Access to this project will be from Gulf-to-Bay Boulevard with the construction of a portion of the proposed Park Place Boulevard. The City Manager reported a problem regarding the off-site drainage. He stated a larger line is needed on the south side of S.R. 60 which is the State Department of Transporation's responsibility. Plans to upgrade this line have been dropped from the State plan. An agreement has been reached between the developer and the City to hold a certain percentage of the water on the property so as not to increase the flow into the inadequate line to assure no adverse affects on downstream property. The agreement includes a provision that no further permits for construction after Phase I will be issued if the problem is not resolved. The Mayor questioned how much construction traffic would be on S.H. 60. Kevin Henderson, construction manager for the project, stated they plan for the construntion route to come from Drew Street and Hampton Road into the project. Alan Stowell stated he is concerned that the drainage problem be handled properly. The City Manager also reported a change in the proposed bike trail throughout the development. The developers plan to install six-foot sidewalks in the development instead of the separate four-foot bike trail and will help the City put a bike trail on Hampton Road. XVX - Verbal ReDOrta - V The City Manager reported a problem in the Goodwin lease for the seafood market and restaurant on the beach. The problem revolves around the fire insuranoe being paid for by the City, in which oase the City is reserving the right to determine whether or not the property is to be rebuilt if destroyed. Mr. Goodwin stated that he felt he had absolutely no assurance in the lease if the building should burn down that he would be able to recoup his construction costs. He stated it would cost him between $1,000 and $1,500 a year to insure the property. Commissioner Calderbank moved to amend the lease that Mr. Goodwin would pay for the insurance and that, beginning the second year of the lease, the rent would be reduced by the same amount Mr. Goodwin would be charged for insurance. Motion was duly seconded. Upon the vote being taken, Commissioners Calderbank, Berfield, Justice and the Mayor voted "Aye"; Commissioner Garvey voted "Nay." Motion carried. Mr. Goodwin stated he did not feel tnat the reduction of the rent of the same amount he would pay for insurance would be fair to the City as the cost of the insurance could continue to rise throughout the entire 15-year period of the lease. The City Manager requested the City Commissioners attend the cocktail party for the officials from Basildon, Great Britain, here for the British- Amerioan Marathon. He also reported that he will recommend to SFWMD that the park that is being developed by the City on the Alli~ator Creek property owned by SFWMD be named for Cliff Stephens. The City Manager asked if the Commisslon had received copies of the Clearwater Sun article regarding the Church of Scientology's letter to the Chairman of the House Judiciary Committee requesting they come to Clearwater and investigate the City files regarding the Charitable Solicitations Ordinance. Consensus was the City Manager write to the Committee as well as the State Attorney General to invite them to come and review our files regarding this subject. Complaints of lots needing to be clearad have been investigated by the Sanitation Division and owners were notified by certified mail to clear the property within ten days or a public hearing would be held to authorize clearance. List D83-17 with eight property owners who failed to clear their propecty within the ten days was presented. City Inspector Albert Brandenberger stated the lots remaining to be cleared constituted a menace to public health, safety, and welfare. Level II group care facilities are defined as facilities for adult congregate living designed to accommodate six to twenty cared-for individuals plus not more than two resident supervisors. Currently, level II group care facilities are permitted by special exception in the HM-8, RM-12, RM-16, RM-20, RM-24, RM-28, PS and ISP zoning districts. The amendment is requested as an interim measure to allow level II group care facilities as a special exception use in the CG districts. It is anticipated that the land development code now being drafted will provide for level II group care facilities as a special exception use within areas zoned "neighborhood commercial" with no such provision in the "general business" district.
