William Tomicki, ~epresenting property owners of Imperial Park,
read into the reoord a preamble from a petition requesting that the city
trim and maintain palm trees in the dedioated right-of-way in the Imperial
Park area. The item will be discussed at the next work session on July
30, 1984.
Anne Garris noted that there is parking on the beach--all beaoh
parking lots are not closed in the evening. There are 485 spaces available
at the Marina parking lot and in several others not on Gulrview Boulevard.
She noted that other communities in Pinellas County consider curfews
necessary to ourb rowdyism and that all county parks close at dark.
Syd Snair questioned why utility deposits are required from prompt
paying customers when the City may file a lien against the property for
delinquent bills.
Peter Cafentzis representing three business owners from the small
shopping center at the intersection of Hampton Drive and Gulf-to-Bay
Boulevard requested the new "no left turn" sign for east bound traffio
be removed as it was affeoting their businesses.

ITEM '82 - Bayfront Park Improvement Plan.
Wray Register, President of the Long-Range Waterfront Planning
Committee, was present and reported the key features of the plan include
installation of marina slips in an area designated as the north park;
establishment ot a watertront promenade along the west edge; a green
belt along the eastern edge ot the loop; and location of a oommunity center
in several alternative locations. It is also proposed that the tennis
complex be rebuilt with re~trooms, shower facilities, and handball and/or
racquetball courts.
The cODDlittee recommends the t'Unding tor purcha:Je of the Sand Castle,
WTAN, and Bie property, be included in the referendum tentatively set for
December 4, 1984. A picnic area south or the tennis oourts and a boardwalk
extending from the north end to the south end of the project are also
proposed.
Commissioner Garvey noted that the Belvedere Apartments are opposed
to a marina. The City Manager reported funding tor a marina will not be
included in the referendum. That will be a private enterprise project.
There was some discussion on the loss of parking, but it was noted thSlt
there are nearby lots and a parking garage also under consideration within
walking distanoe.
Commission consensus was to aocept the plan.
Several citi~ena questioned various ~spects or the plan.
Anne Garris noted that at the last referendulI, no buildings would
be allowed below the bluff unless a referendum was held to approve __.

The gas line expanSion project of the Gas Division in North Pinellas
County requires additional welding services. The contract 'is for a period
or one year trom date or award, with the welding company supplying welding
truck, welder, and ~heir own gasoline. Two bidders were tied tor low bid
and the bid was recommended to the bidder with the most pipeline welding
experience, as gas is a very volatile chemical.

Parking Lot 9 has been declared surplus to city needs for sale to the

ITEM '94 - Millage Rate for Fiscal Year 1984-85.
The tentative millage rate will be included in the TRIM bill notices
sent to taxpayers in the middle of August and cannot be increased without
special mailing. However, the millage rate may be decreased prior to the
adoption of the final budget. The current proposed millage rate of 4.303
is a decrease of .066 mills over 1983-84 millage. The proposed millage
will indicate a tax increase of 2.4J.

for fiscal year 1984-85 and to set public hearings on the budget for

ITEM '95 - Clearwater Square Development Agreement Amendment (Community
Development).
The agreement between the city, the Redevelopment Agency and J. K.
Financial Corporation provided J.K. Financial Corporation deposit
$650,000 as the purcbase price of the Jannelli parcel and $140,000 for
parking lot 9 with tbe Agency. J.K. Financial Corporation has requested
tbat the Agency accept, in lieu of those deposits, one or more letters
of oredit totaling the amounts of the required deposits pending the entry
of' an order of taking by the Court.
Gilbert G. Jannelli, owner of the property to be condemned, presented
a counter offer ot a settlement price of $925,000. Tbe offer includes
$25,000 for relocation of a tenant currently in the building with a
two-year lease.

J!JII - Verbal Reports.
Police Chief Klein reported on the Beach Task Force Committee
meeting. He said a number of alternatives had been discussed and that
the parking ban, while not permanent, has helped the situation. He stated
that on a temporary basis he bad reassigned a short squad of five police
officers to patrol the Pier 60 area if the Commission wanted the lot
opened. It would be a temporary measure. He requested the task force
be given suffioient time to COMe up with a solution to the problem.
Commission questioned the costs for overtime for the squad. The Chief
replied it would be minimal--just from 7 p.m. to 3 a.m. on Friday and
Saturday evenings and to be funded from the meters at the Pier 60 lot.
Dr. Ken Rosenow of the task foroe stated the aim of the force is
to open all the lots, but lawful behavior must be guaranteed. There 1s
also a need for bathroom facilities to be open and he also noted that all
of the lots on the beach are not closed. He agreed that one lot could
be opened and patrOlled, but requested time for the task for~e to get
organized.
Dr. Peter Caftentzis, also of the task toroe, stated the oritical
issue ot the Task Foroe is to define the task. He felt that rowdyism
should be oontrolled and that the parking lots mayor may not be an issue
in the control or rowdyism.

Meetings have been held with the three designated target areas
requesting citizen views and proposals for the use of C.D.B.G. funds for
1985. The City will receive $841,000 this October, a possible supplement
of $150,000 in program income (repayment and sales of loans) and that
$200,000 will be rolled forward from previous years, for a total estimated
1985 budget of $1,255,700. The three-year plan was reviewed and accepted
by the Neighborhood Advisory Committee.
Lois Cormier requested funding for a bus shelter at Ross Norton Park
and also noted that Sadlon and Carmel Avenues need paving and 3ewers. Don
Jass, Program Coordinator, noted that they had received additional
requests for funding from Latchkey for $50,000 and the Clearwater Housing
Authority for $150,000 for rehabilitation of the Winn-Dixie site.

ITEM 1120 - Zoni Ordinance Text Chan e of Art III See 1 1.086 to add
12 Lodges and Private Clubs in RH-28 (City).
Staff had been directed by the Commission to initiate the request
to allow olubhouse activities as a nonconforming use under the present
restrictions of the RM-28 zoning district. However, subsequent litigation
has resulted and the recommendation is to deny the text change.
Commissioner Garvey moved to dear the subject Zoning Ordinance
text change. HDtlae was duly seconded and oarrled unanimously.
ITEM 1121 - Zoning Atlas Amendment from RS-200 (Single-Family Residence)
and RPD-5.5 (Residential Planned Development) to RS-200 and RPD 4.0 and
a Revision to the Master Site Plan fo~ the Gei er Parcels H&B 22.02 Sec
21-2 - ; located between Landmark Dr and McMullen-Booth Rd, S of Curlew
Rd (Geiger) PSP-83-29.
The area is vacant with the exception of a single family residence.
In November 1983, the City Commission approved the RS-200 and RPD 5.5
zoning request. The Pinellas County Commission ~od a transfer of
jurisdiotion on M&B 22.02 with the RPD 5.5 zoning. The applioant has
revised his plan for an apartment development of 14 units and to combine
parcel two and three for an RPD of 3.5 units whioh will meet the County
requirement.

Commissioner Garvey moved to approve the RS-200 zoning on Parcel
1 of MlB 22.02; to deBr the RPD 4.0 and RS-200 zonlngs on Parcels 2 and
3 ot M&B 22.02 as advertised; to approve an RPD 3.5 zoning over Parcels
2 and 3 combined; to direct the City Attorney to include this in an
ordinanoe; and to approve th~ revised RPD master site plan for the Geiger
Parcels subject to the tollowing oonditions: 1) a 10-foot drainage and
utility easement be granted along the north and south property line, 2)
additional right-of-way be granted to provide a 100-foot half right-ot-way
tor MCMullen-Booth Road, 3) twenty teet of additional right-of-way be
granted tor Landmark Drive, 4) required open space and reoreation land
tees be paid prior to certifioation ot the revised RPD master site plan,
and 5) that the requisite initial building permit(s) be prooured within
6 months trom the date of final ordinance reading on the rezoning and all
requisite certificate(s) of occupanoy be procured within 2 years trom the
date of issuanoe of the initial building permit; and that the appropriate

ITEM 1122 - Amendment of Restriotive Covenants of a traot of land 1n the
~ of the SW~ of See 2-29-15; looated S of Oreenlea Dr, E of Highland
Ave and N of 'Sandy Lane 88d Review of the Preliminary Site Plan for
Pineview Apartments (Kosmo) PSP-84-22.
The developer plans to oonstruct a 60-unit apartment projeot south
of the existing Pines of Clearwater condominiums with aooess proposed to
be from Greenlea Drive along a 24-foot private drive construoted along
the east property line of the Pines of Clearwater. In order to proceed
the developer has requested that the city remove itself from Item 15 of
the restrictive covenants.
The City Attorney responded that the oity was a party to these
restriotive covenants imposed by the original owner in 1968 and again in
1970 when the property was sold. W. A. Maxwell expressed oonoerns on the
removal of the oovenants.
Riohard Kosmo, the developer, reported that previous requests to have
aooess to the property from the south had met with resistanoe from
surrounding property owners. He is now attempting to work with the owners
of the Pines of Clearwater for an aocess.
Commissioner Calderbank moved to approve removal of Item 15 of the
Restrictive Covenarlts plaoed on the subjeot property; to authorize Resource
Development Comadttee review of a final site plan and tinal action by the
City Manager subjeot to the following considerations being addressed: 1)
parking spaces must be a minimum of 3 feet from all property lines, 2)
internal parking area landsoaping must be provided as required by COde,
3) building and impermeable coverage figures must also be shown as
peroentages of the total area, 4) the total number of apartment units must
be reduoed to not exoeed 24 units per net aore, or apprOXimately 50
apartment units, 5) the proposed masonry wall along the east property line
oannot exoeed 30 inohes in height in front of the front building setback
line unless a varianoe is approved by the Board of Adjustment and Appeal
on Zoning prior to final site plan submission; and that the appropriate
officials be authorized to exeoute same. IDttaD was duly seconded and
oarrIed unanimously.
Commissioner Calderbank moved to amend Ordinance 13526-84 by deleting
M&B 11 .04. *,Ial was duly seoonded and oarrt_ unanimously.
