Don McFarland, Attorney, representinR the owner, stated the restrictive covenants would be recognized and abided by. Jack Wolle of the P1anninR Department presented for the record two reasonable uses of the property in the current RS-SO zoning by dividing it into four and/or five lots. Emil Marquardt, Jr., Attorney, representing the adjacent owner of the Clearwater Trailer Park stated all of the neiRh- bors object and a petition was on file. Charles Finton stated the property was purchased with the present zoning and a warehouse would be out of character with the land use. Commissioner DeBlaker moved to deny the request for CG (general business) zoning. Commissioner Martin seconded the motion. Florence Evers of the Planning and Zoning Board stated that the vote was 3 to 2 in favor of the zoning with restric- tions. Upon the vote bein~ token, motion carried unanimously. ITEMS 87 and 08 - A Public Hearing on Request' for Annexa- tion and Determination and Establishnent of Zoning and Fire, District Cla*sification. - W. Sheldon, et al. ITEM 07 - East 248 ft. M.O.L. of South 666 ft. of NW 1/4 of'SW 1/4, less North 265 ft. of South 315 ft. of Esst 20a ft., and leso South 50 ft., Section 18-29-16, with RM-24 (high density multi- family) zoning and Fire District 82 classification. Section 18-29-16, with PS (profeSSional services) zoning and Fire District 02 classification. Items 07 and (}8 relate;'to two parcels of property under the same ownership. By unanimous consent, the Commission agreed to discuss Item Ha, Annexation and Zoning of PS (pro- fessional services) for property located north of Druid Road about 400 ft. east of Belcher Road. Request for annexation of this property, consisting of two parcels, and declaration of proposed usage for the total tract covers development of the property to the north con- sidered for Senior Citizen Public Housing usage. The PS requested zoning is not in conformance with the City or County Comprehensive Plan and also should have been accompanied by a Community Impact Statement. The Planning and. Zoning Board and the Planning Director recommend denial without prejudlce. Two letters of objection were read into the record and accepted as exhibits. The Commission discusBcd no commitment for the 10% parkland requirement and the narrow enclave strip on the west por'tion of the property. C. R. Blizzard spoke in opposition to the professional services zoning. ITEM 011 - A Public "eartnR on Annexation and ZoninR. Lots 23 to 26 inclusive. Block A. and Lote 10 to 15 inclusive, Block B. Sunset Point Estatee, with RS-50 (single family) zoning and Pire District No. 2 classification. Property ie located on both sides of Atlantis Drive about 300 ft. north of Sunset Point Road. (r.. Hohimer, et all. The recommendation is the Commission deny the request of RS-50 (single family) zoning and in lieu thereof recommend annexation and zoning of RS-60 (sinRle family). This request is in accordance with the Comprehensive Plan and the appli- cant has agreed to the RS-60 zoning. Planning and Zoning' ,. Board and the Planninp, Director concur with the recommenda- tion. Commissioner Martin moved that annexation by G. Hohimer, et al.. be approved with RS-60 (sinRle family) zoninp, and Fire District No. 2 classification and the City Attorney be instructed to include this in an ordinance to be brour,ht back to the Commission for approval as soon 8S possible. Commissioner Garwise seconded the motion which carr.ied unanimously. ,\ ITEM 012 - Request of Northeast Clearwater Civic Asso- ciation. Inc. (Re Airpark & Golf Park in W 1/2 of Section 12-29-15.> Harold Maul, Director of the NorthenstCivic Association proposed the City repurchase the lease of the Golf Park and Airpark. They do not want an Airpark in the area as it is dangerous to the residents and it does not serve a public purpose, and ther~ are no buffer zones., They BUBcented if the City were to purchase the property, Keene Road could be opened as R north-south thruwa~ and the property could be used for many thinp,s, including Q, recreation area for soft- ball, soccer. a library, a civic center. etc. Phyllis Fuchs and Lester Wilbert also spoke in opposition to the Airpark. Bob Bickerstaffe BBve a short history of the Airpark and als~ spoke in favor as it does aid industry and tourism. The Airpark has an excellent safety record. Emil Marquardt, Attorney for Mr. Frank, stated the lease is leRal and the purpose that the Airpark serves is a public one and any negotiatinR would be done through him. ITEM "13 - Request to Hypothecate Clearwater Golf Park Lea8e In W 1/2 of Section 12-29-15. (Continued from March 18, 1976.) The recommendation is to approve the 'request of Clear- water Golf Park, Inc. to hypothecate their'lease for a 10ftn in the amount of $400,000 from the Exchange National Bank of Tampa, Florida, and that the appropriate officials be auth- orized to execute same.' Commissioner Frank moved to approve the Staff recommen- dation and Commissioner Martin seconded the motion.' A sett1e- men~ agreement between the City of Clear~ater an~ the Clear- water Golf Park bas been received ,and the first p'lyment will be due April 15, 1976. ITEM nl4 - Labor Agreement Between FireflRhters'and the City of Clearwater. An agreement acceptable to both parties wao presented and Commissioner Martin moved that the agreement between the City of Clearwater and Local 1158 of the International Asso- ciation of Firefighters, AFL-CIO. for the fiscal year 1975/76 be approved, and that the appropriate officials ,be authorized' to execute aame. Commissioner Carwise seconded the motion which carried unanimously. ITEM #15 - Appeal of Sidewalk Waiver Denial, Lots 15 and 16. Block C. Carolina Terrace. - J. Love. Mr. Love has requested a waiver of sidewalk construction because when Uissouri Avenue was widened. a portion of his property was used for road right-of-way and this reduced the amount of parking space available. He wiahes to construct. a parking lot on the corner of Michigan and Howard cnd does not wBnt to construct the sidewalk as required by City codes. Commissioner Carwise moved to deny the appeal,of Mr. Joseph R. Love for waiver of City Code requirements for installation of a sidewalk in conjunction with construction of a parking lot on Lots 15 and 16, Block C, Carolina Terrace. because the request doee not conform to the provisions of Section 7-6 of City Code of Ordinances in that B sidewalk can readily be constructed o~ this property and that undue hardship has not been made apparent. Commissioner DeBlaker seconded the motion which carried unanimously. ITEM 116 - Chesapeake Villas Status Report. Joseph McFate, Housing Coordinator, presented his report on Chesapeake Villas and suggested four alternatives. 1. Additional funding of the nonprofit corporation through a grant from the City of Clearwater. ITEM 017 - Condon Gardens Recreational Project. The Condon Gardens Recreational Project is nearinK com- pletion. A budget of $35,000 was established to cover the cost of a recreational bui1dinR, baRketbal1 court and equip- ment. Recommendation is to authorize the City Manager to spend up to $5,000 of Community Development Block ,Grant funds for painting, landscapinR and acquiring rocreational equipment for the project, and authorize the use of $365. of the C.D. Contingenty Account (2-8111-l0-x) to supplement the $35,000 budget if necessary. Commission discussed Beveral of the expenditures for equipment and Commissioner Prank donated an addressograph machine to the project. Ben Fields, a resident of Condon Gardens, asked for a traffic 1i~ht at the intersection there and was informed that Traffic EngineerinR is studyinR the situation. ITEM "18 - Review and Adjustment of Sewer Rates. Assistant City Manager Shoemaker presented Staff recom- mendation to lower sewer service rates as follows: Residential - From $4.50 base, plus 26~ per 100 cu. ft. water, to $4.25 base, plus 25e per 100 cu. ft. water. Commerc~al, profeSSional and industrial From 177% to 160% of water bill. In July, 1975, projected data was assessed and sewer rates were adjusted, effective September 1, 1975. Actual data from November, 1975, to February, 1976, resulted in this recommendation which will generate funda for capital costs and operation of the sewer system for fisca1 year 1975/76, and additional hookups could provide adequate revenue through fiscal year 1976/77. Staff will monitor this situation' closely and report to the Commission in Octob~~, 1976. . ITEM #22 - Review and Approval of Building Additions' for Oak Lake Park, a Proposed Condominium. ,RPD (Residentia~ Planned Development). In SE 1/4 of SW 1/4, Section 36-28-15. Property is located on the north side of Union Street about 500 feet west of Hercules Avenue. - Columbia Properties. Assistant City Mana~er Shoemaker preoented Staff recom- mendation that existinr. screened enclosures on Buildings 18, 19 & 20, 21 & 22, and 26 be approved on interior of tract. but enclosures on Buildings 7 & 8, and 9 & 10, shall be re- moved; further, that any subsequent enclosures on the periphery of the tract be approved by City Commission with advertised public hearinr., and that subsequent proposalS for the interior of the tract may only require administrative approval. He outlined the project's approval in 1971 and approved change in 1973, and stated Building inspection revealed patio areas for certain structures had been enlarged and screened ln, thus violating orir.inal setback lines and reducing space between structures. RPD zoning requires such variance approval by City Commlsoion and should be approved before any further building construction is permitted. Richard Funk, President of Columbia Properties, proposed that in lieu of removal of the screened porches-with-roofs on Buildings 7 & 8, and 9 & lO--that thooe enclosures be modified to "bird cage"-type and also modify corner part in violation.
