01/18/1979 CITY COMMISSION MEETING January 18, 1979 The City Commission of the City of Clearwater met in regular session at the City Hall, Thursday, January 18i 1979, at 9:30 a.m., with the following members present: Charles F. ITEM #7 - Artist-in-Residence Program. Sallie Parks presented a report and slides on the Artist- in-Residence Program. This committee is a functional element of the Community Development Block Grant Program. Three representatives from each target area and three members at large are to be appointed. Commissioner DeBlaker moved to approve the request for beverage zoning and to instruct the City Attorney to prepare an amendment to the Beverage Zoning Ordinance. Commissioner Tenney seconded the motion which carried unanimously. ITEM X10 -• Bid Specifications - Former Marina Service Station art o Lots 12 and 13, City--_Park Subdivision. Bid specifications and a lease agreement have been pre- pared to advertise for bids on City property known as the former Chevron Service Station at the City Marina. Commission discussed acceptance of a lower bid as out- lined in Paragraph 3A - Lease Bid Specifications, and evalua- ting the desirability and potential of the business. Commissioner Tenney moved to approve the bid specfications and lease agreement and to direct the City Manager to advertise for bids. Commissioner Nunamaker seconded the motion which car- ried unanimously. ITEM 011 - Annual Requirements for Pro ane. This is one of several open-end contracts being reviewed by the Purchasing Agent. The contract was approved in 1971 to provide the Utility Department with a reliable supply of pro- pane gas for commercial customers and the need continues to exist. Commissioner Tenney moved to award a contract to purchase approximately 108,000.gallons of propane 0.2457 cents per gal- lon from Warren Petroleum Company, Tampa, during the period 1/1/79 to 9/30/79 for a total estimated price of $28,000.00 and to authorize the appropriate officials to execute same. Commissioner DeBlaker seconded the motion which carried unani- mously. ITEM #12 - Preliminary Site Plan Reviews: a. Countryside Tract 36 in the S 1/2 of Section . - U.S. Home Corporation. The parcel contains 13.83 acres adjacent to the Executive Golf Course. The plan indicates development to a density of 10.92 dwelling units per acre, with 151 condominium units in 27 one and two-story buildings. The Resource Development Committee and the Planning Director recommend approval. Commissioner Tenney moved to approve the Tract 36 Pre- liminary Site Plan. The development is located on Sand Kay just north of the City Limits of Bollcair Beach and oast of Gulf Boulevard. Two 7-story buildings with 64 total dwelling units are planned. The Resource Development Committee and the Planning Direc- tor recommend approval. Commissioner Nunamaker moved to approve the Preliminary Site Plan as shown and discussed. Commissioner Tenney sec- onded the motion which carried unanimously. ITEM #13 - Park Dedication of Tract A and Money in Lieu of Remainder. arter Oaks Su xv sion, NE 1/4 o Section 1-4V-15 - Ulu development company. The Preliminary Subdivision Plat was approved subject to approval of a road plan and monetary donation and park dedica- tion. The road plan has been approved by the Traffic Depart- ment and approval of this item will satisfy the second require- ment. The subdivision is on the east side of Hercules Avenue south of Union Street. Commissioner DeBlaker moved to accept the deed for park dedication of Tract A, together with $5,975 in lieu of remainder of portion required, and to instruct the City Clerk to record the deed in the Public Records of Pinellas County. Commissioner Nunamaker seconded the motion which carried unanimously. ITEM #14 - Poll Workers and Com ensation, Munici al Election, February 13, 1979. The City Charter requires Commission approval for poll workers for City elections. Commissioner Nunamaker moved to approve the attached list of poll workers, the compensation of $40 for clerics and $30 for inspectors, and an additional $5 for attendance at the required poll workers instruction class. Commissioner DeBlaker seconded the motion which carried unanimously. ITEM #l5 - Regulated Opening of Clearwater Pass Bridge - Resolution - Requesting oast Guard to revise an implement new regulations to govern the drawbridge located at' Clearwater Pass. The city commission, by a prior resolution, had requested the Coast Guard adopt and implement special drawbridge regula- tions which would have required installation of a digital dis- play time clock system. Information subsequently received indicates excessive maintenance with this type of timing equip- ment. The Coast Guard has evaluated statistical data on vessel and vehicular traffic and has indicated that usage of the bridge appears to merit a regulated opening at fixed 15-minute inter- vals, which would not require a display-type timing device. The Marine Advisory Board, Harbormaster and Traffic Engin-eer recommend adoption'of the 15-minute intervals on Saturdays, Sundays and holidays between the hours of Noon and 7 p.m., with no.requirement for a timing device. Commissioner Nunamaker moved to pass and adopt Resolution 079-2, amending the City's previous request to the U.S. Coast Guard for special drawbridge regulations for Clearwater Pass Bridge, and to authorize the appropriate officials to execute same. Commissioner Tenney seconded the motion. Upon roll call the vote was: "Ayes": DeBlaker, Nunamaker, Tenney and Lecher. "Nays": None. Absent: Martin. ITEM #16 - Computerized Traffic Signal System Contracts. The City is currently installing a computerized traffic signal system. Improved software has been developed and the Federal Highway Administration will grant $25,000 toward the cost of incorporationg this software into Clearwater's system. The remaining cost of $21,300 must be borne by the City. The new software will allow more positive control of actua- ted controllers, implementation of timing changes while the sys- tem is operating, and the ability to attempt to restart equipment which has failed to respond to computer commands. Commissioner Nunamaker opposed the purchase as being too costly for the budget. Commissioner Tenney moved to approve a contract with the Federal Highway Administration and an amendment to an existing contract with Kimley-Horn and Computran, and to authorize the appropriate officials to execute same. Commissioner DeBlaker seconded the motion. Upon the vote being taken, Commissioners DeBlaker and Tenney and the Mayor voted "Aye"; Commissioner Nunamaker voted "Nay." Motion carried. ITEM #17 - Westinghouse Pum Motor - Price Increase of $1,075.00. Bi : Westinghouse ectric Supply Company, Tampa - $15,325.00 Total. Only one bid was received when the sealed bids were opened and, because of this, the bidding process and specifications were reanalyzed by staff prior.to requesting Commission approval on this purchase. The delayed submission of the request re- sulted in Westinghouse not accepting the order because there had been a price increase since their original bid was submitted. Westinghouse is the only source for this particular item and the City Manager recommends approval. Commissioner Tenney moved to authorize a $1,075.00 increase in purchase price of pump motor and to award contract to Westing- house Electric Supply Company, Tampa, Florida--the sole source of supply for this item, with purchase price increased to $15,325.00, and to authorize the appropriate officials to execute said contract which shall be in accordance with the specifications and bid. Commissioner DeBlaker seconded the motion which carried unani- mously. ITBI #18 - Main Library-Renovation/Construction Design. A Consultant Selection Committee approved a list of archi- tectural/engineering firms to be proposed for the Main Library Renovation/Construction Design Project. The Committee rated the firms on previous experience in designing libraries, renovating existing structures, extensive structural design, and contract supervision; plus experience and depth of the proposed dose n team; anticipated work load of the firm; experience in working with grant-fundod projects; and the quality, function, and aesthetics of some of their past designs. Commissioner DeBlaker moved to approve the following list of architectural/engineering firms: IJ Watson and Company, 2) Williams and Walker, 3) Henderson, Ames, $ Bortles, Commissioner Tenney seconded the motion. The City Manager reviewed the'Con- sultants Negotiation Act. Upon the vote being taken, Commis- sioners DeBlaker and Tenney voted "Aye"; Commissioners Nunamaker and the Mayor voted "Nay." Motion failed. Commissioner Nunamaker moved to continue this item until later in the meeting, Commissioner DeBlaker seconded the motion which carried unanimously. (Continued on Page 10). ITEM #19 - Bids: By unanimous consent, the Commission agreed to consider the bids collectively. a. Laundry and Dry Cleaning Services, 3 bids, low bid, Sanitary Cleaners and Laundry, Clearwater, $13,837.85. b. Three 4-door sedans, 4 bids, low bid, Clearwater American Auto Sales, Inc., Clearwater, $13,766.55. c. Bay Front Tennis Courts Replacement Contract, 2 bids, low bid, Big K Construction Company, Clearwater, $47,360.00. Commissioner Tenney moved upon the recommendation of the City Manager to award contracts for the above items to the bidders in the amounts indicated above, which are the lowest and best responsible bids, and to authorize the appropriate officials to execute said contracts which shall be in accordance with the plans, specifications and bids. Motion was seconded by Commissioner DeBlaker and carried unanimously. ITEM #20„- Verbal Reports and Other Pendinfi_Matters. The City Manager reported the PACT Committee had requested a meeting with the City Commission at a special work session to discuss legal documents for lease of the property, operation and financing. A special work session will be held January 22, 1979, at 9 a.m. in the Commission Chamber. (Continued on page 10). The projects include Utility and Street Improvements, South Greenwood, Phase II; Drainage and Sidewalk Improvements, Condon Gardens; Waterproof and Paint, Barbee Towers; Coin Laundry, Condon Gardens; Housing Rehabilitation Program; Acquisition of Real Property for Low-Income Elderly ('lousing; and Swimming Pool, Condon Gardens/Wood Valley Area. Laurel Dagnon, Executive Director of the Clearwater Housing Authority, stated funds in escrow could be used for waterproofing and painting at Barbee Towers and recommended that this item be deleted from the list. Discussion ensued with citizens participating. Commissioner Martin moved to increase the funding for Utility and Street Improvements in the South Greenwood Area $185,000; Drainage and Sidewalk Improvements in Condon Gardens $2,900; and Condon Gardens Coin Laundry $12,500; the Housing Rehabilitation,Program and the Acquisition of Real Property for Low-Income Elderly Housing to remain as currently funded at $75,000 and $200,000, respectively; and to delete the swimming pool for Condon Gardens/Wood Valley in the amount of $205,000; as priority ranking for the projects and to approve submission of amended applications for the third and fourth program years that reflect these adjustments, and to authorize the appropri- ate officials to execute same. Commissioner Nunamaker seconded the motion. Upon the vote being taken, Commissioners Nunamaker and Martin and the Mayor voted "Aye"; Commissioners DeBlaker and Tenney voted "Nay." Motion carried. The Board of Adjustment and Appeal on Zoning had approved, with conditions, the request of William Nunamaker for a special exception to construct a watchman's apartment in a commercial building at 621 Pinellas Street in an ML (light manufacturing) zone. The four citizens are appealing the decision in accord- ance with Section 35.09, Subparagraph 9, and contend an illegal action was taken and all citizens of Clearwater are adversely affected as Section 35.09, Subparagraph 5, of the Zoning Code prohibits the BAA from granting a special exception for a pro- hibited use. Commissioner Nunamaker requested permission to step down from his Commission seat and stated lie would abstain from voting as he had a conflict of interest. (Memo of voting conflict attached). Robert Hayden, attorney representing Air. Nunamaker, ques- tioned the right of the appellants to appeal as, with one ex- ception, they did not live in the area.
