MINUTES OF THE MEETING OF THE CITY COMMISSION
The City Commission of the City of Clearwater met
in regular meeting assembled at the City Hall on the
evening of October 16th, 1939, with the following members
present:

!jinutes of the previous meeting were read and
approved.
The City Manager read a Resolution from the Turner-
Brandon Post # 7 of The American Legion requesting that
the City Commission pass an Ordinance requiring all
domestic servants to produce a health certificate at the
time of employment. The City Hanager presented an
Ordinance requiring health certificates ~or domestic
employees. The Ordinance was referred to the Oity
Attorney and the Health Inspectol' for revision.
Mr. R. M. Thompson presented a proposed lease o~
the Fish Plant to the Clearwater Yacht Club. Moved by
Mr. Dempsey, seconded by ~~. Grice and unanimously oarried
that a ten year lease be granted with option of renewal
for an additional five years. Mr. Thompson expressed his
appreciation of the cooperation of the Commission.
The City Manager read a letter from Mr. George A.
Wilson in which Mr. Wilson resigned from the Zoning Board.
Moved by Mr. Dempsey, seconded by Mr. E~er and
unrunimous1y oarried that the resignation be accepted.
The City Hanager read a letter from 11r. W. H. Wolfe
with referenoe to Driver's License Law, and suggesting that
the City Commission pass an Ordinance requiring all persons
driving an automobile in Clearwater to have a Driver's
Lioense.
The City Manager read a letter from Doctor Guinand
with reference to pro~essional services rendered Thomas
Asbell. Moved \by Mr. Peeler, seconded by Mr. Dempsey and
carried that the matter be referred to the City Attorney
for his oonsideration.

Mr. Leo Butler presented the following: RESOLUTION
BY THE CITY COMl~ISSION OF THE CITY OF CLEARWATER, FLORIDA,
ACCEPTING CONTRACT II 5, SEWERS EXTENSIOnS AND IMPROVEMENTS,
DOCKET NO. FLA. ll06-F. Moved by Mr. Grice, seconded by
Mr. Baker and unanimously carried that the Resolution be
adopted.
l~oved by Mr. Dempsey, seoonded by Mr. Grice and
unanimously carried that the City Engineer be authorized
to file two additional PWA ~rojects, conneoting pumping
station with sewer line on Beaoh at a cost of $ 3,500.00
and construction of a Compost Building at the Disposal
Plant at a cost of $ 3,200.00 for a covered building
30 by 60 feet or with open roof for $ 1,600.00

unanimously oarried that the following resolution be

The City Manage~ read a letter from the Zoning Board
with referenoe to changing Sections of the Zoning Ordinance.
Mr. Alfred Marshall addressed the Conmission,
expressing his appreciation of the confidence shown by
the Commission in allowing the Zoning Board to fill vacancies
on the Zoning Board, but he preferred that the City Commission
make the appointments.
The City Manager presented a proposal from Mr. J. V.
Davidson agreeing to deed the City oertain lots in Magnolia
Park to olear the delinquent taxes and assessments against
oertain other lots in MagnOlia Park.
The City Manager reported the accident of Policeman

League of Municipalities requesting that the City take an
advertisement in the Florida Municipal Record.
W!oved by Mr. Dempsey, seconded by Mr. Baker and
unanimously oarried that the :purchase of 100 gas meters
at a cost of $ 8.25 eaoh, be ap~roved.'
The City Manager reported that it had been brought
to his attention by the Polioe Department as to the
house numbering in the Country Club Addition. There seem
to be quite a few duplioations in numbers which are very
oontusing in iocating certain numbers; and requested thap
the house numbering ordinanoe be enforoed.

awarded to them by the City of Olearwater on May 15, 1939,

NOW THEREFORE BE IT RESOLVED by the City Commission o~

Section 1: That the said equipment furnished by

RESOLUTION EXTENDING THE TnvtE FOR COMPLETION
OF DOCKET FLA. 1106-F, CLEARWATER, FLORIDA,
60 DAYS FROM DECEMBER 1, 1939.
VrnrnREAS, the Ebersbaoh Construotion Company, whioh was
awarded Oontraot No.6, Dooket No. Fla. 1105-F, is making every
erfort possible to oomplete their contraot at the earliest
possible moment, and
WHEREAS, the said oompany has experienoed oonsiderable
delay due to unforseen inolimate weather, and
WHEREAS, the said oompany has agreei to install
approximately 6400 feat of additional sewers, and
Vn~EAS, the approved Contraot Doouments signed by
the Ebersbach Construction Company, the City of Clearwater,
and approved by the P\lbli.c '/lorks Administration set forth a
oompletion date of December 22, and
WHEREAS, the offer reoeived'from the Government on
Docket No. Fla. 1105-F sets forth that construction shal~
be completed by Deoember 1, 1939, and
WEER~, the ~. B. McCrary Company, Inc.~ who were
sucoessful bidders on Oontraot NO.2, Sewer Extensions
and Improvements, Dooket No. Fla. 1106-~, will require
additional time to complete, due to unforseen inclimate
weather and the removal of a large 'wnount of soil whioh
was found to be unsatisfaotory under the Digestor Tank
and the main oontro~ building,
NOW THEREFORE BE IT RESOLVED by the City Commission
of the City of Clearwater, Florida as follows:
Seotion 1: That the completion date on Florida Sewer
Extensions and Improvements, Fla. Docket 1106-F, Clearwater,
Florida, be extended 60 days from December l~ 1939, to
January 28, 1940.
Seotion 2: That F. 1. Hendrix, City Manager, is
hereby authorized and direoted to grant said extension
of time for and on behalf of the City Commission.

every insuranoe oompany, oorporation or other insurer now
engaged in or oarrying on, or who sh~ll hereafter engage
in or oarry on, the business of insuring property against
loss or damage by fire or tornado, an exoise or lioense
tax amounting to one (1%) per cent of the gross amount
of reoeipts of premiums from polioy holders on all
premiums oollected on fire and tornado insuranoe polioies
oovering property within the oorporate limits of the City
of Clearwater.

Seotion 2. All money derived from the taxes imposed
by this ordinance is hereby appropriated to the Firemen's
Relief and Pension Fund of the City of Clearwater, which
shall be administered in aooordanoe with the proviaions
of Chapter 19112, Laws of Florida, Acts of 1939, providing
for the Creation and Administration of a Firemen's Relief
and Pension Fund in certain Cities and Towns.
Seotion 3. The license tax herein assessed and

imposed shall be in addition to all other lioense taxes
now levied by the City of Clearwater.
Section 4. The excise' or lioense tax herein provided
r0r shall be payable and colleoted in the manner provided by
Cahpter 19112, Laws of Florida, Acts of 1939, providing for
the Creation and Administration of a Firemen's Relief and
Pension Fund in certain Cities and Towns.
Section 5. This Ordinanoe shall become effeotive
immediately upon its pa~~age and adoption by the City
Commission of the City of Olearwater.
