01/16/1978The City Commission of the City of Clearwater met in
special session at the City Hall, Monday, January 16, 1978,
at 11150 a.m., with the following members present:

The Mayor called the meeting to order and the City Mana-
ger read into the record his letter of January 12, 1978,•
Notice of Special Meeting, for the purpose of approval of
the sale/purchase of property for Countryside High School.
A Waiver of Notice of Meeting was signed and presented to
the Clerk for the record.
The City Manager read into the record his recommendation
of approval for the exchange of property and the Memorandum
of Understanding Re Sale and Purchase of Properties for
Countryside High School. The wording in the third paragraph
in the Memorandum of Understanding was changed from "environ-
mental impact statement" to "assessment impact statement."
The Mayor read into the record memo of January 16, 1978,
from the Planning Director, Subject: Economic Impact of
Countryside High School.
Ed Mazur, representing the home owners in the area, pre-
sented a petition with 146 signatures. The petition stated
they were opposed to the land transfer between the City and
the School Board without the following stipulations: 1) A
detailed study of the effect this land transfer would have on
adjoining residences and land owners, 2) A buffer zone
(minimum of 100 feet) to maintain privacy and protect the
surrounding home owners' investments and 3) A detailed evalu-
ation by the City Engineering Department, of the drainage
design to insure future drainage problems would not occur.
Michael Kenton, Environmental Planner, outlined the land
area under consideration.
The City Engineer reported the drainage problem will be
a joint effort of the School Board and the City. Discussion,,
l ensued or access, sewer,easements and traffic problems.
Gus Sakkis, Superintendent of Schools, stated they would
take into consideration the.concerns,of the citizens in the
' area.

Charles Finton auggested as the City's.property`is worth "
more and the City is allowing a IOX'discount, that the;School
Board reciprocate in future land negotiations. ,
Commissioner Frank moved to concur with the attached
Memorandum of Understanding and to authorise the sale 'of a
54-acre tract of City property at the northwest corner of
State Road.•580 and McMullen--Booth Road to the School Board
for the sum of $936,000 and the purchase of a 50-acre tract
of land from the School Board for the sum of $760,000, so that
Countryside High School can be constructed on the City Tract,
legal descriptions described as Attachment "All in the Memo-
randum of Understanding will be attached for the record', and
that the appropriate officials be authorized to e'xecute same.
Commissioner Nunamaker seconded the motion..
Commission discussed the assessment impact information
and requested studies on.traffic and drainage•problems.
Upon the'vote being taken, motion carried unanimously.
Commissioner DeBlaker moved that the additional monic.a
received from-the School'Board in-the transfer of property,
be placed in the-account for 'repurchase of property. Commis-
sioner Frank seconded the motion which carried unanimously.
The meeting was adjourned-at 12:40 p.m.

MEMORANDUM OF UNDERSTAND

RE: SALE AND PURCHASE OF-PR R'TIE5'
FOR COUNTRYSIDE HIGH SCHOOL
This memorandum confirms the following understandings reached In our
recent staff discussions relative to the construction of Countryside High School:
1. The City staff will recommend to the Cleai-water City Commission #hat the
City sell to the Pinellas County School Board a 547-acre tract of land situated at the
. N: W. corner of S. R. 580 and McMullen?-Booth Road (described in Attachment A)
for the sum of $936, 000.00. The Pinellas County School Board staff will
recommend to the School Board that It purchase . the 'City -- - property at
this price.
2. The City staff accepts the condition that the purchase and sale of properties
will be contingent upon determination-of adequacy of the soil conditions at the
city's property to support the school facility. ' This determination to be made
by soil test borings to be-obtained by the School Board.
3. The City agrees to provide an assessment impact statement -of its
property to the School Board.
4. The City will deliver fee simple title and title insurance on this property to
the School Board.
5. The Pinellas County School Board staff will recommend to the School Board
that it sell to the City of Clearwater a 50-acre tract of land situated approxi-
mately 1/2 mile north of the northern end of Landmark Drive, generally one
mile north of S. R, 580 and 1/4 mile west of McMullen-Booth Road (described
in attachment B) for the sum of $760, 000. 00. The City staff will recommend
to the City Commission that it purchase the School Board property at this price.,
b. The School Board staff accepts the condition that the purchase and sale of
properties will be contlnttent upon the School Board undertaking construction of
the Countryside High School on the City parcel by September, 1978.
