ITEM #5 - Minutes. Commissioner Nunamaker moved that the minutes of the regular meeting of February 16, 1978, and the special meetings of February 15 and 21, 1978, be approved as recorded and as submitted in written summation by the Clerk to each Commis- sioner. Motion was seconded by Commissioner DeBlaker and.car- ried unanimously. ITEM 16 - Designation of Official to Represent the City of Clearwater on Tour to Nagano City. Commissioner DeBlaker moved that former Mayor Joe Turner be requested to serve as the'official representative of the City. Commissioner Nunamaker seconded the motion. Motion was seconded by Commissioner Frank and carried unanimously. ITEM f8 - Review of Preliminary site Plan of Sambo's Restaurant in the SE~ of Section 19-29-16. (continued from 2/16/78). The site plan for the restaurant to be located on the west side of U.S. 19 shows approximately 280 front feet to be devel- oped while the rear portion will remain undeveloped. . Commission had requested as many trees as possible be preserved. Leonard Wengatron, representative, stated they object to changing the driveway as there is a visibility problem from the highway. There are 32 trees on the property, 25 .will be preserved and six new ones planted, which would mean a loss of only one tree. He presented pictures of the area Which were accepted for the record. . Richard Follett, architect, presented drawings of the overall design showing. parking and circulation, landscaping, and.shade trees.in.the.open area. (Memo of Conflict to be attached), Commissioner Frank moved to accept the Preliminary site Plan of Sambo's Restaurant, identified as CrOBS Section AA, and as submitted to the city under site Plan Sheet C-3 and Tree Survey C-3A. Commissioner Nunamaker seconded the motion. Upon the vote being taken, Commissioners Nunamaker, Frank and Martin and the Mayor voted "Aye", Commissioner DeBlaker voted UNay." Motion carried. ITEM 49 - Farmers Market. The City Commission had authorized a farmers market on City Parking Lot #9 for a test period of six months, conditional on approval of the market's rules and regulations. Commissioner Martin moved to approve the proposed rules for the Farmer's Market as Exhibit A to the Amendment to Memorandum of Understanding. commissioner Fr.ank seconded the motion which carried unanimously. ITEM #10 - 201 Facilities Plan. The City Commission adopted a resolution stating Clearwater would participate in the 201 Facilities Planning Process as required by the Environmental Protection Agency. A policy Coordinating committee and a Technical Advisory Committee must be appointed. The POlicy Coordinating Committee will consist of the three principal agencies which will he operating regional treatment plants (pinellas County, Clearwater and Largo). The Technical Advisory Committee will consist of interested citizens and utilities specialist/technicians. Commissioner Frank moved to appoint the city Manager as:a member and Assistant City Manager Michael Paroby as alternate member to the 201 Facilities Policy Coordinating Committee and to authorize the city Manager to appoint two members of his staff to the Technical Advisory Committee. Co~nissioner Nunamaker seconded the motion which carried unanimously. .\ Commissioner Nunamaker suggested Ed Mazur for consid- eration as a citizen member for the Technical Advisory Committee. ITEM #11 - Site Plan Review of Imperial Cove XIV, in the SE~ of Section 20-29-16. - u.s. Home Corporation. This property is located on the east side of u.S. Highway 19 between Belleair Road and GUlf-to-Bay\Boulevard. Unit XIV will complete the project and will be five stories in height with 32 dwelling units at a density of 17.58 units per acre. The developer has agreed to a 40-foot easement along U.S. 19 and will construct acceleration and deceleration lanes. as required. . Commissioner DoB1aker moved to amend Page 2, Subparagraph (8), line 3, to add the word "front" before "surface of the backrest area"; and to add at the end of the paragraph, "and only with specific approval of the City Commission." Commis- sioner Martin seconded the amendment. Upon roll call the vote was: "Ayes": Cazares, DeBlaker, Frank, Martin and Nunamaker. "NaysII: None. The City Attorney presented Ordinance #1762 for second reading and stated he would read by title only unless there was a request to read in its entirety. The ordinance was read by title only. Commissioner Frank moved to pass and adopt Ordinance #1762, as amended, on second and final reading and to authorize the appropriate officials to execute same. Commis- sioner Nunamaker seconded the motion. Upon roll call ~he vote was: "Ayes": Cazares, Frank and Nunamaker. "Nays": DeBlaker and Martin. Motion carried. ITEM #13 - Clearwater Jaycees Inc. Bench Proposal. The proposed agreement has been revised to comply with the city Code and Charter and also contains revisions submit- ted by the City Commission. Commissioner Frank moved to approve the Clearwater Jaycees proposal, as revised, for advertising on benches, and to authorize the appropriate officials to execute same. Com- missioner Nunamaker seconded the motion. Commissioner DeBlaker stated she has not supported the proposal because it violates the Constitutional provision which prohibits leasing of City property without adequate compensation. John Wyllys of the Sparkling City Jaycees reported they anticipate income of $2,000 to $2,500 per year to be used to continue their public service programs. Upon the vote being taken, Commissioners Nunamaker and Frank and the Mayor voted "Aye"; Commissioners DeBlaker and Martin voted "Nay." Motion carried. ITEM #14 - Authorization to fill new seasonal positions which were approved in the 1977-78 Parks and Recreation Budget. Commissioner DeB1aker moved to continue this item to later in the "meeting as the material requested had not been 'received. Commissioner Martin seconded the motion which car- ,'ried unanimously. ITEM #18 - Quote - Purchase of Bridge Tokens, 3 quotes, low quote, Meyer & Wenthe, Harwood Heights, Illinois, $7,035.00. Due to the May 1, 1978, target date for implementation of the token system at Clearwater Pass Bridge, formal bidding procedures were not inatituted but quotes were.obtained from three different sources. The Harbormaster recommends contract award to Meyer & Wenthe Co. Commissioner Nunamaker moved to award a contract for the purchase of 100,000 bridge tokens to Meyer & Wenthe Company, Harwood Heights, Illinois, for the sum of $7,035.00, which is the lowest and most responsible quote received, and to author- ize the appropriate officials to execute same. Commissioner Frank seconded the motion. Upon the vote being tqken, Commis- sioners DeBlaker and Frank voted If Aye 'I; Commissioners NunamaJcer and Martin voted "Nay." There was no decision and the request is automatically continued to the next meeting. (See ~age 16). ITEM i19 - Verbal Reports and other Pending Matters. The City Manager requested the Commission reconsider Item #14 as additional information was available. He suggested the date of March 27, 1978, at 7 p.m. for the dedica~ion of the branch library at Fire station is. City Attorney Reports ITEM i25 .... Robert Bickerstaffe stated the Citizens to be Heard item is being misused when one item is discussed for 45 minutes. The purpoAe, originally, was to bring up a subject and have it placed on a future agenda. Charles Finton stated the citizens should have unlimited speaking time. Citizens should not be discouraged from filing law suits against the City and,should not have to pay court costs if they sue the City and lose. ITEM #14 - Authorization to fill new seasonal positions which were approved in the 1977-78 Parks and Recreation Budget. The Parks and Recreation Department requests authoriza- tion for additional personnel, approved and included in the 1977-78 Operating Budget. Ream Wilson, Assistant Parks and Recreation Director, submitted a chart of the summer schedule for Norton Pool to the Commission and discussed the programs. He stated the schedule is flexible and can be modified, depending on needs and inter.ests. Commissioner Martin moved to authorize 5 Beach Guards for Norton Park Swimming Pool, that one of the existing Recreation Leaders be upgraded to Recreation Specialist for the Camp '0' states program, and one Recreation Leader be employed for Camp Chaka.
