and Zoning Board and the Planning Director support the recom-
mendation for approval. There were no objections.
Commissioner Frank moved to approve rezoning from PS
(professional seJ.'vices) and CP ('(IRrlmay business) to RU-28
(high density multi-family), that property described as
Item 2-8 in the Notice of Public Hearing attached, and the
City Attorney be instructed to include this in an ordinance
to be broucht to the Commiasion for approval as soon as pos-
sible. Commissioner DeB1aker seconded the motion which car-
ried unanimously.

The recommendation is to deny the request for change of
zoning. The Planning Director explained that commercial leas-
ing by the Jaycees of their building 'had changed the status
and ISP zoning CQuld not apply to this property. Neither the
County nor the City's Comprehensive Land Use Plan recogniz~
commercial zoning for this area. The building permit was is-
sued and the building constructed before the rezoning.

Elliott Stern, past president of the Jaycees, stated
they wish to retain the commercial zoning as the building
,'. was constructed to be an income-generating f~cility.
The Planning and Zoning Doard and the Planning Director
support the denial of this change in zoning. ,There were no
objections.
Commissioner Prank moved to deny the request for change

Robert Hale, Preoident of the Montclair ]Iomeowners Association
and Tepresenting 100 homeowners ~n tho area, stated they would
like single family zoning for the aren~ Floyd Hathorne also
spoke in favor of less denoity.
The Planning Director stated there was a need to conform
to the City and County Comprehensive Land Use Plan and dis-
played an aerial photo showinu the surrounding area 00 resi-
dential. He stated tbe change to RM-8 would recognize that
this is a low density area, and support our land use plan and
permit many useo. The Planning and Zoning Board and the Plan-
ning Director concur in the recommendation for approval.
Commissioner' DeBlaker moved that the request for rezoning
Tracts A, D, C and D, Hontclair Lake Estates, from Rl-I-28 (high
density multi-family) to RM-B (single family duplex apartment)
be approved and the City Attorney be instructed to include
this in an amendment to the Zoning Ordinance to be brought
back to the Commission for approval as soon ao possible. Com-
missioner Frank seconded the motion. Upon the vote being
taken, Commissioners DeBluker and Frank voted "Aye"; Commis-
sioner Martin and Acting Mayor Carwisc voted "Nay." Motion
failed. Commiesioner Martin Bsked that the record show her
"Nay" vote was not because she believed the property should
remain ml-2B, but the granting of RM-8 is not suitable uoe
for the. land and the property should be zoned commensurate
with tbe surrounding property, which is single family dwell-
ings.
Commissioner Uartin moved that Agenda Item fl13 be con-
tinued to July 6, 1976, at 12:30 p.m., to be heard before a
full Commission. Commissioner Frank seconded the motion.
