The City Commission of the City of Clearwater met in
regular session at the City Hall, Thursday, September 21,
1978, at 9:30 a.m., with the following members presentz

The Mayor called the meeting to order. The Pledge of
Allegiance was led by Chief Daniels and the invocation was
given by Rabbi Peter Mehler, Congregation Beth Shalom.
ITEM #3 - Introductions and Awards.
Proclamations were presented declaring Ocotber 22 to 28,
1978, "Fall Fun Festival Days" and the month of October,
,"Trekker Month" (four area residents to present flag in Nepal
on 2~-day trek to Mt. Everest).
Don Olsen, intern in the Budget Office, was presented a
u.S. Savings Bond Drive Award.
ITEM #4 - Service Awards.
Service pins were presented to twenty-six (26) City em-:'
p1oyees.
ITEM #5 - Minutes.

Commissioner Martin moved to approve the minutes of the
regular meeting of September 7,' 1978, as recorded and as sub-
mitted in written summation by the Clerk to each Commissioner.

ITEM #12 - Request of the Downtown Development Board for
an eight month renewal of arrangement with City to operate a
Farmer's Market with the support of the Downtown Clearwater
Association.
Commissioner Martin moved to approve the request to
resume the operation of a'Farmer's Market on City Parking Lot
'9 on Saturday mornings, October 1, 1978,~to May 31, 1979,
to waive license requirements for participants, and the appro-
priate officials be authorized to execute same. Commissioner
Nunamaker seconded the motion which carried unanimously.
ITEM 113 - Request of ,Kiwanis Clubs of Clearwater to
,Conduct,Annual "Kids Day Ce1ebr~tion."

ITEM .14 - Agreements for sanitary Sewer-Annexations.
East ~ of Lot 5, Hanouaekts Subdivision -
Dr. Richard H. 'Carter. .
The property is contiguous to existing city limits but
cannot be annexed because it would create an enclave. It is
designated low~density residential on clearwater's Land Use
Plan, and proposed construction is for storage garages and a
single family rental unit.

subject to approval of thG site plan and that the appropriate
officials be authorized to ,execute same.' Commissioner Tenney
seconded the motion. Upon the vote being taken, Commissioner

b. Lot 161, Clearwater Manor Subdivision - Leon and
Genevieve Poulopou1os.
Property is in the County and does not meet requirements
for annexation. The owner is unable to build without sanitary
sewer.
Commissioner Martin moved to approve the agreement for
sanitary sewer and annexation as requested and that the appro-
priate officials be authorized to execute same. Commissioner,
OeB1aker seconded the motion which carried unanimously.'
ITEM #15 - Request for Alcoholic Beverage Zoning to
Permit Sale of Beer and wine on Premises at 724 Missouri
Avenue South, Lots.ll, l2,and 13, Block 6, Maryland subdivision.

By memo, the Traffic Engineer reported there was adequate
parking at the location.
Commissioner DeBlaker moved to approve the request and
the city attorney instructed to prepare an amendment to the
beverage ordinance. Commissioner Martin seconded the motion
which carried unanimously.
ITEM #16 - Request to Waive Board of Adjustment and
Appeals Filing Fee for Fence Variances on west side of Mary-
mont Playground.
Unimproved street right-of-way between Gilbert Avenue and
Airport Orive abuts the west side of Marymont playground, a
city facility, and is currently being used for ingress and
egress along with parking by individuals who disregard the
rights of property owners west of subject right-Of-way. The
owners want to construct a fence on their east property line
in excess of the 30 inches allowed in the zoning ordinance.
Commissioner Nunamaker moved to waive the fee of $50.00
whereby an application can be made to the Board of Adjustment
and'Appeal on Zoning for a fence height variance. commissioner
Tenney seconded the motion. Upon the vote being taken, Commis-
sioners DeBlaker, Nunamaker, Tenney and the Mayor voted "Aye."
Commissioner Martin voted IINay." Motion carried.

effective methods to meet current and future needs. The City
Manager reported information will be requested for a recommen-
dation on the sales force.
commissioner Martin moved to authorize the city Manager to
advert!.3e "Request For Proposals." Commissioner Tenney seconded
the motion which carried unanimously.
ITEM *la - Preliminary site Plan Reviews:
a. Perkins' Cake and Steak, Inc., Portion of M&B
19-1 in the NW~ of Section 17-29-16 (Continued
from 9/7/78).
The proposed restaurant is to be located at the northeast
corner of U.S. 19 and S.R. 60. William Johnson, attorney re-
presenting the applicant, ,stated the plan had been revised and
the number of parking spaces reduced with additional green area
provided. Discussion ensued on an access easement running east
and west and the elimination of additional parking spaces.
Commissioner Martin moved to approve the revised prelimin-
ary site plan with the revisions as agreed upon to delete an
additional seven parking spaces on the east and to provide four
spaces on the west for the handicapped. Commissioner Tenney
seconded the motion which carried unanimously.
b. Tract 4 Countryside, U.S. Home- Zoned RM-24.
Tract 4 is located south of Northside Drive between U.S.
19 and Countryside Boulevard, and contains 15.5 acres. It is
presently undeveloped with a total of 152 units ,planned at a
density of 9.8 units per acre. The Planning Director recom-
mends approval and reported 233 parking spaces and BO% tree
. coverage on the property. '
Richard McAuliffe, U.S. Home representative, stated they
will replant the trees.
Commissioner Martin moved to approve the preliminary site
plan of Tract 4 Countryside. Commissioner DeBlaker seconded the
motion which carried unanimously.
ITEM #19 - Parks and Recreation Department Use of School
Facilities.

This School Facility Use Lease between the School Board
of Plnellas County, Florida, and the Clearwater.Parks and
Recreation Department is similar to contracts approved in
prior years by the Commission. Funds have been allocated in
the operating budget.
Commissioner Martin moved to approve the School, Facility
Use Lease and, that the appropriate officials be authorized to
execute same. commissioner Tenney seconded the motion which
carried unanimously. .
ITEM.#20 - Preliminary Subdivision Plat Reviews.
a. Tract 55 Countryside, U.S. Home.
The property is located west of Landmark Drive, east of
Countryside Golf Course and contains 54.94 acres. The subdivision'

Negotiatio~s are underway for drainage easements. The
Planning and Zoning Board and the Planning'Pirector recommend

Robert Thornton, represent~tive for U.S. Home, stated there
would be no utility easements at the rear of"theselot.s, all all
utilities will be underground to the front of the. lots~nd the
lots are of sufficient size for,the addition of swimming pools.,
Commissioner Martin moved to approve the preliminary sub-
division plat of Tract 55. Commissioner DeBlaker seconded the
motion which carried unanimously.
b. Tract 56, Unit 1, Countryside, U.S. Home.
This property is located east of Countyside Boulevard
and west of the golf course. The tract contains 74.9 acres,
will be subdivided into 111 lots and is zoned RS-75.
The Planning and Zoning Board and Planning Director
recommend approval.
The Planning Director reported there are six double
frontage lots in this tract and requested an open-split rail
fence be included in the deed restrictions.

, Commissioner DeBlaker moved to approve the preliminary
subdivision plat of Tract 56, Unit 1, subject to the restric-
tions,on the agenda letter and that the deed restrictions in-
clude landscaping and fencing in accordance with the zoning
ordinance for Lota 78 through 84. Commissioner Nunamaker
seconded the motion which carried unanimbusly.
ITEM #21 - Review of preliminary Townhouse Site Plan/
Subdivision Plat for Northwood Villa Townhouse, Tract H,
Northwood Estates (Greenbaum and Associates).
AND
ITEM 122 - Amendment of restrictions, on property referred
to as Tract H, Northwood Estates - located south of C.R. 102,
,halfway between U.S. 19 and McMullen-Booth Road.
The developer plans townhouses on the 16.87 acres of land
with no more than 10 units in one building. The lots will
vary in depth from 127 to 171 feet, and in width from 27 to 42
feet. Commissioner DeBlaker expressed concerns about the en-
vironment which would be affected if the amendment of restric-
tions is approved.
Douglas Roach, representing the developer, stated the
proposed development would consist of 92 units, one-Btory( ,
buildings with individual garages. a total density of 5.4 "1Oi\s
per acre,which is greatly reduced density from the present \\
RM-28 zoning. ',\

Michael Kenton, Acting Chief Planner, spoke in support of \.
the compromise development as it would be aesthetically better"
without highrise development and there would be a minimum 30-
foot setback from the marsh in order to save the trees.
, Max Battle, City Engineer, reported the drainage plan
,meets the requirements, and the lowered density will be
beneficial.
Commission discussed rezoning of the property and suggested,

Commission recessed at 12115 p.m. for lunch and reconvened at
12:45 p.m.
ITEM *28 - A Public Hearing on Lot Mowing Resolution
'78-103, List 18.
The city Attorney explained the purpose of this public
hearing and requested City Inspector Willard stewart report on
the status of lot clearing actions. The city Inspector reported
the lots remaining to be cleared constituted a menace to public
health, safety and welfare. There were no objections.
Commissioner Martin moved that Resolution #78-103, passed
September 7, 1978, be confirmed and made effective as to all
persons and parcels listed thereon, except for those whose lots
have been verified 'as being cleared and those who have paid the
City for the Clearing, and that the proper City officials and
employees be directed to, proceed in accordance with law to
see that the lots 'are cleared. Motion was seconded by Commis-
sioner Nunamaker. Upon roll call the vote was:

The Planning Director presented slides of the areas for
all of the Public Hearing items.
ITEM '29 - A Public Hearing to discuss the removal or
retention of ,the Carlouel Fence iying on the north side of
Juniper Street from the Gulf of Mexico to Lantana Avenue, south
to Aurel street and east to Clearwater Harbor.
Major McClamma replaced Chief Daniels at 1:00 p.m.
William Sterrett and Walter Smith spoke in support of
removal of the fence and presented a petition with 154 signa-
tures requesting the opening of five streets.
Frank Logan and James Close, Chairman of the Carlouel
Garden and Improvement Association, Inc., spoke in support of
retaining the fence and presented a petition with 234 signa-
tures in addition to the petition which was presented in July
with 213 signatures.
Five additional citizens spoke in support of removal and
five for retention of the fence.
Chief Daniels returned at 2:30 p.m.
Commissioner Nunamaker moved that the City Manager develop
the guidelines for a public hearing and present a recommendation
for the street ends to be vacated in order to establish a cul-
de-sac neighbOrhood on the north end of Clearwater Beach. Com-
missioner Martin seconded the motion. Upon the vote being taken,
Commissioners Nunamaker, Martin, Tenney and the Mayor voted
,"Aye." commissioner DeBlaker voted "Nay." Motion carried.
Commissioner Tenney moved to temporarily retain the fence
for the safety, health and welfare of the citizens of the north
end of Clearwater Beach. Commissioner Nunamaker seconded the
motion. Upon the'vote being taken, Commissioners ,Nunamaker,

By unanimous consent the Commission agreed to hear Item
.310.
c. ' Bay Pointe Towerl Co. for a special exception
to construct tennis courts, and a variance to
allow a lO-foot fence on Lots 23, 24 and 25,
Island Estates Unit SA. Located at the north-
west corner of Dolphin Point and Larboard Way
and zoned CTF (commercial/tourist facilities).
The City Manager reported a letter received from william "
Gilkey; attorney representing the Bay Pointe Towers Co., that
their appeal of the decision of the Board of Adjustment and
Appeal on Zoning be dismissed.
Commissioner DeBlaker moved to approve withdrawal of the
appeal request. Commissioner Martin seconded the motion which
carried unanimously.
ITEM #30 - Public Hearings on Requests to Vacate Property:
a. Vacation of alley south of Lot 1, Block 46A,
Mandalay Subdivision, east side of Bruce
Avenue - Ronald Fitzgerald. (Continued from
9/7/78).

This property has been sold to Robert J. Saltz stein and
will be readvertised for a public hearing on October 5, 1978.
Commissioner Martin moved to table this item. commissioner
DeBlaker seconded the motion. There was no one to speak in
objection. Motion carried unanimously.
b. Vacation of Ten-Foot (10') Easement Between
Lotsl96 and 197, Clubhouse Estates of
Countryside, Unit IV, located at 2669-2675
Concorde Court - U.S. Home Corporation.
The property owner will combine Lots 196 and 197, and

shop becaule of noile and traffic and a probable reduction
in their proporty values.
The Clerk reported a petition with 11 signatures opposing

,The prospecti~purchasers have filed letters expressing
interest in this one acre tract. It was determined the first
offer to purChase was received from Frank Kunnen on July 11,
1978, and a need for the property was established.
Commissioner Martin moved to approve the sale to Frank
Kunnen for the amount of $22,000, and that the appropriate
officials be authorized to execute same. Commissioner Tenney
seconded the motion. Commissioner Nunamaker announced a conflict
of interest. Motion carried unanimously.
Commissioner Martin moved that staff negotiate with
Knight and Nisk for other property still available in Indus-
trial Park. Commissioner Tenney seconded the motion which

By unanimous consent the Commission agreed, due to the
