Oi ty 1.:anager F. L. Hendrix submitted a proposed operating
budget for the City of Clearwater for the fiscal year beginning
July 1, 1941 and ending June 30, 1942. Moved by Ur. Smith,
seconded by Mr. Lowe and carried that the proposed budget be
passed ahd adopted. Herewith and iMmediately following is set
out in verbatim the adopted budget:

OF CLEARWATER ADOPTING A BUDGET AND FIXING
THE RATE OF TAXATION.
WHEREAS, the City Manager of the City of Clearwater, Florida
has subnitted an estimate of the amount of money necessary to
carryon the City Government for the fiscal year beginning July
1st, 1941, and ending June 30th, 1942; and
VnnmEAS, the City Cocrmission has, in meeting ~uly
assembled, examined carefully, considered, and approved the
same; and
VfrrnREAS, the tax assessment roll has been submitted to
the City Commission by the Equalization Board in correct form;

taxation by law, shall be necessary to raise the said sums
appropriated for operating purposes, and the said rate of
millage is hereby assessed on all real and personal property
upon said tax assessment roll not exempted by law from taxation.
Third: That it is hereby determined that the following
rates of millage shall be necessary to raise the necessary sums
for debt service on the City's outstanding bonded indebtedness,
and said rates of millage are hereby assessed against the

the City of Clenrvmter to collect from the purchaser for the
use of the City the tax hereby levied at the tine of collecting
the selling price charce in each transactio~.
It shall be
unlawful for nny seller to collect tIle price of any sole of
gas, water, electricity, fuel oil and telephone service in
said City wi thout 8 t the SanG time collect in[J:, the tax hereby
levied in respect to such s~des, unless such seller she.ll elect
to aSSUT;1e and pay such tax VIi thont collecting the same from the
purchaser. Any seller failing to collect such tax at the time

shall be deemed to be nacle in the City of Glearwater in every

within the limits of the City of Clearwater or elsewhere.
Section 9. The taxes imposed by this ortl inance shall
not appl~r to any sale made to the Federal Government or any
of its branches, nor to the 3tote of Florida, nor to the
County of Pinellas, nor to the City of Clearwater.
Section 10. If any section, sub-section, paragraph,
sentence, or provision of this ordinance shall for any reason
be held to be unconstitutional, it shall not in any manner
a~~ect any other section, suh-section, paragraph, sentence,
or provision of this or~inance.
Section 11. Any person, firm or corporation violating
any provision of this ordinance shall, upon conviction in the
~unicipal Court of the City of Clearwater, be punished by a fine
no t exceecline ~~ 250.00 or by imprisonment not exceed ing thirty
days, or by both such fine and imprisonuen t.
