At the instance of Mayor Seavy the City Manager opened
the 011 and grease bids, oovering requirements for twelve
months beginning Mar 1,1941 of the following bidders: Gult
Oil Company, Standard Oil Company, Texas Oil Company, Shell
Oil Company, Orange State Oil Company, Sinolair Oil Company,
Seaboard Oil Company. It was disoovered after oomparison of
the bids that the most favorable bid, oonsidering the requir-
ements as a whole was the Gulf Oil Company and upon motion
of Mr Smith, seoonded by Mr Lowe the Oil and Grease Bid of
Gulf Oil Company was acoepted by unanimous vote. The accep-
ted Bid is set out in detail as follows:

AN ORDINANCE PROVIDING FOR THE DISPOSITION
OF GARBAGE, TRASH, AND WASTE MATERIALS,
PRESORIBI1,!G THE CONTAINERS IN' WHICH GARBAGE,
TRASH AND WASTE MATERIALS SHALL BE KEPT, AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OJ!' THE CITY OF CLEARWATER,
FLOnIDA:
Section 1. DEFINITIONS: The following words, terms
and phrases when used in this,ord,inance shall be construed to
have the same meaning as herein&fter defined:
(a) Moist Garbage: The term moist garbage shall b'e
construed to mean any and all animalt fruit nnd ~egetable refuse
matter whether oooked or raw, or any can, containert or other
material from which any animal, fruit or vegetable matter has
been removed which might beoome sourt spoiled, rotten or putrid
and from whioh obnoxious odors are liable to be emitted or to
whioh flies or other insects are liable to be attraotedo
(b) Dry Garbage:

(c) Trash:
The word trosn is hereby derined to
mean and inolude- yard clippings, grass cuttings, leaves and
such other small rUbbish (other than thnt as defined in the
terms "moist garbage" and "dry garbagett) as ordinarily acc-
umulates e~out a residential premises.
(d) Waste Materials:
The term waste materials is
hereby defined to mean and include sand, wood, stone, brick,
cement, concrete, roaring and ot~er refuse building materials
usually left over from a oonstruction or re-modeling project.
Also, trees, tree limos, tree trunKS and tree stumps.
{el Garbage Can:
The term garbage can shall be
construed to mean only an impervious, cylindrio, metallio can,
constructed of not less than # J..l gauge material which has
a permanent metallic bottom constructed as a part thereof, and
Which has a removable metallic lid so designed as to aot as
olose fitting hood and which further has tw~ handles plaoed
on opposite sides near top to faciliate the lifting and hand-
ling thereof. No oan shall be of more than thirty-two (32)
gal~on capacity, nor shall it be used for other than a moist
or dry garbage container.
(f) Garbage Box:
Any wooden or metallic box con-
structed so that the contents will be kept dry and intact
therein'-and in whioh dry garba~e on1:,z shall be deposited. The
size, design and location of all garbage boxes shall be a~p.
roved by the City Manager of the City of C1ea~vater or his
authorized agent.
$ection 2. It is herebY deolared unlawful and a
vio1ati~n of this ordinance for any person, firm or oop~or-
at10n to do or permit to be done any o~ the following ects or
practices:

(a) To deposit, on or bury in, or cause to be de-
posited on or buried in, any land, public square, street, elley,

vacant lot or unoccu~ied lot, the waters of Clea~vater Bay,
Stevenson Creek, or any other creek, water course or ditch with-
in the City Limits of the City of Clearwater, any garbage or
other noxious, malodorous or ofrenslve matter.
(b) To deposit or place in or cause to be deposited
or placed in a garbage can any materials other than those de-
fined in tbis ordinance as moist garbage or dry garbage.
(0) To deposit or place in or cause to be de~osited
or plaoed in a garba~e box any materials other than those de-
tined in

rubbish, sweepings, debris, trash or waste materials of Any
kind which might be a menace to traffic both vehiculAr And ped-
estrian or which might endanger the proper operation of the
Oity's sewer or d~ainage system.
(g) To oollect or permit to be oollected by anyone
the garbage from any garbage oan or garbage box other than by
persons regularly employed by the City of Clearwater for that
purpose or by persons working under contract withtthe City of
Clearwater or by special written permit from the City Manager
of the City of Clearwater or his authorized agent.

To violate any of the provisions or sections
of t>>is ordinance or any reasonable interpretation of the smne.
Section 3.
If any section, provision, or clause of
this ordinance shall be declared invalid of unconstitutional,
or if this ordinance as ~pplied to any circumstances shall be
declared invalid or unconstitutional , such invalidity shall
not be construed to affect the portions of this ordinanoe not
so held to be invalid, or the application of this ordinance
to other circumstances not so held to be invalid.
Section 4.
Any ~erson violating any of the prov-
isions of this ordinance shall, upon conviction in Municipal
Court, be rined ina sum not exceeding $200.00, or be sentenoed
to the City Jail for a term not exceeding thirty (30) days, or
rosy be punished by both fine and imprisonment, in the discretion
of the Court.

proposed ordinanoe to be known as Ordinanoe No. 470 relative
to City Board$and Tenure of Ofrice of Board members. Moved by
Mr Lowe, seoonded by Mr Clark that the ordinance be passed on
its first reading. Motion oarrtda. Moved by Mr Lowe, seconded
by Mr Smith thaD the ordinance be passed on its seoond reading.

PLUMBER'S EXAMININO BOARD:
The Plumbing Inspeotor of the City of Clearwater
shall be a member or the Plumber's Examining
Board. Other members of the Board shall be as
follows.

Mr Clark brought up the question of the advisability
of closing the north and south:.alley interseoting Cleveland
street just east of the Coaohman Building. Polioe Chief Joe
Russell appeared before the Board and explained that the use
of the alley by vehioles was a definite hazard to pUblio
safety. Moved by Mr Clark, seoonded by Mr Smith that that part
of above mentioned alley extending from Clegeland street South
to the intersection of the f"irst alley running East and West
be closed to vehioular traffic, temporarily. Motion carried by
unanimous vote.
Mayar Geo Seavy explained that the laok of impro~er
lights on automobiles was presenting a dangerous situation in
Clearwater and recommended that the Police Department be in
struoted to proceed at onoe to enforoe all requirements regu-
lating lights on automobiles. After full disoussion the
