The approved final site plan for Park Place, Phase I, Traot I should be
revised to reflect the final approved plans for the restaurant in order
to accurately reflect compliance with the development order.
Commissioner Garvey moved to accept the preliminary site plan,
authorize RDC review of the final site plan with final action by the City
Manager subject to the following conditions: 1) a preliminary plat must
be filed for this project with the final site plan, 2) parking calculations
must be prOVided on the site plan, 3) parking spaces shall be 19 feet in
length, 4) bUilding height must be shown in feet, 5) landscaping must be
provided between parking and public right-of-way; and the appropriate
officials be authorized to execute same. MOtion was duly seconded and

ITEM #95 - Vacation Request (84-09) a Portion of 3rd Ave South RQW 1~1~

The applicant plans a medical office complex on the site and the
preliminary site plan indicates a portion of the current alignment for
Third Avenue South would be used in this development. Planning and
Traffic Engineering object to the vacation because it would reduoe the
available access for adjoining properties on the east. The Public Works
Department objects to the vacation, unless it is approved subject to the
applicant deeding to the City a 60 foot parcel of land for the relocation
of ~hird Avenue South.
The Planning Director reported that the entire Lake Chautauqua area
has not been annexed. Some of it is in the county, but it is residential
by nature with most of it under an RS-200 residential zoning. The county
Land Use Plan lists the area as residential/office/retail with limited
development.
The Traffic Engineer spoke in support of the area remaining
residential as a medical complex would generate more traffio.
Andrew Bylenga stated that the total area consists of approximately
3 acres and he has requested the vacation in order to construct a needed
medical complex which he felt was the highest and best use for the
property. If the property is divided by the street with all of the
setbacks that are required the site would not be adequate.
One citizen spoke in support of the medical complex. Roger Larsen,
attorney representing Pat 11ey and Bernice Ward, spoke in opposition to
the vacation as his clients would be inconvenienced by the vacation of
the street. Each of the two property owners also spoke in opposition.
Discussion ensued on the Public Works Department's suggestion
to relocate Third Avenue to the south portion of the property.
Commissioner Garvey moved to approve the request subject to the
applicant deeding to the City a 60 foot parcel of land for the relocation
of Third Avenue South and to direct the City Attorney to include in an
ordinance. MDtlOD was duly seconded and carried unanimously.
