CITY COMMISSION MEETING
M,arch 2, 1978
The City Commission of the City of Clearwater met in
regular session at the City Hall, Thursday, March 2;- 1978,
at 9130 a.m., with the following members present:

The Mayor called the meeting to. order. The invocation
was given by the Reverend George Harper, Mt. Zion United
Methodist Church. The Pledge of Allegiance was led by Chief
Daniels.
The Mayor pressnted proclamations declaring March 10 to
19, 1978, "Fun In Sun Festival Days'1, . 25.th anhiversa~y of the
Fun 'n Sun Festival; and February 26 through March 6, 1978,
"Special Olympics Booster Week."
ITEM #5 - Minutes.
Commissioner Nunamaker moved that the minutes of the
regular meeting of February 16, 1978, and the special meetings
of February 15 and 21, 1978, be approved as recorded and as
submitted in written summation by the Clerk to each Commis-
sioner. Motion was seconded by Commissioner DeBlaker and.car-
ried unanimously.
ITEM 16 - Designation of Official to Represent the City
of Clearwater on Tour to Nagano City.
Commissioner DeBlaker moved that former Mayor Joe Turner
be requested to serve as the'official representative of the
City. Commissioner Nunamaker seconded the motion. Upon the
vote being taken, Commissioners DeB1aker, Nunamaker, Frank
and Martin voted . II Aye 11; the Mayor voted II Nay. 11 Motion carried.

Commissioner Martin moved to accept all items on the
Consent Agenda for appropriate action and to authorize the
appropriate officials to execute same. Motion was seconded
by Commissioner Frank and carried unanimously.
ITEM f8 - Review of Preliminary site Plan of Sambo's
Restaurant in the SE~ of Section 19-29-16. (continued from
2/16/78).
The site plan for the restaurant to be located on the west
side of U.S. 19 shows approximately 280 front feet to be devel-
oped while the rear portion will remain undeveloped. . Commission
had requested as many trees as possible be preserved.
Leonard Wengatron, representative, stated they object to
changing the driveway as there is a visibility problem from
the highway. There are 32 trees on the property, 25 .will be
preserved and six new ones planted, which would mean a loss of
only one tree. He presented pictures of the area Which were
accepted for the record.
. Richard Follett, architect, presented drawings of the
overall design showing. parking and circulation, landscaping,
and.shade trees.in.the.open area. He'stated it was a workable
. plan ~hat would compleme~t the environment. Discussion en~ued
on preservation and conservation of the environment and the

commissioner Nunamaker reported a possible conflict of
interest as hiD firm may have done work for Sambo's. (Memo
of Conflict to be attached),
Commissioner Frank moved to accept the Preliminary site
Plan of Sambo's Restaurant, identified as CrOBS Section AA,
and as submitted to the city under site Plan Sheet C-3 and
Tree Survey C-3A. Commissioner Nunamaker seconded the motion.
Upon the vote being taken, Commissioners Nunamaker, Frank and
Martin and the Mayor voted "Aye", Commissioner DeBlaker voted
UNay." Motion carried.
ITEM 49 - Farmers Market.
The City Commission had authorized a farmers market on
City Parking Lot #9 for a test period of six months, conditional
on approval of the market's rules and regulations.
Commissioner Martin moved to approve the proposed rules
for the Farmer's Market as Exhibit A to the Amendment to
Memorandum of Understanding. commissioner Fr.ank seconded the
motion which carried unanimously.
ITEM #10 - 201 Facilities Plan.
The City Commission adopted a resolution stating Clearwater
would participate in the 201 Facilities Planning Process as
required by the Environmental Protection Agency. A policy
Coordinating committee and a Technical Advisory Committee must
be appointed. The POlicy Coordinating Committee will consist
of the three principal agencies which will he operating regional
treatment plants (pinellas County, Clearwater and Largo). The
Technical Advisory Committee will consist of interested citizens
and utilities specialist/technicians.
Commissioner Frank moved to appoint the city Manager as:a
member and Assistant City Manager Michael Paroby as alternate
member to the 201 Facilities Policy Coordinating Committee and
to authorize the city Manager to appoint two members of his
staff to the Technical Advisory Committee. Co~nissioner
Nunamaker seconded the motion which carried unanimously.

Commissioner Nunamaker suggested Ed Mazur for consid-
eration as a citizen member for the Technical Advisory Committee.
ITEM #11 - Site Plan Review of Imperial Cove XIV, in the
SE~ of Section 20-29-16. - u.s. Home Corporation.
This property is located on the east side of u.S. Highway
19 between Belleair Road and GUlf-to-Bay\Boulevard.
Unit XIV will complete the project and will be five stories
in height with 32 dwelling units at a density of 17.58 units per
acre. The developer has agreed to a 40-foot easement along U.S.
19 and will construct acceleration and deceleration lanes. as
required. .

ITEM '12 - Second Reading, Ordinance *1762 Amending
Chapter 18, Signs, of~Code, Relating to Bench Signs.
Commissioner DoB1aker moved to amend Page 2, Subparagraph
(8), line 3, to add the word "front" before "surface of the
backrest area"; and to add at the end of the paragraph, "and
only with specific approval of the City Commission." Commis-
sioner Martin seconded the amendment. Upon roll call the vote
was:
"Ayes": Cazares, DeBlaker, Frank, Martin and
Nunamaker.

The City Attorney presented Ordinance #1762 for second
reading and stated he would read by title only unless there
was a request to read in its entirety. The ordinance was read
by title only. Commissioner Frank moved to pass and adopt
Ordinance #1762, as amended, on second and final reading and to
authorize the appropriate officials to execute same. Commis-
sioner Nunamaker seconded the motion. Upon roll call ~he vote
was:

"Nays": DeBlaker and Martin.
Motion carried.
ITEM #13 - Clearwater Jaycees Inc. Bench Proposal.
The proposed agreement has been revised to comply with
the city Code and Charter and also contains revisions submit-
ted by the City Commission.
Commissioner Frank moved to approve the Clearwater
Jaycees proposal, as revised, for advertising on benches, and
to authorize the appropriate officials to execute same. Com-
missioner Nunamaker seconded the motion. Commissioner DeBlaker
stated she has not supported the proposal because it violates
the Constitutional provision which prohibits leasing of City
property without adequate compensation.
John Wyllys of the Sparkling City Jaycees reported they
anticipate income of $2,000 to $2,500 per year to be used to
continue their public service programs.
Upon the vote being taken, Commissioners Nunamaker and
Frank and the Mayor voted "Aye"; Commissioners DeBlaker and
Martin voted "Nay." Motion carried.
ITEM #14 - Authorization to fill new seasonal positions
which were approved in the 1977-78 Parks and Recreation Budget.
Commissioner DeB1aker moved to continue this item to
later in the "meeting as the material requested had not been
'received. Commissioner Martin seconded the motion which car-
,'ried unanimously. (See page 16 ).

Services, Data Processing.

The Mayor recommended Frank H. Morris, Jr. be appointed to

The Mayor recommended Harold J. House be reappointed to
the' Board of Adjusbnent and Appeal on Zoning. commissioner

Central pinellas Transportation Authority.
The Mayor recommended Commissioner Nunamaker be appointed
to the Central pinellas Transportation Authority to replace '

"growth of the area. The Commission expressed concern as ~his
area is not within the City Limits and the City should solve
the problems of its citizens first.
Co~nissioner Martin moved to award a contract for standby"
use one (1) two~phase traffio signal controller and one (1)
,three-phase traffic signal controller, to Transportation Con-
trol System, Tampa, Florida,' for the sum of $5,731.00, which
is the lowest responsive and responsible bid received by the
State of Florida, Departmnnt of General Services in accord-
ance with the plans and specifications'~ and to authorize the
appropriate officials to execute same. Commissioner Frank
second~d the motion which carried unanimously.
commissioner Frank moved that Staff be instructed to
meet with the Florida Department of Transportation and the
County ~o attempt to. Bolve the traffic problem at no cost to
the City. Commissioner Martin seconded the motion which car-
ried unanimously.
ITEM #18 - Quote - Purchase of Bridge Tokens, 3 quotes,
low quote, Meyer & Wenthe, Harwood Heights, Illinois, $7,035.00.
Due to the May 1, 1978, target date for implementation
of the token system at Clearwater Pass Bridge, formal bidding
procedures were not inatituted but quotes were.obtained from
three different sources. The Harbormaster recommends contract
award to Meyer & Wenthe Co.
Commissioner Nunamaker moved to award a contract for the
purchase of 100,000 bridge tokens to Meyer & Wenthe Company,
Harwood Heights, Illinois, for the sum of $7,035.00, which is
the lowest and most responsible quote received, and to author-
ize the appropriate officials to execute same. Commissioner
Frank seconded the motion. Upon the vote being tqken, Commis-
sioners DeBlaker and Frank voted If Aye 'I; Commissioners NunamaJcer
and Martin voted "Nay." There was no decision and the request
is automatically continued to the next meeting. (See ~age 16).
ITEM i19 - Verbal Reports and other Pending Matters.
The City Manager requested the Commission reconsider Item
#14 as additional information was available. He suggested the
date of March 27, 1978, at 7 p.m. for the dedica~ion of the
branch library at Fire station is.
City Attorney Reports
ITEM i25 .... Second Reading, Ordinance fl:1741 - Amending
Chapter 22 of Code to Provide for Sale and Redemption of
Tokens for clearwater Pass Bridge.
By unanimous consent the Commission agreed to continue
this item until later in the meeting. (See Page 17).
ITEM #26 - Second Reading, Ordinance #1757 - Amending
Section 2-70.01 RelatIng to Boards to Provide for Ex Officio
Membership.
The City Attorney presented Ordinance #1757 for second
reading and stated he would read by title only unless there

errors in the ordinance--page 10, Section 3A-9, Subparagraph
(b), the words "the party rejecting the recommendation shall
notify the Board" were omitted and would be the fourth line
from the bottom in the paragraph; on Page 11, Section 3A-lO,
SUbparagraph (d), delete the word "renewal" and replace with
ltremoval."
Charles Glover, Chairman of the Clearwater Mobile Horne
Owners Association, spoke in support of the ordinance as
written and amended and urged passage and adoption.
Robert Struchen, owner and/or manager of a mobile home
park, spoke in oppositon and read into the record a prepared
statement.

He suggested a continuous flow of traffic across the causeway
and suggested a 2S~ round, trip fee for the Clearwater Pass

Lois Cormier discussed train derailments and freight
trainD stopping overnight in Clearwater with dangerous cargos.
She requeoted the City Manager write to Seaboard Coast Line
for their policy on overnight storage, etc.
Howard Groth discussed the zoning violation of recreation
vehi~les in mobile home parks and requested enforcement of the
zoning ordinance. Constance Groth suggested that action be
taken against owners of the mobile home parks.
Robert Bickerstaffe stated the Citizens to be Heard item
is being misused when one item is discussed for 45 minutes.
The purpoAe, originally, was to bring up a subject and have it
placed on a future agenda. Charles Finton stated the citizens
should have unlimited speaking time. Citizens should not be
discouraged from filing law suits against the City and,should
not have to pay court costs if they sue the City and lose.
Commission returned to Item 14, which had been continued
to later in the meeting.
ITEM #14 - Authorization to fill new seasonal positions
which were approved in the 1977-78 Parks and Recreation Budget.
The Parks and Recreation Department requests authoriza-
tion for additional personnel, approved and included in the
1977-78 Operating Budget.
Ream Wilson, Assistant Parks and Recreation Director,
submitted a chart of the summer schedule for Norton Pool to
the Commission and discussed the programs. He stated the
schedule is flexible and can be modified, depending on needs
and inter.ests.
Commissioner Martin moved to authorize 5 Beach Guards
for Norton Park Swimming Pool, that one of the existing
Recreation Leaders be upgraded to Recreation Specialist for
the Camp '0' states program, and one Recreation Leader be
employed for Camp Chaka. Commissioner Frank seconded the mo-
tion which carried unanimously.
ITEM #18 - Quote - Purchase of Bridge Tokens, 3 quotes,
low quote, Meyer & Wenthe, Harwood Heights, Illinois, $7,035.00.
This item had been considered earlier and received a 2-2
vote which automatically continued it to the next meeting.
Bill Burchfield, Harbormaster, responded to Commission
questions and distributed copies of the new design for the
token. Clearwater will use a one-inch token approximately the
size of a quarter.
Commissioner Nunamaker moved that the Commission reconsider
prior action taken on the purchase of bridge tokens. Commis-
sioner. Frank seconded the motion which carried unanimously.
COIrunissioner Nunamaker moved to award a contract for the
purchase of 100,000 bridge tokens to Meyer & Wenthe Company,
Harwood Heights, Illinois, for the sum of $7,035.00, which is
the lowest and most responsible quote received, and to auth-
orize the appropriate officials to execute same. Commissioner
DeBlaker seconded the motion which carried unanimously.

ITEM' 125 - Second Reading, Ordinance 11741 - Amending
Chapter 22 of Code to provide for Sale and Redemption of' Tokens
far Cloarwater Pass Bridge.
The City Manager reviewed the two options available to
the Commiseion and reported the city Engineer, as required
by Ordinance 11701, could certify that 6 tokens for $1 would be
sufficient revenue.
Commissioner DeB1aker moved to amend Ordinance 11741 on
Page 1 in the fourth WHEREAS to read: "WHEREAS, The City
Engineer hereby certifies that this revision in rate structure
will be sufficient in each future year to produce net revenue
equal to 100% of the average annual amount of bond service
requirements which will become due in such years on all out-
standing 1977 bonds" and on Page 2 to amend Section 22-81,
Clearwater Pass Bridge Toll SchedUle, Two-Axle Vehicles (In-
cluding motorcycles and mopeds) - Token System, 6 for $l.no."

Commissioner DeBlaker reported the Metropolitan Planning
Organization had continued its discussion on the new parkway.
She suggested the Commission take action by resolution.
Commissioner Nunamaker requested the status of the City
advisory Board on Aging as the Community Relations Board has

. The Mayor discussed clearwater as the County Seat and the
County court facilities being located in clearwater. Commis-
sioner De Blaker moved to pass and adopt Resolution *78-28,
urging the pinellas County commission to maintain criminal and
civil court facilities in Clearwater and st. Petersburg which
is in' the best interest of the majority of the citi~ens, and
to authorize the appropriate officials to execute same. Commis-
sioner Nunamaker seconded the motion. Upon roll call the vote

The Mayor reviewed the actions of the Commission in the
past year and commended City Manager Tony Shoemaker for his

The City Commission then met as Trustees of the Pension
Fund with the Mayor calling the meeting to order.
ITEM #42 - Trustees of the Employees' Pension Fund.
a. Pension to be Granted.
The City Manager presented the recommendation of the
Advisory Committee of the Employees' Pension Fund to grant an
Employee Retirement Pension under Section 5 of the Employees'
Pension Plan, ~or Ralph J. Brock, Parks and Recreation Depart-
rnent, effective March 14, 1978, in the amount.of $393.61 per
month.
Commissioner Frank moved that the recommendation of the
Advisory Committee be approved. Commissioner Martin seconded
the motion which carried unanimously.
b. Pension Trustees Resolution #78-2.
The City Attorney presented Trustees of the Pension Fund
Resolution #78-2, authorizing the City Treasurer to execute
such documents as are necessary to transfer securities to the
Fund's CustOdian Bank or its nominee.
Commissioner DeBlaker moved to pass and adopt Trustees
Resolution #78-2 and to authorize the appropriate officials
to execute same. Commissioner Nunamaker seconded the motion
which carried unanimously.

ITEM #23 - A Public Hearing to Receive Citizen Recommenda-
tions Regarding Development of the Fourth Year Community Devel-
opment Block Grant Program.
The City Manager reported this is the fourth year for' the'
Community Development Block Grant Program and a number of
neighborhood meetings have been held to inform the community
of this program and to obtain citizen recommendations for pro-
gram activities to be funded. This is the first of four pub-
lic hearings scheduled for the application process. The
purpose of the public hearings is to present citizen recommen-
dations to the Commission for their consideration in formulating
a budget to utilize next year's grant of $846,000. '
