Seven citizens spoke in opposition, expressing concern about: 1) the loss
of a checks and balances system; 2) the effect the decision would have on
citizens and employees; 3) tho need for more careful thought regarding the
issue; 4) the existence of problems other than the appointment of the Personnel
Direotor; and 5) the importance of the Personnel Direotor being aacountaole
to the Civil Servioe Board.
Several of them supported the suggestion made by Commissioner Regulski
at the point meeting of the Civii Servioe Hoard and the City Commission on
January 15, 1986, that a committee be established to look into the Civil Service
ordinance as a whole and to make suggestions for changes which could be placed
on the March, 1987, ballot.
Six citizens spoke in support stating the Personnel Director was the only
department head not solely under the direction of the City Manager. He has
been poorly treated by the Civil Servioe Board at resent meetings, and the
effectiveness of his position has diminished.
The City Manager stated the ordinance will change nothing other than the
method of appointment of the Personnel Aireotor. He emphasized that he has
no intention of trying to destroy Civil Servfoe. The passing of the ordinance
will place the matter an the March 11, 1986, ballot; and the citizens of
Clearwater sill make the final decision with regard to this matter. He stated
not all members of the Civil Servioe Board oppose the change, and the matter

on the Personnel Director's ability to do his fob. The City Manager has
found it necessary to exclude the Personnel Director from some meetings because
of his accountability to different superiors. He stated the dual appointment
system was a comuromise decision made in 1y?7/18, and the current ordinance
follows the national trend with the exception of the dual appointment of the
Personnel Director.
The Commission expressed concerns regarding other problems with Civil
Service, the Board's unresponsiveness to the City Commission's request for a
meeting in September, and whether or not this is the appropriate time to take
action.

Lawsuit in
The Plaintiff in this case alleges she was inured due to the City's
negligence in maintaining the sidewalk near 3275 Mulberry Street. An
investigation shows that the Plaintiff claims to have fallen at a spot on the
sidewalk where the sidewalk meets the driveway of the house located at 3275
Mulberry Street. It appears that the plaintiff's fall was due in part to
defects in the driveway, which staff believes should be maintained by the
property owner.

to the lawsuit by virtue of a Third-Party Complaint. Therefore, he is

The looation and size of the free-standing transmitting antenna and the
building were questioned It was stated they would be located to the east
of the commercial property as far from the residential area as possible. This
site was selected as being the best with regard to transmission. The only other
alternative site was Crest Lake Park; but due to height restrictions for the
Clear rater Airport, it Nas not feasible to looate it there.

oompleted a survey and found that the shared-saving method is a viable approach

Besides giving the City the largest net savings in dollars over aten-year
period, the shared-savings option offers several other advantages. First, it
Mill allow the entire system to be done immediately. This is important as
energy costs will increase, as well as the increased cost of adding to the
system in Future years. Second, there is no front money required. Third, there
Will be capital money available under this plan for cost-effective retrofit
and/or replacement of mayor equipment. Fourth, after the initial contract
period, the larger share of the savings sill go to the City with a much smaller
share to the vendor for continued maintenance and updating of highly
sophisticated equipment.
A Faoility Management System offers several more advantages to the City
above the dollar savings: 1) the decrease in risk for the buildings covered
in regard to fire and security problems; 2) the monitoring of all mechanical
equipment will indicate operating run time and condition which will allow proper
preventative maintenance to be performed; and 3) the actual field time spent
by our repair crews on the fob site will be reduced by the information provided
from the management system, which will have diagnostic capabilities in analyzing
the readings from the various sensors on the meehaniaal equipment.
John Paddy, Energy Officer, gave an explanation of the management system.
He stated the system will not adversely affect the one already installed at
the Library and, in fact, will improve it greatly.

of 10 percent. One of the conditions in the dead was that the property be used

Since receiving the land in 1978, the City has maintained the land on a
regular basis and has created a wooded passive park site. However, additional

benches, trash containers, and a park identification sign. Recommended funding
of $3,000.00 is to Dome from applicable recreation facility impact fees which
have already been collected.

the $16,200.00 for this project, which is funded by park impact fees, was
misplaced in the schedule of planned CIP expenditures for 1986/87.

playground equipment at Ed Wright Park, Del Oro Park, and Overbrook Park. It
is anticipated the equipment will be installed in two months.

The Florida Department of Community Affairs is accepting application for
projects to be funded through the Community Services Bleak Grant (CSBG) Por
local pro,)ecta to assist low-income individuals. These grants will be for the
six-month period from April 1, 1986, through September 30, 1986. Funds
available to the State have been allocated to each County, computed vn a minimum
for each County, plus apro-rata share based on poverty population. Pinellas
County's share of the State fund is x17,621.00. Prospective applicants in
Pinellas County have agreed to a population based ailooation with a Clearwater
share of x2,468.00. A local match of x494.00 (20 percent) is required.

manner:
1. On page 2, in Section 1, after the name of the owner of Parcel 1,

Allan Stowell stated approximately two years ago the end of Rogers Street
was vacated by the County Commission with no opposition. fie has allowed the
residents of Bayview Gardens to Dross his property to get to the Bethel
Presbyterian Church and has no problem with oontinuing to allow them to do so.
He is willing to stipulate that as a condition to the vacation.
Six citizens spoke in opposition stating they have been both walking and
driving over Rogers Street for many years in order to avoid using Gulf-to-Bay.
If this route is cut off, many of the residents of Bayview Gardens might not
be able to attend church as it is too dangerous and too far to walk on Gulf-to-
Bay.
Discussion ensued as to whether the vacation of Rogers Street was legal
as the pastor of the church stated they were never notified of that portion
of the vacation. yr. Baker, Public Works Director, stated if Sherwood Street
was a public road, the County would not have approved the vacation of the
portion of Rogers Street located in the County. If the County had not approved
the previous vacation, the City would not recommend approval of this item.
Commissioner Regulski moved to approve the request with the condition that
a pedestrian access from the east to the west boundary be shown on the site
plan and to direct the City Attorney to include in an ordinance. l?iotiion was
duly seconded and carried unanimously.
ITEM X71 -Vacation of 15x234 ft. access strip of land in See. 21-29-15;
located to the 'uJ. of Ft. Harrison Ave. 345 ft. S. of Jeffords St. (Morton
Plant Hospital) V-85-1y.
Morton Plant Hospital owns the surrounding property which abuts a 15-foot
wide strip of land on the west side of Ft. Harrison Avenue in the same east/west
alignment as Grand Central Street. There is no record of this strip having
been dedicated as public right-of-way.
The request has been reviewed by various City departments/divisions and
the three utility companies and there are no ob?eetions.
Commissioner Garvey moved to approve the request and to direct the City

Highland Avenue property and a minimum bid of $17,000.00 for the Brentwood Drive
property. The money will be put into a special fund that will be used to
purchase additional property.

Steven Watts, attorney representing the owner, stated the traffic is
already congested in this area and there is a condominium office building on
the northwest corner of this intersection. The owner of the subject parcel
proposes to construct an office building and feels it would set as a buffer
