Tom Brown, Committee Chairman, urged adoption of the resolution. Commission discussed the route of State Road' 60 and the' right-of-way acquistions. Fred Rosenstock spoke in opposition to the new connector route to Drew Street and presented a petition signed by 108 businessmen opposing any change or rerouting of State Road 60. Lewis Homer suggested a joint meeting between the Down- town and eastern corridor business owners to discuss a moder- ate approach until an adaquate system can 'be developed. Commissioner Carwise moved that redesignation of State Road 60 be continued to January 6, 1977, 12:30 p.m., to give all interested parties time to discuss the problem. Commis- sioner Frank seconded the motion which carried unanimously. John Rankin questioned whether Drew Street could handle all the traffic and the severe traffic problem at Highland and Gulf-to-Bay. ITEM la - A Public Hearing on the Proposed City Charter. Commissioner DeBlaker moved to add to Section 2.01 (c) (2), "No ,contract or purchase which is subject to the require- ments imposed by this paragraph may be split or otherwise awarded in a cumulative manner.tI Commissioner Martin seconded the motion which carried unanimously. Commissioner DeR1aker requested the City Attorney to check the recall percentage as the Home Rule law states 10% of the registered electors. Commissioner Frank moved to continue this public hearing to 7:00 p.m., December 9, 1976. Commissioner Martin seconded the motion which carried unanimously. The City Manager announced that Public Hearing Items 9 and 10. Ordinance 11643. Merit System, and Ordinance 11648. Pension Fund, have been advertised for 1:00 p.m. and requested a motion from the Commission. Commissioner DeBlaker moved to continue the public bearings on Items 9 and 10 until 7:00 p.m., on December 9, 1976. Commissioner Frank seconded the motion which carried unanimously. ITEM #11 - Civil Service Board Funding Request for Legal Assistance. (See after Item 15) The chairman of the Civil Service Board had been tempor~ ari1y called from the meeting, and Commissioner Prank moved to continue this agenda item within the hour. Commissioner Hartin seconded the motion. Upon the vote being taken, Com- missioners DeBlaker, Frank and Martin and the Mayor voted "Aye": Commissioner Carviee voted "Nay." Motion c&rried. ITEM 112 - Use and/or Disposition of Former Fire Station 11 Property on Garden Avenue. (In NE~ of Section 16-29-15). The former fire station property was declared surplus by the Commission in early 1975 and advertised for sale. An of- fer to purchase was received from Peter Rodich, who lub8equent~ 1y withdrew bis offer. The City Com~i88ion removed the prop- erty from the surplUS list because of the Downtown Development Study.. , . " , The Flagship Bank of Tampa recently acquired title to 80' units in the Woodlake Condominium Development At 2050 Sunset Point Road.' A marketing campaign will be conducted to aeli', these units using aluminum poles and multi-colored flags for, a period of six (6) months. The City Code of Ordinances per~, mits flage- for promotional use for only a tvo (2) week period. The City Manager reported contact with the Sign Committee Chairman who feels the flags are not detrimental and the re- quest should be approved. As an added consideration, the Flagship Bank will construct a sidewalkaloDg Sunset Point ' Road. Commissioner Carwise moved to approve waiver of the provisions of Sections 18-3 (D) (3) (a) (b) and 18-8 (A) (8) of the City Code of Ordinances and approve iS8uance of a tem- porary six-months permit to the Flagship Bank of Tampa for displaying 2' x 3' nylon flags at Woodlake Condominiums at 2050 Sunset Point Road, subject to the Flagship Bank deposit- ing with the City the sum of $3,150.00 as assurance that it will undertake and complete construction of a S-foot wide, 300-foot long sidewalk along Sunset Point Road. Commissioner Martin/seconded the motion which carried unanimously. ITEM #14 - Request for Special Exception Fee Waiver: Clearwater Housing Authority. A substandard dwelling unit 1s located on Lot 12, Block A, Leona Smith's Subdivision and the Housing Authority's Re- habilitation and Redevelopment Program will take title to the property. The dwelling will be raze~ and a newBlngle-fa~ily dwelling unit constructed. The property is currently zoned CG which allows single family construction as a special exception by the Board of Adjustment and Appeals on Zoning with a $50 fee. The Planning Department concurs in the recommendation to vaive the fee. " I, ITEM III - Civil Service Board Funding Request for Legal Assistance. Suit has been filed by the three Clearwater employee',bar- gaining units against the City Commission, the City Manager and the City Attorney to stop the Commission, etc., from at- ' , tempting to change the Civil Service Law and that the Civil' ' Service Board be allowed to utilize outside legal aS8istaric~. Letter of November 26, 1976, from Personnel Director Kike Laursen, Secretary of the Civil Service Board, requested fund- ing be made available to hire outside legal assistance.' Robert Krause, Chairman of the Civil Service Board, stated the Civil Service Board held a special meeting to request fund- ing for outside independent legal counsel. They would like legal counsel of their own choice to represent them and would be for just the one case. Discussion followed on sections of the Civil Service Act referring to powers of the board. The City Attorney reported there would be a rehearing on Judge Phillipo statemerit "in this particular instance, the Civil Service Board, if it so desired, should have the privilege of intervening in this ac- tion as an interested party." Bill Bryant. ~resident of the Firefighters' Association, stated they had started this action to protest changes to the Civil Service Act. There was discussion of conflict with the attorneys' canon of ethics. Commissioner Carwise moved to continue this item c~ntin- gent on receipt of the court order. ITEM liD - A Public He.ring on' Ordinance '1648, Amendin. Chapter 2, Adminiltration, of the Code of Ordinances (Penlion Fund), Scheduled for 7 p.m. The City Manager announced that Jaae. Shively of the Wyatt Company, who are actuaries for the pension fund, could not be present this evening to give his report. The first reading for Ordinance '1648 is scheduled for December 16, 1976. Commissioner Frank moved to continue this item to be merged into the December 16, '1976, meeting. Commissioner Carwise seconded the motion. There was no citizen input. Motion carried unanimously. The City Manager reported Ordinance 11648 amending Chap- ter 2, Administration, of the Code. creates a pension fund for employees of the City of Clearwater. From time to time there have been items relative to the pension fund that needed Com- mission attention, ie: a court decision in 1973 with reopect to counting the original six (6) months of employment with the City toward the employees' retirement. The State Legisla- tive Delegation did not consider the issue, conaequently, this ordinance addresses that and several other questions. ITEM #9 - A Public Hearing on Ordinance 81643, Amending Chapter 2, Administration, of the Code of Ordinances (Herit System), Scheduled for 7 p.m. The City Manage~presented Ordinance '1643 which estab- lishes a system of Civil Service Administration; defines Ca- reer Civil Service, establiohea a Personnel Department and its duties, a Civil Service Advisory Board and the appointment of its members and duties, provides for a Hearing Officer, etc. Commissioner Hartin reported that employees had contacted her and were concerned about the conduct of public hearings. She and the City Manager assured them there would be no re- prisals. The City Manager presented the highlights of the ordinance and read into the record Section 2-34, System of Civil Service Administration - General Purpose; and Ssction 2-43, Status of Present Employees, Sub-paragraphs (a), (b) and (c); and Section 4, which provides for the effective date of the ordinance after approval at a referendum. Section 2-35 establishes a Career Civil Service but deletes department, division and ageDcy heads and persons serving in positions funded in whole or in paxt by U.S. government manpower assist- ance programs. Andy Nicholson, stated the exclusion of department heads ,would lead to frequent changes and lower prOductivity. , Oscar Downing discus.ed a condition in the thirties when there waa no Civil Service and all the department heads W4re fired or demoted, which finally led to the paasase of the Civ- il Service Act in the fortie., with the dopartment heads under it.juri.diction. Andy Nichol.on spoke of a possible conflict of Section 2-35 of this Ordinance and the Charter on appointment. and removal only by the City Manager. Subparagraph 4 would be in conflict as he could hire and fire himself. Max Battle, Public Works Director, stated Civil Service gives security to the employee. Ed Winslow stated department heads are confidential em- ployees and should be under Civil Service. Wallace Cardwell spoke in favor of appointing depa~tment heads. Section 2-36, Personnel Department - The City Manager presented the highlights of this section on the Personnel' , Department, the Personnel Director and the duties and responsi- bilities. The City Manager reported that the language used in the ordinance came from the National Civil Service League's Model Personnel Ordinance. Section 2-38, Hearing Officer. - Discussion ensued on tbe paragraph relating to the City Manager accepting or reducing the recommended penalty set out in an order. The employees felt the hearing officer should have the power to make the final decision and the order should be binding on all parties. This was explained as a longer probationary period for firemen and policemen. Gordon Scott, Attorney, stated polarization wal taking place on this issue. He presented a petition, which W~B read into the record, containing approximately 7,000 signatures of citizens requesting the Civil Service Act remain os it is. The petition was written by Mr. Scott. Marcia Warden stated changing the Civil Service Board will go against the wishes of the citizens and the employees. Bill Bryant stated there has been a communicstion break- down and a disservice to the community, the employees, and future commissioners. This is a major step which needs seri- ous consideration. Dick Howard requested that the uextpublic hoaring be held in the evening hours so that the employees could agmin participate. The workload of Central Services has grown tremendously and the need for the position is evident.
