Planning Director concur in the recommendation for approval.
There were no objections.
Commissioner Carwise moved that the request for annexa-
tion by William Lynch, Jr., with RS-50 (sing1e family) zoning
and Pire District 82 classification be approved and the City
Attorney be instructed to include this in an ordinance to be
brought back to the Commission for approval as soon as ,
possible. Commissioner Martin seconded the motion which
carried unanimously.

zoning and Fire District 02 classification. -

Property is located on the East side of West Drive about
220 ft. North of Greenlea Drive. The owner was not present

cur with the recommendation for approval. There were no
objections.
Commissioner Carwise moved that the request for annexa-
tion by J. B. Carbonaro. Inc., with RS-60 (single family)
zoningmd Pire District #2 clasoification be approved and
the City Attorney be instructed to include this in an ordi-
nance to be brought back to the Commission for approval as
soon as possible. Commissioner Frank seconded the motion'
which carried unanimously.

Bay View City Subdivision. with RS-50 (single
family) zoning and Fire District #2 classifi-

Property is located on the North side of Carolina Avenue

tion by Sheldon et a1., with RM-lb (multi-family) zoning and
Fire District '2 classification be approved subject to.. 10%
parkland or money in lieu thereof to be deposited and desig-
nated for future parkland purchases and the City Attorney be
instructed to include this 1n an ordinance 'to be brought back .'
to the Commission for approval as soon as possible. Commis-
sioner Martin seconded the motion. Upon the voto beins taken,
Commissioners PeBlaker, Martin and Frank, and the Mayor voted

Boulevard adjoining South side of Lot 13, Block E, Bayside

David Ramsey was present.
Acting City Engineer Cecil Henderson recommended the
Citymtain a right-of-way easement for the construction of
sidewalks and utilities. City departments involved and the
utility companies have indicated no objection or need for the
right-of-way parcel.
Commissioner Carwise moved to approve the request for
vacation of 5 ft. easement on the North side of Lots 11 and
12, Block C, Bayside Shores; 3 ft. easement on the North side
of Lot 13, Block E, Bayside Subdivision No.6, Unit Bi and to
vacate the right-of-way on the south side of Lot 13, Block E,
Bayside Subdivision No.6. Unit B, but to retain an easement
for the installation of sidewalks and utilitiesi and to in-
struct the City Attorney to prepare a resolution to be brought
back to the Commission as soon as possible. Commissioner
Frank seconded the mot1on. Upon the vote being taken, Com-
missioners DeBlaker, Frank and Carwise. and the Mayor voted
IIAyell; Commissioner Martin voted IINay." Motion carried.

Sgt. Shaffer replaced Sgt. Desmarais at 3:30 p.m.
Charles Sagona, the applicant, was present and requested
reconsideration on a decision in November, 1975, when the
Commission denied his request for annexation;
Commissioner Carwise moved to deny without ,..judice ,': "
the annexation request of Charles Sagona, for 1209 Canterbury
Road. Commissioner Frank seconded the motion. The City
Attorney stated a decision to deny would historically include
"with prejudice." Upon the vote being taken, Commissioners
Carv1.se and Frank voted "Aye"; Commissioners Hartin and
DeDlaker, and the Mayor voted "No.1I Motion failed.

The City Manager reported there were irregularities in
Bid. a, b, c, d and h. Recently the requirement for a bid
bond wa. changed from 5% to 10% but the bidder. only 8ub.it-
ted S% bid bonda. However, the performance bond viII cover
the City. The second City requirement for 8'financia1 state-
ment&om the bonding firms aeems to.be i.pos.ible to get, and
the requirement baa been cbanged 'bat tbe bond be counter-
signed and the bond firm bave a AAAA rating with tbe A. H.
Best Co. The waiving of irregularities 1s covered in every
contract, and the contractors were advised to be present,
but none wero.
The City Manager summarized the bidding on the above
items and recommended awards as indicated. Com~iB8ioner
Carv1semved upon the recommendation of the City Manager that
contracts for Items 124 a through h be awarded to the bidders
in the amounts indicated above, including waiver of irregu-
larities on Items 124 a, b, c, d and ,h, which are tbe lowest
and best reaponsible bids, and thet the ap~roprlate officials
of the City be authorized to execute said contracts which
shall be in accordance with the plans, specifications and
bids. Motion was seconded by Commissioner DeBlaker. Upon
the vote being taken, Commissioners DeBlaker and Carwise,
and the Mayor voted "Aye"; Commissioners Hartin and Prank
voted "Nay." Motion carried.

Commissioner Frank suggested policy be set for property
purchases to discuss arrangements with the seller and pos-
sibly arrive at a better deal.
Commissioner Martin discussed secretarial service for
the Mayor.
Commissioner DeBlaker commended the work of the Community
Relations Department and Director Dillon. She also stated
she received many compliments about the work of the Main-
tenance Division.

tion 176-35. Motion was seconded by Commissioner Frank and

ITEM 128 - Second Re~din8 - Ordinance 11612 - Amending
Section 17-8, Schedule of Sewer Rates, to Establish New
Uniform Schedule of Rates. (Approved April 1, 1976.)
The City Attorney stated that Ordinance #1612, second
reading, would be read by title only un1ess'a Commissioner
requested otherwise, and then read Ordinance 01612 by title
only. Commissioner DeBlaker moved that Ordinance 11612 be
passed on its second and final reading and adopted and the
appropriate officials of the City be authorized to execute
it. Commissioner Frank seconded the motion which carried
unanimously.
ITEM '29 - First Reading - Ordinance '1613 - Annexing
and Zoning Lots 23 Through 26, Inclusive, Block A, and Lots

Code to Enact New Chapter 15A to Adopt a Purchasing System
and Establish Procedures Therefor. (Approved April 15, 1976.)
The City Attorney presented Ordinance 11614 for first
reading. Commissioner DeBlaker moved that Ordinance #1614 be
read and considered by title only on the first reading by
the unanimous consent of the Co~m1ssion. Motion was seconded
by Commissioner Frank and carried unanimously. The Ordinance
was read by title only. Commissioner Carwise moved that
Ordinance U16l4 be passed on its first reading. Motion was
seconded by Commissioner Frank and carried unanimously.
The City Manager asked the City Attorney to review the
matter of reading titles of ordinances and to report whether
casting a transparency on the screen would suffice.

ITEM 134 - Resolution 116-50 - Payment to Briley, Wild
& Associates, Utility Revenue Certificatas, Series of 1972.

Commissioner Carwise moved that Resolution, 176-50 be
passed and adopted and that tho appropriate officials be
authorized to execute it. Motion was seconded by Commissioner

ITEM #35 - Authorizing Execution of Lease Agreement
Lease Site for Emergency Mobile Housing Program from Pinellas
Gounty School Board.
The City Attorney presented Lesse Agreement for that
portion of the Palmetto Elementary-Clearwater Comprehensive
Complex which is located on the East side of Holt Avenue
from the fenced-in area currently used by Clearwater Compre-
hen8ive, Northward to Engman Street. Commissioner Frank noted
Paragraph II. should be amended to read 60 days, rather than
30 days written notice for cancellation, to conform to Para-
graph 03. i.
Commissioner Carwis8 moved that the Lease Agreement, as
amended. be approved and the appropriate officials be auth-
orized to execute it. Motion was scconded by Commissioner
DeRlaker and carried unanimously.
ITEM 136 - Authorizing Execution of Agreement for Instal-
lation of Sanitary Sewer Line and Filing of Lien. ($670.00)
West 10 Ft. of Lot 4, Suban's Subdivision - A. McLatchy et ux.
Commissioner Carvise moved that the agreement as out-
lined by the City Attorney be approved and the appropriate
officials be authorized to execute it. Motion was seconded
by Commissioner Frank and carried unanimously.
ITEM 037 - Authorizing Execution of Agreement for Instal-
