Motioo oarried. Commission reoessed from 8:06 to 8:25. ITEM '5 - Chapter 135. Zoning District Regulations. a. Single-Family Districts. By consensus this Section was approved. b. Multi-Family Districts. By consensus this Section was approved. o. Mobile Home Park. By consensus this Section was approved. d. Planned Development. Conoerns were raised regarding the amendment allowing planned beach redevelopment being limited to 4-acre paroels. It was stated that a plan for less than 4 acres, if approved by the Commission, would be allowed. By consensus this Section was approved. e. Office Districts. By consensus this Seotion was approved. f. Commercial Districts. Nine citizens spoke regarding the regulation of development on the beaoh. They stated a Clearwater Beach revitalization task foroe and speoial taxing district are needed. It was requested that a height of ~O feet be allowed and that provisions for rebuilding in the case of natural disaster be provided for. They stated parking needs to be inventoried and back-out parking should be allowed. Disoussion ensued regarding whether the proposed code would allow more than the current oode and whether or not the grandfathering of densities allowed rebuilding of the square footage. It was restated that the consensus of the City Commission is that it is amenable to oonsidering a revitalization plan for the beach if one is presented and that the oode would be amended, if necessary. Commissioner Regulski moved to amend Section 135.098 - Conditional Uses, (A) Within Neighborhood Commercial Districts, to add, as a oonditional use, "6. Business Servioe." Any commercial vehioles. 2. Within Front Yards. The fOllowing vehicles shall not be parked or stored within any required setback area from a street right-of-way on a residentially zoned property: a. Any boat whioh measures in excess of twenty feet in length (including any trailer upon which a boat is mounted). b. Any hauling trailer (except for trailers mounted with boats permitted under preceding reoital "a"). c. Any of the fOllowing recreational vehicles: travel trailers, motor homes and camping trailers. d. Any semi-trailer truck on oab. e~ Any commercial vehicle which measures in excess of twenty feet in body length. 3. Enforcement. The preceding parking restrictions shall be enforced according to the terms contained 1n Article VI of Chapter 137 and the following: a. The aforementioned parking restrictions shall not apply to commercial vehicles during the actual performance of a servioe at the premise where it is parked. b. The aforementioned parking restrictions shall not apply to the loading, unloading or cleaning of vehicles provided such act if fully completed in twenty-four hours. c. Notllithstanding the terms contained in perceding recital "2," any commercial vehicle which is the sole means of motorized transportation for the resident shall not be restricted from parking within the front yard in the event there is no alternative parking location available on the property~ d. Vehicles titled prior to the effective date of this Development Code shall not be subject to enforcement proceedings for the initial sixty-day period fOllowing the adoption of this Development Code, but shall thereafter conform to terms contained herein," Motion was duly seconded. Upon the vote being taken, Commissioners Regulski and Winner and the Mayor voted "Aye"; Commissioner Garvey voted "Nay." Motion carried. One citizen spoke supporting the enforcement of parking regulations in residential zones. Commissioner Garvey moved to amend Section 136.02LI, Paragraphs A and B to insert: "change of business ownership." Motion was duly seconded and carried unanimously. Commissioner Garvey moved to amend Section 136.024, Paragraph D to delete: "lAPS: Beer - Package Sales." Motioo was duly seconded and carried unanimously. Commissioner Regulski moved to amend Chapter 136 to insert a new Seotion, 136.026, as follows: "Landscape Standards to Buffer Residential Zones from Non-Residential Zones. A. Purpose. It is the purpose of this Seotion to diminish the potential for any adverse effect upon residential development from adjacent nonresidential development by providing landscaping along the common property line to serve as a burfer. B. Buffering Requirements. The following buffer shall be required prior to the issuance of a bUilding permit for any new building or for the expansion of any existing building which increases the gross floor area in excess of fifty percent: 1. On Nonresidential Properties. Where any office, commercial or industrial zoning district (including the Urban Center District) abuts a residential zoning district, a landscaped strip of land measuring not less than five feet in width shall be provided adjacent to the common property line on the nonresidenti~lly-zoned proeprty.
