To the Honorable Mayor- Commiss1oner and the
City Commissioners of the City of Clearwater,
Clearwater, Florida.
Gen tlemen:
Th9 calendar year of 1935 having come to a clo se, 1 desire at
this time. to submit this I1I3 annual report. It will not be my desire in this
report to make the SBIle unnecessarily long or burdensome. I will endeavor
to make the s~e as brief as possible, but at the same time give to this
Honorable Body some idee ot the services which I have rendered.
Upon entering my duties as City Attorney the follo'idng mandams

The nnn:iamua suits referred to above have been stayed by" order entered by
the Jud8e of the Distr:lct Court 'in the bankruptcy proceedings. The City
Uo:mm1ss1on is ~am111ar with the status o:t all of these suits, so I only
oall your attention to the existence of t ~ same. The Klemm sui t wae
argued in the SUpreme Court beofre the bankruptcy proceeding waa ins't1'1i1lted
by the Gity, and the decision which was rendered by the SUpreme Court was
one which was favora.ble to the City_ In addition to the IIfl.ndamus suits
referred to above, there has been one other mandamus suit instituted against
the City, this being the suit of State of Florida. ex reI, A. Stone va.
City of Clearwater. The City COIID1l1ssion is likewise fmn1liar with the
status of this sui t. The above covers all mande.mus actions.
There are, howev'31', thl.ee civil Slits pending which are baaed on
bonds, and in which jud8ment is attempted to be recoyered against the City-
First, the two A. N. Klemm suits, second, the Slit of A. T. Herrin for
$20,000.00 da.ma.ges. There wag also pending at the time of my appointment
as Oity Attorney, the case of E. B. Gautier against the City of Clear-
water. I filed a br1 ef in t his suit in t he SUpreme Court of the state ot
Flori~ on behalf' of the C1 ty, but r l'egret to advise that the decision
rendered by the SUpreme Court was adverse to the City. This case, however,
ha.s been disposed of_

I teel that the City was very fortunate in securing oan-
oellation of outstanding taxes aM tax ~ertlt1.oates on the airport
pro]:lerty, and a100 on th.e Old Guaranty Title am Trust Company
Building. Cancellation of theae taxes ani tax oertifioates were
seoured through Aota passed by the Leg1s1at~e at its 1935 seesion
and. resulted in the savillg of several thousald dollars to the CiV.
In the preparation o:f th.e .Act canoelling the taxes on the Guarsntr
Title and Trust Company b11lding I was assisted by :Mr. V{il.liam,:
Wol:te, of this City. After the introduction ot the Aots In the
Legislature the C1t~ was ably represented bY' the Rellresent at1ves
frOG Pinellas County. Florida. in securing the passage of the sane.
In conneotion with the canoe11at ion of tlla taxes and tax certifi-
oates it was necessar,y to prepare and have published in eaoh instance
a Ilot1~e of the int en ti on of the 01 ty to introduoe before the Legis-
lature suoh Acts.

r have also at the request of the City Commission filed
a su.it in Chancery against H. B. Wesson and Margue1'1. ty D. Wesson,
his wife. in referenoe to the re~val o~ a shaok or certain building.

had in this case last week on .the defend~ts' nwt10n to dismiss the
bill of oomplaint, whioh notion was denied bY' the oourt, and I am
of the opinion that this case can be disposed. of wi thin a short t:t.m.e,
A oonsiderable number ot leases have been 'Prepared on be-
half o~ the City. Most o~ these 1 €t8.ses have reqo.1red a great amount
of time .and effort on my behalf', as well as on behal:f of this Honor-
able Body and. also the C1 ty Mrnager. However, it is not IfII' desire
to go into det&.11 wi 'th. re~erenoe to the leases, beoause the City
Oommission is familiar wi th the many dif:t1oul t1 es ,mil)h were en-
oountered and. overcome with respeot to these leases. I do desire.
however, t.o call atteJl tion to several of the leases which required
the DX>et time. Firat, t he lease between the Oi ~l'" and the '\Vest Coasi;
Broadcasting Company 11 seoond the lease between the City and Charles
Everingham, third the lease between. the CitY' end Harry P. Talbot.

There are two cases whioh have been appealed from the
decision which wes rendared in th.e Munioipal Co"art. those caBes being
as ibllows: CitY' of Clearwater vs. R~ph Haman, and City of Clear"
wet er vs. E. W. Sass ere r expect to have the Ralllh Haman oaee d:f.~:po sed
o:f wl~tn the next ueak. I also exneot to have the Sasser case set
down tor argument a.t a. very early date in the fUture.
On acco~nt o~ the ra.t1f'i3~?:t ion o:f the Homes'tend Amendment
by the voters of the state of Florida 1n the itlaotion held in November,
1934, it "as neoessary to give this matter much atten tlon and_ thoU8ht.
It is fortunate that the SUpreme C01~t of thts state has sustained
the position which the City O:f:fic1aJ.s, aoting on my advice, had taken
in in this nw.tter.

I wish to call your attention the status of several su.its whioh
have heretofore been inst1 tuted on behalf of the City of Clear-
water, involvi~ paving liens.
The first suit to which your attention is oalled is the suit
of the City of Clearwater, Complainant, vs. 1. P. Clar!~on, et a1,
being Chancery case #13040. This suit involves property looated on
Clearwater Beam. Island. The status of this suit has been previous-
ly called to your attention as well as to the a-ttention of the
City Commission 80 I do not deem it neoessary to discus s this aui t
further at this time.
Next 1s the suit of the City of Clearwater, vSo James D. Bourne,
Jr. etL ale The Bill of Complaint in this BU.i t was filed on March
7th, 19~. No proc ess of service had been had on any of the De-
fendants named in this sui tel An Appearance, however, was filed in
the suit on April 16th, 1934, by two of the Defendants, namely,
B. C8 Bass and Carolyn S. Bass. For your informat ion this suit
covers certain property located in Brookwood Terrace, a subdivi-
sion plated of record in Play Book 8, Page 34, of the Publio Reco rds
of P1BBllas County, Florida. This suit likewise, cowersucertain
property situated in Overbrook SubdiVision, Subdivision Plated of
record in Plat Book B, Page 23, of the Public Records of Pinellas
County, Florida. This suit rovers the following described Lot s:
Lots 16 to 23, both inclusive, o~ :Block 1, Brookmod Terrace.
Lots 9 to 14, both incluwive, of Block 20 Overbrook Snbdivis10n.
The next sui t is that of the City of Clearwater, Complainant,
VSe H. P. Aiken, et aI, Defendants, being known as Chanoer" Case
#69050. The Bill of Complainant in thi s suit was filed 0 n June 21st.
1934, and no pro cess has been issued in this suit and summons has
only been seI'ved on V. C. Ricker. Decree Pro Confesso has been
entered against V. C. Ricker. This appears to have been the only
steps that have been t eken in this suit other than the filing of
the Bill of Complainant. For your inf'orrmtion this su.it covers
certain property located in Aiken SUbdivision, according to DE.p
of Plat as reoord.ed in pla'b Book 14, Page 46 of the l:'u.blic Records
ot Pinella.s County, Florida. The property described as following:

SUrvey made of existing surfaoe toilets located in the city
limits. SUrvey shows 289 surface toilets being used, giving owner's
name a.nd address am loo&tion of toilets. Ordinanoe reoonmended to
eliminate a grent maJority of those 1n"use.
Extensive mosquito control program launched whioh terminated
with t he September storm period whioh rendered mosquito control im-
possible.
Used 6,000 gallons larviside. Covered the oi~ once each week
wi th spray orew. Cleaned out approximately 6 miles 0 f drainage di tGhes.
Made periodioal inspections of aJ.l da1 r:r farms and to ok milk
samples to Sttite Laboratory ~or tests.

The old pavilion on 01 ty proJlerty was torn ou.t. exceJlt top

The expe rimental groins in front of old :pavilion were o6mpleted
and found decidealy satisfactory as a beach building aid.
The second story of old fire station was repa.ired and rearranged
tor Ke o:e P. Hal.l.
Additional lam. wa.s aOCD1,1red for the cemetery, and the improve-
ment (fillinB and beaut 1ficat ion) o~ this for use now under way under
WPA. Only a few lots left now in old seotion.
Myrtle Avenue au.rb and paving sout from Jeffords to cemeter,y
now under w~ as WPA project.
At DelOra Groves we are giving m1n1lmwn care to keep up. Fair
crop set but September storm removed the moat of it.
At auditorium, the FERA DIllrals .ere placed on a new built fl'amed.
curtain and with one on either side of prosoenium arch. Later the
setting was bala.nced out by the paintings in place on either side
and above. The city has borne entire expense, except for the original
murals themselves and the labor of painting the latter three items.

A letter from the Garden Club of ClAarwater was read, p~oteBt1ng
the location of the Island Fire Station. It was pointed out by several
of the Comnis:::lionars that most people are under a mlsapprehension as to
the type of building to be erected, stating that it will be an im-
provement to the Beach and not ~n "eye-sorell; that other organizat:ions
which have protestedt have withdrawn-all objections and indorsed the
location upon finding these things to be true. No action was taken in
this case.

OF THE CITY OF CLEA.~WATER. FLORID~\
WHEREAS ~e-registration of eleotors of the City of Clearwater,
Florida has no t been required :to:r. at least thirty years, and
WHEREAS ma~ who are resis'tered as electors are deoeased or
removed, unknom to the City Clerk or other o:rfioials of' the City, and
WHER!'AS the population of the City ha.s shifted greatly during
this period, due to the Boom and other o1roumstano es, and
WHEREAS the City Limits of the City have been recently contraoted.
Therefore, be :I.t resolved that the present registration book of the
City bet and it is hereby deolared obsolete.
Be it :fUrther resolved that a new registration book of the City
o~ Clearwater, be o:pened immediately and that re-registration of 811
electors of the City be re~ired.
