Minutes of the previous meeting were read and approved.
Mr. S. E. Sinmons, representing the Gulf Oil Company,
addressed the Commission with reference to permit for a filling
station to be erected on the northwest corner of Cleveland

Street and Osceola Avenue. r~r. C. E. Wal~e and Mr. Guss Wilder,
representing property owners and church members, spoke in opposition
to granting of the penlite After discussion, moved by Mr. Peeler,
seconded by Mr. Baker and carried, unanimousl~ that the matter be
postponed until the next meeting of the Commission in order that
the matter be more thoroughl~ investigated.
Mr. H. R. McEneany complained of newsboys making too much
noise in the early morning hours and objected to Chamber of
Commerce literature advertising apartment rentals in Cleanvater
at fifteen dollars per month. Mayor Casler instructed the Chief
of Police to enforce the City Ordinances pertaining to loud noises.
Mr. J. B. Hornsby presented a letter requesting a contri-
bution to the High School Band to help in paying expenses to
West Paln: Beach. It was decided to d e.fer action until the nex:l;
:meeting.

Minutes of the pr~vious meeting were read and oorreotion
noted in the matter of truck parking spaoes being for all trucks
instead of for Coca Cola truoks. Also water well be drilled
north of stevenson's Creek.
1~. s. E. Simmons addressed the Commission with reference
to permit for a filling station on the northwest oorner of
Cleveland street and Osoeola Avenue. 1~. J. W. Niohols,
representing C. E. Ware, presented a petition in opposition
to ereotion of the filling station. Mr. E. H. Coadlman also
protested granting of the permit. After considerable disoussion,
Mr. Gri oe moved tha t the permit be granted. Motion died for laok
ot a second.
Moved by Mr. Grice, seconded by 11:r'. Baker and unanimously
oarried that the offer of Mr. Cyril Pogue to pay $ 32.19 in
settlement of paving assessment against the South 100 feet of
Lot 4 BIQok H of Plaza Park be acoepted.
Mr. E. H. Coachman asked hovl muoh ot his house on Garden
Avenue would have to be removed for street widening and who
would bear the oost of suoh removal. The City Attorney stated
that the expense should be paid by the property owner because
the widening of the street is not being assessed to the property
owner. The matter was referred to the Building Inspector and
the City Engineer.
The City Auditor & Clerk presented his $ 25,000.00 suret,y
bond. :Moved by Mr. Dempsey, seoond.ed by Mr. Eaker and unanimously
oarried that the bond be accepted and :filed.

There is hereby establishsd a board to be known as
the Publio Reoreation Eoar~ for the City of Clearwater,
oonsisting of five members Who sha11 serve without pay.
the oity manager shall be an ex officio member of the Board.
The Board shall reoommend to the City Manager some suit-
able person espeoially trained and properly qualified for the
position of Superintendant of Pub1ic Reoreat ion , and suoh
assistants as shal~ ~rom time to time be necessary. The City
Manager shall employ the Superintendant ot Publio Reoreation,
who shal~ hold offioe during the pleasure of the City Manager
and shall. reoe ive suoh. salal'Y as shall be f !xed by the Oi ty
Commission. The Sup,erintendant of Publio Reoreation shall
reoeive instl'uotions tl'om the Eoard, and shall be responsible
for oarrying out the plans and polioies of the Board.
The Board, acting through the Superintendant of Publio
Recreation and his assistants, shall have supervision and
direotion of all pub1io reereationa1 activities conduoted on
all pub1io play grounds, ath1etio fields, bathing beaohes,
swimming pools, and any other ~roperties owned or oontrolled
by th~ City exoept the Munioipal Galt Course. When public
reoreational aotivities are conduoted in the Munioipa1
Auditorium by the Public Reoreation Board or under its authority,
the Board shall have supervision and! direction of suoh activitl. es.
On Brook1yn Field, Green Fiala, an~ othe~ playing fields where it
is necessal'Y to maintain a playing surfaoe, the Board shall be
responsible for the instaUation and proper care of such playing

funds reoeived by the Board shall be deposited in a Clearvlater
bank to tae oredit of the Board, and al~ disbursements shall be
made by oheck. The l30ud shall have authority to payout of such
tunds all neoessary expenses inonrred in oonneotion with reoreational
activities; provided, h.owever, that athletio or reoreational
equipment ~ a permanent nature sha11 not be purohased by the :Board"
but shall be purchased by tl1e 01 ty Manager on reoommendation of the
:Board.

On the first of eaoh month the Board shall submit to the
City Manager a detailed written report showing all reoeipts and
disbursements during the preceding month. Whenever suoh a report
shows that the funds in the hands of the Board amount to more than
two hundred dollars, the Board shall submit with the report a
oheck payable to the City of Clearwater for the amount of the
exoess over and. above the sum of two hundred dollars. All moneys
so reoeived by the City shall be credited to the Reoreational
Fund and. shall be available for reoreational aotivities, in
addition to the funds ~rovided. in the budget for that purpose.
The Board shall make a written report to the City Commission
on the first of January and on the first of Jul.y of each year.
Eaoh report shall shOW' the acti vi ties earrie d on under the
supervision of the Board during the period oovered by the report,
and shall inolude any recommendations that the Board desires to
make oonoerning reoreational aotivities. The Board may submit
speoial reports and reoommendations to the City Commission at
any time it so desires.
The Publio Reoreation Board shall be appointed by the
City Commission for the term of two years. In case of vaoancy
in said Board, the unexpired term shall be filled by appointment
as provided/herein.
The City Manager shall, in his annual budget, estimate
the neo.essary expenses for the maintenance of the reoreational
system as provided herein.
Ordinanoe No. 441J adopted January 25th, 1939, be and the
same is hereby repealed. All other ordinanoes and resolutions
in oonflict herewith are hereby repealed.
This Or~tnanee shall become effeotive immediately upon
its passage and adoption by the City Commission.

owned or aontrolled by the City and UBed for publio purposes.
The duties of the Board shall be to oonsult ~d advise
with the City Manager and other munioi~al offioers regarding
publio parks and play grounds. The Board shall not oonoern
itself *ith any reoreational aotivities oarried on in publio
parks or play grounds, but only with the physical oondition
o~ the properties, the improvements thereon, and the
beauti~ioation thereof. It shall pertieularly be the duty. of
the Board to make reoommendations regarding whieh City properties
shouJ.d be used for publio purposes, and the development,
improvement and beautifioation of City properties as publio
parks and p1ay grounds.
The Board shall make semi-annual reports to the City
Commission and suoh reports shall inoluae any reoommendations
that the Board desires to make oonoerning parks and play grounds.
The Board may submit speoial reports ana reoommendations at any
time it so desires.
The Board shall recommend to the Oity Manager some
suitable person espeoially trained and properly qualified for
the position of Superintendant10f Parks, and suoh assistants
as shall from time/to time be neoessary. The City Manager shall
employ the Superintendant ot Parks, who shall hold offioe during
the pleasure o~ the City Manager and shall reoeive such salary
as shall be fixed by the City Oommission.
The Superintenfuant of Parks shall have supervision of all
publio parks and. play grounas, and shall be respons ible for the
physioal oondition of these properties at all times.

Neither the Park Board nor the Superintendant of
Parks shall have any supervision or authority over the
playing surfaoe on Green Field, Brooklyn Field, and other
playing fields. The supervision of the Park Board and
Superintendant of Parks shall extend only to beautifioation
work.
The Park Board shall be appointed by the City Commission
for a period. of two years. In oase of :taoanoy in said Board,
the unexpired term shall be filled by appointment as provided
herein.
The City Manager shall, in his annual budget, estimate
the neoessary expenses for the maintenance of parks and play
grounds as provided herein.
The provisions of this ordinanoe shall not apply to the
Municipal Golf Oourse or the Municipal Auditorium.
All ordinanoes and resolutions in oonfliot herewith are
hereby re~ealed.
This ordinanoe sha11 beoome effeotive immediately upon
its ]assage and adoption by the City Commission.
