The invocation was given by Chief Daniels. The Pledge of Allegiance was led by the Mayor. The City Manager read into the record Special Meeting Notice dated June 22, 1977, and a Waiver of Notice of Meeting was presented to the City Clerk. Two items are on the agenda for discussion. ITEM #1 - Discussion of Status Report of the Bond Elec- tion. " The City Manager reported that on June 22nd, the City had been notified and subsquently a letter dated June 22, 1977, was received from Nugent Walsh, Attorney', stating Sections 24 and 25 of the old Charter had been violated and a proper legal notice for the bond referendum had not been advertised. The City Manager stated he and the City Attorney had reviewed the provisions of the new Charter relating to the election laws and the City is in compliance. However, the recent decision of Judge Driver nullifying the results of tbe February 8th referendum that approved the new charter, complicates the'aat- ter. Section 24 of the old Charter require81~he heading of the notice shall be 'Notice of Bond Issue for Publ.ic Improve- ment' stating when the City Commission adopted the saae. des- cribing in general terms, the improvement, and stating the total amount of bonds to be issued, in wbat denominations, when maturing, when to be dated~ the rate of interest, when and where payable." Section 25 states it "shall be printed in a new~paper of general circulation in tbe municipality, in the body'type of the paper, and under headlines of eighteen point type,~ which is considerably larger type than the ad placed by the ~lty~ I,t: . Commis- sioner Frank seconded the motion. Upon roll call the vote wast "Ayes": Cazares, DeBlaker, Frank, Martin ond Nunamaker. "Nays": None. The City Manager reported the August 9, 1977, date for the new referendum would present few problems. A great deal of interest has been generated in the bond issue ond.he felt the momentum should not be lost. Several dates were suggested but the Commission was advised that the utility billing cycle could be met and the same brochures used with a new cover letter. Rose Phifer spoke in favor of postponing the referendum until early September after the vacationers come back. Rita Garvey requested the Commission set the earliest date possible to keep the momentum going. Commissioner Frank moved that the referendum be rescheduled to August 9, 1977, as recom~ended by the City Manager. Com- missioner Nunamaker seconded the motion. Discussion ensued on the validity of the present absentee ballots and the City At- torney will request an opinion from the Attorney General. Upon roll call the vote was: "Ayesll: Cazares. Frank and Nunamaker. IlNaystl: DeBlaker and Martin. Motion carried. ITEM 12 - Discussion Relocation Policies Regarding Resi- dents at the Site of the Civic-Culture. Center. The City Manager reported on a meeting organized by the NAACP, with residents of the Civic-Culture Center area. There were approximately 2S citizens present. The property owners were concerned about the amount of money they would receive. the availability of mortgage money. and they did not want to move to a housing project such as Condon Gardens. The City's relocation program was explained to the resi- dents, and the availability of mortgage money under the Reha- bilitation Loan Program. A number of objections were voiced at the meeting and another meeting was requested with the Com- mission attending. Talmadge Rutledge, a representative of the NAACP, stated the residents should be compensated for having to move. E. J.
