Golf �ark will� rece�.ve a xent reduction af ap raxima�ely four
thausand dolYars per year, a cash payment of $7S,OU0, the City
w�I1 create a butfer bexween the two proper�xes if the axrpark
opera�ion �s discontinu�d, the Go1� Park wi.l�. be xelzeved of
the o�ligation to pay �d valorum real property taxes, and a

The Mayor called the meeting to order. Interim Police
Chief McClamma led the Pledge of Allegiance and offerc~ the
invocation.
ITEM #3 - Introductions and Awards.
A proclamation was presented to the Fire Chief for Fire
Prevention Week, October 5 through 11, 1930.
ITEM #4 - Service Pin Awards.
Two service pins were awarded to City employees and ,a
ring presented to Assis~ant Fire Chief Roy Goodwin for
30 years of service.
ITEM #5 - Minutes.
Commissioner Garvey moved to approve the minutes of the
special and regular meetings of September 18, 1980, as re-
corded and as submitted in written summation by the Clerk to
each Commiss ioner. !llotion was seconded by Commiss ioner
Hatchett and carried unanimously.
ITEM #6 - Citizens to be Heard re Items Not on the Agenda.
Mr. Green, vice-president of the Woodgate Home Owners
Association, requested Commission approval to hold a Candidates
Forum, October 26, 1980, at Woodgate Park. Commissioner Garvey
moved to approve the request. Commissioner Hatchett seconded
the motion which carried unanimously.
Don Mains, tourism coordinator of the Greater Clearwater
Chamber of Commerce, requested further assistance from the
City in the conduct of the Jazz Festival scheduled October 24
through November 2~ 1980,--1) waive fee for an additional stage~
2) supply police officers for traffic control and security,
3) waive deposit - barricades, and 4) a temporary power pole in
Coachman Park. Commissioner Garvey moved to support the four
needs but not to automatically includp. support for police
officers in the future. Commiss ioner Tenney seconded the .'

ITEM n7 - Mid-Beach Rezoning:
a. Treatment of Nonconforming Densitr.
The Planning Director stated the intent of the proposed
Zoning amendment would be to allow those' existing uses which
are nonconforming with respect to density, to be rebuilt or
replaced in the event of damage or destruction by natural
causes to a1lO\'/ reconstruction of the previously existing
units. Section 35.08 (E) of the Zoning Code and appropri-
ate definitions in Article II and related provisions must
be amended.
Commissioner Moore moved to direct staff to prepare for
Commission consideration and action, amendments to the Zoning
Ordinance. Commissioner Hatchett seconded the motion which
carried unanimously.
b. Second Reading, Ordinance #2164 - Amending
Zoning Atlas of the City - Mid-Beach Rezoning.
Emil Marquardt, attorney representing property owners of
Block 5, Clearwater Beach Revised Subdivision, requested these
properties be deleted from the ordinance and considered sepa-
rately.
The City Attorney presented Ordinance #2164 for second
reading and stated he would read by title only unless there
was a Tequest to read in its entirety. The Ordinance was
read by title only. Commissioner Moore moved to pass and
adopt OrdinanceH2164 on second and final reading and to
authorize the appropriate officials to execute same. Com-
missioner Garvey seconded the motion. Upon roll call the vote
was:

The Lease Amendment and the Amended Lease Agreement will
provide for the City's acquisition of the Golf Park's interest
in the Clearwater Executive Airpark. The considerations for
transferring all rights of the Airpark Sublease will be: the
Golf Park will receive a rent reduction of approximately four
thousand dollars per year, a cash payment of $75,000, the City
will create a buffer between the two properties if the airpark
operation is discontinued, the Golf Park will be relieved of
the obligation to pay ad va10rum real property taxes, and a
cash payment of $8,545.00 will be made to settle a dispute
between the Golf Park and the Airpark. The City will receive
all rights to the Airpark sublease and title to all Clearwater
Executive Airpark improvements.
Commissioner Hatchett moved to approve the Lease Amendment
and the Amended Lease Agreement and to authorize amendments to
the 1980/81 Capital Improvement Budget to increase appropria-
tions for Clearwater Executive Airpark Project in the amount of
$83.545; and to increase appropriations from General Revenues,
$83,545; and to amend the Operating Budget to increase a~propri-
ations for transfer to the Capital Improvement Program, $83,S45i
increase appropriations of Prior Years Surplus Carried Forward,
$87,575; and to decrease appropriations of Commercial Rentals
and Leases ~$4,030); and that the appropriate officials be author-
ized to execute same. Commissioner Garvey seconded the motion.

Library and Recreational services have been denied to
nonresident City employees. The City Manager requests these
services be extended to all City employees regardless of
residence because of the outstanding quality of work
delivered to this community.
Commissioner Moore moved to instruct the City Attorney
to amend Resolutions 77-99 and 80-102 to include City
employees in the criteria establishing the taxpayer class
for use of the library and City recreation facilities and
programs. Commissioner Garvey seconded the motion which

ITEM #14 - Selection of Municipal Code Enforcement Board
Members.
The 1980 Florida Legislature authorized creation of a
Municipal Code Enforcement Board for the purpose of conduct-
ing hearings related to the enforcement of occupational
licenses, fire, building, zoning, sign, and other related
technical codes, to be effective October 1, 1980.
The board will have six members to be chosen from six
categories. After the initial appointment a term ~hall run
for three years.
Commissioner Garvey moved to appoint Lee Regulski, con-
tracto~ for a three-year term. Commissioner Hatchett seconded
the motion which carried unanimously.

The Southwest Florida Water Management District has
agreed to assist the City of Clearwater in the acquisition
of'lands required for construction of the Alligator Creek
Water Management Project. This project will ameliorate flood-
ing problems, enhance water quality, and provide water-based
recreational opportunities. The City will provide the engineer,
design, construction, and perpetual maintenance. SWFWMD has
agreed to purchase the lands.
Commissioner Moore moved to approve the license agreement
and that the appropriate officials be authorized to execute
same. Commissioner Garvey seconded the motion which carried
unanimously.

#80.-10.5 commendin~ the Anclote River Basin Board for their

The property is located west of and abutting Comet Avenue,
north of Gulf-toBay Boulevard. It is developed with a duplex
and contains .40. acres MOL.
The Planning Director reported that under the Subdivision
Regulations of the City Code of Ordinances, ,if an existing
platted lot is to be resubdivided without filing a replat1
approval by the City Commission is required. This request
would create a nonconforming small lot and he felt the add-
itional units could be placed on the property without rlividing
the lot.

Commissioner Moore moved to deny the request. Commissioner
Garvey seconded the motion which carried unanimously.
ITEM #17 - Four-Day Work Week Trial Period - "City Hall
Annex.
At the end of the trial period the Annex offices will
revert to a five-day work week while the results of the trial
period arc studied. The purpose of the reduced work week is
to produce dollar savings to the City in terms of energy and
fuel costs.
Commissioner Moore moved to approve a trial' period of
six months beginnning 11/1/80, to test the effectiveness of a
four-day work week for services housed at the City Hall Annex.
Commissioner Garvey seconded the motion. Two citizens spoke
in opposition. Upon the vote being taken, motion carried
unanimously.
ITEM #18 - Verbal Reports.
Octoberfest - Clearwater Optimist Club.
The club has requested use of a platform and three
six-yard dumpsters on October 17, 18, and 19, on property
lying in the County north of Talk of the Town Restaurant on
U.S. 19 and cast of Tropic Hills Subdivision; and that all
fees and charges for the platform and dumpsters be waived.
Proceeds from the event ,'lill support STRAIGHT, INC. and other
nonprofit groups.
Commissioner Tenney moved to approve the request. Com-
missioner Moore seconded the motion which carried unanimously.
ITEM #19 - Other Pending Matters.
By unanimous consent, the Commission agreed to consider
Item 19-b out of order.
ITEM #19-b - Bid - Motor Grader.
Scaled bids were solicited from 13 heavy construction
equipment dealers for a motor grader needed in the Public
Service Division. The bids were opened and all were rejected.
The low bidder, revised its bid by increasing the value for
the trade-in. All bidders were allowed to reevaluate the trade-
in and submit revised bids.
Commissioner Tenney moved to award a contract to purchase
one new Babcock Allatt AG-100 Motor Grader in exchange for
one 1975 Caterpillar 120G Grader from Linder Industrial
Machinery, which is the lowest responsive and responsible
bid in accordance with the specifications, and that the
appropriate officials be authorized to execute same. Commis-
sioner Moore seconded the motion which carried unanimously.
ITEM #19-a - Agreements to Annex ProEerties in the SEl
and SWA of Section 6-29-16 and NEJ and NWa of Section 7~29-16.
Blackburn Land Development Corp. Annex ATA-117.
There are two Agreements to Annex, one for property east
and the other for property west of the Florida Power right-of-
way. The applicant requests City water and
sewer service on the property east of the R.O.W. (Parcel VII)
and has agreed to pay $154,000 in lieu of the park dedication
requirement. In the second agreement referring to parcels
wes~ of the right-of-way, the applicant requests and agrees to
ded1cate Parcel V for parkland. Parcel VII is classified
Residential/Office and Commercial/Tourist Facilities on the
City Land Use Plan but there are environmental constraints _
on the site. The remaining property west of the right-of-way
is classified Low Density Residential.

Complaints of lots needing to be cleared have been investi-
gated by the Sanitation Division and owners were notified by
certified mail to clear the property within 10 days or a public
hearing would be held to authorize clearance.
List #80-8 with property owners who failed to clear their
property within the 10 days was presented.
City Inspector Dominick (Jack) Carannante stated the lots
remaining to be cleared constituted a menace to public health)

The property is located west of and abutting Keene Road
extension between Palmetto and Long Streets. It is currently
vacant and contains 5.5 acres zoned RPD (Residential Planned
Development). The developer pl:,ns to continue development of
the site but additional rights-of-way will be required prior
to development. The request will require an amendment to the
Pinellas County Land Use Plan.
Several residents of the area spoke in support of the low
density residential designation as traffic and speeding are
problems in the area. The developer requested the Commission
consider Medium Density.
Commissioner Tenney moved to approve the Land Use Plan
Amendment to Low Density ~esidential and to direct the City

The Planning Department and the Downtown Development Board
have worked together to prepare revised zoning regulations that
are consistent with and seek to implement the Plan for Downtown
Clearwater.
This proposal is designed to replace the existing Article
XXIV, Planned Redevelopment Urban Center (PRUC) provision of
the Zoning Ordinance.

b. U.S. Coast Guard Sand Key Channel Dredging
OrdInance H2225, First ReadIng.
A permanent Coast Guard Search and Rescue (SAR) Station
will be constructed on the lower portion of Sand Key on the
Bay side and a channel to accommodate the required rescue
vessels will be necessary. The project is vital for protec-
ti~n of boaters in Clearwater and adjacent areas. Approxi-
mately sixty-thousand cubic yards of material must be
excavated and this will require referendum approval.
Commission requested the City Attorney prepare additional
wording for the official ballot to indicate the channel was
necessary for a permanent Coast Guard Search and Rescue
Station.
Commissioner Garvey moved that Ordinance #2225 be read

has a large cash deficit and the increased rates are necessary
to make the system self-sufficient. This is the first increase
in five years. The increase will cover operating requirements

Pension Fund with the Mayor calling the meeting to order.

a. Appointment of Trustees to Supplementary Police
Pension Fund.

Commissioner Moore moved to appoint Ray Kaminskas,
William Sedrick, and Donald Hibbard as Trustees of the
Supplementary Police Officers' Retirement Fund, for a period
of two years. Commissioner Hatchett seconded the motion.
Upon the vote being taken, Commissioners Garvey, Hatchctt,and
,Moore, and the Mayor voted "Aye"; Commissioner Tenney voted
"Nay." Motion carried.
b. Pensions to be Granted - Donald Bean and
Howell Norman.
Commissioner Moore moved to approve Retirement Pension
under Section 5 of the Employees' Pension Plan, for Donald
Bean, Tradesworker II, Building & Maintenance Division,
Central Services Department, effective August 1, 1980, in
the amount of $616.38 a monthi and Howell Norman, Foreman,
Building and Maintenance Division, Central Services Department,
effective August 16, 1980, in the amount of $665.31 a month.
Commissioner Garvey seconded the motion which carried
unanimously.

Policy - Trustees of the Employees' Pension
By unanimous consent, Commission agreed to set policy
to convene as Trustees of the Pension Fund, for discussion
of pension items during regularly scheduled work sessions.
