The City Commission of the city of Clearwater met in
regular session at the city Hall, Thursday, September 7, 1978,
at 9:30 a.m., with the following members present:

The Mayor called the meeting to order. The Pledge of
Allegiance was led by Chief Daniels and the invocation was
given by the Reverend Ensley of Peace Memorial Presbyterian
Church.
ITEM #3 - Introductions and Awards.
Carolyn Beard, a sculptor in the Artists-in-Residence
Program, was presented a thousand dollar ($1,000) check.
George Tice, president of the Upper Pinel1as Chapter of
the Red Cross, presented Certificates of Merit to Mike Dillon
and Joseph O'Niell, Clearwater lifeguards, for their heroic
action in saving a life. ·
A proclamation was presented to Chuck Williams, principal
of Clearwater High School, declaring September 7, 1978, Clear-
water High School Day.
A Citation of Appreciation was presented the Clearwater
High school Cheerleaders Squad for being number one for the
fifth time in the International Cheer leading Foundation compe-
tition.
citations of Appreciation were presented to 'Juanita
Anderson and Francis Krame for their service on the Beautifica-
tion Committee.

Commissioner DeBlaker moved that the minutes of the regu-
lar meeting of August 17, 1978, he approved as recorded and as
sUbmitted in'written summation by the Clerk to each Commissioner.

Commissioner DeBlaker moved to approve the items on the
Consent Agenda and to authorize ,the appropriate officials to
execute same. Commissioner Tenney seconded the motion which
carried unanimously.
ITEM #6 - Resolution #7B-103 - Lot Mowing List #8.
Commissioner Martin moved to pass and adopt Resolution
#78-103 and to authorize the appropriate officials to execute
same. Commissioner OeBlaker seconded the motion. upon roll
call the vote was:

ITEM t7, - F~ontage Road on U.S. 19 at Imperial Cove -
Section 20-29-16.
Staff prepared estimates of the cost of developing a
frontage road on the east side of U.S. 19 for Imperial Cove.
Harlan Yerkes reported u.s. Home, developers of the pro-
ject, had agreed to pay the costs of the frontage road.
Commissioner Nunamaker moved to eliminate the accelera-
tion lane from the site plan and to accept the offer of u.s.
Home to pay Imperial Cove for a frontage road, subject to
review by the City Engineer, of the estimated $6,BOO costs. Com-
missioner DeBlaker seconded the motion which carried unanimously.
ITEM #B - Amendment to Agreement with Management Resources,
Inc.
Extensive problems have surfaced and the original agreement
must be amended to allow the consultant to aid the City with
technical assistance and expertise beyond the requirements
provided in the original agreement. An estimated 235 additional
hours of consultant time plus travel expenses for a total of
$lB,075 has been requested.
Commissioner Martin moved to amend the agreement on Page
2, Section I A (3), to delete the word "all". from the fifth
line and add the word "needed." commissioner Nunamalter seconded
the motion which carried unanimously.
Commissioner Martin moved to approve the Amendment Tq,
Agreement, as amended, with Management Resources, Inc., and
that ,the appropriate officials be authorized to execute same.

ITEM '9 - Preliminary site Plan Review - Perkins' Cake &
Steak, Portion of M&B 19-1 in the NW~ of sec~ion 17-29-16.
The proposed restaurant will be located at the northeast
corner of U.S. 19 and S.R. 60 with access from the service
,road and S.R. 60. A nationally registered camphor tree is
located east of this property and the Resource Development
committee recommends a fence be constructed at the city's
expense around the tree to protect it.
Discussion ensued on curb cuts for ingress and egress.
William Johnson, Attorney, advised the Commission of, a recip-
rocal agreement with the adjoining property owner to the east.
Accesscould be provided across that property and down to S.R.
60. Commission expressed concerns about ingress and egress
traffic hazards and too many parking spaces and suggested addi-
tional landscaping.
Commissioner Nunamkaer moved to continue this item to
,September 21, 1978. Commissioner Tenney seconded the motion
which carried unanimously.
ITEM *10 - Community Impact Statement - Sunset Point
Nursing Center (Pt. of M&B II in SE~ of NW~ of Section 1-29-15),
Richard W. Cope, Trustee.
The Resource Development committee recommends approval of
the CIS for a .120-bed nursing center to be located on a 4.4-
acre site at Sunset Point Road and Hercules Avenue.
Commissioner DeBlaker expressed concerns about the cost of
review of ,the C.I.S.
commissioner Martin moved to approve the CIS, only insofar
as it applies to the nursing center facility and without refer-
ence or prejudice to any related land use plan and zoning atlas
'amendment that may be a prerequisite to the use of the property
for nursing center purposes. Commissioner DeBlaker seconded
the motion which carried unanimously.
ITEM ill - Authorization to Sell City Property.
The Gas Division Superintendent has identified a list of
gas distribution supplies as surplus to his needs as polyethy-
lene pipe and fittings are now used for new and replacement gas
service throughout the City.
CornmissionerMartin moved to authorize the sale of surplus
gas distribution supplies currently valued at approximately
$9,000, to the highest bidder via sealed bid procedures in
accordance with Section ISA-l7 of the Clearwater Code of Ordi-
nances, and that the appropriate officials be authorized to
execute same. Commissioner Nunamaker seconded the motion
which carried unanimously.
ITEM Il2 - Appointment of Advisory Board Members:
a. Community Relations Board. (continued from 8/3/78).
'Commissioner Martin moved to continue appointments to the
Community Relations Board to the meeting of October 5, 1978.

b. Housing Board of AdjuBtmentand Appeals.
commissioner DeBlaker moved to reappoint Dr. Joseph Worth
and Carroll Nall, Jr., to the Housing Board of Adjustment and
Appeals. Commissioner Martin seconded the motion which car-
ried unanimously.
,c. Central pinellas Transit Authority.
Commissioner Martin moved to reappoint Commissioner william
Nunamaker to the central Pinellas Transit Authority. Commis-
sioner Tenney seconded the motion which carried unanimously.
d. Clearwater Housing Authority.
Appointmentsto the Clearwater Housing Authority are made
by the Mayor with approval of the Commission. The Mayor will
make his selection and report to the Commission.
e. Library Board.
Commissioner Martin moved to appoint Jim Yacavone to the
Library Board. Commissioner Nunamaker seconded the motion
which carried unanimously.
Commissioner Nunamaker moved to appoint Mrs. Arlyn Hutt
to the Library, Board. Commissioner DeBlaker seconded the motion
which carried unanimously.
f. Mobile Home Park Board.
Commissioner DeB1aker moved to appoint Bruce Brown and
John oty, owners of mobile home parks, to the Mobile Home Park
Board. commissioner Tenney seconded the motion which carried
unanimously.
Commissioner Nunmaker moved to appoint Violet Tassone,
a mobile home park resident, to the Mobile Home Park Board.
Commissioner Martin seconded the motion which carried unani-
mously.
g. State Road 60 Committee.
commissioner DeBlaker moved to appoint Maxine Lovejoy to
the State Road 60 Committee. Commissioner Martin seconded
the motion which carried unanimously.

Commissioner DeBlaker moved to consider the bids collec-
tively by the unanimous consent of the commission.. Commissioner
Tenney seconded the motion which carried unanimously.

Commissioner Martin moved upon the recommendation of the
City Manager to award contracts for the above items to the
,bidders in the amounts indicated above, which are the lowest
responsive and responsible bids, except Item 13-e as indicated,
and to authorize the appropriate officials to execute said con-
tracts which shall be in accordance with the plans, specifications
and bids. Motion was seconded by Commissioner DeBlaker and
carried unanimously.
ITEM #14 - Change Order #2 to Water storage and Pumping
Facility Project, Christopher Construction Company Contract.
This change order incorporates a number of Engineering
Orders to the contractor for additional changes to modify
structures, etc.
Commission discussed the use of plantings and landscaping
of the fenoe instead of installing material to provide privacy
for the property owners and the need for an irrigation system.
commissioner Martin moved to amend the change order to
delete charges for redwood slating in the amount of $2,692.90
and to set a budget for "an amount not to exceed $1,200.00
for buffered landscaping." Commissioner Nunamaker seconded the
motion. Upon the vote being taken, Commissioners Martin,
Nunamaker and the Mayor voted "Aye"; Commissioners DeBlaker
and Tenney voted "Nay." Motion carried.
commissioner Nun~aker moved to approve Change Order No.
2, as amended, to Christopher Construction Company in the
amount of $l4,625.18, to make a new contract total of
$1,483,750.80. Commissioner Martin seconded the motion. Upon
the vote being taken, Commissioners Martin and Nunamaker and
the Mayor voted "Aye"; Commissioners DeBlaker and Tenney
voted "Nay.1I Motion carried.
ITEM #15 - Verbal Reports and other Pending Matters.
The City Manager reported the community Relations Board
would meet 'with the Commission at the regular work session
scheduled for September 18, 1978.
A proposal was submitted for Commission consideration
from the Florida Testing Laboratories, Inc. for soil borings
for the transmission line to run between the East and North-
east Plants. (Continued, See Page 10).
Commission recessed for lunch at 11:40 a.m. and reconvened
at 12:40 p.m.

ITEM *16 - A Public Hearing on Lot Mowing Resolution
#78-93, List #7.
The city Attorney explained the purpose of this public
,hearing and requested City Inspector Willard stewart report
on' the status of lot Clearing actions. The City Inspector
reported the l~ts remaining to be cleared constituted a menace
'to public health,' safety and welfare. There were no objections.

ITEM #17 - A Public Hearing on Adopting Operating Budget
for Fiscal Year 197B/79.

ITEM #19 - A Public Hearing on Adopting Capital Improve-
ment Program and Budget for Fiscal Yenr 1978/79.
Jeff Butler, Assistant City Manager, advised the Commis-
sion the Ta:lpAssessor must be advised of the City' a millage by
October 5, 1978.
Citizens spoke in objection to additional boat slips at
the Mandalay Youth Center and a parking lot in place of the .
Avalon Apartments on Clearwater Beach. They spoke in 8upport
of a'playground or mini-park for Island Estate., funda for
intersections improvements and bike trails. Several oitizens
spoke in support of allocating funds to social agencies and
one spoke against funding Legal Aid.
Commission discussed a millage allocation for road im-
provements and if additional positions were needed.
Commissioner Nunamaker moved to amend the Operating
Budget to allocate no more than $175,000.for additional em-
, ployees until the departments are analyzed on a monthy basis.
Commissioner DeBlaker seconded the motion. Upon the vote
being taken, Commissioner Martin, Nunamaker and the Mayor
voted "Ayetr1 Commissioners DeBlaker and Tenney voted "Nay."
Motion carried.
Commission recessed for ten minutes at 2140 p.m. and
,reconvened at 2:50 p.m.
Commissioner DeBlaker moved to amend the Operating Budget
that,a specific millage allocation for road improvements, inter-
sections; etc. be identified. Commissioner Martin seconded
the motion which carried unanimously.
.Commissioner Martin moved to approve an allocation of
matching,funds for the Visitors' Bureau, not to exceed
$25,000, but to eliminate this allocation if the 2% resort
tax passes, and tO,reduce the COlt of the Phillies Promotional to

Revenue Certificate Sinking Fund by deleting $11,600 for
bleachers at Jack Russell Stadium. Commissioner Nunamaker

account tlpayments to Agencies" to $25,500 with the funds to
be allocated to the various agencies the same as last year.

Commissioner DeBlaker moved to amend the capital Budget
by deleting the purchase of a high-rise fire truck in the
amount of $250,000. Commissioner Nunamaker seconded the mo-
tion which carried unan~ously.
Commissioner DeBlaker moved to amend the Capital Budget
by deleting the $20,000 allocation for conversion of the
Marina. Commissioner Martin seconded the motion which carried
unanimously.
Commissioner DeBlaker moved to amend the Capital Budget
by deleting the $60,000 Avalon Parking Lot allocation. Commis-
sioner Martin seconded the motion which carried unanimOUSly.
, Commissioner DeBlaker moved that $25,000 for Beach park-
ing signs be funded from the Parking Revenue Fund instead of
General Revenue ,for the 1978/79 budget year. Commissioner
Tenney seconded the motion which carried un~nimously.
, Commissioner DeBlaker moved to amend the capital Budget
that $10,000 for landscaping and signs be allocated from the
parking Revenue Fund instead of General Revenue Fund. Commis-
sioner Martin seconded the motion which carried unanimously.
Commissioner Nunamaker moved to amend the Capital Budget
to allocate $10,000 for playground equipment for the Island
Estates recreation area. in 1978/79 from General Revenue.
Commissioner Martin seconded the motion which carried unani-
mously. '
Commissioner Martin moved that the Capital Improvement
Program Budget reflect the $800,000 available for Library
Facilities in the current bUdget and project a General Obli-
gation Bond Issue for a new library in 1981. Commissioner
Nunamaker seconded the motion which carried unanimously.

commissioner Martin moved to amend the Capital Improve-
ment Budget (1978/79) to include Right-of-Way Acquisition for
Druid Road in the amount of $85,742. Commiesioner Tenney
seconded the motion. Upon the vote being taken, Commil.ioner.
Mart.in and Tenney and the Mayor voted "Aye"r Commissioner.
DeBlaker and Nunamaker voted "Nay." Motion carried.
commissioner Martin moved to approve staff discretion
on the transfer of funds between street sealing and/or re-
surfacing as allocated in the Capital Budget. commissioner
Nunamaker seconded the motion which carried unanimously.
Commissioner Martin moved that the Capital Budget re-
flect development of a soccer complex in the amount of
$18,200. Commissioner Tenney seconded the motion which
carried unanimously.
commissioner Martin moved that the Capital Budget re-
flect a reference to purchase of a dredge in the amount of
$500,000. Commissioner Nunamaker seconded the motion which
carried unanimously.
Commissioner Nunamaker moved that the Capital Improvement
Budget include a reference for $800,000 for maintenance, pro-
tection and/or const.ruction of facilities relating to Clear-
water Pass. Commissioner DeBlaker seconded t.he motion which
carried unanimously.
,Commissioner DeBlaker moved to amend the Capital Improve-
ment Program (l980/8l) by deleting the Norton Park Football
and Soccer Fields projected funding from a future General
Obligation Bond Issue. Commissioner Martin seconded the mo-
tion which carried unanimously.
, Commissioner DeBlaker moved to appropriate $55,000 of
the unappropriated surplus in the, utility Fund of the Opera-
ting Budget to replace the anticip~ted revenues of the Sanita-
tion rate increase. Commissioner Nunamaker seconded the
motion. Upon the vote being taken, motion carried unani-

The property has been sold and the new owner requested a
continuance to September 21, 1978, 12:30 p.m. No one spoke
in objection.

ITEM #22 - A Public Hearing to Consider Amending Zoning
Atlas to Rezone the North Greenwood Area, Phase I, properties
listed on Notice of Proposed Enactment of Zoning Ordinance
attached.
Roland Waller, Attorney, requested that Lot 26, Palm
Bluff Subdivision, lst Addition, be deleted from the ordinance
to remain CG (general business) zoning. The Planning Director
will check the legal description of the property and report
to the Commission before the second reading of the ordinance.

ITEM 026 - A Public Hearing on the Zoning Appeal of Paul
Bodden Et Al (Lots 76 through 80, Forest Wood Estates Addi-
tion *1).
The applicants are appealing the decision of the Board
of Adjustment and Appeal on Zoning. The property is located
at 3019-3043 Prestige Drive. The applicants are requesting
permission to build an 8-foot masonry wall at the rear of
their lots which front on Main street (County Road SO). The
Zoning Ordinance permits a 30-inch fence. Five adjoining
property owners have joined together in the request. There
are presently wooden fences erected which are in poor condi-
tion and depreciating appearance. The installation of a
masonry wall along with landscaping will improve the appear-
ance of the property and offer some degree of privacy to the
home owners.
Between the residences and the road level (in most instances),
there is a ,two-to-three-foot drop and this wall will provide
privacy. Slides and a petition of support with l5 signatures
of residents of North Prestige Drive were presented. No one
spoke in objection.
Commissioner Tenney moved to approve the request for a
private engineered wall with the stipulation of landscaping
and subject to plans being reviewed by the City Engineer.
Commissioner Nunamaker seconded the motion which carried unani-
mously.

Rate Increase for the Sale of Natural Gas.

ITEM '46 - Authorizing Execution of Partial Release of
lO-Foot Gas Line Easement in the SW~ of the NE~ of Section
30-28-16 to Herda's steak Hou~e, Inc. (Lot 9, Bell Haven Sub.)

ITEM #47 - Acceptance of Easements:
utilities and Drainage Easement in the
NW~ of the SW~ of Section 18-29-16 -
Edmond R. Henderson.
Commissioner DeBlaker moved to accept the E. Henderson
Basement and to direct the City Clerk to record same in the
Public Records of Pinellas County, Florida. Motion was sec-
onded by Commissioner Tenney and carried unanimously.
Sewer line and storm drain Easement, 20 Feet in Tract A
and lO Feet in Tract B, both in the Countryside Area in
the NW~ of Section 20-28-l6 - Florida Power Corporation.
,conunissioner Martin moved to accept the easement from
'Florida Power Corporation and to direct the City Clerk to re-
cord same in the Public Records of Pinellas county, Florida.
Motion was seconded by Commissio~er Tenney and carried unani-
mously.
ITEM #48 - other Commission Action.
Commissioner Tenney moved to pass and adopt Resolution #78-
108, to support the County's move of the court and jail out of
the City of Clearwater. Motion and resolution died for lack of
a second.
The meeting adjourned at 8:l3 p.m.
The City Commission then met as Trustees of the Pension
Fund with the Mayor calling the meeting to order.
