The Acting Planning DiI~ector stated the City would not be party to the covenant required as a condition. She reviewed the possible problems that exist on this property stating that there are environmental concerns as Spring Lake currently has excellent water conditions. The proposed 171 single-family homes are tightly construeted and the need for the covenant regarding no parking in the streets is needed to facilitate sanitation pickup. Staff is recommending that the number of sites be reduced to 16B-- eliminating Lots 1, 2 and 130. Timothy Johnson, Jr., attorney for the applicant, stated that the Resource Development Committee and the Planning and Zoning Board both had voted in favor of the request to include the 171 lots in an RPD 7.6 district. Ed Mazur of Post, Buckley, Schuh and Jernigan, Inc. said they have taken into consideration the water quality problems and have met with members of the Parks and Recreation Department as well as the environmental management people to assure that the water quality is protected. He stated that, the property will be developed in such a way as to prevent flooding of the development as well as surrounding areas. Commissioner Calderbank moved to approve the annexation, RPD-7.6 ISP and AL District zoning, and the Land Use Plan amendment to Public/Semi- Public for the subject property under the following conditions: 1) an additional 10 feet of right-of-way be granted for C.R. 34, 2) right-of-way for Beecher Road be granted as shown on the master site plan, and 3) the parkland be dedicated to the City and deeded prior to final ordinance reading of the annexation, and to direct the City Attorney to include this in an ordinance; to approve the community impact statement; and to approve the preliminary subdivision plat and final master site plan subject to the follOWing conditions: 1) a private covenant be filed with the plat to preclude parking of any motor vehicle, recreational vehicle, or boat on the street surface; 2) the final plat be recorded within six months from the date of City Commission approval of the preliminary plat; 3) the ISP zoned area be subject to separate site plan review prior to its development; 4) all easements be granted prior to the issuance of a certificate of occupancy; 5) a detailed site plan for the internal project recreation area be approved prior to its eonstruction; 6) a detailed plan for the proposed wall and landscaping along Keene Road and C.R. 34 to accompany the certified site plan, said wall not to be located closer than five feet to the I'ight-of-way; and 7) the requisite initial building permit(s) be procured within six months from the date of final ordinance reading for the annexation and all requisite certificates(s) of occupancy be procured within two years from the date of issuance of the initial building permit. He also stated there are concerns regarding the Beaoh Traffic Study that recommends taking away diagonal parking and replacing it with parallel parking on a portion of Mandalay Avenue between the Fire Station and Acacia Street. This will eliminate 80-percent of the parking along that stretoh of road and will impact the businesses there.
