The City Commission of the City of, Clearwater met' in
regular session at the City Hall, Thursday, June 2l, 1979,
at 9:30 a.m., with the following members present: ,

ITEM 14 - Service Awards.
Service pins were awarded to five City employees.
William Widner, Kenneth Hovance, Jr., and William E.
Sheppard, Firemen, were awarded Certificates of Merit from
the American Red Cross for life-saving action during a cardiac
arrest emergency.
ITEM 85 - Minutes.

Commissioner Tenney moved to approve the minutes of the
regular meeting of June 7, 1979, as recorded and. as submitted
in written summation by the Clerk to each Commissioner. Motion
w~s seconded by Commissioner DeBlaker and carried unanimously.
ITEM #6 - Self-Insurance Program.
E. W. Siver & Associates, Inc., the C~tyfs insurance
consultants, recommend adoption of a self-insurance retention
program coordinated with excess insurance to cover possible
losses ~n excess of the self-insurance retention, including
catastrophic,.lo~ses. . .

Workers' Compensation with a first year premium of $78,113.
Commissioner Tenney moved to approve the recommendation
of E. W. Siver & Associates, Inc., City of Clearwater insurance
consultants. Commissioner Moore seconded the motion which
carried unanimously.
ITEM #7 ~ Consent Agenda:
7.1 Change Orders:
a. #l (Final), Mosell Acres Sanitary Sewers, to adjust
bid quantities to actual quantities, increasing
Purcell Excavating, Inc. contract $32.40 for a
total present contract of $14,084.40. .
b. #3, Twelve-Inch Cutter Dredge, for providing and
installing corrosion protection system, increasing
DredgeMasters International, Inc. contract $l,ll5.25
for a total present contract of $330.640.25. Funds
for this Change Order to be transferred from Fund
Source Bridge Bonds; Code 334~1-270l, Dredge Clear-
water Pass.
7.2 Notification of Expiration of Advisory Board Member -

Commissioner Tenney moved to accept the Final Consent
Agenda as presented to the Commission, and to authorize the
appropriate officials to execute same. Commissioner Moore
seconded the motion which carried unanimously.
ITEM #8 - Northeast Treatment Plant Sewer Units.
The Building Permit Review Committee has issued all the
single-family sewage treatment units allocated to them,and
recommendstransfer of seven units from another category leaving
a balance in that category of eight units. The design capacity
of the Northeast Treatment Plant has been reached and when
all buildings are':completed that have been authorized the flow
will reach the maximum capacity of one million gallons. The
Plant is currently running at 700,000 gallons a day. There
is an approximate six-months time lag between the time
builidng permits are issued and the flow reaching the treat-
ment plant.
ihe new eight million gallon sewage treatment plant is
essentially complete and should be operable by August 15, 1979,
with three tanks. Because of the time lag in actual flow
to construction permits, and because the new Plant is nearly
ready to gOt Staff recommends appToval of an allocation of
additional units in the Northeast Plant area.so that building
construction can continue until the new plant is on line.
'Commissioner DeBlaker moved to approve the reallocation
of seven units and to add an additional 120 single~family units
and 60 'other units to the sewer allocation for the Northeast
Sewage Treatment Plant and that any building permits issued
for sewage connections in this excess over design capacity

treatment capacity is available. Commissioner Moore seconded
the motion which carried unan~mously.
ITEM '9 - Downtown Sign Program.
The City Manager reported receipt of a letter from
Bronson Thayer requesting a continuance.
Commissioner Tenney moved to continue the item to July
5, 1979. Commissioner Moore seconded the motion which carried
unanimously.
ITEM HlO-City Hall Parking Lot.
The City Manager requested a continuance on this item
as the parking bond ordinance is being researched.
Commissioner Tenney moved to continue this item. Com-
missioner Moore 'seconded the motion which carried unanimously.
ITEM #11 - Mandalay Playfield-Alternative Plan.
The City Manager reported the Parks and Recreation Depart-
ment, in response to a request, has prepared an alternate site
plan which would include 30 additional parking spaces along
Mandalay Avenue.
Commissioner Tenney moved to reaffirm the original intent
of the City Commission to develop the property as a playfield.
Commissioner DeBlaker seconded the motion which carried unanimously.
ITEM Nl2 - Ten Seasonal Sanitation Workers.
The available manpower in the Sanitation Division is
reduced during the summer months because of vacations and
an increased workload generated by the handling of
additional grass and hedge clippings. The use of seasonal
employees augments the permanent staff and is cost effective.
Commissioner DeBlaker moved to approve the employment of
ten seasonal sanitation workers during the summer months of
1979. Commissioner Moore seconded the motion which carried
unanimously.

ITEM #13 - Pinel1as Sports Authority.
This authority was created by the Legislature of the
State of Florida in July. 1977, to determine the feasibility
of developing a comprehensive sports and recreation complex for
Pinellas County and to plan, construct and operate such a facility.
Cecil Englebert, who has completed a partial term of
two years, requests reappointment as the City of Clearwater's
representative.
Commissioner Tenney offered his services as a representative
of the City.
Commissioner DeBlaker moved to appoint-Commissioner
Tenney to a four-year membership on the Pinellas Sports
Authority. Commissioner Moore seconded the motion which
carried unanimously.

ITEM *14 - Bid for Equipment Rental.
Commissioner Tenney moved upon the recommendation of the
City Manager to award contract to Campbell Paving Company for
rental of l-yard Dragline at $26.00 per hour, 8-yard dump
trucks at $10.00 per hour, and 14-yard dumptrucks at $18.00
per hour, which is the lowest responsive and most responsible
bid, and to authorize the appropriate officials to execute
said contract (not to exceed $40,300.00), which shall be in
accordance with specifications and bid. Motion was seconded
by Commissioner DeBlaker and carried unanimously.
ITEM #15 - Verbal Reports and Other Pend~ng Matters.
The City Manager requested Fire Station #4 be designated
the "Cultural Arts Workshop," for the purpose of advertising.
Commissioner DeBlaker moved to designate Fire Station #4
to he known as the "Clearwater Cultural Arts Workshop."
Commissioner Moore seconded the motion which carried unanimously.
The City Manager reported on a request by the Florida
Motion Picture and Advertising Company for a temporary permit
to erect a dock on Clearwater Beach for advertising purposes.
The City Manager reported he would be on vacation the
week of July 2, 1979.
He announced he would report to the Commission on the
special arbitration with the firemen, later today.

ITEM #25 - Second Reading, Ordinance #1896 - Amendin~
Chapter 3 of Code re Alrcraft, to Provide Curfew Restrict~ons
on Take Offs and Landings.
Commissioner DeB1aker moved to amend Ordinance H1896 as
follows:
I. Delete the sixth WHEREAS clause on Page 1.
2. On Page 2, after the third WHEREAS clause, insert the
following:
"WHEREAS, the lease admits of a proprietary interest
in the City of Clearwaterto determine operation of the
air park in a manner consistent with the public interest;
and
WHEREAS, the Circuit Court in the case of Clearwater
'Golf'Park, Inc. v. City of Clearwater, Circuit Civil
No. 74-5779-16, has determined that Clearwater Golf
Park, Inc. did contract away its opportunity to con-
duct'night operations at the air park facility; and"
,3. On Page 2, amend the~4th WHEREAS clause to read
as follows: .
tlWHEREAS, Clearwater. Golf Park, Inc. I through
amendment to its lease arrangement, agreed that
"no night flying shall be allowed from said'runway
without the pri~r.written consent of the City

4. On Page 2 of Ordinance No. 1896, after the seventh
WHERBAS, insert:
"WHEREAS, Clearwater Golf Park, Inc., lessee under
the lease, by letter dated March 8, 1978, advised
the City of Clearwater that it had no responsibility
with respect to flights from the air park and would
not respond 'to the lawsuit, and that such responsi-
bility rested with the City;"
5. Change title of Section 3-2.1 Cd) to read:
Violation of Neise level limit Curfew.
6. Add a new WHEREAS clause at the top of Page 3 to
read as follows:
HWHEREAS, the Federal Aviation Administration has
reviewed proposed Ordinance No. 1896 and has deter-
mined that it is not inconsistent with or preempted
by Federal Statutes and Regulations governing the
navigation of aircraft and aircraft noise; andtt
7. Amend the last WHEREAS clause on Page 3 and delete
the words nthe lack of a beacon and"
8. Amend Section 3-2.1 (b) to substitute t1Curfew"
in the title for "Noise Level Limit"

Upon the vote being taken, Commissioners DeBlaker and
Tenney and the Mayo 1. voted "Aye"; Commissioner Moore voted
"Nay. " Motion carried. "
The City Attorney presented Ordinance #1896, as amended,
for second reading and stated he would read by title only
unless there was a request to read in its entirety. The
Ordinance was read by title only. Commissioner DeBlaker
moved to pass and adopt Ordinance #1896, as amended, on
second and final reading and to authorize the appropriate offi~~
cials to execute same. Commissioner Tenney seconded the motion.
For the benefit of the citizens present, Commissioner
DeBlaker stated the amendments clarify the wording to be very
specific as to the prior agreement by the Airpark. The ordi-
nance provides for the official sunrise and sunset hours to
be followed and provides an hour leeway for take offs 8np landings.
Discussion ensued on limiting the time for take offs, which
cause a greater noise problem than landings and on lights
for the runways;
Commissioner, DeBlaker moved to further amend Section
3-2.1 (b) to read as follows:
uCurfew . No aircraft shall be permitted to take off at
Clearwater Airpark during the time between one hour
after official sunset and 7:00 a.m. the fOllowing day.
and no aircraft shall be permitted to land at Clearwater
,Airpark during the time between 9:00 p.m. and 7:00 a.m.

Agreement for approval to allow U.S. Home Corporation to
excavate a drainage ditch to serve Tract 5, Countryside,
. in Sections l8 and 19-2B-16.

ITBM ~21 ~ Public Hearings on South Greenwood Rezonings,
Phase I.
The area under consideration for City~initiated rezon1ngs
is south of Lakeview and north of Bel1eair Roads, between
Missouri and South Fort Harrison Avenues.
The Planning Director reported the properties in the
South Greenwood Area that are not zoned commensurate with
actual or most appropriate usage and the Comprehensive Land
Use Plan, have been recommended for rezoning. The public
has been notified by individual notice and a post office affi~
davit to that effect is on file. There are approximately
600 acres involved with 1,700 parcels. The area is pre-
dominantly residential and urban in nature and the 1972
Land Use, Plan was used as a guide for the rezonings.
The Neighborhood Housing Services is making rehabilitation
loans in the area and approximately $2,000,000 in Community
Development Block Grant Funds have been used to improve the
area over the past five years. Three neighborhood meetings
were held requesting citizen input for use in the rezoning
proposals.
Jack Gilbert, chairman of the Neighborhood Housing Ser-
vices, Inc., spoke in support of the changes and stated it '
w~uld preserve the residential character of the neighborhood.

ITEMS #22 and 23 - A Public Hearing and First Reading"
Ordinance ~1925-Amending Zoning Atlas - South Clearwater
Beach, P.H. 1/18/79.
, Six citizens spoke in support of the rezoning~ citing
density and traffic congestion. A comparison report was re-
ceived for the record on the amount of taxes paid by various
units and lots on the beach.
" Nine citizens spok~ in objection, requesting the zoning
remain as it is. A petition with approximately 400 signatures
in opposition was presented for the record.
The Planning Director reported CTF-28 zoning allows
42 units and 80 feet height and CTF-24 zoning allows'36
units and 40 feet height. The CTF-24 zoning addressed the
off-street parking requirements, service facilities and
access and egress to and from the Beach.
He stated the 1975 rezoning from ~1.S4A to CTF-28 was
City-wide and not just in the South Clearwater Beach area.
The Florida Statutes require zoning be used to implement
a comprehensive plan, with the plan and zoning consistent,
and such zoning is required to further implement such plan.
The rezoning more nearly reflects the City's Comprehensive
Plan and better reflects the current development character-
istics. The South Clearwatex.Beach area, because of its
geographic 10cation~ configuration and limited means of ingress
ahd egress has limited capability for movement of traffic.
The limited land area and its location dictate measures de-
signed to preclude overutilization to the,'detriment of all '
Clearwater citizens.
Commissioner Tenney moved that Ordinance #1925 be read
and considered by title only on the first reading by the
unanimous .consent of theCommission. Motion was seconded by

ITBM #24 - Citizens to be Heard re Items Not on the Agenda.
James Gray suggested better communication between the
citizens and the City on rezoning matters.
Prank Morrow stated the property owners' rights should
not override the rights of the community as a whole.
Doris Stein requested dedication of Belmont Park and
commended the Commission for their patience during this long
public hearing.
Don'Gonce, vice-president of Clearwater Yellow Cab Company,
requested Commission approval to sell the business. The Code
of Ordinances requires Commission approval for the sale of
taxi permits. Commissioner DeBlaker moved to authorize the
City Manager to investigate the request and to proceed if it
is in order. Commissioner Moore seconded .the motion which
carried unanimously.
Angela Merkle presented a petition with 30 signatures
requesting the Commission take action to stop the
speeding on Lincoln Avenue north of Drew Street.
The City Manager reported the International Association
of Fire Fighters had accepted a 4 1/2% pay increase effective
October 1, 1978, and unless the Commission instructed otherwise,
he would also accept the compromise offer. Commission consensus
was to approve the settlement.
