The Oi ty Commission of the Oi ty of Clearwater, .Florida---
met in regular session the evening of April :5rd, 1944 at 8:00
o'olock p.m. in the City Hall with the following members present:
George R. Seavy, Mayor-Commissioner
Jesse G. Smith, Commissioner
Dan L. Stoutamire, Commissioner
Sumner R. Lowe, Commissioner
Absent: Herbert Grice, Commissioner
The meeting was duly called to order by Mayor Seavy and
the minutes of the previous meeting were read and approved.
A oommitte representing the Citzens from East Clearwater
presented to the Board a petition signed by approximately 250 peo-
ple of the seotion requesting that City bus servioe be furnished
this part of the City. The Oity Oommission advised representatives
ot: the Clearwater Trans! t Comp any who were prpsent that they would
like to see seriv8 given to these East section citzens for a period
ot: 60 days as a trial. The bus officials agreed to do so if they
could get permission from the O. D. T.
Mr. Kenneth Kerr appeared before the Board relative to
the closing of an alley in Block 8 of Milton Park Subdivision.
It was moved by Mr. Smith, seconded by Mr. Stoutamire and carried
that a Resolution vacating an aller in Block 8, Milton Park Sub-
division be adopted. Below and set out elsewhere in these minutes
is a copy of this Resolution.
'\'" City Manger Hendrix now read a letter from Mr. M. B.
. . Thayer and Ethel C. Thayer requesting t~at the City Commission
vacate the 15 foot alley running East and West through Block
4? of Mand.alfiY Subdivision. It was moved by Mr. Stoutamire,
seoonded by Mr. Lowe and carried that a Resolution vacating
the alley in Block 47, Mandaly Subdivision be adopted. Below
and set out elsewhere in t~ese minutes is a copy of this Resol-
ution.

City Manger Hendrix reported that a sea wall along the
side of the City's property on the North side of the Causeway and
running from the Causeway bridge to the East side of Barbour-Mar-
row S~bdivision would be about e5;QOO.OO/
City Manager Hendrix also reported that Mr. F. E. Hamm
had changed the plans of an addition to a building on Prinoess
Street and that the plans as changed would not conflict with the
building lines in the subdivision.
Moved by Mr. Lowe, seconded by Mr. Smith and carried
that the transfer of $10,000.00 from the Gas & Water Fund to the
General Fund on March 20th be approved.
It was moved by Mr. Smith, sec.:mded by Mr. Lowe and car-
ried that the City of Clearwater enter into a contract with the
Stacey Brothers Gas Construction Oompany of Cinncinati, Ohio, for
the erectiD~ of one 500!;'OOO oubic f'eet capac1 ty gas holder 1n the
oomount of $59,300.00, the Oity to purchase the holder itself from
the Atmospheric Nitrogen Corporation for $31,700.00, said contract
subject to the approval of the City Manager and City Attorney.
There being no further business to come before the Board
the meeting was adjourned.

There is no need for this alley, and never will be any need for it.

RESOLUTION
-
WHEREAS, PlNELLAS GROWERS ASSOC~ATION, a cooperative oorpor-
ation orgainzed under the laws of Florida with its prinoipal oftice in
Clearwater, Florida, by and through its attorneys, Kerr & Peebles, has
petitioned and represented to the City Commission ot the City of Clear-
water, that said corporation i~ the owner in fee simple of oertain lots
in Clearwater, Florida, to-wit:
Lots 1, 2, 3, 4, 5, 11, 12, 13 and 14 in Block 8,
of Milton Park Subdivision, acoording to the plat
thereof as recorded in plat book 1, psge 69, of
the public records of Pine1las County, Florida,
which said lots are free and clear of all tax and assessment liens, and
fully paid up, and
~REREAS, according to the official plat of said Milton Park,
said lots 1, 2, 3, 4 and 5 face north on Grand Central Avenue, and
said lots 11, 12, 13 and 14 face or front south on Pinellas Avenue, and
said lots frontihg north are separated fTom said lots fronting south
by a 16 foot alley extending east and west between said tiers of lots,
allot which said lots and alley are and constitute the whole of said
Block 8 of Milton Park lying between the Seaboard Air Line Railway (East
Avenue) on the east, and the right-ot-way of the Atlantic Coast Rail-
road on the west, and
WHEREAS, said Pinellas Growers Association represents that
the building o~ said lots 11, 12, 13 and 14 extends over ..nd upon
said alley on the north side of saide lots, and has so extneded over
and upon said a leyway for many years under the occupanoy of said
present owner and its predecessors in title, and
~~EREAS, said alley has never b8en open nor used as a pub-
lic' :right-of-way in any respect, and it is apparent from the topo-
graphy, and the street Hnd right-ot-way boundaries of said Block 8
ot Milton Fark that the alleyway above described would not could serve
any usetul pUblic purpose, and
~~EAS, Pinellas Growers Association has requested that said
alley, as described, be Officially closed and vaoated, and the plat
thereof annulled to that p~rtion of said alley as desoribed, and
~~EAS, upon investigation, report and re~ommendation at the
City Manager it has been determined that it will be to the best interest
ot the property rights involved that said alley be offioially vacated,
and that such a~tion will "ot, in any WB'f, be prejudicial to any other
rights or interest, either public or private;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the
City of Clearwater, Florida, in regular session assembled this 3rd day
ot April, A. D. 1944, that said petition and renuest of Pinellas
Growers Association be granted, and that the alley in Block 8 of
Milton Park Subdivision extneding east and west between Lots 1, 2,
S, 4 and 6 on the north, and Lots 11, 12, 13 and 14 on the south,
and East Avenue on the east, and Atlantic Coast Line Railroad right-of--
way on the west, is hereby declared closed and vaca ted; and the same,
from and after this 3rd day of April, 1944, is hereby cancelled and
annulled and Shall cease to be a pUblic alley or right-ot-way in the
City of Clearwater, and, insofar as the Oity Commission of the City
of Clearwater is concerned, shall become the property of the abutting
owner, viz., said Pinellas Growers Association."
