The City Attorney presented Ordinance H2331-81 as amended for second reading and stated he would read by title only unless there was a request to read in its entirety. The ordinance was read by title only. Commissioner Garvey moved to pass and adopt Ordinance #2331-81 as amended on second and final reading and to authorize the appropriate officials to execute same. ITEM #32 - Second Reading Ordinance #2332-81 - Amendins Chapter 42, Purchasing, of Code to Enumerate Instances Where Bidaing May be Dispensed With. The City Attorney presented Ordinance #2332-81 for second reading and stated he would read by title only unless there was a request to read in its entirety. The ordinance was read by ti tIe only. COJllmissioner Garvey moved to pass and adopt Ordi- nance #2332-81 on second and final reading and to authorize the appropriate officials to execute same. Motion was duly seconded. Commission recessed at 7:25 and resumed at 7:40 p.m. Public Hearings ITEM #15 - (contrd) Proposed Amendments to Code of Ordinances Cnapter 140, Mobile Home Parks. T. D. Hawkins, City Liaison Officer to the Mobile Home Park Board, reviewed the background and Ordinance #1724, which created a Mobile Home Park Board and provided for its composition, organi- zation, purposes, duties and responsibilities. Recommendations presented by the Mobile Home Owners Association were considered by the Mobile Home Park Board and incorporated into Ordinance #2268-81, as amendments of Ordinance #1724. Charles Glover, representing the Clearwater Mobile Horne Owners Association, presented four additional recommendations to the Commission. Ti'lO of the proposals relate to the proposed amend- ments in Ordinance #2268-81 and no additional advertising. is needed. The other two amendments relate to amending Sec 140.22, Ordinance #2268-81 (Ordinance ~1724 - Sec. 3A4(b), Composition, and Sec 3A4(d), Purposes, Duties, and Responsibilities):l.and will need to be advertised. Commission discussed appointment of all board members by the City Commission, and other aspects of the composition of the Mobile Home Park Board and binding arbitration procedures. Commissioner Calderbanl< moved to amend See 140.23(d) to read as follows: "Participation in or utilization of any of tne pro- visions of this Chapter by a mobile home park resident may not be used either directly or indirectly as grounds to cooonence eviction proceedings pursuant to Chapter 83 of tne Florida Statutes. It shall be unlawful for any person or mobile "home park owner to interfere with, obstruct or attempt to prevent a mobile home park resident from exercising any rights established by this chapter." Motion was duly seconded and carried unanimously. Discussion ensued on See 140.24(b) - Selection of Negotiating Agents. The Home Owners Association agreed to establishment of a two-year term of office for negotiating agents. Several Mobile Home Park residents spoke in support of the two-year term.
