RESOLUTION NO. 91.49 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, TO THE FLORIDA LEGISLATURE, OBJECTING TO THE 1991 AMENDMENT TO THE LAW RELATING TO THE DISPOSITION OF CIVIL PENALTIES RECEIVED BY COUNTY COURTS. AND URGING THE RESTORATION OF THE DISPOSITION SCHEDULE AS IT APPLIED TO MUNICIPALITIES BEFORE JULY 1, 1991; PROVIDING AN EFFECTIVE DATE. WHEREAS, the schedule for the disposition of civil penillties received by county courts was amended as of July I, 1991, by Chapter 91~200, Laws of Florida, which reduced the share for municipalities from 75 percent of the penalties received to 56.4 percent, a revenue reduction of 24.8 percent; and WHEREAS, the 1991 amendment created an unexpected revenue shortfa 11 for the current fiscal year and substantially diminished a revenue source that was intended to replace the fines from the former municipal courts; and WHEREAS, the City of Clearwater will lose an estimated $312,670 during the 1991-92 fiscal year as the result of the amendment to the disposition schedule~ now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City of Clearwater urges the Florida Legislature to amend Section 318.21, F.S., as amended by Chapter 91-200, Laws of Florida, to restore the municipal share of civil penalties received by the county courts to 75 per cent, which was the share for municipalities prior to July 1, 1991. Section 2. This resolution shall take effect immediately upon adoption. The City Clerk shall, upon adoption, distribute copies by mail to the Pres'ident of the Florida Senate, the Speaker of the Florida House of Representatives, and to each member of the Pinellas County legislative delegation.
