ITEM #9 - City Representative for Overall Economic
Development Program Committee.
The OEDP process is required by the United States Economic
Development Administration to maintain and update a plan for
the economic development of Pinellas County. Only those pro-
jects included in the plan are eligible for funding.
The committee is composed of representatives :from the
political jurisdictions within the County with meetings held
only as needed.
, The Planning Director reported Clearwater has two pro-
posals to present to the committee: 1) a study to evaluate
industrial park areas; and 2) the potential expansion of
Clearwater's Industrial Park.
Commissioner Nunamaker moved to appoint Mayor LeCher
as the City's representative. Commissioner Moore seconded
the motion which carried unanimously.
Commissioner Moore moved to appoint Commissioner Nunamaker
as an alternate. COJnmissioner Garvey seconded the motion which
carried unanimously.
By unanimous consent, the Commission moved to,Verbal
Reports and heard a Status Report on the City's Major Drainage
Proj ects. .
City Engineer Max Battle reported on the retention pond
area under construction at Pierce Street and Prospect Avenue.
One of the, delays on the project was the finding of 19,000
yards of clay which had to be removed. The second phase is
underway with a concrete bulkhead being constructed in the
excavation area. Other inlets will be installed from Cleveland
Street to the pond and these inlets will, run along Prospect
Avenue. The pond should be operational by the middle of May.
A ponding area on Chestnut Street has been completed and
replacement of sanitary sewers is under construction in the
former railroad right-of-way. Traffic on Court and Chestnut
,Streets ,illl not be completely blocked during this operation
as one ,lane ''lill' always be open.

Commissioner Tenney expressed concerns on the use of
City property by citizens parking in this railroad right-
of-way.
ITEM HID - Street Name Change. Resolution H80-29 -
Changing Name of Road From Bostrom Road to Damascus Road.,
This road is off the Courtney Cambell Causeway in Portion
of Government Lot 4 in the SBl of the NEl of Section 16-29-16.
Commissioner Nunamaker moved to pass and adopt Resolution
#80-29 and to authorize the appropriate officials to execute
same. Commissioner Garvey seconded the motion. Upon roll
call the vote was:
"Ayes": Moore, Nunamaker, Tenney, Garvey and
LeCher.
"Nays": None.
ITEM #11 - McMullen Park Tennis Professional Agreement -
John R, Williams.
The tennis professional, John Williams, has worked at the
complex since 1977, with an annual agreement. The City pays
no monies to Mr. Williams but collects revenues from his classes.
The new agreement contains two major changes: 1) he will
pay a flat monthly fee of $75 instead of $1 for each hour of
private teaching; and 2) the Parks and Recreation Department
will promote large group lessons to be taught by Mr. Williams,
with the City receiving 20% of the revenue.
Commissioner Moore moved to approve a I-year agreement
with John Williams, tennis professional at the McMullen Park
Tennis Complex, and that the appropriate officials be author-
ized to execute samo. Commissioner Tenney seconded the motion
which carried unanimously.
At this time, a certificate presented earlier in the
meeting to the Mayor from the Power Squadron to the City of
Clearwater for the longtime use of the Youth Maritime Center
for their study classes, was presented to Ream Wilson,
Director of the Parks and Recreation Department who maintain
the center.
ITEM N12 - State Urban Forester. Resolution H80-30 -
Requesting Establishment of an Urban Forester Position by
State of Florida De~artment of Agriculture and Consumer
Services under the Cooperative Forest Management Act,
The City Manager reported this program would provide a
tremendous service responding to citizens' technical questions.
Commissioner Nunamaker stated he supported the program but
had" reservations on the need for another local bureaucrat.
, Commissioner Garvey moved to pass and adopt Resolution
H80-30 ,and to authorize the appropriate officials to execute

, By unanimous consent, at the Mayor's request, the Com-
mission agreed to consider Item l7-b at this time.
Commission consensus was to continue this item to allow
the Marine Advisory Board to consider the item.
Commissioner Nunamaker moved to continue this item to
the regular Commission meeting of April 3, 1980, at 12:30 p.m.
Commissioner Moore seconded the motion which carried unanimously.
The City Manager reported receipt of a letter of opposi-
tion from Frank Morrow, to be read into the record. The City
Manager reported he l~ould copy the letter for the Commission.
ITEM #17-a - A Public Hearing to Consider Ap~eal from
the decision of the Board of Adjustment and A~peal on Zoning
on request for variance to erect townhouses wlth 5-foot
setback from property line abutting right-of-way on Thornton
Road. Lot 11 less W 125 feet, S of N 245 feet, and Lot 12
less E 100 feet less N 24Sfeet and land to water, Wm. Brown's
Subdivision of Bay View. - Allan J. Stowell.
The property is located approximately 420 feet south of
Gulf-to-Bay Boulevard, west of Thornton Road and is zoned
CT~-28 (high-density commercial tourist facilities).
The applicant requested a special exception to construct
a single family dwelling and townhouse models and a variance
to construct the townhouse with a 5-foot side yard setback
instead of the required IS-foot setback. Two other variance
requests were withdrawn at the Board of Adjustment and Appeal
hearing of January 23, 1980.
The BAA granted the special exception but denied the
variance.
The applicant is appealing the decision to deny the
10-foot setback variance but subsequently amended his request
to a variance of S feet to allow a 10-foot setback from the
property line abutting the street right-at-way instead ot the
required 15 feet.
Fred Wilder, attorney representing the applicant,' stated
the applicant plans a townhouse development, low-rise with
3 stories. Thornton Road is partially paved from Gulf~to-Bay
but does not extend completely to the waterfront and a number
of old oaks have been preserved in the unpaved area.
l~en the property was annexed the applicant had given
the City a lO-foot right-of-way easement. Subsequently, a
request was ,made to vacate that easement and the City is
. currently, in court seeking a declaratory judgment as to
whether ~t has the right to vacate the property.

Mr. Wilder further stated the applicant has reduced the
unit size and amended the site plan in an effort to meet the
requirements. The area is currently zoned to allow a mid or
high-rise facility.
Considerable discussion ensued on the porches extending
into the easement area. The City Attorney reminded the Com-
mission the variance is their only consideration at this time.
The Assistant City Engineer stated the right-of-way will prob-
ably never be used.
Several commissioners expressed concern about no site
plan or community impact statement having been filed for
review with the Resource Development Committee.
Mr. Wilder responded that plans are costly to prepare
and when they know the parameters they can plan accordingly.
The City Attorney quoted Section 35.09(5) relating to
variances and the provisions the Commission must consider--
practical difficulties or unnecessary hardship.
The City Manager recommended the Commission establish a
policy to set future procedures to require that site plan and
community impact statment be approved before a developer
requests variances.
Commissioner Tenney moved to deny the request. Commis-
sioner Garvey seconded the motion. Two citizens spoke in
support of the denial. Discussion ensued on the location
being the practical difficulty, and whether a conditional
variance with safeguards and conditions could be considered.
In response, the City Attorney stated the request could be
approved with safeguards and conditions by recording of a
covenant to run with the land, Upon the vote being taken,
motion carried unanimously
The property is located on the north side of Dell Avenue
west of Belcher Road and north of Drew Street and currently
developed with a single family residence. The request is in
conformance with the Clearwater and County Land Use Plans.
Commissioner Moore moved to approve the annexation,
establish RS-60 zoning and Fire District H2, and the City
Attorney instructed to include this in an ordinance. CommisM
sioner Tenney seconded the motion. There were no citizens to
speak. Motion carried unanimously.

The property is located at 313-315 Gulf View Boulevard
,(east side) approximately 200 feet south of Third Street and
is developed with a single family residence.
The requested change is in conformance with the compre-
hensive Land Use Plan.

seconded the motion. Upon the vote being taken, tho amendM

Earlier in the meeting Commissioner Nunamaker requested
this item be continued for additional information on the
concrete mixer. The information was received from the City
Engineer and the concrete mixer in question was the one

The City Attorney presented Ordinance #2091 for second
reading and stated he would read by title only unless there
was a request to read in its entirety. The Ordinance was
read by title only. Commissioner Nunamaker moved to pass
and adopt Ordinance #2091 on second and final reading and to
authorize the appropriate officials to execute same. Com-
missioner Garvey seconded the motion. Upon roll call
the vote was:

The City Attorney reported there were two additional
items he wished to bring to the Commission's attention.
ITEM - Legislative Delegation Meeting:
Relating to the Local Bills and Charter presented to
the Pinellas Legislative Delegation, of all amendments sub-
mitted for the Charter, only one was admitted, and only one
Local Bill was admitted and that referred to the Firemen's
Pension Fund. There were no sponsors to the other' bills.
The Legislative Delegation elected to go with the County
Emergency Medical Services (EMS) Bill rather than the City
bill, as requested by Resolution H80-28.
The City Attorney also reported that the proofs had been
received for the new City of Clearwater Code of Ordinances
book.
The City Manager reported amendments to the General Bills
may be supported by Representatives Sample and Smith.

Mayor LeCher reported on a request for the City to do
wiring for lights for the Bobby Walker swimming pool for (l'
special swim meet to be held March 18, 1980. A suggestion,
was made to offer the use of Ross Norton or Morningside
swimming pool. The City, Manager will review this.
Mayor LeCher noted an invitation to the Commission to
attend a ribbon cutting ceremony at the St. Cece1ia Pun Pest,.
March 6, 1980, 6 p.m.
Commissioner Tenney requested the status of the North
Clearwater Beach rezoning.
He suggested trucks not be permitted on Countryside
Boulevard when exiting Belcher Road Extension.
He also requested review of the Fire Code for buildings
within the City, and the need for additional fire exits in
night clubs.
