ITEM #120 .. Holiday Inn SUrfside Waiver Modification.
Due to charges of disorimination by local residents, Holiday Inn
Surfside has requested removal of the "guest only" restriction on the
rental of aqua oycles. The Board of Adjustment and Appeal on Zoning also
restricted the aqua cycle rentals to the hotel's guests only when it
granted the necessary speoial exception for this use.
Commissioner Calderbank moved to authorize removal of the "guests
only" restriction contained in the limited waiver of the prOVision of Sec.
114.43 of the City Code granted to Holiday Inn Surfside on February 16,
1984, to permit rental of aqua oycle paddle boats to non-guests; this
waiver modification to be conditional upon removal of a similar restriction
adopted by the Board of Adjustment and Appeal on Zoning. MotlaD was
duly seconded and ~ unanimously.
Commissionor Garvey requested that all concessionaires ,be required
to keep their re~tals up on the beaoh out of the way of beachgoers.
ITEM 1121 - Resolution 184-55. State Aquatio Plant Control Funds.

The City Manager congratulated Commissioner Justioe on the
scholarship fund established in his name.
The City Manager reported an ordinanoe will be required to prohibit
the tossing of articles from parade floats and oars and will be

He reported the Gee and Jensen Company will present its proposed
baYfront development conceptual design May 23, 1984, from 7 to 9 p.m. in
the Commission Chambers. It will be open to the publio.
I11I - Publi~ Hearings.
ITEM #128 - A Public Hearing on Lot Clearing Violations. List #84-9.
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to clear the
property within ten days or a public hearing would be held to authorize
clearanoe.
List #84-9 with three property owners who failed to clear their
property within the ten days was presented. City Inspector Albert
Brandenberger stated the lots remaining to be cleared oonstituted a menace
to public health, safety, and welfare.
Commissioner Garvey moved to authorize clearance of the properties in
violation of Ordinance #1894, and billing of the property owners for oosts
and/or administrative oharges and that the appropriate officials be
authorized to execute same. MDtloD was duly seconded and oarrisd
unanimously.
The Sanitation Inspector requested direction regarding the property
adjacent to Pierce 100 owned by Katharine B. Bie. The City Manager
reported a letter had been sent to Mrs. Bie giving her until May 16 to
begin work on the projeot. If work had not begun, he proposed the city
contract with a private company to clear and level the land.
ITEM 1129 - Vacation Request. Cw R. 224 Adjacent to and E of Northwood
Estates Tract "G" in Seo. 32-28-16 (McNay Brothers Investment Co.)
V-84-10.
The developer is requesting both the City and the County Commission
to vacate their respective portion of C.R. 224. Should the vacation be
approved it should be in concert with the approval of the proposed
subdiVision. The use of existing C.R. 224 depends on suitable relooation

Emil C. Marquardt, attorney representing the applicant, stated the
property has been used for four years as a prayer oommunity, not a ohuroh.
He stated that the Diocese of St. Petersburg will not authorize the
faoility to be a churoh. They are requesting annexation to receive oity
services.

Harold S. Wilson, attorney representing an abutting property owner,
stated they have no objeotion if the use remains as it is. They are
concerned that with the ISP zoning, the property could be developed to a
more intensive use and the Diooese is not the property owner. He requested
the oity take some action to assure the use remains as is.
