The City Commission of the City Commission of the City
ot Clearwater met in the City Hall at five o'olook on the
afternoon of February 26th, 1940 for a Called Meeting of
which the Mayor and eaoh Commissioner had been notified by

purpose of oonsidering a request for the olosine of the
alley 1n the rear of the Coachman Building and such
other business as may properly come before the Commission.

unanimously carried that the Cityllanager be instructed to
purchase a truck for the Gas and Water Department trom
Kennedy and Stric~~and at a price of $ ;t~~for cab and
ohassis as quoted by then and oredit s~e to purchase
contract on balance ot Block 4 of Sarah McMullen's Sub-
division as per agreement.

BE IT RESOLVED by the City Commission of the City
of Clearwater, in meeting assembled this 26tu day of
February, A. D. 1940, that
WHEREAS, Prior to the 21st day of December. A. D.
1931, that the Heirs at Law of S. S. Coaohman, deoeased,
to-wit: Jessie Candler Coaohman, widow; Jessie Candler
Ooaohman, daughter; S. O. Ooacnmmn, son; H. M. Coaohman,
son; Jromes Warren Coachman, son; Franois Lane Coaohman,
son; Bonnell Ponteau Coaohman, son; and(Harr1et Coaohman
Dan1el, daughter; were the owners in fee of that certain
piece or paroel of land situated and located in the City
of Clearwater, described as ~o110ws, to-wit:
The South Five (5) feet or North Twenty-six (25)
feet and Two (2) inohes or Lot Three (3), Blook
Four (4) of Gould and Ewing's Seoond Addition to
Clearwater, Florida,
which said tract of land, together with the rive foot
strip to the North thereof, had been for many years prior
to said date maintained by said heirs and, during his
lifetime, by S. S. Coaohman as a ~rivate alley as an
appurtenanoe and for service to that oertain property in
the City of Clearwater generally known as the "Coaohman
Build ing";
AND VlHEREAS, That prior to the 21st day of December,
A. D. 1931, the Donald Roebling Company, a corporation, was
the owner in fee of that certain strip or parcel of land in
the City of C1earwater,'Pinellas County, Florida, described
as follows, to-wit:

and Ten (10) inches or Lot Three (3), Block Four (4)
of Gould and Ewing's Second. Addition 'to Clearwater,
Florida,

AND WHEREAS, on the aroresaid date of December 21, A. D.

former private alley looated on the five foot strip to
the North of the above desoribed Coachman five foot strip;
AND WHEREAS, the said City of Clearwater, in
consideration of' the aforesaid conveyances by the said
Roebling Company and the said Coachman Heirs, aereed to
remove said foundation wall from the Roebling five foot
strip a.nd rem ove the North five feet of the, paving briok
of said private alley to the aaid Hoebling five foot strip
thereby constituting and establishing on the respeotive five
foot strips conveyed by the said Coachmans and said Roehling
Company a paved alley which was to be henceforth maintained
by the said City of Clearwater as a pUblio alley;
AND WHEREAS, since the date of said oonveyanoes the
said City of Clearwater has in nowise oomplied with its said
agreement with the said Roebling Company and said Coaohman
Heirs by rem oving said foundation and re-locating an~
maintaining said proposed pUblic alley, and that by reason

were on the date of said respective conveyanoes and the said

building is to be of suoh architecture and oonstruction as
will be a great improvement and perpetual asset to the City
of Clearwater and will add greatly to the convenienoe and
benefit of the general publio thereof;

to this Commission that said lease agreement, and hence the
building of the proposed structure thereon, is whOlly

AND VmEREAS, it appearing to this Commission that
there lies immediately to the East of said Roebling end
Coaohman properties a fully dedioated and publioly main-
tained fifteen foot alley running North and South with
outlets on Park Street to the South and Cleveland Street
to the North and that continuing Eastward from the East
end of said respective five foot strips is a fully
dedicated and publicly maintained pUblio alley which
affords ample ingress and egress to all property owners
and the general public for the proper servicing and ingress
and egress to all other properties located in the City block
in the City of Clearwater bound on the North by Cleveland
Street, East by Garden Avenue, South by Park Street and West
by Fort Harrison Avenue;
AND WHEREAS, the City Commission finds that although
the population of the City of Clearwater has during the past
eight years increased more than twenty per cent, and although
during said time there have been extensive improvements and
new buildings established in the residential sections of said
City, there has been only a very slight tendency toward
improvement and modernization of what might be termed the
business district of said City which would thereby keep
pace with the increase of population and development of
the residential sections;

finds it to be a fact that it is to the best interest of
the general population of the City of Clearwater that the
said proposed pUblic alley on the aforesaid respective
Coachman and Roebling five foot strips be vacated and
abolished and that the City of Clearwater re-convey to
said Roebling Oompany and said Heirs at Law of S. S.
Coachman, deceased, the respective five foot strips
previously conveyed by them to the City of Clearwater
for ,the establishment of a public alley so that said
lease agreement might be consummated by the said Heirs
at Law of S$ S. Coachman, deceased, and the said Roabling
Company, and the said general pUblic of the said City of
Olearwater might receive the general benefits which will
naturally flow fram the building of the proposed structure
on the respective properties and the continued maintainance
thereof for the benefit of the general pUblic by the proposed

Jordan oited a Supreme Court ruling whioh stated

that no street or a~ley oould be olosed for private use.
Arter considerable disoussion, including a request by Mr.
Peeler that aotion be postponed until the next Meet1ng.
moved by Mr. Grice, seoonded by Mr. Seavy and carried that
the Resolution be adopted. Mr. Peeler voted "NO".
The City Manager brought to the attention of the
Commissioners the necessity of codifying the City Ordinanoes
and stated that Mr. C. E. Ware had agreed to do this work
at an approximate oost of three hundred dollars. Moved by
Mr. Dempsey, seconded by Mr. Seavy and unanimously oarried
that Mr. C. E. Ware be instruoted to go ahead with the work,
:provided that the cost wi 11 not exoeed th:ree hundred dollars.
Moved by Mr. Seavy, seconded by Mr. Danpsey and
unanimously oarried tha tall Oi ty owned tax olaims against
Lots 43 and 44 B~ook B or Bib! sous Gardens be assigned to
F. B. COle, Jr. tor payment ot . 83.15.
Moved by Mr. Peeler, seconded by Mr. Dempsey ani
unanimously carried that Lot 14 Block 11 of Country Club
Add 1 tion be turne d Over to Lowell Thomas to be Bold at
auotion. Proceeds from sals of this Lot are to be a:pplied
to the Finnish Relief Fund.
