regular session at the City Hall, Thursday, September 6, 1979,

The Mayor called the meeting to order. The Pledge of
Allegiance was led by Chief Daniels. The invocation was
given by the Reverend John Burciaga of the Unitarian Univer-
salist Church.
ITEM #4 - Service Pin Awards.
Four service pins were awarded to City employees.
ITEM #3 - Introductions and Awards.
A proclamation was presented declaring September 6, 1979,
"Clearwater High School Day."
ITEM #5 - Minutes.
Commissioner Nunamaker moved that the minutes of the .
regular meeting of August 16, 1979, be approved as recorded
and as submitted in written summation by the Clerk to each
Commissioner. Motion was seconded by Commissioner DeBlaker
and carried unanimously.

ITEM #7 - Amendment to Lot Mowing Contract with David
Britt.
The City's lot mowing contractor requests an increase in
the 1973 price schedule for the mowing of lots as the price
of fuel, capital cost of equipment, maintenance, and labor
have increased tremendously since that time.
Commissioner Tenney moved to approve an amendment to
the Lot Mowing Contract between the City of Clearwater and
David Britt as follows:

ITEM H13 - Lease Amendment, Fish Market on Portion of
Lots 12 and 13, City Park Subdivision - William F. Goodwin.
Paragraph 7 of the current lease precludes the lessee
from utilizing signs that would be in conformance with the
City's Sign Ordinance. A first amendment has been prepared
and paragraph 7 rewritten.
Commissioner DeBlaker moved to add a new sentence to
the end of the paragraph to read as follows: liThe language
of this paragraph shall not be construed to include erection
of Ii freestanding pole sign." Commissioner Nunamaker seconded
the motion which carried unanimously.
Commissioner DeBlaker moved to approve the amended First
Amendment to Lease and that the appropriate officials be
authorized to execute same. Commissioner Tenney seconded
the motion which carried unanimously.
The City purchased this property to install a drainage
retention area and is using a portion that is leased to
Winn-Dixie for parking. An amendment has been prepared to
reduce the annual rental.
Commissioner Nunamaker moved to approve the Fourth
Amendment to Lease to reduce the monthly rental payment
to $2,500, and that the appropriate officials be authorized
to execute same. Commissioner Moore seconded the motion
which carried unanimously.
ITEM #15 - Florida Power Joint Attachment Agreement.
The City will realize substantial savings from a
reciprocal agreement with Florida Power Corporation which
will permit City departments to attach cables to Florida
Power Corporation's poles.
Commissioner DeBlaker moved to approve the Joint Attach.
ment Agreement and that the appropriate officials be authorized
to execute same. Commissioner Moore seconded the motion which

ITEM '16 - Northeast Sewage Treatment Plant.
The Northeast Sewage Treatment Plant has reached its
. design capacity and the flow will reach maximum capacity of

The current allocation will be expended by mid-September and
allocation of additional units will allow orderly development
in Northeast Clearwater to continue until the new 8 MGD
Northeast Sewage Treatment Plant is completed.
Commissioner DeBlaker moved to approve an additional
120 units of single-family and 180 units of other units to
the sewer allocation for the Northeast Sewage Treatment Plant,
and that the appropriate officip.ls be authorized to execute
same. Commissioner Nunamaker seconded the motion which
carried unanimously.
ITEM Hl7 ~ Preliminary Site Plan - Tracts 45, 72, 73,
and 74, Countryside. - Lane Company. (See Page 8.)
By unanimous consent, Commission agreed to consider
this item later in the meeting as the applicant was not
present.
ITEM #18 ~ Northeast Pollution Control Facility -
Temporary transportation of sanitary sewa~e from Tracts 55,
56, 60, and 67, Countryside.
These tracts in Countryside are under development. The
Northeast Treatment Plant will increase its capacity in
approximately 3 months, but the force main connecting these
tracts to the plant will take approximately 9 months to com-
plete. U.S. Home requests to be allowed to transport sewage
from these tracts to the City's Marshall Street Plant until
the City can provide them with on-line service.
Commissioner DeBlaker questioned the time frame and
expressed concerns about odor and overflow. She felt
services should be in before development begins.
Max Battle, City Engineer, reported there should be no
problem with transporting sewage. Delays in construction
of the Hermitage lift station and force main necessitate the
transporting.
Comlnissioner Nunamaker moved to approve and allow U.S.
Home to transport sanitary sewage from Tracts 55, 56, 60. and
67 until all facilities are completed to Marshall St. Pollution
Control Facility, subject to the submittal of a bond by U.S.
Home to assure that the transport of the sanitary sewage be
continued until additional capacity is available, with the
City to have ultimate control and the City Manager instructed
to take immediate action if a problem arises. Commissioner
Moore seconded the motion. Upon the vote being taken, Com-
missioners Nunamaker, Moore, and Tenney and the Mayor voted
"Aye"; Commissioner DeBlaker voted "Nay." Motion carried.
Odor, Grease,

Problems with sanitary sewer odor, grease, and deteriora-
tion have existed for some time at the Clearwater Beach
Sanitary Sewer System. A preliminary test program by the
Griffin Pollution Control Corporation has provided positive
,improvement and a contTact has been drawn to continue the
program. '

Commissioner Tenney moved to approve the lease/main- .
tenance contract agreement with the Griffin Pollution Control
Corporation, in the amount of $16,470 a year for pollution
control equipment in the Clearwater Beach sanitary sewer
system, and to approve payment of charges for 4 existing
units utilized in B test program from April 15 through
September l5, 1979, in the amount of $5,125, and that the
appropriate officials be authorized to execute same,.
Commissioner Moore seconded the motion which carried
unanimously.
ITEM H20 - Regional Housing Initiatives Program.
(Coordination Agreement,- with TBRPC)
A special technical assistance planning funds grant has
been offered to the Tampa Bay Regional Planning Council to
establish a program to assist Community Development Block
Grant recipients and housing agencies in improving the utili-
zation of Section 8 housing funds and the coordination of
housing services in the region.
The grant requires each municipal government and housing
agency in the region to agree to participate in the develop-
ment of this program with no financial obligation. It will
be an opportunity for local governments to work together.
Commissioner Tenney moved to authorize the City Manager,
to enter into a Coordination Agreement with the Tampa Bay
Regional Planning Council to participate in the development
of a Regional Housing Initiatives Program, and that the
appropriate officials be authorized to execute same. Commis-
sioner Nunamaker seconded the motion which carried unanimously.
ITEM #21 - A Two-Dollar Surcharge on Certain Permits
and Services Rendered by Police Department. Resolution

An increased fee is necessary to recover the actual cost
of the issuance of certain permits and services from $3 to $5.
Commissioner Tenney moved to pass and adopt Resolution
179-76 and to authorize the appropriate officials to execute
same. Commissioner Moore seconded the motion. -Upon roll call
the vote was:

LeCher.

ITEM #22 - Agreement with Mainstem Corporation.
The Mainstem fleet maintenance management system has
been used by the City since 1911 maintaining historical data
on City equipment.,

Agreement for Fleet Maintenance Management System Services
with Mainstem Corporation for one year with an option to
renew and to authorize the appropriate officials to execute

ITEM '23 - Clearwater Housing Authority w Land Acquisi-
tion. -
-
The City Commission approved at a'prior meeting con-
tinued action by the Clearwater Housing Authority to acquire
a site for an elderly housing project adjacent to Barbee
Towers, providing that regulatory procedures established by
HUD were adhered to and that HUD concurred that the site
was acceptable for this type of housing project. The eHA
is in the process of obtaining a second appraisal on the '
property, which is only one of many steps required to complete
the acquisition procedure.
Commissioner DeBlaker moved to approve obtaining a
second appraisal on the property, but that the CHA suspend
acquisition of additional land adjoining Barbee Towers,
"until the cost of repairs to Barbee Towers and a source of
funds have been determined. Commissioner Tenney seconded
the motion. The Mayor reported contact with HUD revealed
they have no funds to finance the repairs to Barbee Towers
in this budget year. Motion carried unanimously.
ITEM #24 - Verbal Reports and Other Pending Matters.
(See Page 9.)
Commission returned to Item 17.
The property contains 30.9 acres, is zoned CP (commercial
parkway) and is located on the northwest corner of Enterprise
Road and U.S. 19. The Preliminary Site Plan propose~ 16
buildings (14 I-story and 2 2-story) containing 256,000 square
feet. Of this total, 138,000 square feet are designated for
office use, and 100,OOO for retail/commercial. The balance
of 18,000 square feet is comprised of 5,000 for a bank,
4,500 for a savings and loan institution, and 8,500 for
restaurant use and the developer requests this be considered
in the residential/office category.
The Resource Development Committee recommends the Pre-
liminary Site Plan not be approved as the maximum permitted
square footage of commercial use has not been met. The Plan-
ning Department is concerned about the number of buildings
and prefers more multiple-story buildings to reduce the
extensive lot coverage.
The applicant has declined to meet the conditions stipu-
lated by the RDC and requested to be heard by the Commission.
David Healey, Planning Director, reported that U.S. Home
(the original owner of the property) agreed not to exceed
100,OOO square feet of commercial use on this property.
Additional commercial development would have required a
developmental regional impact study. l~hen the property was
sold to Lane Co., the agreement included a restriction of
100,000 square feet for commercial use.
Commissioner DeBlaker expTessed concerns for the build-
ing sites on the plan and access to U.S. 19. She also noted
that D.O.T. plans two overpasses in the future.

William Gilkey, attorney reprosenting the developers,
quoted sections of the Zoning Code and requested banks and
restaurants be placed in an office category and not be con-
o sidered part of the commercial development.
The City Manager suggested the applicant and U.S. Home
reach an agreement between themselves and U.S. Home delete
18,000 square feet of commercial from one of their other
tracts in the area.
Jerry Sheets of the Lane Company, agreed to revise the
site plan as recommended by the RDC if the City will assist
in getting an interpretation from the State on the classi-
fication for the three buildings in question.
Commissioner Tenney moved to continue this item to
September 20, 1979. Commissioner Nunamaker seconded the
motion which carried unanimously.
ITEM #24 - Verbal Reports and Other Pending Matters.
The City Manager reported the new dredge has been
delivered and is being assembled.
Commission proceeded to City Attorney Reports.
The City Attorney presented Ordinance Hl925 for second
reading and stated he would read by title only unless there
was a request to read in its entirety. The ordinance was
read by title only. .
The Planning Director reported the RM-28 zone that had
been discussed for CTF-24 zoning did not comprise the required
four acres and the entire block would have to be rezoned to
meet the requirement. There are two motels in the area,
which would exceed the permitted density. The alternative
is to consider rezoning property to the east to arrive at the
4-acres. This property lies between Third and Fifth Streets
and Harnden, COTonado, and Brightwater Drives.
Commission discussed various configurations to arrive
at a 4-acre site.
Commissioner Nunamaker moved to defeat Ordinance Hl925.
Commissioner Moore seconded the motion. Frank Morrow expressed
concerns that the defeat of the rezoning ordinance would affect
other areas of the Beach and there would be overdevelopment.
Commissioner DeBlaker moved to amend the motion as follows:

Nunamaker refused to accept the amendment to his motion. Upon

Public Hearings
ITEM #25 - A Public Hearing on Lot Clearing Violations,
List 1/6.
Complaints of lots needing to be cleared have been in-
vestigated by the Sanitation Division and owners were notified
by certified mail to clear the property within lO days or a
public hearing would be held to authorize clearance.
List #6 with 7 property owners who failed to clear
their property within the 10 days was presented.
City Inspector Willard Stewart stated the lots remaining
to be cleared constitute a menace to public health, safety,
and welfare.
Commissioner DeBlaker moved to authorize clearance of
the properties in violation of Ordinance Hl894, and billings
of the property owners for costs and/or administrative charges.
Commissioner Nunamaker seconded the motion. There were no
objections. Motion carried unanimously.
A site plan has not been received with this application
and Commissioner DeBlaker moved to continue this item until
September 20, 1979. Commissioner Nunamaker seconded the
motion which carried unanimously.

Year 1979/80.
. The City Manager, reporting on the Operating and Capital
Improvement Budgets, stated the primary issue is a tax millage
increase of .686 mills and a recommendation that a specific
I-mill be allocated for road and drainage improvement projects
on a long-range basis. The. l-mill allocation should make
approximately $l,500,OOO available for road and drainage
improvement projects. Maintenance of facilities has been

The only proposed fee increase which is included in the
Goneral Fund is an increase in the golf course fees at Glen
Oaks. He will De recommending increases in various user
fees for recreation, library, etc. He noted the CBTA Program
will be phased out 9/30/79, and has requested a number of the
positions be converted to permanent status.
Citizens speaking on the budgets included Dick Friel and
Ralph Roberts, both in opposition to the increased Glen Oaks
golf course fees. Seven citizens requested drainage and road
improvements. The City Engineer reported the permitting
process causes many delays.
Commissioner DeBlaker moved to pass and adopt Resolution
'79-77, requesting the Department of Environmental Regulat10ns
to ex~eaite the permit process, and to authorize the appropriate
offic1als to execute same. Commissioner Nunamaker seconded '
the motion. Upon Toll call the vote was:
"Ayes": DeBlaker, Moore, Nunamaker, Tenney, and
LeCher.
"Nays": None.
Rita Canan spoke in opposition to a tax millage increase.
Commissioner DeBlaker presented a budget memo dated 9/6/79,
with suggestions for Commission consideration before adoption
of the 1979/80 Budget.
Commissioner DeB1aker left at 2:l5 p.m. to appear in court.
For the Operating Budget, she suggested approval of only
20 new positions, and a decrease in capital equipment purchases.
For the Capital Improvements Budget, she suggested a bond
issue for a branch library and for parkland. a bond issue for
other projects at a later date; reallocate $10,000 to "Down-
town Park Improvementstl; and add the Mandalay Marina in the
CIP Budget.
Commissioner Nunamaker spoke in opposition to a millage
increase. He suggested deletion of the Druid Road extension,
the widening of Missouri Avenue, the high-rise fire truck,
and supported a 1% Operating Budget cut, and an increase in the
golf course fees. The approximate savings would be $750,000.
Commissioner Tenney recommended a 5% overall cut and
opposed a tax millage increase.
Commissioner Moore suggested reducing just the Operating
Budget in the amount of $450,000.
The City Manager reported an impasse in labor negotiations
with the Police, and that the City will have to find the funds
for cost~of-1iving increases. None of the three employee
unions has reached an agreement at this time.
The'Mayor suggested facilities be included in the budget
for Coachman and Crest Lake Parks. He spoke in support of
the l-mill road and drainage improvement.

Discussion ensued on attendance by board members and setting
of policy. Commission requested the Mayor send a letter to
the board requesting improvement in attendance. Motion
carried unanimously.
ITEM *35 - Citizens to be Heard Re Items Not On the Agenda.
The Reverend William McCarty of the Sunset Point Baptist
Church, requested the City correct erosion in a drainage ditch
on their property near Sunset Point Road. The ditch was
originally along the center line of the easement~ but erosion
has caused it to encroach on their property. The City Engineer
reported it is the property owner's responsibility to shore
up his property. The City Attorney will write a memo speci-
fying the City's responsibility on erosion in easements.
Winifred Neudeck asked for clarification of the action
taken on Ordinance ff192S (South Clearwater Beach Rezoning).
He plans to construct a gift shop, whi~h is not a permitted
use in an RM-28 zone. Discussion ensued and the Planning
Director was asked to present alternatives to the Commission.

ITEM '29 - A Public Hearing on the Capital Improvements
Budget for Fiscal Year 1979/80.
Commissioner Nunamaker moved to delete the following
from the Capital Improvements Budget: Druid Road, $89,000;
Missouri Avenue Right-of-Way, $285,000; and High-Rise Fire
Truck, $30,000; and to reduce the Street Resurfacing by
$50,000; for a total of $454,000. Commissioner Tenney'
seconded the motion. Commissioner Nunamaker stated the in-
tent of the motion was to retain the present millage with no
increase. Upon the vote being taken, Commissioners Tenney
and Nunamaker voted "Aye"; Commissioners DeBlaker and Moore
and the Mayor voted "Nay." Motion failed.
Commissioner DeB1aker moved to approve a $2,000,000
projected bond issue for 1980/81 - $1.200,000 to construct
a full-service branch library in the eastern section of
Clearwater and $800,000 for the purchase of parkland. Com-
missioner Tenney seconded the motion which carried unanimously.
Commissioner DeBlakeT moved to project a 1983/84 bond
issue for all other projected projects. Commissioner Moore
seconded the motion which carried unanimously.
Commissioner DeBlaker moved to transfer the $lO,OOO
allocation for Playground Apparatus to Downtown Park Improve-
ments. Motion died for lack of a second.
Commissioner DeBlaker moved to include in the CIP Budget:
the Mandalay Marina Bulkhead 'and the Mandalay Marina in the
Budget Appropriations for 1979/80, with the fund source to be
"Marina Borrowing.t1 Commissioner Nunamaker seconded the motion.

Commissioner DeBlaker moved to place a monetary cap of
$275,000 on new personnel in the budget. Motion died for
lack of a second.
Commissioner Moore moved to place a monetary cap of
$325,000 on new positions and personnel. Commissioner DeBlaker
seconded the motion. Upon the vote being taken, Commissioner
Moore and the Mayor voted "Aye"; Commissioners DeBlaker,
Nunamaker, and Tenney voted "Nay." Motion failed.
Commissioner DeBlaker moved to place a $300 000 cap on
new positions and to decrease Capital Equipment $150,000.
Commissioner Moore seconded the motion. Upon the vote being
taken, Commissioners DeBlakerand Moore and the Mayor voted
"Aye." Commissioners Nunamaker and Tenney voted "Nay,"
Motion carried.
Commissioner Tenney moved to establish a special card
for use at Glen Oaks golf course to allow those 18 yeaTS or
under and 60 years or older to play year-round at a fee of
$50. Commissioner Moore seconded the motion. Upon the vote
being taken, Commissioner Tenney voted "Aye"; Commissioners
DeBlaker, Moore, and Nunamaker and the Mayor voted "Nay."
Motion failed.
Commissioner DeBlaker moved to delete $38,9ll Projected
Additional Revenue from the Operating Budget. Commissioner
Nunamaker seconded the motion which carried unanimously.
Commissioner DeBlaker moved,to transfer into a contingency
fund, approximately $373,064 (the balances in the Personnel
and New Equipment Accounts). Commissioner Moore seconded the
motion. Upon the vote being taken, Commissioners DeBlaker
and Nunamaker and the Mayor voted "Aye"; Commissioners Moore
and Tenney voted "Nay." Motion carried.
Commissioner DeBlaker moved to transfer $38,911 from the
contingency fund to the Golf Course Fund. Commissioner Tenney
seconded the motion which carried unanimously.
Discussion ensued on the various fee and rate increases.
Commission requested the suggested increases come back at a
later date.
Commissioner DeBlaker moved to approve the budget, as
amended. Commissioner Moore seconded the motion. Upon the
vote being taken, Commissioners DeBlaker and Moore and the
Mayor voted "Aye"; Commissioners Nunamaker and Tenney voted
HNay." Motion carried.

The City Manager and the Commission commended all who
worked on the budget.
The Mayor allowed a citizen to speak. Kenneth Zablocki
requested the Commission require a wall between his property
(a motel) and a restaurant on the Beach, to eliminate a noise
problem from the restaurant parking lot. The City Manager'
stated the City has no authority to require such a wall, but
can make a request to the restaurant owner (Vanech).
Commission recessed from 5:15 p.m. to 5:30 p.m.
Commission returned to Item #36.
Commission discussed recision of the action taken on
Ordinance #1925. The Planning Director reported they had
three options: l) Change the Code to require less than 4
acres; 2) Change the zoning to CTF-28; or 3) Create a CTF-24
district of 4 acres. The City Attorney advised the Commission
to consider only that each citizen has reasonable use of his
property.

Discussion ensued on the computation of pensions. .
Jeffrey Butler, Assistant City Manager, reported the fire-
fighters receive a'lump'sum settlement for unused vacation
and holiday time, as a condition of their,union contract.
Pensions are figured on an average of the pastSMyears'
earnings. In the other pension plans, the employees are
paid out ,through the date of their unused vacation, so in
effect, the firemen are receiving additional benefits
because of the lump sum settlement and their pension is
figured on more than the average of 5-years. This has.
been in effect since October, 1977.
Julian Hunt stated he would accept the pension if it
is approved, but requested the right to come back at a
future date for clarification.
The advisory board of the pension funds will be asked
to examine their policies and Mr. Butler will report on the
other approved pensions that this ruling would affect since
October, 1977.
Commissioner Nunamaker moved to grant service connected
disability pension to Julian E. Hunt, Firefighter, Fire
Department, effective August 21, 1979, in the monthly amount of
$1,178.15 with adjustment to be made and changes brought
back if necessary. Commissioner DeBlaker seconded the
motion which carried unanimously.
