CITY OF CLEARV:ATER, FLORIDA. NOVEMBER 15, 1943.
The City Commission of Clearwater, Florida met in regular
session on the evening of November 15th, 1943 at 8:00 P. M. in the
City Hall with the following members present:
George R. Seavy, Mayo:."-Commissioner
Herbert Grice, Commissioner
Jessie G. Smith, Commissioner
Swnner R. Lowe, Commissioner
Dan L. Stoutsmire, Uommissioner
Absent: None.
The Corrunission was duly called to order by Mayor Seavy
and the minutes of the previouo meeting were read and approved.
City Manager Hendrix read a letter from the United States Coast
Guard Auxiliary situated on Clearwater Beach, the letter being
signed by Russell H. Elwell. This letter is set out elsewhere in
these minutes as Exhibit #1. The letter called the attention or
the Corr~mission to unreasonable charges and unsatisfactory work of
the Brumby Marine Ways. The Commission took no action in the mat-
ter except to plan to have Mr. Brumby before the Con~ission at its
next meeting to explain his position in the mAtter.

A letter WAS now read from H. C. Bixler of 1285 Drew
Street in which he objected to the stoppage of the East Bound Bus
Service. This letter is set out later in the minutes as Exhibit
#2. The Commission took no action on the matter.
The Commission had a' letter before it from E. H. Coach-
man relative to the selling price of some of his property on Osceola
Avenue just South of the Library. The Conmission took no action
on the matter. The letter above referred to is later set out in these

The Commission.ll'f..11"d to take any action on the proposal
of the minimum taxi rate of twenty-five cents (25i). The Commission
was of the opinion that a zone map presented by Mr. Martin of the
ClearwAter Transit Company was a step in the right direction in the
handling of taxi charges and directed that these maps be placed in
a prominent place in all cars c2rrying passengers for hire. This
map is made a part of these minutes as Exhibit #4.
Mr. Hichards now read an ordinance to be known as Ordinance
#498, forbiding the purchasing of any bicycle except from a person
who holds a municipal license covering such. It was coved by Mr.
Grice and seconded by Mr. Smith that Ordinance #498 be passed on its
first reading. It wes mov~d by Mr. Smith end seconded by Mr. Lowe
and carried that Ordinance ff498 be passed on its second
reading. Below and set out elsewhere in these minutes is a copy o~
Ordinance 11498.
City Attorney Richards read to the Board a letter addressed
to him by Goodman Kelleher. 'l'his letter is in regard to a strip of
property now own~d by the City just North of the Clearwater Beach
Hotel which was once a part of Ambler Street. The Commission took
no action in the matter end this letter is set out here merely as
a matter of reference.

At the regular meeting of the Clearwater Flotilla of the U. S.
Coast Guard ~uxiliAry held Friday dight November 5th, 1943, at
their Base on Clearwater Beach the Secretary was instructed to
draw up a statement of protest against the unreasonable charges
and unsatisfe ctory work of the Brwnby I'!.arine Ways. In making
,this statement our boat owners ere fully aWAre of the existing
prices for labor, mBteria1 etc., but feel very strongly that
there is no just r!'ason for too large a discrpency between
nearby ways and our local one.
We also wish And invite your attention to the channel lights.
These have had practicaly no attention since Pearl Harbor - very
few have been in operation at anyone time ~nd at the time of
this wirting the north channels are entirely dark and only one
or two are in operation in the shouth channel. We believe if due
effort and energy hAd been put forth, batteries, could have been
obtained for this service either with or without priorities.

Inasmuch as the above two factors do not tend to develop a sat-
isfied and a happy group of boat owners in Clearwater Ba~, and inas-
much as it is our 8im as soon after the war as possible to build
up and enlarge a bonting colony at Clearwater which would be out-
standing on the West Coast. We respeotfully urge that the City
Council find some way to encourage the building and developing
of a competing marine ways here, as competition generally takes
care of the many abuses monoply thrives on. Also that someone be
obtained thnt will give the channel lights the attention necessp.ry
to permit them to render the service they were designed for.

I see it is contemp18ted to take off the ~ast bus run because it is
stated it ~oe~ not pay. It might pay if it would run on time. If
the people could depend on ito Often it does not run and a taxicab
makes the run, but the taxicab is so much in a hurry that it passes
by the passengers waiting on the street.
Does the contraot with the bus line not call for bus service to the
principal sections of the city? Or is each individual bus supposed
to make a profit? It seems as though the guod paying bus runs. like
the beach runs, sho~ld stand the loss if there is a loss, on the
poor paying runs. Lhen again, it is oertainly a poor time to take
Off a bus run to a prominent section of the city when Clearwater is
..spending good money to advertise for people to come here to live.

announcing an offer to the City of my bay Hall property at a
price of $45,000.00. In justice to myself and other interested
parties I wish this statement corrected and am here stating the

About a month ago, a committee or one colled to inquire at what
price I would sell these premises to the City for a PARKSITE.
I gave as my terms: $40,000.00, with $10,000.00 down, the balance
in five years. This offer I confirmed in a letter to Mr. Lee,
Secretary of the Chamber of Commerce, at whose instance, I under-
stood, the inquiry had been made. I then told him my terms were
made at a discount on the cost price to me originally but that, for
civic welfare and my interest in this as a pioneer, I was Offering
the best possible tenus, provided the property was to be used as
a public park, but not otherwise.
Shortly thereafter, Mr. Frank Carmack called me over the telephone,
asking my lowest cash price, but not disclosing hi? principal.
Assuming this to be a private individual, I quoted a price of
$45,000.00, and this was the price th~t was published. I hereby
aff'irm thet I never offered such terms to the City, but admit the
f'igure may have been a misprint.
If the of'fer I made to Mr. Lee has not yet been brought before the
City Commission for consideratio~, I hereby request that it may
receive their official attention and the decision communicated to
me, as I am considerihg other plans in connection with this proper-
ty.

1. No person, firm or corporAtion shall pu~chase any
bicylce in the City of Clearwater except from the person, firm or
coproation by whom a municipal license is held covering said bicycle.

2. It shell be the duty of any person, firm or corpora-
tion purohosing a bicycle to ascertain, before making such purchAse,
thBt the person~ firm or corpor8tion offering to sell said bioycle
holds a municipal license therefor. Any persoh, firm or corpol'a-
tion who purchases a bicycle from any person, firm or corporation
who does not hold B municipal license therefor shall be prima facie
guilty of purch~sing stolen property.
3. Any person, firm or c"rporation who violates any pro-
vision of this ordinance shall, upon conviction thereof in the Muni-
cipal Court, be puniShed by a fine not exceeding $BO.OO, or by im-
prisonment in the city jail for n period not exceeding thirty days,
or by both such fine and imprisonment.
4. This ordinance shell become effective immediately up-
on its passage and adoption by the City Commission of the City of
Clearwater.
