CITY COMMISSION MEETING
October 21, 1976.
The City Commission of the City of Clearwater met in
regular session at the City Hall, Thursday, Ocotber 21, 1976,
at 12:30 p.m., with the fOllowing members present:

The Acting Mayor called the meeting to order. The invo~
cation was given by the Reverend Doyce Wise of Faith United
Church of Christ and the Pledge of Allegiance was led by the
Acting Mayor.
ITEM 13 - Introductions and Awards.
The City Manager reported that the City of Clearwater
and landscape architect Arthur Kruse, in recognition of their
exceptional contribution to the quality of our nation's en-
vironment, have received a Certificate of Merit from the
American Association of Nurserymen for the formal rose gar-
den in Kruse Gardens located at the Memorial Civic Center on
Clearwater Beach.
ITEM '4 - Minutes.
Commissioner Martin moved that the minutes of the reg-
ular meeting of October 7, 1976, and the special meeting of
October 14, 1976, be approved as recorded and as submitted
in written summation by the Clerk to each Commissioner. Mo-
tion was seconded by Commissioner Frank and carried unani-
mously.
ITEM IS - Citizens to be Heard re Items Not Appearing
On the Agenda.

Jean Homer spoke of the Beach area's request for a gras-
sed play area. She has recruited eitizens to work as volun-
teers to help plant, water and care for sod that she hoped the
City would order immediately.
Michael Harrell spoke on Tree Ordinance No. 1623, Sec-
tion 23.5-4, Paragraph (e), Application and Submission, which
causes needless delay, and recommended amending the ordinance
to speed up the application. This is under Staff considera-
tion.

Public Hearings
ITEM '7 - A Public Hearing on Lot Mowing Relo1ution 176-
115.
The ASlietant City Attorney explained the purpose of
this public hearing and requested the City In.pector. Willard
Stewart, to report on the status of lot cl.aring action..
The City Inspector reported that the lot. remaining to be
cleared constituted a menanee to public health, safety and
welfare. There were no objections.
Commissioner Martin moved that Resolution 176-115, pal-
sed on October 7, 1976, be confirmed and made effective as
to all persons and parcels listed thereon, except for those
whose lots have been verified as being cleared and those who
have paid the City for the clearing, and that the proper City
officials and employees be directed to proceed in accordance
with law to see that the lots are cleared. Commissioner
Frank seconded the motion.
At a prior meeting Commission had recommended the moving
fees be changed and the City Manager reported the recommenda-
tion is under consideration and a report will be forthcoming
around the first of the year.
Motion carried unanimously.
ITEM 68 - A Public Hearing to Consider Revocation of ~c-
cupational License of "The Wizz," now known as "The Mark VII."
," ":
A petition was received from Concerned Citizens of Pinel-
las County with approximately 152 signatures alleging that
the business establishment known as "The Wizz" at 1463-1465
Sunset Point Road, constitutes a public nuisance and that
their occupational license should be revoked. The petitioners
further state that the business is contributing to juvenile
delinquency, causing destruction of private property, inter-
fering with transaction of business, disturbing noises. etc.

A number of complaints were filed with the Police De-
partment and on October 1. 1976, the establishment was found
to be providing live entertainment. serving food and permit-
ting dancing without tbe, proper licenses. Consequently. the
establishment was closed. However. on October lS, 1976, the
owners, doing business as Mark Enterprises. renewed their
amusement parlor licnese for the establishment now known as
"Mark VII" and requested licenses to permit dancing, snack
bar and entertainment. Since the establishment had been ex-
panded it was necessary that appropriate inspections be made
before these licenses could be issued. The inspections are
expected to be completed by October 21. 1976, at which time
the licenses can be issued.
The Assistant City Attorney stated the Clearwater Code
in Section 13-7 provides the right to revoke or suspend a
license and prOVides procedure to offer and examine witnesses
and present evidence 1n support of their case and to cross-
examine witnesses and offer evidence to refute evidence of-
fered .in opposition.
By unanimous consent of the Commission, each witness
vas sworn in before testimony. was given. The fOllowing cit-
izens testified and recited the reasons stated in their peti-

ITEM '6 - service Avards.
Fourteen e~ployeeB were presented service pinl. The
Employee of the Month 11 J. B. Hattaway, Sanitation Driver
in the Utilities Depart~ent.
The public hearings resumed.
ITEM #8 (Continued). The following vitnelses gave their
testimony; speaking for the revocation of the license and vere
crosl-examined: Sue Cabina, Betty Lawhorn and Ruth M. Smith.
Mr. Clodfelter established the fact that for the last seven
to ten days since the Mark VII has reopened there has been
conaiderable improvement and fewer problems as the owners had
hired security police and reduced the hours of operation. He
presented a petition requesting that the efforts to revoke
the license of the establishment be denied. This petition
had approximately 250 signatures of patrons of Tbe Wizz, or
Mark VII, and was accepted as "Composite Exhibit A~ for the
record.
The City Manager requested that the memorandum to the
City Commission, Agenda Item No.8, Meeting of 10/21/16, be
accepted and attached to the official record by the City Clerk.
The petition from the Concerned Citizens of Pinel1as County,
Florida, was also received into the record. Kr. Clodfelter
also presented to the Commission a list of complaints made
about or concerning The Wizz from July 8. 1916. to October 21.
1976, and another list of complaints reported by the manage-
ment of The Wizz to the Police Department. Mr. Clodfelter
presented a map of the area showing the proximity of the res-
idences to the establishment and stated most of the signers
were not from the immediate vicinity.
The three security officers (employees of Terrell and
Craycraft, investigators). namely David Long, Fred Brown and
David Yoder, testified as to their duties to keep order and
not allow loitering, and to stay at night until the parking
lot was cleared.
Tim Nieporte. manager of the establishment. and Dr. Den-
nis Downey, one of the owners, testified that no beer is sold
or on the premises. At the present eime the hours are from
7 'ti1 11. and Dr. Downey stated he was attempting to clear
up the problem by employing the security officers and to be
open fewer hours and that he had not been aware of the prob-
lem until the petition was presented.
Charles Ma~vint Vice-President of the Landmark Bank,
acted as spokesman for the Concerned Citizens and cross-
examined the witnesses for The Wizz.
Major McClamma reported that 42 complaints had been reg-
istered by the citizens and the owners; that there was a con-
trolled drug buy on August 7, 1916, in the p~rklng lot and an
arrest for possession of marijuana on October 8, 1976, in the
parking lot.
Commissioner Frank expressed concern for the investment
of the owner and the possibility of litigation if the license
i8 revoked. He moved to continue this item to November 4,
1976, and that the Police Department at that ti~e inform tbe
Co..ission of the record of complaints from the time they re-

ITEM 19 - Public Hearings on Annexation and Zoning:
a. North Half (N~) of Northwest Quarter (NW~) of
Northeast Quarter (NE~) of Section 1-29-15,
with RS-60 (Single Pamily) Zoning and Fire
District No.2 Classification. - H. Allen et

This property is located east of Hercules Avenue and
south of Lake Citrus Estates and is vacant except for a sin-
gle family homesite. A preliminary plat for a single family
subdivision of 84 lots to be known as Charter Oaks was pre-
viously submitted but approval bas been delayed pending an-
nexation of the property.
The Planning and Zoning Board and the Acting Planning
Director reco~mend annexation as it is 1n conformance with
the Comprehensive Master Plan.
Manuel Raim1, representing the owners, stated the devel-
opers had agreed to pay cash in lieu of a property donation
as the Parks and Recreation Department felt that a two-acre
park is expensive to maintain. Commission discussed a park
area adjacent to Lake Citrus on the north side of the property.
There were no citizens to speak on this item.
Commissioner Martin moved that the request for annexa-
tion by H. R. Allen. Ralph Allen and Annie Allen with RS-60
(single family) zoning and Fire District No.2 classification
be approved subject to parkland dedication to be decided lat-
er, and the City Attorney be instructed to include this in an
ordinance to be brought back to the Commission for approval
as soon as possible. Commissioner DeBlaker seconded the mo-
tion which carried unaniQously.
b. Lot 7, Block E. Oak Acres Addition. - T. Jones.
Due to ill health, the petitioners have requested their
application be withdrawn. Commissioner DeBlaker moved to
deny without prejudice the request for annexation and zoning
of Lot 7, Block E, Oak Acres Addition. Commissioner Frank
seconded the motion which carried unanimously.

Rezoning will provide a site to construct facilities for
Bethany Christian Methodist Episcopal Church.
The Comprehensive Land Use Plan indicates this area as
low density residential and is presently zoned RS-SO.
Previous rezoning requests have been denied and the res-
idents of the area have submitted petitions with 133 signa-
tures requesting denial of the rezoning.
The Planning and Zoning Board and the Acting Planning
Di~ector recommend denial.
Robert Zens, Attorney, representing the owners, stated
the applicants wish to build a new church. At the present
time the cODgregation is small and will not create a great
deal of traffic. Use of this property would be a benefit to
the community, to the Church and the neighborhood.

Don HOlsapple, acting aa spokesman for the group, stated
they'vere against spot zoning, that the church would add to
the traffic congestion as the streets are narrow, there would
be ecological problems, the values of the area would be de-
preciated and the tax base would be lowered as the church

These three parcels of land, one occupied by a sing1e-
family home, and two vacant lots, were planned for use in
conjunction with a lorger parcel adjacent to the east. How-
ever. the City Commission approved down zoning the larger
parcel from RM-28 to RM-8 and the Comprehensive Plan indicates
this area should remain as developed (low density residential).
The Planning and Zoning Board and the Acting Planning
Director recommend denial of the request for rezoning.
The applicant was not present and there were no citizens
to speak.
Commissioner Prank moved to deny the request for rezon-
ing of unplatted properties on the east side of Virginia Lane
from RS-50 to RM-28. Commissioner Martin seconded the motion.
The Acting Planning Director reported receipt of letters
of opposition and Commissioner DeBlaker stated for the record
that this would be an extension of spot zoning on an adjoin-
ing parcel which had been denied at a prior meeting. This is
primarily a single-family area.
Upon the vote being taken, motion carried unanimously.
d. Rezone Tracts A, B, C and D, Montclair Lake
Estates from RM-28 (High Density Multi-Family)
to RM~8 (Single-Pamily-Duplex). Owners: Tracts
A, B & C, Monco Construction Company. Tract D.
Keene, Inc. (City Application).
These tracts of Montclair Lake Estates were platted, an-
nexed and zoned multi-family in order that a non-profit swim
club could be established. The tracts in question are locat-
ed on the northeast corner of Montclair Road and North Keene
Road and a spot zone of high density is not compatible to sur-
rounding development.
The Acting Planning Director recommends rezoning to RM-8.
The Planning and Zoning Board recommends establiShing RS-75
(single family residential district) on the property and
further recommends that the commercial swim club activity be
rezoned to CR (commercial recreation) when this becomes avail-
able with the adoption of the Uniform Development Code.
Robert Hale, president of the Montclair Homeowners Asso-
ciation; John Rankin: and Edward Winslow, president of the
Northeast Civic Association spoke in support of down zoning.
The City Manager left the meeting at 5:30 p.m.. and waB~-
placed by Tony Shoemaker, Assi.tant City Manager.
Agnes Rush, representing Keene, Inc., owner of Tract D,
stated plans had been approved when the property vas originally
zoned R-54-A. She said this would be the second down zoning
of the area and spoke against further rezoning_

and DeBlaker and Acting Mayor Carwise voted "Aye"; Commission-
er Martin voted "Nay.~ Motion carried.
The City ManaKer returned at 6:15 p.m.
ITEM III - A Public Hearing on Request for Vacation of
Alley Lying Between H. E. Tooke's Subdivision and Block 7.
A. C. Turner's Subdivision 13, Less Right-of-Way of Pierce
Boulevard. Pinellas County Board of Commissioners.
All abutting property to this alley is owned by Pinellas
County and the design of a new parking lot south of Pierce
Boulevard requires use of the alley. All City Departments
have reviewed the request and have no objection.
The applicant's representative was present and there
were no objections.
Commissioner Martin moved to approve the request of
Pinellas County to vacate the alley and to instruct the City
Attorney to prepare a resolution to be brought back to the
Commission for approval as Boon as possible. Commissioner
Frank seconded the motion which carried unanimously.
ITEM 112 - A Public Hearing on the Amendment of Zoning
Atlas, Ordinance No. 1631.
Edward Brannigan, president of the Interhouse Associa-
tion of Clearwater Point representing the five condominium
associations, spoke in support of RM-28 zoning.
William Gilkey spoke in support of RS-60 zoning for
Northwood Estates.
Patti Nelson asked for clarification of CTF zoning and
the maximum number of units. Acting Planning Director Warren
Renando reported 42 motel/hotel units, but the south end of
Clearwater Beach was built under another zoning. She request-
ed a lower classification to eliminate the possibility of high-
rises. Commission concensus was to maintain a low profile on
that portion of Clearwater Beach.
ITEM #13 - A Public Hearing to 'Consider Revision of Oc-
cupational License Ordinances. Chapter 13 - Licenses and
Regulations.
The City Commission, at a prior session, requested the
City Manager examine City Ordinances to determine if some
could be revised so that ~ity Commission approval would not
be required for issuance of occupational licenses. Twelve
catesories require Co..iaaion approval but four could be

There were no citizens to comment.
City Manager Reports
ITEM #14 - Downtown Parking Lots Proposal.
The Downtown Development Board and Downtown Merchant.
Association propose to make free parking available to Down-
town shoppers. They have requested the City remove the,
meters from Lots 4, 8 and 9 and the Kravas Lot and will reim-
burse the City for lost revenues at the rate of $1,122.75 per
month. This rate is based on the average monthly revenues
that the City received on these lots in the past fiscal year.
The cost to implement these procedures will be subject to
further negotiations.

Lots 4 and 8 are off of North Garden Avenue, Lot 9 is
East of Soutb Garden Avenue and Kravas Lot south of Laura
Street.
Commissioner Martin moved to approve the understanding
developed by the Clearwater Downtown Development Board and
the City Manager, whereby the City will remove meters from
certain parking lots (4, 8 and 9) downtown, known al the ACL
Lots, Garden Avenue Lot, and part of the Kravas Lot, for an
initial twelve (12) month period. with the City retaining
full control of the lots and the Downtown Development Board
reimbursing the City for lost revenue and costs associated
with implementing this procedure. Commissioner Frank second-
ed the motion which carried unanimously.
-ITEM D15-a - Public Works Act Projects.
Applications for fourteen projects are being prepared
for submission to the Economic Development Admini8t~ation
for federal funding. Tony Shoemaker. Assistant City Manager,
reported each application should he approved by separate res-
olution.
Bymanimous consent, the Commission agreed to delete the
Mandalay Community Recreation Center BUilding as that seemed
to be the consensus of the citizens on the Beach, and also to
delete the South Belmont Street Storm Drainage because it
will require an environmental permit. and to combine the
McMullen Community Center and Park with Road and Eleven Ten-
nis Courts into one application.

Commissioner Martin moved to pass and adopt Resolution
076-117 through Resolucion '76-127. authorizing separate ap-
plication. for the Public ~ork8 Project. and to. waive the
community impact statements and building permits unci1 it 1s
known which project(s) will be funded, each project to be
located roughly in the areas indicated on the material pro-
vided to the Commission, and that the appropriate officials
be authorized to execute same. Commissioner Prank seconded
the motion. Upon the vote being taken, Commissioners Frank
and Martin and Acting Mayor Carwise voted "Aye": Commission-
er DeB1aker voted "Nay."
Commissioner DeBlaker stated for the record that she did
not vote for this because she did not approve of Del.Oro's
location and did not approve of not providing,one for the
Northeast Countryside area.
Motion carried.
ITEM H15-b - Contract Revision - Mandalay Community
Recreation Center Building. Section 5-29-15.
In November of 1913 an agreement was signed with Prindle,
Patrick and Partners, Ltd., to design the Mandalay Community
Recreation Center Building. Lack of funds for construction
delayed completion of the plans after the first stage. As
the Commission deleted the Mandalay Marina/Recreation Center
Building from the list of projects, there was no need to mod-
ify this contract.
Commissioner Martin moved to deny modification of the
contract with Prindle, Patrick and Partners, Ltd. Commission-
er Frank seconded the motion which carried unanimously.

Works Bill.
The Kings Highway Recreation Center Building has proven
most satisfactory and Goorge 1t~4dox, the architect, has agreed
to duplicate the design and-~ri~ necessary new site work and
will supervise construction of the three recreation centers
for a total cost of $14,250. The total estimated construction
cost for each building is $200,000 and will include construc-
tion, architect's fee, landscaping, paved parking lot, and
necessary utility work. The cost of annual operation of each
center is approximately $35~OOO.
Commissioner Martin moved that George Haddox be hired
as the architect for three neighborhood recreation centers,
and that the plan which was designed for the existing Kings
Highway Recreation Building be used for each of these centers
and that the appropriate officials be authorized to execute
same. Commissioner Frank seconded the motion. Upon the vote
being taken, Commissioners Martin and Prank and Acting Mayor
Carwise voted "Aye"; Commissioner OeBlaker voted "Nay." Mo-
tion carried. Commissioner DeBlaker stated for the'record
that she voted no for the same reason--she does not approve
of the .Del Oro location of the Del Oro Center or the fact
that we're not providing for the Countryside residents.

I~EM 115-d - Architectural Selection - Main Library and
Two Branch Libraries.
The Staff, following the Competitive Negotiation. Act
procedures, heard presentations by the four architectural
firms selected through screening of the ten firms expre..inl
interest in the main and two branch libraries. After car.ful
review and discussion the Staff rated three architectural
firms as moat experienced in library design and construction
and recommends that Ranon, McIntosh, Bernardo and Ramire.1
Croll be selected for design of the main library and the
Staff be authorized to enter negotiations for a contract.
RMBR is currently involved in construction of a library in
Manatee County and the building deSign, plans and specifica-
tions are acceptable for Clearwater1s needs with some modifi-
cations. Staff is also recommending demolition of the old
building.
Police Chief Daniels left at 6:45 p.m.
RMBR has received numerous design awards and haa had a
great deal of experience with construction of librariea. The
Manatee Library has had construction problems and Max Battle,
City Engineer, reported he and other members of staff had
visited the site and the problem was not with the d..ian, but
the contractor was not meeting specifications B~1 project wa.
not supervised by the architect.
Commission discussed including the old building within
the new; the possibility of being able to meet the ti~. fraMe;
and that the fees might be higher if the old building were
included, as remodeling fees are higher than new conatruction
fees.
Charles Finton discussed the present libr.ry and a prior
recommendation for an L-shaped building. He a.ked for clari-
fication about plans for another building being u.ed.
Commissioner Martin moved to authorize the City Manaser
to negotiate with Mudano and Associates/McElvy, Jennewein,
Steffany and Howard (Joint Venture) to design and .upervl..
construction of the main library and that an appropriate
contract be drafted to include two f~e schedules for a new
building and/or a remodeled building. Commi.sloner Frank
seconded the motion.
The City Manager reported that Robert Levi.on, Vice-
President of Mudano is also Chairman of the Clearwater Hou.-
ing Authority.
Don McIntosh, of RMBR, stated there would be el!ans..
incorporated into their plans for use on the Clearwat.r .ite.
Upon the vote being taken, Commissioner Hartin voted "Ay.lI;
Commissioners Frank and DeBlaker and Acting Hayor Carwia.
voted "Nay." Motion failed.

cordance with the plans, specifications and bids; and the
1975/76 and 1976/77 CIP budgets be amended a8 set forth above

eration, proposing a tunnel to eliminate opening the bridge

lation of lights at McMullen Park Tennis Complex. The bid is
being readvertised.

water Beach (Coronado Drive area), presently zoned RH-28

either zoning. The Acting Planning Director atated the area
needs to be rezoned but is a very complex situation.
Commissioner DeB1aker moved to amend the ordinance by
deleting the areas "Zoned as CTF - Commercial-Tourist Facil-
ities Use District." Commissioner Martin seconded the motion,
which carried unanimously.
Commissioner Martin movod to pass Ordinance 01631, as
amended, on its first reading. Commissioner Frank seconded
the motion which carried unanimously.

seconded the motion which carried unanimously. The Assist-
ant City Attorney read Ordinance 11634 by title only. Com-
