The City Commission of the City of Clearwater met in
regular session at the City Hall, Thursday, November I, 1979.

'The Mayor called the meeting to order. The Pledge of
Allegiance was led by Chief Daniels. The invocation was given
by the Reverend Mac Williams of Mt. Carmel Baptist Church.
. ITEM 1# 3 - Introductions and Awards.
The Mayor issued Proclamations declaring Shriners Hospi-
talsPaper Drive Days, November 16 and 17, 1979; Zonta Inter-
national Day, November 8. 1979; Religious Community Services
Week of November 11,1979; and Sing1e~ Social Concern Day,
November 17, 1979.
ITEM #4 - Service Pin Awards.
Three service pins were awarded to City employees.

CommissioneT DeBlakeT moved to accept the Final Consent
Agenda as presented to the Commission and that the appropriate,
officials be authorized to execute same. Commissioner
Nunamaker seconded the motion which carried unanimously.
The City Manager announced he was withdrawing this item.
ITEM 18 ~ Fiscal Feasibility of the Comprehensive Plan.
Michael Bier, representative of Barton~Aschman and
Associates, Inc., presented the report which assesses the
fiscal feasibility of the Clearwater Comprehensive Plan.
The study used five different analysis methods to project
revenues and expenditures through 1995. Considered in the
analysis were projections of land use and population against
projections of tax base and utility fees and taxes. The
analysis indicates that capital and operating revenues will
meet or slightly exceed expenditures and recommends careful
monitoring of future expenditure increases, particularly the
Cityts capital expenditures, as the necessary level of ex-
penditures may exceed projected revenues.
Five policies and actions were recommended to ensure the
fiscal, feasibility of the Clearwater Comprehensive Plan:
reviews of municipal expenditures, municipal revenues, impact
fees and other revenues to ensure appropriate charges are
levied to reflect actual ,expenditures; regUlar updating of
the study; and consideration of the impact of new development.
Commissioner Nunamaker nloved to accept the report of
Barton-Aschman and Associates. Commissioner Tenney seconded
the motion which carried unanimously.
ITEM "9 - Nagano City Recognition.
The City of Clearwater will honor a contingent of 30
visitors from Nagano, Japan.
Commissioner Tenney moved to approve the display of a
welcoming banner and the Nagano City flag from November 4
through 7, 1979, and to waive all applicable fees. Comis-
sioner Moore seconded the motion which carried unanimously.
The usual investigation was conducted.
Commissioner Tenney moved to approve the request for
alcoholic beverage zoning to permit the sale of beer, wine,
and liquor, on and off the premises and to instruct the City
Attorney to prepare an amendment to the beverage ordinance.
Commissioner Moore seconded the motion which carried unanimously.

ITBM '11 ~ Municipal Slection. February 12. 1980.
Commissioner Tenney moved to instruct the City Clerk to
prepare for and conduct the municipal election to be held
February 12, 1980. Commissioner Moore seconded the motion
which carried unanimously.'
ITEM '12 - Purchase of Property 410 Vine Avenue, All
of Lot 6t and Lot 41 Less the West 36 Feet Thereof. Drew
Park SUbdivision.
The growth of the City and additional vehicles make
expansion of the Motor Pool a necessity. Additional area
for the garage complex and parking are required.
Commissioner Nunamaker moved to authorize purchase of
all of Lot 6, and'Lot 41 less the west 30 feet thereof, Drew
Park Subdivision, for a total purchase price of $17,000, and
to authorize the appropriate officials to execute same.
Commissioner Moore seconded the motion.
Wells Brown, Garage Superintendent, stated the Plaza
Street property would be used for garage expansion and the
Vine Street area would be used for parking. They are working
toward a motor pool concept, for which $1,000,000 has been
budgeted in the Capital Improvements Budget.
Commissioner Tenney expressed concerns for the impact of
a garage on the residential neighborhood.
Upon the vote being taken, Commissioners DeBlaker,
Nunamaker, and Moore and the Mayor voted "Aye"; Commissioner
Tenney voted "Nay." 'Motion carried.

ITBM '15 - Proposed Wage and Fringe Benefits for Certain
City Employees.
Approximately 100 City employees are not represented by
a bargaining unit. A percentage wage increase offered to the
City's 3 unions has been recommended, to be effective October
1, 1979.
Commissioner Nunamaker moved to approve a 71' wage in-
crease for all employees except those represented by a bar-
gaining unit and employees whose annual salary exceeds $24,000'-
with an effective date of October I, 1979, and that fringe
benefits finally approved for members of bargaining units also
be approved, as applicable, for employees covered by this
recommendation; and that the appropriate officials be author-
ized to execute same. Commissioner Moore seconded the motion
which carried unanimously.
ITEM #16 - FOP Contract Proposal.
In response to the City Manager's request, Commissioner
DeBlaker moved to continue this item until later in the meet-
ing. Commissioner Tenney seconded the motion which carried
unanimously. (See Page 9.)
ITEM #17 - Grant AEPlication - Moccasin Lake Park.
Resolution "79-98 - Authorizing SUbmission of A\,p1ication
to Florida Department of Natural Resources Seek1ng Funding
for Development of Moccasin Lake Park.
Commissioner DeBlaker moved to pass and adopt Resolution
#79-98 and to authorize the appropriate officials to execute
same. Commissioner Nunamaker seconded the motion. Upon
roll call the vote was:

ITEM H18 M Amendment - Bid: Motor Vehicles - Kenyon
Dodge.
Commissioner DeBlaker moved to amend Purchase Order 59089
with Kenyon Dodge, Clearwater~ to add one (1) 4-door Dodge
Aspen with police package, for $4,996.24, changing the total
quantity from eighteen (18) to nineteen (19) and the total
purchase amount from $75,223.72 to $80,219.96, and that the
appropriate officials be authorized to execute same. Commis-
sioner Nunamaker seconded the motion which carried unanimously.
A settling sanitary sewer at the above intersection was
creating a traffic hazard.\ The City Manager authorized im-
medi~te repairs and the Director of Public Works obtained bids
from several contractors. Work done by General Telephone
Company may have been partly responsible for the failure of
the sewer .line and General Telephone has agreed to reimburse
.::.., the City in the amount of $4,450.

Commissioner DeBlaker moved to approve, after the fact,
the repair of the sanitary sewer at Belcher Road and Cleveland
Street intersection, in the amount of $17,876.50, which amount
was paid to Purcell Bxcavating, Inc. Commissioner Nunamaker
seconded the motion which carried unanimously. '
ITBM H20 - Lake Hobart - Ponding Area at South Bnd.
A ponding area owned by the City at the south end of
Lake Hobart has been the cause of numerous complaints over
the past 6 years from the residents because it is so shallow.
The City has two options; to fill and grass or to deepen the
ponding area. The residents are opposed to signing a release
agreement and none have been returned by the property owners.
The area is a continuing maintenance problem for the City as
insecticides cannot be used to control the weeds because the
water is used for watering lawns.
Several residents spoke in support of deepening the
ponding area and requested a modified release agreement.
,A meeting will be held with the City Attorney and City
Manager and a representative of the area to discuss and
media te a nc'~ agreement.
Commissioner Nunamaker moved to table Item 20 indefi-
nitely. Commissioner DeBlaker seconded the motion which
carried unanimously.
Commission recessed for lunch at 11:45 a.m. and recon-
vened at"12:45 p.m. M!!jor Vellucci replaced Chief Daniels
and Cecil Henderson replaced Max Battle at that time.

The property contains 6.07 acres located north of Druid
Road, west of Orange Avenue, and south of Jeffords Street.
It presently has one large residence and several outbuildings.
The developer is requesting RPD-2.5 zoning.
Harry Cline, attorney for the developer, stated the
City's 'request for consideration of 4 items had been con-
sidered and a revised site plan presented reducing the number
of units to 11 and allowing 80% open space. The entrance and
drive locations were approved by the Traffic Engineer as being
satisfactory.

Commissioner Nunamaker moved to approve RPD-2 (resi-
dential planned development) zoning, and preservation of the
Roebling residence and the City Attorney instructed to in-
clude this in an ordinance. Commissioner Moore seconded the
motion.
A letter dated October 30, 1979, from the Clearwater
Historic Committee expressing concerns for the preservation
of the house and the area was read into the record. The
developer agreed to present a preservation agreement for
recording in the public records. Upon the vote being taken,
Commissioners DeBlaker, Nunamaker, and Moore and the Mayor
voted "Aye"; Commissioner Tenney voted "Nay." Motion carried.
The applicant was not present.
Commissioner DeBlnker moved to continue this item
temporarily. Commissioner Nunamaker seconded the motion
which carried unanimously.
ITEM H27 - Public Hearings on Requests for Annexation~

dential) Zoning and Fire District #2. -

The property is located on the southwest corner of Clark
Street and Wood Avenue. It is currently vacant, but a single-
family residence is proposed.
Commissioner Nunamaker moved to approve the annexation
with RS-75 zoning and Fire District H2 and the City Attorney
instructed to include this in an ordinance. Commissioner
DeBlaker seconded the motion. There were no citizens to
speak. Motion carried unanimously.

The .82-acre vacant property is located north and east
of the service road at U.S. 19 and S.R. 60.
The developer proposes self-service storage units.
Commissioner DeBlaker moved to approve the annexation
with CG zoning and Fire District #1, subject to a 24-foot
access easement on the east side of the property; and the
City Attorney instruced to include this in an ordinance.
Commissioner Nunamaker seconded the motion. There were no

City Attorney instructed to include this in an ordinance. Com-
misssioner Tenney seconded the motion. There were no citizens
to speak. Motion carried unanimously.

The property is located on North Missouri Avenue north
of Palmetto Street and contains ~54-acre currently developed
as residences. The change is requested to permit development
of a church. Section 28 of the Zoning Code requires a mini-
mum of I-acre to establish ISP zoning. The City Attorney had
ruled the City Commission would have the authority to deter-
mine'whether the I-acre requirement would have to be met.
The Planning Director reported the applicant is aware of the
fact that Missouri Avenue may be widened.
Commissioner DeBlaker moved to approve ISP zoning and
the City Attorney instructed to include this in an ordinance.
Commissioner Moore seconded the motion. There were no citizens
to speak. Motion carried unanimously.
c. South Greenwood, Phase II Follow-Up, City-
Initiated:
These properties were considered for rezoning at the
August 16, 1979, meeting, at which time citizens spoke in
opposition. By Commission direction the Planning Director
was instructed to reconsider the zonings.

and considered by title only on the first reading by the
unanimous consent of the Commission. Motion was seconded by
Commissioner Nunamaker and carried unanimously.
The ordinance was read by title only. Commissioner
Nunamaker moved that Ordinance #1997 be passed on its first
reading. Motion was seconded'by Commissioner DeBlaker. Upon
roll call the vote was:

Commissioner DeBlaker moved to dismiss the appeal and
to allow the decision of the Board of Adjustment and Appeal
on Zoning to stand. Commissioner Tenney seconded the motion
which carried unanimously.
ITEM 131 - Citizens to be Heard re Items Not on the Agenda.
Bonnie Harding requested the status of the fence repair
on South Osceola Avenue on the Church of Scientology property.
Commission recessed from 2:15 to 2:30 p.m., and returned
to City Manager Reports.
ITEM #16 - Proposed Agreement Between the City of Clear-.
water and the Fraternal Order of Police, Florida State Lodge 10.
An agreement has been negotiated between the City and the
F.O.P. and will become effective if approved by the City Com-
mission.
The City Manager reported the language in Article VIII,
Work Rules and Personnel Practices, Section 1, Subsection (J)
and Sub-subsection (4) on Page 14 of the Agreement, creates a
problem. This section and its component part have been in-
terpreted differently by the F.O.P. and the City representatives.
The option of taking a lump sum payment was incorporated into
this contract for the first time.
Mike Stuart, president of the F.O.P., stated the ~.O.P.
membership had voted and ratified the agreement expecting to
be compensated for all of their accumulated sick time instead
of one-half (!). City representatives stated it was never
their intention to provide more than one-half (1) accumulated
sick time, and believed that that was the F.O.P.ts under-
standing as well.
Discussion ensued on provisions of the other union
contracts, which include this provision at one-half (1).
Commission consensus was to uphold the Cityts interpretation
of one-half (1) of the accumulated sick leave.
The president stated he would have to return to the
F.O.P. membership for another vote on the agreement.
The item was withdrawn by the City Manager to allow the
F.O.P. to vote again.

The property'contains 15.7 acres currently zoned RM-l6
(medium density, multi-family) and located on the south and
west sides of Enterprise Road.
The proposed development would consist of 228 dwelling
units in 26 buildings. Variances to allow 11 additional
feet in height and 10 units per row in Buildings 24, 25, &
26, were granted at an administrative hearing on October'18, 1979.
Commissioner Moore moved to approve the preliminary site
plan conditional upon issuance of the initial building permit
within six (6) months from the date of approval and the total
project to be completed within five (5) years; and that the'

Investments of Central Florida.
The property contains 2.22 acres and is an L-shaped,por-
tion fronting partially on the north side of Gulf-to-Bay
Boulevard and on the east service road of U.S. 19. Coordination
of access easements on the adjoining restaurant parcels has
been accomplished.
Paul Fasolas, representing the applicant, stated the
camphor tree would be protected in response to Commission
concerns.
Commissioner Moore moved to approve the preliminary site
plan conditional upon issuance of the initial building permit
within six (6) months from the date of approval, and that the
camphor tree be protected, and that the appropriate officials
be authorized to execute same. Commissioner DeBlaker seconded
the motion.
Commissioner Tenney expressed concerns on the access from
GUlf-to-Bay Boulevard. Mr. Fasolas stated there would be a
right turn into the property only. Commissioner Moore amended
his motion to include that the entrance be for access only
from Gulf-to-Bay Boulevard to the restauratlt; no egress onto
GUlf-to-Bay. Commissioner DeBlaker accepted the amendment.

The Junior League rents City property on East Avenue
(north 100 block) for use as a thrift shop and has maintained
the property in good condition for a number of years. Renewal
of the lease has been requested.

Junior League lease for one additional year at $1 a year, and
that the appropriate officials be authorized to execute same.
Commissioner Nunamaker seconded the motion which carried

24.2 - Carnival - Congregation Beth Shalom.
A request has been received to hold a carnival and to
waive various fees.
Commissioner Nunamaker moved to approve the request of
Congregation Beth Shalom Synagogue to conduct a carnival at

25, 1979, and to waive all applicable carnival operator fees;

Commission met as Trustees of the Employees' Pension Fund,
with the Mayor calling the meeting to order. .
ITEM R57 - Trustees of the Employees' Pension Fund.
B. Investment Management Agreement.
Commissioner DeBlaker moved that the Trustees of the
Employees' Pension Fund approve a letter to The Exchange
National Bank of Tampa identifying the assets to be managed,
clarifying the discretion of the Exchange National Bank, and
stipulating the fee basis for providing investment management
services for insurance contract investments as provided for
in the existing Investment Management Agreement between the
Trustees and the Bank, and that the appropriate officials be
authorized to execute same. Commissioner Tenney seconded the
motion which carried unanimously.
Jeff Butler, Assistant City Manager, reported the majority
of the employees' pension funds are invested in an insurance
contract with Aetna Insurance Company. The Exchange National
Bank has recommended these funds, approximating $15,000,000,
be transferred to Crown Life Insurance and Manufacturer's
Life Insurance Company with a definite rate of interest.
The Aetna contract did not guarantee a definite interest
rate and has averaged 7.65% since 1971. The recommended
change-over is a superior investment opportunity that will
pay lIt-plus, under three different contract years: 5, 7, &
10. It will cost $500,000 to cancel the Aetna contract, but
these funds will be recouped because of the higher interest
rates in the new contracts within 2 years.
Commissioner Tenney moved to authorize transfer of funds
by the appropriate officials, subject to the documents being
