Gordon HoDou~all spoke in support of sign ordinance text change to
allow removal of signs by authorized personnel. He also stated a WTAN
survey supports keeping Pier 60 parking lot open.
Mel Clawson questioned what steps are being taken to solve Pier
60 parking lot problems.

Police Chief Klein explained the construction and use of the device,
the testing it has undergone, and the numerous endorsements it's use has
received.

Dr. Peter Caffentzis spoke in support, but noted concerns to set
guidelines and establish policy when tool should be used.
Gordon McDougall expressed concerns about the intimidation effect
of the tool.

Chief Klein reported officers will have discretion to use the tool,
but will be required to document use. Strict guidelines will be in effect
against unreasonable force. Training sessions for every officer will be
provided and a monthly report of use will be made to the Commission.
Diseussion ensued on psyehological testing of new oCficers, which is under
consideration.
Commissioner Calderbank moved to approve Item P41 and to authorize
the appropriate offieials to execute same. MOtion was duly seconded and
carried unanimously.

He reported the County is requesting waiver of City impact and
development fees for Sand Key Park. He recommends approval exoept for
water and sewer fees. Commissioner Garvey moved to approve the request

He reported T.D. Hawkins of the Planning Department will be leaving
the City's employ to enter private enterprise.
He advised a status report will be forthcoming from Parks and
Reoreation concerning aotivities at the Coachman Park Bandshell.
The Burger King property, whioh is scheduled for an annexation public
hearing on January 19, 1984, will be allowed to begin construction under
a County permit to expedite the project.
A delegation of Commission members and staff will be in Tallahassee,
January 12, 1984 to lobby the CARL committee to purohase Cooper's Point.

Permit for Banner on Memorial Causeway.
The Chamber of Commerce requests permission to install a banner from
January 6, 1984 to January 23, 1984, over the westbound lanes of Memorial
Causeway to welcome Super Bowl fans to Clearwater, Beach. DOT approval
is contingent upon City Commission approval.
Commissioner Garvey moved to approve the request. 1btJ.Ga was duly
seconded and oarr1ed unanimously.

ITEM '7~ - A Public Hearin~ on Lot Cleari~ Violations. List 184-01.
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to clear the
property within ten days or a public hearing would be held to authorize
clearance.
List 184-01 with one property owner who failed to clear the property
within the ten days was presented. City Inspector Albert Brandenberger
stated the lot remaining to be cleared constituted a menace to pUblic
health, safety, and welfare.
Commissioner Garvey moved to authorize clearanoe of the properties
in violation of Ordinance '1894, and billing of the property owners for
costs and/or administrative charges and that the appropriate officials
be authorized to execute same. MotiaD was duly seconded and aarried
unanimously.
Attorney Stephen Beneke addressed the Commission on a prior violation.

ITEM '76 - Zoning Atlas Amendment Crom CTF-28 (High Density
Commercial-Tourist Facilities Use) District to RM-20 (High Density
Multi-Family Use) District for Penthouse Villas of Morningside. Moreland
at Morningside. Lots 23 and 26. Pinellas Groves NE4. Lots 391 through 395.
Morningside Estates Unit ~ in Section 19-29-16; located on the N side
of Harn Boulevard W of Moreland Drive (Multiple/City) Z-83-109.
The property is developed with 58 dwelling units in three separate
projects. The Commission continued this item on December 15, 1983, to
allow additional time fOl' the City Attorney to review documentation
provided by the property owner regarding the property owner's claim to
prior agreements with the City to maintain a CTF-28 zoning on the subject
property.
A l'equest was received to allow the property owner to submit a
preliminary site plan for a residential development which will not exceed
20 units per net acre for the undeveloped portion. Staff recommends the
prohibition on receiving site plans inconsistent with pending zoning
actions be waived and the time period for submission of a preliminary site
plan be extended to no later than April 15, 1984.
George Greer, attorney representing the applicant, reported they plan
25 two-story townhouses. There are problems meeting permeable coverage
and setback requirements. Upon approval of a site plan, there would be
no objection to the recording of height restrictions previously granted
to the City.
Vito Nigrelli, representing Morningside Meadows Home Owners
ASSOCiation, presented a petition bearing 13 signatures which supports
RM-16 zoning.
Commissioner Garvey moved to approve the Zoning Atlas amendment
to RM..20 for the subject property less L.ots 391, 392, 393, the north 25
feet of Lot 394, and the south 5 feet of L.ot 390, Morningside Estates Unit
4, and the west 158 feet of the N 260 feet of the south 325 feet of Lot
23, in the NE~ of Seotion 19-29-16; and to table consideration of the
Zoning Atlas amendment to RM-20 for the lessed-out portion of the property
for a period not to exceed 90 days to permit the submission of a
preliminary site plan in accordance with the current High Density Land
Use Plan classification and a consistent zoning desLgnation not to exceed
20 units per net acre, with the understanding that even if the site plan is
not submitted within 90 days the restrictions be recorded. Motion was
duly seconded. Upon the vote being taken Commissioners Garvey, Calderbank,
Berfield and Justice voted "Aye"; The Mayor voted "Nay". HDt1aD carried.
