The Hayor called the meeting to order. The Pledge of
Allegiance was led by Chief Daniels. The invocation was
given by the Reverend Richard Johnston of Friendship United
Methodist Church.

A Certificate of Appreciation was presented Richard
Lindquist in appreciation of his work on the Mobile Home Park
Board.
A Proclamation was issued declaring June 9, 1979,

Eight service pins were awarded to City employees.
The City Mannger presented the "Golden 100 Awards" to
Wells Brown, for honorable mention, and Floyd Carter, for

. ITEM 1# 7 w' Request .for' Prop'o'sa1 . (RFP) for Cable' Televi-
Slon SerVlces.
. Cable Television Information CenteT, the City'S consultant,
., has ,provided a Request for Proposal for cable television
services for Clearwater. The RFP and the franchise ordinance
were. reviewed by the City Commission and discussed with the
con~ultant at the June 4, 1979, work session.

Commissioner Nunamaker moved to nuthorize the City
Manager to solicit bids from cable operators for cable tele-
vision services for Clearwater, and that the franchise ordinance
include authorization for the City Commission to regulate
rates. Commissioner DeBlakcr seconded the motion which
carried unanimously.
A llcatlon-
The project was initiated by the Clearwater Personnel
Department and the Cities of Tampa and St. Petersburg, and
Hillsborough and Pinellas Counties joined in the project funded
by an IPA Grant in 1979. Advances have been made but much
work remains to be done.
The City is requesting a $42,080 IPA Grant. Clearwater's
matching in-kind contribution will be $8,416, with the other
governments participating with a like matching .inwkind contri-
bution.
Commissioner DeBlaker moved to pass and adop~ Resolution
#79-48 and to authorize the appropriate officials to execute
same. Commissioner Moore seconded the motion. Upon roll call
the vote was:

ITEM #9 w Neighborhood Housing Services Rehabilitation
Loan Contract.
The City had agreed to grant $250,000 to the local NHS,
upon its establishment, to capitalize its Revolving Loan Fund.
The funds were to be provided by $75,000 from fauth-year
Community Development Block Grant Funds, Bnd $175,000 from
fifthwyear Block Grant Funds when available.
A Housing Rehabilitation Loan Contract between NHS and
the City has been drafted with Section VIII, Suspension or
Termination, Paragraph 2, added at the request df the City
Commission. The agreement deliniates the responsibility under
the grant and sets forth the uses far which these funds may
be expended.
Commissioner DeBlaker moved to approve the revised
Housing Rehabilitation Loan Contract and to authorize the
appropriate ~fficials to execute same. Commissioner Nunamaker
seconded the motion which carried unanimously.

The lot was offered to the City for $19,000 and wixl
allow expansion of the Motor Pool.
Discussion ensued on the use of this lot and future

Commissioner Nunamaker moved to authorize the purchase
of Lot 10, Block G Plaza Park Subdivision, for 0 total '
purchase price of 119,000; nnd to authorize the appropriate
officials to execute same. Commissioner DeBlnker seconded
the motion. Upon the vote being taken, Commissioners DeBlaker,
Nunamaker and Moore and the Mayor voted "Aye"; Commissioner
Tenney voted "Nay." Motion carried.
ITEM #11 - Request for Alcoholic Beverage Zoning to
Permit the Sale of Beer for Consumption on Premises, Block
Z, Stores 2e, ZD and Z, Gulf-to-Bay Shopping Plaza. Sunshine
Snack Bar, 515 S. Belcher Road'. (Portion of the NW 1/4 of
the SW 1/4 of Section 18-29w16. Joseph P. Menolascino.
Commissioner Tenney moved to approve the request and
to instruct the City Attorney to prepare an amendment to
the beverage ordinance. Commissioner DeBlaker seconded the
motion which carried unanimously.

The City Players have requested use of the fire station
for construction and storage of scenery and props. Other
groups will also use the facility. Parking is more than ade~
quate for the needs and no building, or remodeling will be
necessary. '
The Parks and Recreation Department recommends approval.
Commissioner DeBlaker moved to assign the surplus City
fire station building at 1776 Drew Street to the Parks and
Recreation Department to be used fOT cultural activities and
craft classes, and to authorize the City Manager to initiate
action to rezone the remaining portion'of the property to
mf-8 (single-family, duplex/apartment) preparatory to its
eventual sale. Commissioner Moore seconded the motion which
carried ,unanimously.
Two offers have been received for this property which
was declared surplus by the City Commission on December 7,
1978. In addition to the three lots, a portion of the former
SCLRR right-of-way is included in the package.
Jayford Developments, Ltd., Trustee, had no representative
present and declined to purchase until Mr. Jayford returned
from a trip. '
Robert Binder, was present and stated'he Elanned to remodel
,the building for office use and had deposited $14,700 as
, earnest money.

ITEM "14 - Public Auction.
Items of City-owned personal property have been declared
surplus to the needs of City departments. The property is
mostly obsolete, unserviceable, beyond economical repair. or
junk. The Police Department has also a'cquircd items which
have gone unclaimed through its lost and found department.
Commissioner Tenney moved to authorize the sale of
miscellaneous items of surplus personal property with a
combined market value estimated to exceed $5.000 to the
highest bidders at a public auction to be held at the City
Hall Annex, 10 South Missouri Avenue in Clearwater,' beginning
at 9 a.m., June 16, 1979. Commissioner Nunamaker seconded
the motion which carried unanimously.
ITEM #15 - First Reading, Ordinance #1946 w Amendin~
Chapter 7, Buildings; Residency Requirements, Contractor s
Board of Examiners (Section 7-13) and Board of Roofing Examiw,
ners (Section 7-99).
City residence is required for all members of the Con-
tractor's Board of Examiners and the Board of Roofing Exami-
ners. It has become more and more difficult to find qualified
candidates who have their residence \'lithin the City limits.
The proposed amendment would require each board member
to have either resided or had a principal place of. business
in the City of Clearwater for at least 2 years.
The Building Director recommends approval.

The City Manager repo~ted ~he major change in the 1978/79
budget was transfer of excess funds in the Utility Fund, into
a major rehabilitation program. He requested the balance of
new positions be reinstated.

Midyear Review but instructed the City Manager to request
Commission approval for.each new'position. Commissioner
Nunamaker seconded the motion which carried unanimously. .

ITEM #19 - Request for Use of Public Beach Area-
Windsurfer Regatta. .
A portion of the public beach area will be preempted
to hold The Windsurfer Class World Championships during the
week of September 29th on Clearwater Beach with several hun-
dred competitors expected. Section 6-10 of the City Code
prohibits operation of any type watercraft within 300 feet
of any public beach o\ined by the City and City Commission
approval is required for this variance.
Mark Robinson will provide insurance coverage and security
arrangements as needed and required by the City.
Commissioner Tenney moved to approve the requested
variance and to authorize the appropriate officials to exew
cute same. Commissioner Moore seconded the motion which carried
unRnimously.
ITEM H20 - Land Acquisition for Elderly Housing. -
Lots 1-7, Block Bw2; Lots 1-6 & 15-20, Block B-4; Lots 1-6 less

, The Clearwater Housing Authority requests approval of
the site they have selected for construction of an elderly
housing project. The site will serve a dual function by
providing space for the construction of a drainage detention
area to serve the Stevenson Creek Drainage Basin. The two~
. acre ponding area could yield sufficient fill material to
':elevate other portions of the site to aid in construction
of housing units as proposed.

Officials of HUD visited the sito located in Maryland
Subdivision. south of Turnor. west of Missouri, north of
nruid, and east of South Greenwood nnd will submit an eval-
uation.
The City Engineer stated borings had been made and the
site will be usable if the fill material is compact~d.
Commissioner Nunamaker moved to accept the recommendation
of tho Clearwater Housing Authority nnd approve the site
subject to approval by the Department of Housing and Urban
Development. Commissioner DeBlaker seconded the motion which
carried unanimously.
ITEM "21 . Repair of Barbee Towers.
The Clearwater Housing Authority application for a
special grant of Modernization Funds to repair Barbee Towers
was rejected. The eHA has $50,000 that can be utilized for
this purpose and is asking the City to provide $80,000.
toward the estimated costs of $130,000. The funds could be
borrowed from the South Greenwood Street and Utilities Impove-
ment Project fund. However. a reallocation of this nature
will require a necessary follow up amendment to existing and
proposed applications and a public hearing.
Commissioner DeBlaker recommended contingency funds
be used and other projects be preserved.
Commissioner Tenney moved to direct staff to initiate
action to reallooate necessary funds from the fourth-year
Community Development Block Grant Program to assist the
Clearwater Housing Authority in waterproofing the exterior
of Barbee Towers~ and in repairing damages resulting from
water leakage. Commissioner Nunamaker seconded the motion
which carried unanimOUSly.
ITEM #22 - Downtown Sign Program.
The Mayor reported Bronson Thayer. Director of the
Downtown Development Board, had requested a continuation until
later in the meeting as he had an appointment in St. Petersburg.
Commissioner DeBalker moved to continue the item until
later in the meeting. Commissioner Moore seconded the motion
which carried unanimously. (See page 12.) . . .
An agreement between Pinellas County and the City has
been drawn and agree~ upon to exchange street maintenance
responsibilities. State law established the Functional Classi-
fication of streets to provide for maintenance responsibilities.
Commissioner Tenney moved to exchange street maintenance
whereby Pinellas County will maintain the entire length of
Nursery Road from US 19 to Highland Avenue and the City of
Clearwater will maintain Highland Avenue from Union Street
to GUlf-to-Bay Boulevard. and that the appropriate officials
be authorized to execute same. Commissioner DeBlaker seconded
the motion which carried unanimously.

amendment carried unanimously.
Upon the vote being taken on the amended motion, it

Commissioner DeBlnker moved upon the recommendation of
the City Manager to award contract for Item 28-g to Quaid
Fence Builders, Inc. in the amount of $5,355.00, which is
the lowest responsive and responsible bid, and to authorize
the appropriate officials to execute said contract which shall
be in accordance with the plans, specifications and bids.
Motion was seconded by Commissioner Nunamaker. Upon the
vote being taken, Commissioners Nunamaker, DeBlaker and
Moore and Mayor LeCher voted "Aye"; Commissioner Tenney
voted "Nay". Motion carried.

ITEM #29 - Summer Youth Artists Program.
A Summer Youth Artists Program has been recommended for
students, age 16 through 25. The applications will be pro-
cessed by the Board of Street Artists Examiners, but no license
will be required as it will be considered a Parks and Recrea-
tion program. Works of art would be displayed in spaces
not utilized by the professional artists and the Street
Artists Program will be enhanced by the extra activity generated.
Commissioner DeBlaker moved to authorize a Summer Youth
Artists Program and to authorize the City Manager to vary the
Program's rules for a period of six months. Commissioner
Nunamaker seconded the motion which carried unanimously.

ITEM R34 - Public HearinRs on ZoninR; Appeals:
a. Sand Key Proportios, Inc., fo~ variance to
permit occupancy of motor home for security
purposes on tract of land west of Gulf Boule-
vard in the SW 1/4 of Section 17-29-15 and
the NW 1/4 of Section 20-29-15. Landmark

The Board of Adjustment and Appeal on Zoning denied the
request April 12, 1979.
Christopher Kallivokas, Construction Coordinator, reviewed
the history of the facility which is partially constructed
and under litigation. A security service has been used but
concerns for the safety of children playing in the area prompted
a need for a resident security guard. He presented photos
of the area and letters from the Harbour Light Towers Asso-
ciation in support of the request. He estimated the project
would take ten months to complete.
Considerable discussion ensued an Section 35.09, Sub-
paragraphs 4 and 5 of the Code, which states that mobile
homes may be lived in only in a mobile home park. The City
Attorney stated the City Manager has the right to allow a
temporary use under Chapter 23-4.
Commissioner Moore moved to deny the request and uphold
the 'decision of the Board of Adjustment and Appeal on Zoning,
but to instruct the City Manager to work out a temporary per-
mit. Commissioner DeBlaker seconded the motion. No one
spoke in objection. Motion carried unanimously.
b. R. A. Coker, for a special exception to permit
temporary storage of automobiles (no repairing)
and approval of screen planting on Lot 6
P.C. Wells Subdivision, located at 1540 South
Myrtle Avenue and zoned CG (general business).
The Board of Adjustment and Appeal on Zoning denied the
request on May la, 1979.
The City Manager reported receipt of a petition with
15 signatures in opposition.
David Healey, Planning Director, stated the area is resi-
dential in nature and funds are about to be expended to
improve the area.
R.A. Coker, the applicant, stated the ~roperty is fenced

Lois Cormier and Jack Gilbert) Neighborhood Housing
Services Director, spoke in opposition because the property
is in the target area for rehabilitation.
Charles Pinton spoke in opposition citing poor mainte-
nance of storage yards.
Les Barnes, owner of the lots on the north and south
sides, spoke in support and stated no trees had been removed
and there is no fire hazard from the storing of automobiles
on the property.
In rebuttal, Mr. Coker stated he would keep the grass
cut. He has only owned the property for four months.
Commissioner Nunamaker moved to grant the request for a
special exception for one year) ,that the grass be cut in an
acceptable manner, and a SCTeen'OT hedge be placed on the west
(rear) property line. Commissioner Moore seconded the motion.
Upon the vote being taken, Commissioners Nunamaker and Moore
and the Mayor voted "Aye"; Commissioners DeB1aker and Tenney
voted "Nay." The decision of the Board of Adjustment and
Appeal on Zoning was upheld as it requires four affirmative
votes to approve a special exception.

questing dedication of Belmont Park. .
Bonnie Harding reported on mullet fishi~g in the Bay
and requested it be restricted.

Crown Liquor Lou~ge on South ~fissouri' Avenue.
Lois Cormier requested rezoning notices be sent by first
class mail instead of permit mail.
Lewis Dawley of the Kapok Trailer Park, commended the City for
flood control work.

on July 1, 1979, a special work session for discussion will
be held on June 18, 1979, at 9 a.m., before the regular work

Max Battle, City Engineer, reported a request to vacate
a 2-foot easement in Sun Tree Estates. The builder erred
in an effort to save n tree and encroached upon the easement.
The vacation request will be presented at the next meeting
at a public hearing, but in order to allow the builder to
continue, a consensus of the Commission was requested.
The consensus was that the item would probably be approved
at the next regular meeting.

Right-of-Way Iring between S 1/2 of Block 8 and Lot 11, Block
4, Wallace Addltion to Clearwater.
By memo of May 23, 1979, the City Attorney expressed
concerns for paragraphs 8 and 12 of the lease. The City
Manager reported on suggested amendments for the t~o para-
graphs.
George Greer, attorney for the lessee, stated several
of the changes are housekeeping items and the lease had not
been drawn until after the Commission approved the project.
Commission requested a recess to read the lease at
2:30 and reconvened at 2:45 p.m.
The City Manager recommended paragraphs 8 and 12 read
as. follows:

'~. The Lessee hereby covenants and agrees to make no
unlawful, improper or offensive use of said premises, not to
assign this lease nor sublet all or any portion of the demised
premises without written consent of the Lessor. The require-
ment set forth herein relating to assignment of this lease
and subletting of the premises shall relate to the real property
which is the subject matter of the lease, and shall not be
construed to require the Lessee to obtain City Commission approval
prior to leasing any portion or all of the building being placed
on the premisesih Further, nothing cont~ined herein shall
preclude the assignment of this lease to a partnership consisting
of Michael Tagare11e Construction Inc., Michael Tagarelli
and H. H. McCormick or any combination thereof. The Lessee
hereby covenants and agrees to pay the rental promptly on

12. The Lessee hereby convenants to pay all bills for

Florida Department of Transportation of their proposed intent
to grant approval for a heliport site just west of Belcher

was from George Hunt for permission to operate a private
heliport, with operations limited to approximately twenty
flights .a month.
Discussion ensued on whether or not residents of the
area had been properly notified.
