The City Commission of the City of Clearwater met in special session
at the City Hall, Monday, January 9, 1984, at 4:04 p.m., with the following

Notioe of this special meeting had been delivered to the Commissioners
at their places of residpnee, The meeting was called to consider the Heaeh
Renourishment Contract with property owners on Clearwater Beach. The
contract consists of four sections: "Recitals," "Conditions Precedent,"
"Covenants of the Parties" and "General Provisions." Most of the changes
oceured in the sections titled, "Covenants of the Parties" and "General
Provisions,"
The City Manager reported to the Commission that a meeting held with
the property owners earlier today had coneiuded with a number of changes
to the City's proposed contract. Copies of the changes were distributed
to the Commission.
Andy Nicholson reviewed the proposed changes and noted the changes
incorporated the wording in the City's contract with the Norfolk Dredging
Co.
Tom Riden, attorney representing 440 West and acting as spokesman
for the rest of the group, stated they had reviewed the Norfolk Dredging
contract and were satisfied with the wording. The contract calls for the
dredging of 100 fi cubic yards of sand for the property owners' beaches.
Only if future dredging of Clearwater Pass affected their beach, would
the City be held responsible.

General Provisions.
Andy Nicholson continued his review. New Paragraph 9• states,
"Execution of this agreement by the Caribbean Gulf shall be permitted but
not required. If they refuse to be a party to the project, the project
would extend only to the westerly boundary of the property owned by 440
Test."
^i Paragraph 4. was amended to allow a 15-year period following
completion of the project in which the City would place material on the
property owners' respective beaches if Clearwater Pass were dredged. The
paragraph also addressed a possibility of erosion and that 440 West and
!`` the other property owners would share with the public beach on a ratio
of one cubic yard each. The City would be able to fill the public beach
?? at any time as long as the sand did not come from Clearwater Pass.

Paragraph 2, was amended to include "The self assessment shall become

Paragraph 5. will be rewritten and will provide public access
easements for the general public across the new beach area to be created.
The access easement will be on a line parallel to and lying seaward of
the existing seawall a distance of 50 feet.
Covenants of the Parties -Amendments to the City's Responsiblities.

Paragraphs 4,(a) and 5. will be rewritten to be more specific in
the wording of the project. In 4.(a) the Norfolk Dredging Co. will be
instructed by the City to fill in the area fronting the property of the
parties of this contract and also advises that the proprty owners who are
parties to this agreement have become beneficiaries of the Norfolk
Contract. The City agrees to make no modifications, amendments or permit
any waiver or excuse of performance under the Norfolk Dredging Co.'s
cantraet without the prior consent of the parties to this agreement. The
City's sole liability with respect to the fill shall be to perform it's
obligations under the foregoing dredge contract.
In paragraph 4. b) the City warrants and represents that 100,000 cubic
yards of sandy beach material will be placed along the beach seaward of
the properties involved in this Agreement. The property owners will permit
additional sandy beach material to be deposited, but the City will not
be obligated to such additional sand deposition. Such material shall be
placed seaward of the existing seawall and graded to provide a 45-foot
xide vegetated dune ridge at an elevation of 5 feet extending seaward for
an additional 40 to 60 feet. The seaward beach face slope will be
approximately 5:1 to the existing bottom. The City does not represent
or guarantee that said slope shall remain in place for any length of time.
Paragraph 5. addresses the City's obligations and states that the
City has no obligation to the property owners or parties to this agreement
except in the performance and enforcement of the aforesaid dredge contract.

If the dredge contractor is excused from performing such contract, the
City shall likewise be excused from performance. The paragraph also
addresses the property owners all receiving a substantially equal
allocation of sand.
Paragraph 8. addresses construction equipment and the City's
right to use beach area for construction purposes.
Discussion ensued on unsuitable material being dredged up and Mr.
Nicholson responded the contract requires only good material will be
deposited on public and private beaches. The contract requires a total
of 325,Ofl0 cubic yards of good material.
Commissioner Calderbank moved to accept the concepts as presented
subject to the final draft. A?tGfOD was duly seconded and earri®d
unanimously.
Discussion ensued on Frances Stavros' letter of opposition to the
renourishment project. Mr. Riden reported that he had discussed the matter
with her and she is now in total agreement and enthusiastic about the
pro?eet.
The Mayor reported a request from Lee Arnold of the Chamber of
Commerce that Clearwater make a special cleanup effort prior to the Super
Bowl game.
