The Mayor called the meeting to order. The invocation
was given by the Reverend B. K. Han, Church of The Reconeiler.
The Pledge of Allegiance was led by Police Chief Frank Daniela.
ITEM 13 - Introductions and Awards.
The Mayor presented to Pastor and Mrs. Han. a certifi-
cate declaring them honorary citizeno of the City of Clear-
water.
A Proclamation declaring the month of Mayas "Older Ameri-
can Month in Clearwater" was presented to Lee Groth. AARP
representative. and a copy of the Proclamation was presented
to Ingrid Willis of the Neighborly Centers group.
May 9th through the 15th. 1977. was designated "~[uniei-
pal Clerks Weekll and a Proclamation was presented to R. G.
Whitehead. City Clerk.
The Mayor announced Opening Day Ceremonies for the Clear-
water Bombers will be May 6. 1977, at Jack Russell Stadium.
ITEM 14 - Minutes.
Commissioner Frank moved that the minutes of the regular
meeting of April 21. 1977, be approved as recorded and ao aub-
mitted in written summation by the Clerk to each Commissioner~
Commissioner DeBlaker seconded the motion which carried unani-
mously. ,/
The City Manager reported two gift carp kites from the
citizens of Nagano, Japan, are flying on City Hall flagpole
denoting May 5th as the IIDay of the Boy."

The u.s. Coast Guard presently provides search and res-
cue operations in the Clearwater area from a temporary facil-
ity. The City cannot donate property to the Coast Guard, but
by conveying property to the County and receiving real prop-
erty of mmparable value in exchange, a permanent facility
could be built on Sand Key.
Bill Burchfield, Harbormaster, presented a conceptual
layout of the proposed station and site plan. There are two
parcels of land involved, I-A and I-B. Commission questioned
the need for I-B as it cuts off citizen access to the water.
There were no citizen comments.
Commissioner Hartin moved to declare surplus to the im-
mediate needs of the City a parcel of City property on the
bay side of the lower portion of Sand Key, described as Parcel
I-A, for the purpose of conveying this property to Pinellas
County on the condition that Pinellas County agrees to deed
to the City real property of comparable value with clear title
and also agrees to deed the surplus property to the Coast
Guard for a permanent Coast Guard Station site, and said sur-
plus property to revert to the County for public use ohould
the Coaet Guard cease to use it as a permanent station. Com-
mis.ioner DeBlaker seconded the motion.

ITEM '8 - alport - Civic Centar (Blackburn-Phillipa Sit.
in Saetion 16-29-15).
The Itaff raport concerning the feasibility of locating
a civic center on the site proposed by Willia. Blackburn and
Judie Phillips V., di.tributed to the Commi..ion. Warran
Ranandot Acting Planning Director, atated the report a.lu.ld
a need for (1) a 2,OOO-eeat theatre, (2) a 20tOOO .quare feet
flat-floor facility and (3) a total of 1,333 parking .pace.
required by ordinance. It was not possible to use much of
the criteria recommended by the Auditorium Study Committee.
He presented three conceptual examples of how the civic
center might be placed on the site, with a cost range af eeven
to eight million dollars to the City.
Gue Stavros, Chairman of the Auditorium Study Committee,
spoke in opposition as it did not meet the criteria set by
the committee. Frank Morrow, Charles Finton and 3erry Hill
spoke in opposition. Rose Phifer spoke in support of the
Blackburn site.
Co..i8sioner Nunamaker moved that the proposal submitted
by Cliff Erickson, HAl, SRDA, to appraise properties conveyed
to the City by a 8eries of options from William G. Blackburn
be rejected. Commissioner Frank seconded the motion.
Warren Renando and Sam Casellat Senior Planner. mentioned
several disadvantages (inadequate area, insufficient parkins,
overpriced property and 108s of tax base) and one advantage--
helping to rehabilitate the Downtown area.
Upon the vote being taken, motion carried unanimously.

The Commission recessed for lunch and reconvened at 1 p.m.
with Commissioner DeBlaker in the chair.
The Vice-Mayor announced May 5, 1977. has been designated
"Student Government Day" and she introduced those taking part
in the program.
ITEM 15 - Citizens to be Heard re Items Not Appearing on
the Agenda.
Steven Heard, Director of Public Affairs for the Church
of Scientology of Californiat read into the record a letter
dated May 5. 1977, stating they were dismissing their lawsuit
against the Mayor in both his official and private capacity.
Edward Winslow discussed the Chsmber of Commerce use of
a roomt rent free, at the Memorial Civic Center.
The Hayor resumed the chair at 1:10 p.m.

Section 6-10 of the City Code of Ordinances prohibita
windsurfing watercraft from operating within 300 feet of any
public beach and the City Attorney stated the Commi8sion could
not waive the ordinance. ,The City Manager withdrew his recom-
mendation of approval for the request and recommended the re-
quest be denied.
Bill Schricker, representat1veof WOKF/WTAN, clarified
their request by stating they would not conduct the windsurf-
ing competition within 300 feet of the beach, they only wish
to rope off a 100 foot aection for acce.s to the co_petition ar-
ea beyond the 300 foot mark. The competition would actually
take place beyond 300 feet from the beach.
Anne Garris spoke in favor of this new recreation a~tivity.
,Commissioner Martin moved to approve the request to rope
off a 50-foot section of Clearwater Beach to conduct n vind~
surfing competition on Sunday, May 29, 1977, between the hours
of 11 'a... and 4 p.m., subject to approval of the Police Chief.,
Commissioner Frank seconded the motion which carried unanimously.
ITEM '10 - Preliminary Plat Approval. (S~ of S~ of S~
of S~ of Section 20-28-16). Chief Charley's, Inc.
The City Manager withdrew the item.

ITEM III - Mutual Aid Agreement for Fire Protection,
Largo.
Since 1969 the Cities of Clearwater and Largo have had a
Mutual Aid Agreement for Fire Protection. Largo haa recently
acquired an aerial ladder truck and tbe agreement has been
amended to delete hourly charges previously assessed for
Clearwater's truck.
Commissioner Frank moved to approve the Mutual Aid Agree-
ment for Fir~ Protection between the Cities of Largo and
Clearwater, as modified, and that the appropriate officials
be authorized to e~ecute same. Com.issioner DeBlaker'second-
ed the' motion which carried unanimously.

ITEK 113 - Florida Department of Transportation Kainten-
ance Agreement. Resolution 177-42.
The Plorida Department of Transportation proposes to in-
clude a signal installation at Bayshore and Gulf-to-Bay Boule-
varde in the widening project. They have made traffic studies
and determined that a signal is warranted. The City wlllbear
no installation expense but must agree to provide maintenance
(including power costs) when the installation is, completed.
Keith Crawford, Traffic Engineer, reported the City had
not requested the lisht. .
Commissioner Frank moved to reject the propooal of the
Florida n.O.T. Commissioner Martin seconded the motion. '
Commission discussed the proposal and the criteria establisbed
by D.O.T. showing the need. Commissioner Frank withdrew his
motion.
Commissioner Nunamaker moved to paos and adopt Resolution
'77-42, authorizing the City of Clearwater to enter into a
traffic signal maintenance agreement with the State of Florida
Department of Transportation, and to authorize the appropriate
officials to execute same. Commissioner DeBloker seconded
the motion. Upon roll call the vote was:

"Nays": Martin.
ITEM 114 - Appointments of Advisory Board Me~ber8.
The City Manager noted that Ordinance 11664 relating to
Advisory Boards had been adopted and he asked for direction
for a number of citizens who serve on more than one board.
Commission agreed to diB~uss this at the next work seosion.
A rough draft of the letter from the Mayor to the Chair-
men of the Advisory Boards Was distributed and discussed.

The Mayor recommended Wilby Anderson be reappointed.
Commiasioner Martin moved to reappoint Wilby Anderson to the
Library Board. Commissioner Frank seconded the motion which

Change Order 14, Final. Island Estates Interceptor,
Pump Station and Force Main (CL 7335-2), Big Four
Construction Company of West Palm Beach, Inc._ Con-
tractor. (+$648.47).
Commissioner DeBlaker moved to approve Final Change Order
'4 to Big Four Construction Company of West Palm Beach, Inc.,
and to authorize the appropriate officials to execute same.
Commissioner Frank seconded the motion which carried unani-
mously.
ITEM '18 - Other Commission Action.
Resolution 171-43 - Requesting Pinellas Board of
County Commissioners to keep the present jail and
court facilities.
Commissioner DeBlaker moved to amend the resolution to
include another WHEREAS after the increased costs to the City
of Oearwster t atc. t as folloWB: "WHEREAS, moving of such
facilities will cause undue hardship on Clearwster citizens,
causing them needless travel time and expense."; and to also
add the word "Criminal" before "Court" in the title. Comlll1n-

Manager may transfer appropriations within the capital budBe~

The City Attorney presented Ordinance 01633 for first

Ordinance 11633 by title only. Commissioner DeBlaker moved
to pass Ordinance #1633 on its first reading. Commissioner

read Ordinance '1670 by title only. Commissioner Martin
moved to pass Ordinance 11670 on its first reading. Commis-
sioner Frank seconded the motion. Upon roll call the vote

Code.
The City Attorney distributed a memo with a recapitula-
tion of four companies who had returned proposals for the
recodification of the City Code.
Commissioner Martin moved to instruct and authorize the
City Attorney to enter into a contract for recodification of
the City Code with the firms as listed in order of preference,
and the appropriate officials be authorized to execute same.
