The City Commission of the City of Clearwater met in :???. ` ? special session at the City Hall, Fririay, May 29, 1981, at 9:07 a.m., gF,za,>???;? with the following members present Charles F. Lecher Paul A. Hatchett Rita Garvey *James Calderbank Kathleen Kelly Mayor/Commissioner Vice-Mayor/Commissioner Commissioner Commissioner Commissioner .`,_:? w??:< Also present were: Anthony L. Shoemaker Frank Kowalski Sgt. Bill Hebert Cyndie Goudeau City Manager Chief Asst City Attorney Representing Police Chief Deputy City Clerk * Commissioner Calderbank arrived at 9:08 a.m. The Mayor called the meeting to order. The Chief Assistant City Attorney presented the following instrument: An easement for construction and maintenance of a public parking lot parcel of land in the S? of the N? Sec. g -29-16. Commissioner Garvey moved to grant the easement and to delete the portion of the last sentence of the third paragraph reading: "after giving thirty (30) days written notice to the City of Clear- water", and to authorize the appropriate officials to execute same. Motion was duly seconded and carried unanimously. Commission directed the City Manager to proceed with drafting of an Ordinance changing the lengbh of the terms of off ice . Colonel Morrow spoke in opposition to the amount of funding to PACT, and questioned compliance with the City Charter. In response the City Manager reported the document has been studied carefully and there is no violation. Commissioner Calderbank moved to amend Ordinance #2382-81 by amending exhibit "C" Guaranty Agreement, by adding the following sentence to the last paragraph: "Without in any way limiting the generality of the next precedir_g sentence, in the event that- that portion hereof *ahich requires the City to make any payments designated herein as an "Interest Component" (as defined in Section 2.1 hereof) is declared by a court of competent jurisdiction to be invalid or unenforceable, then, in such event, the invalidity or unenforceability thereof shall not affect any of the remaining provisions hereof, including, without li;nitation, the obligation of the City to make any payments designated herein as the "Principal Component" (as defined in Section 2.1 hereof)." Motion was duly seconded and carried unanimously. Commissioner Calderbank moved to pass Ordinance 12382-81, as amended, on second reading and to authorize the appropriate officials to execute same. Motion was duly seconded. Upon roll call the vote was: "Ayes": Garvey, Calderbank, Hatchett, Kelly and Lecher "Nays": None. Other Commission Action. Commissioner Calderbank requested the City waive its 2b$ return on the consession at Jack Russell Stadium for the Buc's Bombers ,game so all funds would go to UPARC. Discussion ensued regarding the possibility of this being. requested by other charitable organizations.
