Seavy; and ~~REAS the City Charter does not specifioally pres- oribe the method of electing Commissioners in a case of this kind where two Commissioners are to be elected for two-year terms and one Commissioner is to be eleoted for a one-year term; and ~~REAS under Section 161 of the Charter the City Commission has authority to prescribe the method and manner of holding all elections in this City, anl1 now finds it neoessary to pass this resolution to cover the sitlmtion hereinabove described; NO'^" THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: 1. That candidates for the office of City Commissioner at the regular election to be held on December 17, 1940, shall not be required to indicate whether they are candidates for a two-year term or for a one-year term. 2. That the two candidates for the office of City Commissioner who shall receive the highest number of votes (at the general municipal election to be held on December 17th, 1940, shall be declared elected to two-year terms on the Com- mission, said terms to begin on the first Monday in January, 1941, and end on the first Monday in January, 1943; and the candidate recei'ving the next largest number of votes shall be declared elected to a one-year 'term on the COmmission, said term to begin on the first Monday in January, 1941, and end on the first Monday in January, 1942. Before any person, firm or corporation shall sell or be engaged in the business of selling diamonds, or any other precious or semi-precious stones, or imitations thereof, wAtohes, clocks, jewelry, gold, silver or plAted ware, ohina, glassware, or leather goods, at public auotion, such person, firm or corporation shall file an application with the City Tax Collector of the CitY' of Clearwater, Florida, for a liconse, ~'hich applica ti on shall be ac companied bY' an affidavit stating all the facts, relating all the reasons for and character of such sale, and including the statement of the nAmes of the persons from whom the said property proposed to be sold was obtained, the date of delivery to the person, firm or corp- oration applying for such license, and the place from which said property was last taken or bought, and all details necessary to exactly locate and fully identify the said property, and shal~ further state that the applicant is of good moral character. There shall be attached to the application a written sworn j.nventory shoVl'ing in detail the quality, quantity, kind or grade of the said property pro- posed to be sold, and stating that no items or articles be- longing to anY' other person than the applicant are included in said inventory. The application shall be accompanied bY' a bond payable to the Governor of the State of Florida in the penal sum of Two Thousand Dollars ($2,000.00), conditioned that the applicant shall pay all losses and damages which may lawfUlly be clabned against the applicant, on account of any misrepresentation of fact or belief or any material suppressing of facts made by the applicant or ceused to be made by the applicant in the conduct of said sale concerning the said property offered at such sale, or any losses or dmnages which may grow out of a violation of any provisions of law relating to such sale by such applicant. Suoh bond to be exeouted as suretY' by a bonding or insurance company lioensed to do business in the state of Florida. The applicont shall pay to the Tax Collector as a lioense for the privilege of selling such property at pUblio auotion the sume of One Thousond Dollars (;)1,000.00), for the duration of said sole, whioh shAll not exoeed fifteen (~5) days, and provided further, that no fractional part of said lioense tax shall be pRid for a sale of shorter duration. Seo. 4. Upon the filing of such application, affidavit, inventory and bond, and upon the payment of the said sum of $1,000.00 as required in Section 3 hereof, the Tax Collector of the City of Clearwater, Florina, shall before issuing a license to the applicant, either personally or by two or more duly licensed jewelers, examine the said property specified in said inventory, which property is proposed to be sold during said auction sale, said inspection being for the purpose of determining whether the said inventory clearly sets forth and describes the property proposed to be sold, and whether the allegations of the application and affidavit relating to said property are true, and should it appear upon such inspection and examination that such proposed sale of said property at publfc auction will probably result in fraud, deceit or other imposition upon the public, or mould it otherwise appear to the Tax Collector that the application, affidavit or inventory is untrue the said Tax Collector is authorized and directed to : ,I , ',~ .' .' ",' " I, file with the City Clerk the said application, affidavit, bond, inventory and his report and recommendations thereon, and the City Clerk sh~ll thereafter submit the same to the City ot " Clearwater, Florida, and said City Commission of the City of Clearwater shall thereupon either set a date for a hearing upon said application at a regular Commission meetinr" or refer the matter to an appropriate committee of Commission members for a hearing upon said application. Provided, however, that before a hearing shall be held by either the Commission at a regular meeting, or an appropriate committee thereof, two week's notice of the time and place of such hearing shall be given by a publication of notice thereof in some newspaper ot general circulation in the City of Cleanvater, Florida, said notioe to be published one time at least two weeks prior to the date of said hearing. " and the said City Commission is hereby authorized and empowers, to refuse to grant said application if in the opinion of the members of said Commission such aotion is necessary to prevent fraud and deception being practiced upon the public. If, how- ever, the City Commission, or a ~~jority of a quorum thereof, finds that said sale will in their opinion be so conducted as to protect the public from fr~ud, deception and imposition, and if satisfied as to the truth .'of said application, affidavit and inventory, And with the sufficiency of said bond, and as to the good moral character of the applicant, they mny direct the Tax Collector to issue a license to said applicant for the pur- pose of conducting such auction sale of said property. If, how- ever, said Tax Collector, upon his inspection of the said pro- perty, or upon the inspection thereof in his behalf by two or more licensed jewelers, is satisfied that the application and affidavit are true, and that the bond is sufficient, and that the applicant is of good moral character, he may immediately upon payment of the sum of $1,000.00 issue a license to said applicant, without filing the said application, affidavit and inventory with the City Clerk, or carrying out the procedure outlined above. Sec. 5. No license shall be issued to conduct a sale at pUblic auction for a longer period than fifteen days, Sundays- and legal holidays excepted, and a period of at least six (6) months must have elapsed after the conclusion of any auction sale conducted after the enactment of this Ordinance before another license shall be issued to the same applicant, or to any other person, firm or corporation in privity with said applicant. Sec. 6. No license shall b~ issued and it shall be un- lawful for any person, firm or corporation to conduct a sale at pUblic auction of diamonds or any other precious or semi-precious stones, or imitations thereof, watches, clocks, jewelry, gold, silver or plated ware, china, glassware, or leather goods, in the City of Clearwater between the hours of 6:00 P.M., and 8:00 A. It shall be unlawful for any person, firm or I , corporation, to aot or to cuuse any other person to act as a by-bidder, or wha t is corn:nonly knovm as a "capper" or "booster" at any suoh sale at public auotion or any place where any such sale shall take plaoe or to offer or mnke any false bid or to pretend to bid for or buy any article sold or offered for sale at any suoh auotion; or for anyone directly or indirectly in the employ of the person, firm or corporation to whom a license has been issued under the Ordinance to bid for or buy any such article. Sec. 10. If any section of this Ordinance, or any part thereof, shall be adjudged by any Court of competent Jurisdiction to be invalid, such judgment shall not affect, impair or in- validate the remainder or any other section or part hereof, And it is further expressly declared that itis the intention of the said Oity Commission of the City of Clea~vater to enaot such remaining portions or seotion hereof without inclUding herein such invalid or unoonstitutional sections or portions. Sec. 11. Any person, firm or corporation who shall violate any of the provisions of this Ordinance shall be liable to punismnent by a fine of not exceeding Three Hundred and nO/100 ('300.00) Dollars, or by imprisonment for not exceeding sixty (50) days, or by both, such fine and imprisonment in the dis- cretion of the Municipal ~udge, and each day that said person, firm or corporation shall fail to pay the license tax herein required shall constitute a separate and distinct offense and shall be punishable as such, and likewise any person, fi~ or corporation shall be deemed to have violated this Ordinance by conducting auction sales of said property at more than one location without obtaining a separate license for each location, and shall be punishable as for a separate and distinot offense for each and every location not separately licensed under the terms of this Ordinanoe. ~ ~~'W~ ..'_ .~)t,l~.... . -:'::'1~ ~..~ (' ~~ ....t' .,,# I:',"/://', I. .':'":r,, .. \",I;~, ,'j ,,::'..' .
