CITY COMMISSION MEETING December 27. 1976 The City Commi.eion of the City of Clesrwater met in Ipeeial ses8ion at the City Hall, Monday, December 27. 1916. at 7:30 p.m., with the following members presont. Floyd Thomas A. Bustin Major George McClamma City Manager City Attorney Representing Police Chief The Mayor called the meeting to order. The City Manager read the Notice of Special Meeting dated December 17,'1976, and presented a Waiver of Notice of Meeting to the City Clerk for the record. The purpose of the pUblic hearing was to consider Ordi- nance No. 1643, Amending Chapter 2, Administration, of the Code of Ordinances, and Establishing a System of Personnel Administration; and to hear comments. . The City Attorney read Ordinance No. 1643 by title only. The City Manager reported he met with representatives of the employee organizations and they had tentatively agreed on some changes. TheBe changes are not in final form and are not included in the Ordinance at this time. He briefly out- lined the following changes that were discussed: Section 2-36 (c) (4) - To add at the end of the paragraph, "and/or Civil Service Board." Section 2-36 (c) (6) - To add "and the Civil Service Board" after "the City Manager." Section 2-36 (d) (7)-To add at end of paragraph "except for initial appointment of Police Officers and Fire Fighters for which tbe probationary period shall be one (1) year." Section 2-37, Second Paragraph - To add a new sentence at the end: "Upon request by the Civil Service Board, the City Com- mission may, in its discretion, prOVide said Board independent legal counsel" and also in every case where it states in the Ordinance, "Civil Service Advisory Board,tI to delete tbe wo:rd "Advisory." Section 2-38, Fourth Paragraph - To delete the second sentence. Section 2-38 To de~ete the fifth. paragraph completely. "Following receipt of the order prepared as provided in Section 120.57. Sub (8). of the Florida Statutes, and the penalty, such order and penalty shall be considered a final order and the City Manager shall be bound to accept the pen- alty unless within five (5) days the City Manager shall seek further judicial review as set out herein." Section 2-42 (a) - To delete the phrase "or of the policies." The individual representatives of the employee organiza- tions were to take these changes back to their memberships for consideration. Citizens' comments were heard at this time. ,', Bill Bryant, President of the Clearwater Fire Fighters Association, stated tbe Association rejects the Ordinance and tbe amendments. The Civil Service Act has worked for thirty- five (35) years in Clearwater and there is no need to change it now in a short period of time. He asked for a continuance to update the current system, and suggested time was needed to consider and explore the ramifications. Ed Sulek, President of the Clearwater Employees' Associa- tion, stated he had not had time to contact his membership but, personally, he approved department heads being out of Civil Service. However the whole issue was confusing and he mentioned a lack of communication and misunderstandings but felt it could be worked out. He recommended a delay of six (6) months to one (1) year. 4 ~,~ Dick Howard, President of the Fraternal Order of Police, Lodge 10, stated his membership supports the ordinance. Discussion ensued on the decision of the Hearing Officer and whetheT it was binding. Commissioner Martin requested an opinion on what can be reviewed in court if the decision were to go to litigation. Bill Bryant suggested job security and tenure be written into the Ordinance to give the City employees due proceas of law and Ed Sulek aoked for clarification of the grandparent clause in Section 2-43 and aaked who, specifically, was cov- ered. ,"< Charles Finton spoke in favor of changing the Civil Serv- ice Act and discussed the recent hearings which he felt were not handled well. He questioned the wording in Section 2-37, "Each member of the board shall hold office until the member's successor is appointed and confirmed." He asked about a Board member who resigns, and the procedure. It was suggested the wording be changed to read, "Each member of the board whose term has expired shall hold. office until a successor is appointed and confirmed." It was ~lso suggested that the ap- pointee, in the case of a resignation or firins. would just co.plete tbe unexpired term of the person he is replacing.
