means while said pipe is being placed therun�er.
�5) That the pmrtion of said line of pipe whzch passes underneath
said tracli and roadbed thereof shall be ancased by and �t the expense of the
se;cond party in cast"iron or conr;�ete pipe of larger diameter, properlg vented.

field fence, ta rapair the wire screening over the grands�and in back of the batrter�s
box, and to provide a suitable batting cage.

, for the bianager, ane to be used as an offi:ce for the secretary, and one to be used
� by the trainer in administering treatments to players. All sl�;•�ping rooms are
to be paid for by t�e Company, but the City guarantees that th� thre�e extra rooms
,above mentiq�ea shall be ilirnished bo the Company� at a rate not exceeding �3.00
per day for each room. Any charges ma3e by the ho:tel for said three room:+ in
excess of �p3.00 per'c�ay per xoom shall be taken care of by the City.

� repair, and the Company shall not be heid re��ou�ible for any accidents that may
� occur or injuries.that may be received on account of the City's negligance in

" It is understood that if tiie training facilities of the,City proves sat-
