sion. Commissioner Tenney seconded the motion which carried
unanimous ly.
Commissioner Hatchett moved to accept the balance of the
Consent Agenda,as presented, and to authorize the appropriate
officials to execute same. Commissioner Moore seconded the
motion which carried unanimously.
ITEM #9-k - Preliminary Site Plan for Lakeview Oaks -
Portion of Lots 1 & 4 & All Lot 5, Block 12; Lots 1 through 9,
Block 11; and Portion of Lots 1 & 16 & All 17, Block 14, Map
of Belleair, together with Part of Second Avenue, West First
Avenue, "B" Street, and the Alleys lying adjacent thereto.
Section 21-29-15. J. Warren Hu~s,.Dynamic Investments, Inc.
The project is located north of Lakeview Road, east of
South Fort Harrison Avenue, and west of the Seaboard Coast
Line Railroad. The developer plans three professional office
buildings for physicians and to use the right-of-way for West
First Avenue as an access to the project from Lakeview Road.
The developer objects to revising the parking around a
20-inch oak tree on the basis that construction will kill the
tree and he will be faced with the expense of its removal. City
staff believes that with appropriate precautions it can be
preserved. J. Warren Hughes stated they have preserved many
trees on the property but do not believe this 20-inch oak could
be saved because of its size.
Commissioner Garvey moved to approve the Preliminary Site
Plan with three conditions: 1) a method acceptable to the City
Attorney to be developed to permit use of the West First Avenue
right-of-way; 2) reconfiguration of the parking area immed-
iately south of Building 1 is satisfactory to the City
Forester, so as to preclude the necessity of removing the 20-
inch oak tree; and 3) a building permit be issued within six
months from the date of approval and the project be completed
within two years; and that the appropriate officials be author-
ized to execute same. Commissioner Hatchett seconded the motion.
Upon the vote being taken, Commissioner Garvey and the Mayor
voted "Aye"; Commissioners Hatchett" Tenney, and Moore voted
"Nay. n Motion failed.
Commissioner Tenney moved to approve the Preliminary Site
Plan but to delete the second condition relating to the 20-inch
oak. Commissioner Moore seconded the motion. Upon the vote
being taken, Commissioners Hatchett, Moore and Tenney and the
Mayor voted "Aye"; Commissioner Garvey voted "Nay." Motion
carried.
ITE~f #10 - Residential Landscape Beautification Program.
The Ci.ty Beautification Committee proposes establishment
of a Residential Landscape Beautification Program to recognize
the improvements made to local residential properties by owners
who upgrade their properties, and strengthen the image of
"Beautiful, Sparl~ling Clearwater." All City residents will be
eligible and there will be five separate geographical areas with
two categories of entries (single and multi-family residences).

ITEM H14 - Setting Public Hearing and Placing Lien on
Properties xor Unpaid UtilIty Bills.
The lien filing procedures require each property owner be
notified of any unpaid utility bills, a list presented to the City
Commission at a public hearing and adoption of a resolution author-
izing the City Clerk to record Utility Liens against each property.
Commissioner Moore moved the City Clerk be directed to set a
public hearing for December 18, 1980, at 7:30 p.m. for the purpose
of authorizing the City Clerk to file liens against those properties
having unpaid utility bills outstanding.
ITEM #15 - Verbal Reports.
a. Marine Science Center Request.
The Acting City Manager reported a proposed agreement
had been presented to the City by the Clearwater Marine Science
Center for approval of an artistic mural to be painted on the
exterior of the building.
By unanimous consent, Commission authorized the City Manager
to approve the design.
b. Northeast Effluent Transmission Line and Alligator Creek
Force Main, Parts I & II.
Co~~issioner Hatchett requested City inspectors be on the pro-
ject and periodically report to the Commission.
Commissioner Tenney expressed concerns about the traffic
problem on McMullen-Booth Road during this construction.
Commissioner Garvey moved to approve award of contracts for
Part I to Woodruff & Sons, Inc. for $1,164,160.00 and Part II to
Pioneer Excavating Co., Inc. for $3,020,735.00 which are the low-
est responsive and responsible bids received in accordance with the
plans and specifications, and that the appropriate officials be
authorized to execute same. Commissioner Tenney seconded the motion
which carried unanimously.
ITEM #16 - Other Pending Matters.
a. Citizen Request - Save Clearwater Beach.
The Committee to Save Clearwater Beach is currently circulating
a petition to change the zoning on Clearwater Beach and wishes to set
up petition tables at various locations on City property.
Commissioner Garvey moved to approve the request to utilize
public facilities for political purpose with the following condi-
tion: tnat prior approval be obtained from the City Manager on
determining the appropriate facilities. Commissioner Moore seconded
the motion which carried unanimously.
