Commissioner Berfield stated he voted "no" because of his previous
stand on the Ordinance.
The City Attorney presented Resolution #84-10 Authorizing the City
Attorney to Defend the City of Clearwater; Thomas Bustin, City Attorney;
and Lucille Williams, City Clerk, in a case in U.S. District Court styled
Church of Scientology Flag Service Org., Inc. v. City of Clearwater, et
al, No. 84-96-CIV-T-15.
Commissioner Garvey moved to pass and adopt Resolution 184-10 and
to authorize the appropriate officials to execute same. Motion was duly
seconded.
Upon roll call the vote was:
"Ayes": Garvey, Justice and Kelly.
"Nays": Berfield.
Absent: Calderbank.
Notion carrJ.ed.
The City Attorney requested authority to hire John Blakely, a
constitutional law attorney, to aid in defending this suit.
Commissioner Garvey moved to approve the City Attorney's request to
hire a constitutional law attorney. MOtion was duly seconded and
carried unanimously.
The City Manager requested Commission consensus and approval for the
release of funds for the Nei~hborhood Housing Services Pro~ram and the
changes made to the Home Purchase Financing Plan. The Mayor requested
that owners of commercial property be banned from applying.
The City Manager responded that income levels and sources of income
are considered--not necessarily an applicants assets.
Consensus of the Commission was to release the funds with the Mayor
requesting a complete investigation so that citizens who do not need the
plan are not accepted.
The Mayor requested the Commission be contacted before a special
meeting is set to consider conflicts with their schedules.
Commissioner Garvey left at this time to attend another meeti~.
Discussion continued on prior notice and the City Manager responded
that special meetings require 24-hour notice to the Commission and are
called on short time frames only when necessary.
